As 2011 comes to an end, we follow up our most pirated movies and TV-shows charts by taking a look at the most pirated games of the year. Crysis 2 comes out on top in the PC games category in 2011. On Xbox 360 Gears of War 3 receives the same honor, while Super Mario Galaxy 2 scoops the title of most pirated Wii game for the second year in a row.
Source: TorrentFreak, for the latest info on copyright, file-sharing and anonymous VPN services.

In February, more than a month before its scheduled release date, and advance copy of Crysis 2 leaked on the Internet. Crytek and EA were hugely disappointed and feared a piracy fest, but the opposite was true.

Although tens of thousands of people downloaded a copy, the real boom came when the full version was released in March, resulting in nearly 4 million downloads by the end of the year.

This ‘success’ landed Crysis 2 the title of most pirated game of 2011 on the PC platform, beating Call of Duty: Modern Warfare 3 and Battlefield 3 with 3,650,000 and 3,510,000 downloads respectively. Interestingly enough, the interest among pirates in the Xbox 360 version of Crysis 2 was relatively low and the game didn’t make it into the top 5 there.

On the Xbox 360 the title of most pirated game goes to Gears of War 3. This game was released in September and amassed a total of 890,000 downloads. Call of Duty: Modern Warfare 3 and Battlefield 3 also came in second and third on the Xbox 360.

On the Wii platform ‘Mario’ titles traditionally come out on top, and this year is no exception. Super Mario Galaxy 2, released in 2010, becomes the most pirated Wii game for the second year in a row. With 1,180,000 downloads it comes just in front of Mario Sports Mix, which was pirated 1,090,000 times since February.

As can be seen from the three lists below, PC games are by far the most downloaded titles, with on average more than three times the number of downloads compared to Xbox 360 and Wii releases. Overall, the number of downloads of the top titles in each category is slightly lower than last year. The platforms that are not mentioned, such as the PS3, get considerably less downloads and are excluded for that reason.

The data for these estimated download numbers is collected by TorrentFreak from several sources, including reports from all public BitTorrent trackers.

Next month the long-awaited Crysis 2 is due for release but perhaps inevitably it's already been leaked onto the Internet. Although it's a PC beta version which requires some coaxing to perform, publisher EA has already decried this unofficial release and some gaming blogs have gone into overdrive condemning 'evil pirates'. But hey, let's all cool down for a second. Just because people can pirate, doesn't mean they always do.
Source: TorrentFreak, for the latest info on copyright, file-sharing and anonymous VPN services.

Type ‘Crysis 2′ into Google and the first result you get is the official site. The second result is a post from publisher EA’s blog titled ‘Crysis 2 Leaked’

“Crytek has been alerted that an early incomplete, unfinished build of Crysis 2 has appeared on Torrent sites. Crytek and EA are deeply disappointed by the news,” the post begins.

Indeed, a beta of the PC version of the game has been doing the rounds on torrent sites since Friday and although clearly unfinished and requiring varying levels of hoop-jumping to keep it running, it’s getting a pretty good reception from those who have downloaded and played it.

The fact that it has leaked, however, has caused gaming blogs to go into overdriven condemnation of the anticipated rampant piracy of this much awaited game. In particular, Destructoid editor Jim Sterling has gone postal with a passionate four-letter-word-littered tirade aimed squarely at pirates.

While some of Jim’s points are debatable, he makes some good points and is clearly absolutely passionate about games. As a former 8bit coder and gamer of more than three decades myself I can respect that. People love games. They appreciate the work that goes into them.

While it’s rare to hear people complain about movies or music leaking onto the Internet in file-sharing circles (in fact such situations are largely relished), games are a bit different. This leak of Crysis 2 appears to show that there’s something, even in piracy circles – I’m not sure what – that elevates the connection people have with games and their creators over the connection people have with those behind movies for example.

As both EA and Crytek plead with people to wait for the March 22 release date for Crysis 2 they appear to be supported, not just by those who never pirate, but also those who do.

Despite the beta being widely available, TorrentFreak stats show (completed) downloads of just 10,000 on public BitTorrent trackers. And that’s not because this title isn’t popular with gamers. Indeed, given the current mood, it’s not unthinkable that these low download numbers may well be a result of it being quite the opposite.

While some people are clearly happy to get an advance copy, it’s eye opening to see people on torrent sites encouraging others NOT to download it. Sure, there is the usual crowd throwing a middle finger up to the publishers while delighting in their juicy booty, but so many others are pleading with people to support Crytek by putting their hands in their pockets next month instead.

That said, there are others who aren’t heeding the advice but are treating this download as a demo to be deleted in due course, having grown tired of waiting for an official one to be released. Perhaps there’s a lesson to be learned there.

High profile game leaks don’t have to result in the doomsday scenario feared by their creators – unless they’re terrible games of course. Rewind back to October 2003 and a beta of Half-Life 2 was also leaking onto the Internet, a full 6 months before its release date, putting this 49 day advance copy of Crysis 2 in the shade. HL2 went on to do staggeringly well, selling 12 million copies to date.

Personally, as upcoming games in this genre go, I had my eyes mainly on Epic’s Bulletstorm but having seen the various videos on YouTube recorded by people playing this leaked beta, all of a sudden March can’t come soon enough. Crysis 2 looks absolutely gorgeous and while I don’t feel much warmth towards EA, I’m happy to support Crytek.

But why, when the game is sitting right there for free?

Do gamers really have more empathy with studios than their movie-going peers? Why are great games so special? What’s your take on this leak and how it should be handled? Are these download stats low because people are doing ‘the right thing’ or is fiddling about with betas just too much hassle? We’d love to hear your thoughts in the comments.

Players of the PC game Gears of War have a problem that means they are currently unable to even load their game. The reason – a hard-coded shutoff date in the DRM that prevents the game from playing. Yet again, DRM prevents an honestly purchased game from working. Will Crysis and GTA IV break next?
Source: TorrentFreak, for the latest info on copyright, file-sharing and anonymous VPN services.

We’ve covered DRM problems in the past, but we’ve never come across DRM before thats deliberately designed to terminate a game regardless of the consumers actions – until now. The Microsoft published Epic Studios game, Gears of War, is now unplayable to all purchasers, due to its DRM.

The DRM in question involves a certificate with a hardcoded date – January 28 2009 – as its time to expire. Now that this certificate has expired the game will not load, giving the following error message.

[installpath]\Gears of War\Binaries\wargame-g4wlive.exe: You cannot run the game with modified executable code. Please reinstall the game

Of course, reinstallation does nothing, as the certificate has still expired. Of greater interest is why there is a certificate with expiration date in the game at all, especially as it’s expired just 15 months after the games release.

After this was pointed out on Epic’s forums, joeGraf, a ‘super moderator’ (and presumably staff member of Epic) stated that they are now aware of this, and “are working with Microsoft to get it resolved.” Just what form that resolution will take is also not clear; be it an updated certificate with later date, an open ended certificate, or removing such certificates. If a new dated certificate is issued, then it can only be expected that we will have the same problems again when it too expires.

This may also raise a question mark over other ‘Games for Windows’ titles released since Gears of War – which include Crysis and Grand Theft Auto IV – over their inclusion of such certificates, but only time will tell.

In the meantime, those of you that wish to play can do so by setting your system date back to January 27 or earlier. Also, in between playing, remember you can drop the FTC a line and tell them about this experience with DRM.

DRM only usually punishes legitimate purchasers, so this screw up with Gears of War is quite unique. We’ve just discovered that the pirated ‘razor1911′ release is also affected, meaning that it’s taken down every copy available. Great work. It must be well hidden if the usually alert crackers didn’t spot it, begging the question “how many more games have an expiration date?”

As 2008 is slowly moving toward its end, we start taking a look at the most pirated titles in various categories. First up are games. As expected, Spore is by far the most downloaded game on BitTorrent, in part thanks to the DRM that came with the game.
Source: TorrentFreak, for the latest info on copyright, file-sharing and anonymous VPN services.

Traditionally, games can’t compete with the most pirated movies and TV-shows in actual download numbers, but Spore came very close this year.

Only 10 days after the game’s launch date, already half a million people had downloaded the game. During the months after that, another million people obtained a copy of the game via BitTorrent. According to our estimates, Spore was downloaded 1.7 million times since early September, a record breaking figure for a game.

When we posted about the impressive download rate on Spore – inflated due to the DRM that was put into the game – EA doubted our statistics. EA’s Mariam Sughayer said that every BitTorrent download was not a successful copy, and that several downloads didn’t work, were buggy, or contained viruses. We wont deny that on badly moderated torrent sites, malicious torrents probably can be found. However, this constitutes less than 1% of the available torrents, and they are not added to our statistics.

Below is the list of the 10 most downloaded (PC) games on BitTorrent in 2008, with an estimated download count for each. In second place we see The Sims 2, also from the hands of Spore creator Will Wright. Assassins Creed completes the top 3 with just over a million downloads.

Spore was without doubt the most anticipated game of the year. The game itself has blown away the people who have played it, but the DRM encouraged thousands to get their copy illegally. Already Spore has been downloaded more than 500,000 times on BitTorrent, and this number is increasing rapidly.
Source: TorrentFreak, for the latest info on copyright, file-sharing and anonymous VPN services.

Most critics agree that Spore is a great game. However, the users aren’t too happy with the absurd DRM restrictions that come with the game. EA decided that people who buy a legitimate copy of the game, are only allowed to install it three times.

The idea behind DRM is that it will stop people from pirating the game, but in reality, it often has the opposite effect. As Forbes points out, many commenters on various BitTorrent sites now legitimize downloading this game because the official copies include some heavy and intrusive DRM.

“You have the power to make this the most pirated game ever, to give corporate bastards a virtual punch in the face,” deathkitten writes in a comment on The Pirate Bay. He or she is spot on. Spore has been the most downloaded torrent on The Pirate Bay for over a week, which is unique for a game.

Since September 2nd when Spore first appeared on BitTorrent, it has been downloaded a little over 500,000 times across various BitTorrent sites according to our most recent statistics. This download rate exceeds that of any other pirated game in history, and in a week or two from now it will be the most pirated game ever on BitTorrent.

As a comparison, Crysis, one of the best-selling PC games of this year has only been downloaded 420,000 times since it was released in November 2007. The Sims 2 currently holds the record for the most pirate downloads. There are no accurate stats for this game, since it was released long before we started tracking downloads, but we estimate that approximately 1 million copies have been downloaded.

Of course the record breaking number of Spore downloads can’t be attributed solely to DRM, but it sure helped. That’s not all, it also contributed to making Spore one of the worst rated games on Amazon. Out of the 2,219 reviews, 2,018 awarded the game with just 1 star, all because of the strict DRM.

DRM doesn’t stop people from pirating a game, on the contrary. It only hurts legitimate customers since the DRM is removed from the pirate version. The same is true for music, movies and books. Let’s hope EA and other media moguls will learn their lesson.
