RoboTrolls Threaten Alleged BitTorrent Pirates With Lawsuit

One of the law firms involved in the ongoing mass-BitTorrent lawsuits in the U.S. is deploying a new tool to threaten alleged pirates. Prenda Law is contacting the defendants through robocalls, announcing that a lawsuit will be filed against them because they failed to settle the case. While the new tactic might be effective, critics are pointing out that the way they are carried out might be against the law.

Starting two years ago, hundreds of thousands of BitTorrent users who allegedly shared films without the consent of copyright holders have been dragged to court in the US.

The aim of the copyright holders, or copyright trolls, is never to take any of the cases to trial.

Instead they want alleged infringers to pay a substantial cash settlement to make legal action go away. Some equal this scheme to extortion, but the copyright holders say they are merely protecting their work.

One of the most active law firms engaged in these mass-BitTorrent lawsuits is Prenda Law. The firm has filed numerous lawsuits on behalf of adult entertainment companies and is frequently accused of harassment-like practices once they obtain the identity of account holders. For example, the firm is known to call accused BitTorrent pirates at their homes, urging them to pay up.

Starting last week, however, these ‘live’ phone calls we replaced by so-called robocalls. Instead of a real person, the accused now hear a previously recorded message. While these calls may be cheap and effective, the way they are carried out by Prenda Law raises all sorts of question.

A transcript of the call was posted online by DTD and reads as follows. Note that the call suggests that the defendant is working for the law firm.

“This is [accused name] with Prenda Law. With our clients offer to settle being expired now for more than 30 days it is pretty clear to them that you don’t plan to enter into a settlement agreement with them which is fine. This call is to inform you that we are going to start the process of filing a lawsuit with your name in it.”

“At first, you will receive time sensitive documents. We have found that most people do have an attorney review them. If you would like to get an idea of what the complaint will look like just go to our website www{.}wefightpiracy{.}com. We do have some of our recent filings there. If you have any questions give us a call. We can be reached at 305-748-2102 and your reference number is xxxx.”

An interesting technique, but also one that might actually be against the law, as Sophisticated Jane Doe points out. For example, while robocalls are allowed in some states, they are not in others.

Perhaps more worryingly is the suggestion that Prenda Law is targeting their entire database of defendants with these calls. This means that defendants whose cases have been dismissed (even with prejudice) are contacted as well.

The same is true for those defendants who already hired a lawyer. Directly contacting a defendant who’s represented by an attorney is frowned upon, to say the least.

The above shows that the law firms retained by copyright holders can go to extremes to get their settlement fees. In recent months several judges realized this. For example, in the Eastern District of New York they are advised to throw these cases out because they’re a “waste of judicial resources”. In other cases we’ve seen that judges specifically state that ISPs can’t reveal telephone numbers of account holders.

The law firms, however, are smart enough to evade jurisdictions where they are not welcome. And as long as they can convince alleged pirates to settle, through robocalls or not, they will continue business as usual.

    strange when it’s perfectly ‘ok’ and/or ‘legal’ to utilize any procedures to extort money from people, but the exact opposite when companies owe people money and refuse to pay up or take an extended amount of time that suits only them. dont know why, but it makes me think there double standards at play here somewhat. how about you?

    Any claims like this should start with three steps.

    1. Send a letter claiming that you believe they are just trolls and could they please send proof that they are the copyright holders of the material in question(ovbiously they will not do so ,or even if they do that is still good for your next step)
    Also ask for the proof they supposedly have that they are using to accuse you of this copyright infringement. I am sure ther are other things you could ask but these should be enough to start with.

    2.Advise them in writing that you did not download the data inquestion and they have no proof that you did and that if they contact you again you will take further steps to resolve this.

    3. Use the small claims court to ask them to stop harassing you with false accusations .
    I am sure they will come to some agreement to leave you alone and remove you from there database as the last thing they want really is to go to court.

      I contacted a lawyer and asked him that once.  I asked if any of these cases had gone “all the way” through the system and he said in his knowledge – No.

        They know their game and they’ve been playing it for quite some time.  In most places, the penalty for violating copyright laws is rather large.  They settle to expedite the process and to collect quickly so that they can be efficient at what they do.  Bringing anyone to court could always leave them with nothing… they still have to provide evidence.  If they only want a settlement, they don’t even need evidence, just contact information.  It’s basically a corporation of bullies that have years of practice against one person.

        Harassment, on the other hand, just isn’t as big of a deal.  You can’t collect pain and suffering, or probably any money in damages.  And then there’s the fact that it’d be one person against the experienced bullies.

        Until their money-making scheme stops working, this is going to continue.

    Pretend law sounds more accurate. Besides if they kept calling i would contact the department of agriculture. There are only certain times when calls can be made then i would file a lawsuit against them for harassment. ;)

      You need to go back to school and learn what ‘agriculture’ entails. In the US, via phone or internet, would be the Federal Communications Commission (FCC) that handles this sort of stuff.

I guess you didn’t figure that if you contacted them you could possibly have lawsuit with any company whom seems to harass you and take them to court and get up to 10000 dollars. so yeah I’ll take my ass back to school lmao!!! The fcc has no control over phone calls nor the internet only the airwaves like radio and television.DUHH A FIVE YEAR OLD WOULD KNOW THAT!!

    Really? It is claiming that the caller is the person who they are calling? So if John Doe is being called by this system, it will say, “this is John Doe from Prenda law?” That is so stupid, and it proves that these people have no idea what they are doing whatsoever. What a dumb message they have there.

    You know what’s fucked up is that it wouldn’t surprise me one bit if some if not the majority of their list comes directly from the yellow pages.

    I wonder what would happen if I setup a bot to call 20,000 people in an area like Chicago.This would be age based of course to maximize success. It really makes me wonder what percent would pay me just out of fear of that 250,000$ fine.

    It would say they were accused of downloading whatever and list legal actions and how they will play out and the possible worse case for them if they decide to fight it.

    Better yet I bet I could do it with just emails by setting up a phony website. The people that decide not to pay would just be dropped to allow more resources to push people that’s closer to cracking and giving in to the extortion.

    It’s basically what they’re doing to people right now. They could care less about if a person was guilty or not. Their only goal is to extract money quickly and quietly as possible so they can stay off the public radar. Sadly the people that pay up most likely sign a NDA which is fucking bullshit especially if they were innocent in the first place but realized it was cheaper and less time consuming to just pay up.

    I they call piracy theft but their actions are actually robbing people. Their idea of solid reliable statistics goes no farther than a hat with numbers and a box of Crayola crayons to draw their info-graph.

    Really how long do you think it will be till someone does exactly what I just talked about? It’s a flawless game to play right now especially when piracy is a hot topic these days. Someone is going to get away with making a lot of money and it will be called illegal but they will still say it’s okay if lawyers do the same thing.

     I’d assume it was a sales call, I’d get as far as ‘this is’ and hang up, if a company can’t be bothered to use a real person to call you then I want nothing to do with it. Seems to be a utter failure of a system for them all round and shows exactly what’s wrong in our society where the corporate bottom line is much more important than a person.

      True…. there was one group when I was in high school calling up homes when there was a ‘rash of mailbox destruction’ and asking parents “Do you know where your children are?” like just because they didn’t, their children had to be the ones doing this.

      Once one parent got on the case of this group, telling them he was going to sue them, they stopped the phone calls.
