When they stand there looking dumbfounded by this remark, I&#039;d go on to explain that I know computers are ultimately designed for one single task; to follow all instructions given to them by programmer and/or user. Since both are human and a computer can do nothing without either, I&#039;d go on to ask for the identity of the exact person or persons responsible for giving their computer(s) bad instructions so they could be summoned to answer some very simple questions in my courtroom, the answers to which being how I&#039;d ultimately determine guilt and course of action to take.

The provision against abuse found within the DMCA is there for good reason and I&#039;d make sure those in front of me understand this without question, particularly when dismissing a case, which I&#039;d most likely do for first time offenders. I&#039;d make certain they also understood that the court won&#039;t be so lenient next time. For those whom prove to be repeat offenders, as well as those who are proven by plaintiff to have caused real monetary loss with their shinanigans, well I think you can guess what I&#039;d do with them. For software, I would suggest looking at file names, as well as MD5/SHA1 Values for the files that are provided - Making sure to decompress the file first of course. Unlike the MAFIAA&#039;s claims of losing vast sums of money; total real revenue lost could be in the billions for all these people. Based on $5-10 per false DMCA take down. There is enough potential revenue to fund a class action law suit for a major law firm. 

I&#039;ve been saying it for years class action lawsuits are a way to fight back. Hit them in the courts, boycott them, develop encrypted anonymous services, and get a campaign 10 times the size of SOPA/PIPA demanding the end IP. 

Really we should be demanding the end of monopolies in general not just IP. Ending monopolies would solve half the worlds problems.]]></description>
