Gonzo porn with no plot and zero creativity is a good example. Copyright law only protects creative expression that, as the US Constitution states, promotes “the progress of science and useful arts.” That’s why, for example, surveillance video is not copyrightable nor is the telephone book, per the US Supreme Court’s decision in Feist v. Rural.

These porn producers better be careful. They might sue the wrong person, who countersues them, and then a court rules the smut in question isn’t even protected by copyright.
