				<content:encoded><![CDATA[<p><a href="/images/policedownload.jpg"><img src="http://torrentfreak.com/images/policedownload-150x150.jpg" alt="policedownload" width="150" height="150" class="alignright size-thumbnail wp-image-67910"></a>In June 2011, police across Europe coordinated to carry out the largest <a href="http://torrentfreak.com/kino-to-raided-in-massive-police-operation-admins-arrested-110608/">anti-piracy operation</a> the continent had ever seen. Their target was Kino.to and its affiliates, a huge illegal movie streaming operation with links to Spain, France and the Netherlands. </p>
<p>Ultimately several people <a href="http://torrentfreak.com/?s=kino">went to jail</a> and Kino.to disappeared, but it didn&#8217;t take long for replacement site Kinox.to to take up the slack. It&#8217;s been clear for some time that anti-piracy groups have had their eyes on the popular site and now action appears to have been taken.</p>
<p>Last week investigators acting on behalf of the Attorney General carried out raids in several regions of Germany looking for four main suspects.</p>
<p>A raid on a house in a village near to the northern city of Lübeck aimed to secure two brothers, aged 21 and 25 years-old. This pair, who reportedly live with their parents, are said to be the main operators of Kinox.to. According to <a href="http://www.spiegel.de/netzwelt/netzpolitik/kinox-to-grossrazzia-mit-durchsuchungen-in-vier-bundeslaendern-a-999250.html">Der Spiegel</a>, the raid drew a blank.</p>
<p>In total, six homes and businesses were searched and arrest warrants were successfully executed in Neuss and Dusseldorf. Two individuals, said to key players, were detained.</p>
<p>According to prosecutor&#8217;s office spokesman Wolfgang Klein, a Berlin-based payment service used by the suspects was also raided to ensure their &#8220;tax liability&#8221; &#8211; a <a href="http://www.heise.de/newsticker/meldung/Staatsanwaltschaft-gibt-weitere-Details-zur-Razzia-bei-Kinox-to-bekannt-2432236.html">reported</a> 1.3 million euros &#8211; is met.</p>
<p>In addition to commercial copyright infringement and tax evasion, the defendants are accused of a range of other crimes including fraud, extortion and arson. </p>
<p>Klein said the defendants had &#8220;made great efforts&#8221; to get rid of their competitors in the piracy market, utilizing verbal tactics and those of a more direct nature.</p>
<p>&#8220;They used all means and also carried out threats,&#8221; he said. &#8220;Sometimes even a car burst into flames.&#8221;</p>
<p>And from here the plot only thickens.</p>
<p>According to a letter sent by anti-piracy outfit GVU to its members, the people behind Kinox.to are also behind a string of other sites including streaming giant Movie4K.to. The ring of services is said to extend to pirate linking sites Boerse.sx and MyGully.com, and GVU even connects file-hosting services FreakShare.com and BitShare.com to the operation.</p>
<p>The prosecutor&#8217;s office says &#8220;lots of data&#8221; and &#8220;assets&#8221; were secured following the raids but at this point the location of the missing brothers remains unknown. Some reports suggest that they may have even left Germany a while back. Adding to the confusion, Lars Sobiraj at <a href="https://tarnkappe.info/meinung-kinox-war-wird-und-die-offenen-fragen/">Tarnkappe</a> says his sources suggest that the brothers in control of Kinox are in fact much older and 21 and 25.</p>
<p>Nevertheless, whether it was published by the brothers or someone else, an update has appeared on Kinox.to mocking GVU and thanking them for the attention.</p>
<p>&#8220;GVU: You make yourself more ridiculous than you are. But THANK YOU again for the extreme (priceless) advertising !!&#8221; the post reads.</p>
<p>And that&#8217;s one of the key points. Along with all of the other mentioned sites, Kinox.to and Movie4K remain operational. In fact, as far as we can see, not a single site is down.</p>
<p>Perhaps inevitably this has led to speculation that some kind of honey pot could be in operation, but according to lawyer Christian Solmecke, that seems unlikely.</p>
<p>&#8220;From my perspective, the users of kinox.to have committed no offense, because the pure consumption of streaming services is not illegal [in Germany]. This is certainly the case whenever any copy of the stream is produced on your own computer,&#8221; Solmecke says.</p>
<p>&#8220;In addition, the GVU &#8211; which here apparently launched the criminal complaint &#8211; is also known normally to tackle the problem at its root. This means that the company is going in against the big fish, which has been shown again with the current raids too.&#8221;</p>

Legal actions are designed to send a message and important decisions in rightsholders&#8217; favor often open the floodgates for yet more action.</p>
<p>This is illustrated perfectly by the march towards large-scale website blocking in several regions around the world.</p>
<p>A topic pushed off the agenda in the United States following the SOPA debacle, web blockades are especially alive and well in Europe and living proof that while The Pirate Bay might the initial target of Hollywood and the record labels, much bigger plans have always been in store.</p>
<p>A typical example is now emerging in Austria. Having spent years trying to have streaming sites Kino.to, Kinox.to and Movie4K blocked at the ISP level, anti-piracy group VAP has just <a href="http://torrentfreak.com/court-orders-immediate-pirate-site-blockade-141003/">achieved its aims</a>. Several key local ISPs began blocking the sites this month but the Hollywood affiliated group has now admitted that they&#8217;ve had bigger plans in mind all along.</p>
<p>Speaking with <a href="http://derstandard.at/2000006700110/Antipiraterie-Verein-VAP-will-hunderte-weitere-Seiten-sperren-lassen">DerStandard</a>, VAP CEO Werner Müller has confirmed that his group will now work to have large numbers of additional sites banned at the ISP level.</p>
<p>Using a term often used by Dutch anti-piracy group BREIN, Müller says his group has compiled a list of sites considered by the movie industry to be &#8220;structurally infringing&#8221;. The sites are expected to be the leaders in the torrent, linking and streaming sector, cyberlockers included. IFPI has already confirmed it will be dealing with The Pirate Bay and two other sites.</p>
<p>The VAP CEO wouldn&#8217;t be drawn on exact numbers, but did confirm that a &#8220;low three digit&#8221; number of domains are in the crosshairs for legal action.</p>
<p>Although Austria is in the relatively early stages, a similar situation has played out in the UK, with rightsholders obtaining blocks against some of the more famous sites and then streamlining the process to add new sites whenever they see fit. Dozens of sites are now unavailable by regular means.</p>
<p>If VAP has its way the blockades in Austria will be marginally more broad than those in the UK, affecting the country&#8217;s eighth largest service providers and affecting around 95% of subscribers.</p>
<p>Of course, whenever web blockades are mentioned the topic of discussion turns to circumvention. In Austria the blockades are relatively weak, with only DNS-based  mitigation measures in place. However, VAP predicts the inevitable expansion towards both DNS and IP address blocking and intends to head off to court yet again to force ISPs to implement them.</p>
<p>Describing the Internet as a &#8220;great machine&#8221; featuring good and bad sides, Müller says that when ordering website blocks the courts will always appreciate the right to freedom of expression.  </p>
<p>&#8220;But there&#8217;s no human right to Bruce Willis,&#8221; he concludes.</p>

<p>Most recently Austrian anti-piracy group VAP <a href="http://torrentfreak.com/court-orders-immediate-pirate-site-blockade-141003/">completed</a> its mission to have two streaming sites &#8211; Movie4K and Kinox &#8211; blocked by local ISPs. The achievement was the culmination of years of work through the Austrian courts right through to the <a href="https://torrentfreak.com/eu-court-isps-can-be-forced-to-block-pirate-sites-140327/">European Court of Justice</a> and back again.</p>
<p>Several local ISPs (UPC, 3, Tele2 and A1) are now all blocking the sites and it&#8217;s widely expected that not only will VAP return for blocks of additional sites, but it will also be accompanied by recording group IFPI who will take on Pirate Bay and other sites.</p>
<p>In the meantime, however, the <a href="https://www.piratenpartei.at/demo-gegen-netzsperren-freitag-10-10-2014-1400-uhr">Austrian division</a> of the Pirate Party is complaining loudly about what they view as web censorship. So today, just a few hours from now, they intend to give the Hollywood-affiliated group a small taste of their own medicine.</p>
<p>At 2pm Austrian time, party members and their supporters say they will descend on VAP headquarters in Vienna to air their opinions on blocking and other censorship measures. The organizers hope that their small offline &#8216;blockade&#8217; will in some way mirror those experienced online.</p>
<p>Under the slogan &#8220;Block the Blocker&#8221;, the pirates say they will form their own symbolic obstruction outside <a href="https://www.google.com/maps/place/Wiedner+Hauptstra%C3%9Fe+63,+1040+Wien,+Austria/@48.1904563,16.3621201,15z/data=!4m2!3m1!1s0x476da82aa6f03d07:0x27c16bd66e9dec5c?hl=en">Wiedner Hauptstrasse 63</a>, 1040 Vienna, to raise awareness of why web filtering is highly problematic and useless for protecting artists. It&#8217;s a position <a href="http://derstandard.at/2000006372510/Gruene-wollen-Antrag-gegen-Netzsperren-einbringen">broadly shared</a> by several political parties in Austria including the Greens.</p>
<p>Of course, the pirates won&#8217;t be able to fully block access to VAP&#8217;s building, since that would be against the law. However, if they did manage to achieve that somehow &#8211; even unintentionally &#8211; VAP employees could simply enter their workplace through another entrance, or perhaps an adjoining building.</p>
<p>And with Kinox now circumventing the ISP blockade after adding a new .TV domain, there won&#8217;t be a pirate present today who doesn&#8217;t appreciate that irony.</p>

				<content:encoded><![CDATA[<p><img src="http://torrentfreak.com/images/pirate-card.jpg" width="250" height="210" class="alignright">Kino.to, at the time one of the world&#8217;s largest illegal streaming portals, was shut down in 2011 as part of Europe&#8217;s largest ever action against piracy sites.</p>
<p>However, just a month before Kino.to was dismantled, Austrian ISP ‘UPC’ was served with a preliminary injunction ordering it to block subscriber access to the site. The order had been obtained by the Hollywood-affiliated anti-piracy group VAP but it was called into doubt by the ISP. This led to the Austrian Supreme Court referring the matter to the European Court of Justice.</p>
<p>Earlier this year the ECJ handed down its <a href="https://torrentfreak.com/eu-court-isps-can-be-forced-to-block-pirate-sites-140327/">widely publicized decision</a> which stated that yes, in reasonable circumstances, pirate sites can indeed be blocked by European ISPs.</p>
<p>On the back of this ruling, VAP subsequently <a href="http://torrentfreak.com/block-the-pirate-bay-within-3-days-austrian-isps-told-140729/">wrote</a> to several local ISPs (UPC, 3, Tele2 and A1) demanding blockades of Movie4K.to and Kinox.to, a site that took over from Kino.to. This would become the test case on which all future blockades would be built.</p>
<p>When this formal request for the ISPs to block the sites <a href="http://torrentfreak.com/isps-face-lawsuits-failing-block-pirate-bay-140818/">was rejected</a>, in August VAP <a href="http://torrentfreak.com/four-isps-sued-for-failing-to-block-pirate-movie-sites-140830/">sued the providers</a>. And now, after more than three years of wrangling, VAP have finally got their way.</p>
<p>In a ruling handed down yesterday by the Commercial Court of Vienna, UPC, 3, Tele2 and A1 were ordered to block Movie4K and Kinox with immediate effect. According to <a href="http://derstandard.at/2000006347840/Provider-muessen-unverzueglich-Piratenseiten-kinoxto-und-movie4-sperren">Der Standard</a>, UPC and A1 placed blocks on the sites within hours, with 3 and Tele2 expected to comply with the injunction today.</p>
<p>But while another important hurdle has now been overcome, there is some way to go before VAP will have achieved everything they initially set out to do. At issue now is how far the ISPs will have to go in order to comply with the court order. It&#8217;s understood that VAP requires DNS and IP address blocking at a minimum, but whether the ISPs intend to comply with that standard remains to be seen.</p>
<p>It&#8217;s important for VAP, and other anti-piracy groups waiting in the wings, that these technical steps are workable going forward. Both VAP and the IFPI have lists of sites they would like blocked in the same way as Movie4K and Kinox have been, so it&#8217;s crucial to them that blockades aren&#8217;t easily circumvented.</p>
<p>Once this issue has been dealt with, in the next few months it&#8217;s likely that attention will turn to legal action being planned by the IFPI. The recording group has taken on the task of having torrent sites blocked in Austria, starting off with The Pirate Bay, isoHunt.to, 1337x.to and H33t.to.</p>
<p>IFPI is expected to sue several ISPs in the hope that local courts will treat torrent sites in the same way as they have streaming services. Once that&#8217;s been achieved &#8211; and at this stage it seems likely &#8211; expect long lists of additional domains to be submitted to the courts.</p>

				<content:encoded><![CDATA[<p><a href="/images/pirate-card.jpg"><img src="http://torrentfreak.com/images/pirate-card.jpg" alt="pirate-card" width="250" height="210" class="alignright size-full wp-image-86520"></a>Favorable rulings in both the European Court of Justice and the local Supreme Court earlier this year gave Austrian anti-piracy groups the power they needed to move forward on site-blocking.</p>
<p>What transpired was an attack from two directions. The first involved VAP, the anti-piracy association of the Austrian film and video industry. The second was launched by the local branch of IFPI, the International Federation of the Phonographic Industry.</p>
<p>In late July, VAP <a href="http://torrentfreak.com/block-the-pirate-bay-within-3-days-austrian-isps-told-140729/">wrote</a> to UPC, Drei, Tele2 and A1 with a request for the ISPs to block ThePirateBay.se plus streaming sites Movie4K.to and Kinox.to. Days later in a letter dated August 4, the IFPI asked five local ISPs to block access to four torrent sites &#8211; ThePirateBay,se, isoHunt.to, 1337x.to and H33t.to.</p>
<p>Unfortunately for VAP and the IFPI, the ISPs were going to need more than just a letter to begin censoring the Internet. By mid August, with their deadlines expired, none had initiated blockades. That led to <a href="http://torrentfreak.com/isps-face-lawsuits-failing-block-pirate-bay-140818/">threats of lawsuits</a> from both anti-piracy groups.</p>
<p>With August now drawing to a close, VAP has made good on its word. CEO Werner Müller confirmed to German media that his organization has now sued four Austrian ISPs. Müller would not be drawn on their names, but <a href="http://derstandard.at/2000004884081/Netzsperren-Verein-fuer-Antipiraterie-klagt-vier-Provider">DerStandard</a> spoke with UPC and A1 who both confirmed receiving letters.</p>
<p>&#8220;[The decision on blocking] should be left to the judgment of a judge, since in a specific case the rights of Internet users and the movie / music industry can be weighed more,&#8221; said A1 spokeswoman Livia Dandrea-Böhm. &#8220;We will now take a position in the time allowed by the court. Thereafter, the judge has to decide.&#8221;</p>
<p>Of further interest is VAP&#8217;s decision to exclude The Pirate Bay from their legal action and only sue for blockades against kinox.to and movie4k.to. There are suggestions that this could prove an easier legal route for VAP as the local Supreme Court is already familiar with the operations of Kinox and Movie4K, sites similar in structure to the now defunct Kino.to, the site which originally prompted calls for blocks in Austria.</p>
<p>However, The Pirate Bay will not escape so easily. The IFPI will tackle the infamous torrent site alongside others including isoHunt.to, 1337x.to and H33t.to. The music group is expected to sue several ISPs to force a blockade, although papers are still being drawn up. </p>

<p>VAP, the anti-piracy association of the Austrian film and video industry, wrote to several local ISPs &#8211; UPC, Drei, Tele2 and A1 &#8211; <a href="http://torrentfreak.com/block-the-pirate-bay-within-3-days-austrian-isps-told-140729/">demanding a blockade</a> of three domains – ThePirateBay.se, Movie4K.to and Kinox.to.</p>
<p>Just days later the IFPI signaled its intention to join the fray. In a letter dated August 4 and sent to five local ISPs, the music group set a deadline of less than two weeks for the service providers to block subscriber access to ThePirateBay,se, isoHunt.to, 1337x.to and H33t.to.</p>
<p>After the VAP letter came talks between the anti-piracy outfit and the ISPs, but a deadline of August 14 expired last week with no blocking having taken place. While the courts have confirmed that in certain circumstances service providers can be required to block errant sites, it appears that the ISPs don&#8217;t want to take action based on mere requests from rightsholders.</p>
<p>&#8220;We continue to believe that the decision to block websites or other Internet content should lie with the courts and legislators,&#8221; UPC told Austrian news outlet <a href="http://futurezone.at/netzpolitik/netzsperren-es-wird-klagen-geben/80.072.581">Future Zone</a>.</p>
<p>&#8220;We have sympathy for rightsholders and we are in full support of the creative industries. However, we offer our customers access to the Internet and have no obligation or right to choose which content is accessed.&#8221;</p>
<p>Faced with blocking requests around Europe, most if not all ISPs have required a court order in order to restrict access to &#8216;pirate&#8217; sites. Given this history, UPC&#8217;s reluctance comes as no surprise to VAP. Managing Director Werner Müller admitted last week that it was always unlikely that the ISPs would act without being legally required to do so. That means legal action, and VAP are ready for it.</p>
<p>&#8220;There will soon be a lawsuit concerning blocking against two websites &#8211; kinox.to and movie4k.to &#8211; against four major domestic Internet providers,&#8221; Müller says. &#8220;The lawsuits are prepared and are waiting almost only on their delivery.&#8221;</p>
<p>And, according to comments made by IFPI CEO Franz Medwenitsch, the music industry won&#8217;t be far behind.</p>
<p>&#8220;As of today there has been no response from the service providers so we had our attorney begin the preparations for legal action,&#8221; Medwenitsch confirms.</p>
<p>These web-blocking cases being brought against Austrian ISPs are of particular importance as they represent the first to take place following the March 27 ruling of the European Court of Justice. How that ruling is interpreted will be closely watched by rightsholders across the continent.</p>

				<content:encoded><![CDATA[<p><img src="http://torrentfreak.com/images/pirate-bay.jpg" width="200" height="207" class="alignright">A long-running legal case involving an Austrian anti-piracy group, a local ISP, and both the Supreme Court and European Court of Justice came to an end this July.</p>
<p>The case, which centered around the now-defunct movie site Kino.to, concluded with both courts agreeing that provided any action is both balanced and proportional, Internet service providers could be forced to block copyright-infringing websites.</p>
<p>Taking that decision and running with it, the IFPI in Austria has now written to the country&#8217;s largest Internet service providers with demands that they block several of the world&#8217;s largest torrent sites.</p>
<p>In a letter dated today, five ISPs were given less than two weeks to block subscriber access to ThePirateBay,se, isoHunt.to, 1337x.to and H33t.to. </p>
<p>IFPI says the sites are &#8220;internationally known piracy portals&#8221; which have already been blocked in UK, Belgium, Ireland, Finland and Denmark.</p>
<p>The music industry group, which protects the rights of the world&#8217;s largest recording labels, notes that its blocking request is reasonable given that the sites&#8217; engage in the unauthorized distribution of copyrighted material for profit.</p>
<p>&#8220;The foundation for website-blocking in Austria was created following a four year process involving the European Court of Justice,&#8221; IFPI&#8217;s Franz Medwenitsch added in a statement. </p>
<p>&#8220;The sites are all internationally known, structurally-infringing BitTorrent portals. Of course, we do not want to have access to the Internet itself blocked, only access to these four sites.&#8221;</p>
<p>The ISPs have been given until August 14 to implement the blockades, but whether they will have any effect remains to be seen. The Pirate Bay, the world&#8217;s most-blocked torrent site, recently informed TF that despite years of blockages, its traffic has <a href="http://torrentfreak.com/pirate-bay-traffic-doubles-despite-isp-blockades-140717/">doubled overall</a>.</p>

				<content:encoded><![CDATA[<p><a href="/images/pirate-bay.jpg"><img src="http://torrentfreak.com/images/pirate-bay.jpg" alt="pirate bay" width="200" height="207" class="alignright size-full wp-image-53470"></a>Kino.to, one of Germany&#8217;s largest illegal streaming portals, was <a href="http://torrentfreak.com/kino-to-raided-in-massive-police-operation-admins-arrested-110608/">shut down</a> during  2011 following the largest law enforcement action against of its type in Europe. But even with the site long gone the disruption it caused is about to affect The Pirate Bay and two other major sites.</p>
<p>Just a month before Kino.to was dismantled in June 2011, Austrian ISP &#8216;UPC&#8217; was served with a preliminary injunction ordering it to block subscriber access to the site. Verein für Anti-Piraterie der österreichischen Film und Videobranche (VAP) – the anti-piracy association of the Austrian film and video industry &#8211; had been on the warpath <a href="https://torrentfreak.com/anti-piracy-group-seeks-isp-level-block-of-movie-streaming-portal-101105/">since 2010</a> and had finally got their way after UPC refused to comply voluntarily.</p>
<p>But would blocking the site be legal? UPC insisted that it couldn&#8217;t be held responsible for a site it had nothing to do with. The ISP also maintained that there had been no court ruling determining that UPC customers who accessed Kino.to were breaking the law.</p>
<p>To settle the matter once and for all the Austrian Supreme Court asked the European Court of Justice to clarify whether a company that provides Internet access to people using an illegal website could be required to block that site. On March 27, 2014, the ECJ handed down its decision.</p>
<p>On UPC&#8217;s first point the Court said that EU law does not require a specific relationship between the person infringing copyright and the intermediary against whom any injunction had been issued. On the second point the Court said that proof of illegality was not necessary as the law exists not only to bring an end to infringement, <a href="https://torrentfreak.com/eu-court-isps-can-be-forced-to-block-pirate-sites-140327/">but also to prevent it</a>.</p>
<p>The key point of the ruling was that ISPs can indeed be required to block access to infringing sites provided that injunctions are both balanced and proportional. As a result, earlier this month Austria&#8217;s Supreme Court found that the blockade against Kino.to, even though the site is long dead, was correctly applied.</p>
<p>On the back of this ruling, this week VAP wrote to several local ISPs, UPC included, demanding a new blockade of three domains – ThePirateBay.se, Movie4K.to and Kinox.to, a site that took over from Kino.to.</p>
<p>&#8220;Letters dated yesterday have been sent to four large ISPs containing a request to block a small number of websites,&#8221; VAP Managing Director Werner Müller <a href="http://futurezone.at/netzpolitik/heimische-provider-muessen-the-pirate-bay-sperren/77.377.461">told</a> Future Zone.</p>
<p>On behalf of three local movie companies (Allegro Film, Wega Film and Epo Film) VAP has requested IP address and DNS blocks of the three sites but has given the ISPs very little time in which to carry them out, by this Friday August 1, to be exact.</p>
<p>The Association of Internet Service Providers Austria (ISPA) feels the deadline is far too restrictive.</p>
<p>&#8220;The period given to the providers to act is ludicrously short. We see this as very problematic. Extreme pressure is being exerted,&#8221; Secretary General Maximilian Schubert said.</p>
<p>&#8220;Two working days during the holiday season is just too little. To implement this by Friday we deem too difficult.&#8221;</p>
<p>Interestingly, Schubert also sees differences between The Pirate Bay and the pair of streaming portals listed in VAP&#8217;s blocking request.</p>
<p>&#8220;There is also legal content on The Pirate Bay,&#8221; Schubert said.</p>
<p>Discussions between VAP and the ISPs are scheduled for later in the week, so whether the anti-piracy group will get its way immediately will remain to be seen. They&#8217;ve waited years already, another few days shouldn&#8217;t make much difference.</p>
<p><strong>Update:</strong> The ISPs were given <a href="http://futurezone.at/netzpolitik/galgenfrist-fuer-netzsperren-in-oesterreich/77.815.521">two more weeks</a> to block The Pirate Bay.</p>

				<content:encoded><![CDATA[<p><img src="http://torrentfreak.com/images/stop-blocked.jpg" width="200" height="168" class="alignright">Although the dream of blocking sites in the United States was completely crushed along with the now-dead SOPA legislation, music and movie companies across Europe have enjoyed a much smoother ride.</p>
<p>Torrent sites such as The Pirate Bay and KickassTorrents are blocked in several countries around the EU and in the UK, for example, dozens of &#8216;pirate&#8217; domains are now blocked at the ISP level.</p>
<p>A notable case originating from Austria, however, has been on hold pending a decision from the Court of Justice of the European Union. The dispute saw movie companies Constantin Film Verleih and Wega Filmproduktionsgesellschaft complain that local ISP UPC Telekabel Wien had been providing subscriber access to illegal streaming site Kino.to, a site now shuttered following police action.</p>
<p>The movie companies previously obtained interim injunctions to have UPC block the site, despite UPC arguing that it couldn&#8217;t be held responsible for a site that it had absolutely nothing to do with. UPC also noted that there was no court ruling indicating its customers had broken the law.</p>
<p>To settle the matter the Austrian Supreme Court asked the Court of Justice to clarify whether a company that provides Internet access to those using an illegal website could be required to block that site. Today the Court of Justice handed down its long-awaited decision.</p>
<p>The Court found that a person who makes copyrighted material available to the public without permission from rightsholders is using the services of the Internet service provider of the people accessing that content. EU law does not require a specific relationship between the person infringing copyright and the intermediary against whom any injunction has been issued, the Court found.</p>
<p>Addressing UPC&#8217;s concerns that none of its customers had been deemed by a court to have acted unlawfully, the EU Court said that proof was not necessary as the law is in place not only to bring an end to infringement, but also to prevent it.</p>
<p>The EU Court added that since any ISP targeted by an injunction is free to carry out its obligations in a way that fits its circumstances, blocking orders do not therefore restrict an ISP&#8217;s freedom to conduct its business.</p>
<p>Any injunction must, however, must be proportional so as not to unnecessarily stop subscribers from lawfully accessing information. Furthermore, any blocking measures must have the effect of preventing access to copyrighted content or at least make it more difficult. National courts are required to ensure that these conditions are met.</p>
<p>The take-home from today&#8217;s ruling, which follows last year&#8217;s advice from the Advocate General, is clear: ISPs can be required to block access to infringing sites but any injunction must be balanced and proportional.</p>

				<content:encoded><![CDATA[<p><img src="http://torrentfreak.com/images/gottfrid1.jpg" align="right" alt="gottfrid">Pirate Bay founder Gottfrid Svartholm is currently held in a Danish prison, where he&#8217;s a suspect in a <a href="http://torrentfreak.com/pirate-bay-founders-imminent-extradition-raises-big-questions-131123/">large hacking case</a>. </p>
<p>At the same time, the 29-year-old is caught up in one of the first cases under Russia&#8217;s <a href="http://torrentfreak.com/large-torrent-site-to-be-blocked-by-russias-sopa-130826/">new anti-piracy law</a>. </p>
<p>In Russia copyright holders have targeted several websites, including the popular Rutor.org, which stand accused of distributing their content without permission. </p>
<p>The authorities found out out that Svartholm&#8217;s name appeared as the domain registrant for two of the sites, Rutor.org and Kinozal.tv. In addition, PRQ, the hosting company founded by the Pirate Bay founder, was listed as the registrant organization.</p>
<p>Last November, Svartholm <a href="http://torrentfreak.com/pirate-bay-founder-ordered-to-take-down-russian-pirate-sites-131126/">was ordered</a> to stop the distribution of these copyrighted works by changing the domain name information, and pay the fees for the publication of the verdict.</p>
<p>While it&#8217;s unclear whether Russia made any attempts to reach out to the Pirate Bay founder, a friend and former colleague at PRQ tells TorrentFreak that Svartholm can&#8217;t help them, even if he wanted to. </p>
<p>Andreas Carsbring says that PRQ offered customers the option to use the hosting company&#8217;s contact details, as a privacy shield. However, the client would have full control over the domain and bear the legal responsibilities, as defined in their contract. </p>
<p>&#8220;The service we offered at PRQ was to register the domain names as &#8216;Customer of PRQ&#8217;, so the domain still belongs legally to the customer even though the contact details for PRQ are being used,&#8221; Carsbring says. </p>
<p>There are additional signs that in the case of Rutor, the people behind the site filled out Svartholm&#8217;s name themselves, as it&#8217;s misspelled.</p>
<p>&#8220;In this particular case with Rutor.org it appears that the customer has registered the domain themselves using PRQ&#8217;s information, and by mistake they misspelled his last name. That might also explain why it says PRQ Inet KB, and not Customer of PRQ Inet KB as is the standard procedure.&#8221;</p>

<p>Even if PRQ were legally responsible there isn&#8217;t much Svartholm can do as he sold the company years ago before he left for Cambodia. In other words, Svartholm can&#8217;t help Russia in the case, even if he wanted to.</p>
<p>That someone else than the Pirate Bay founder has control over the domains is backed up by a recent Whois change for the Kinozal.tv. The domain no longer lists Svartholm as the contact person, a change the Pirate Bay founder himself could not have made from prison.</p>
<p>Carsbring, who recently launched the <a href="http://free.anakata.info/">free.anakata.info</a> website, believes that Svartholm may not even know about the Russian case. He hopes that the Rutor people will remove Svartholm&#8217;s name to avoid more trouble.</p>
<p>&#8220;I&#8217;m not sure if he&#8217;s aware of it. I&#8217;ll try to get this information through to him as soon as possible and see what he says. Hopefully the people behind Rutor.org can sort this out with PRQ Inet and update the registry to remove his name since it shouldn&#8217;t be there since years ago,&#8221; he says.</p>
<p>Meanwhile, Gottfrid has enough other things to worry about. The Pirate Bay founder remains in prison for now as a Danish court recently <a href="http://torrentfreak.com/50000-call-to-free-pirate-bay-founder-as-court-extends-custody-140108/">extended his custody</a> until February 5. </p>
