				<content:encoded><![CDATA[<p><a href="/images/mega4.png"><img src="http://torrentfreak.com/images/mega4.png" alt="mega" width="240" height="85" class="alignright size-full wp-image-87644"></a>Last July the Court of Rome ordered all local Internet providers to <a href="http://torrentfreak.com/dotcoms-mega-blocked-italy-piracy-concerns-140719/">block 24 websites</a> including Mega.co.nz and Russia’s largest email provider Mail.ru. </p>
<p>The broad anti-piracy measures were requested by small independent Italian movie distributor Eyemoon Pictures. The company complained that the sites in question distributed two films, “The Congress” and “Fruitvale Station,” before they were released in Italian cinemas.</p>
<p>Several sites affected by the blockade decided to appeal the order, and not without success. <a href="http://www.fulviosarzana.it/en/fulvio-sarzana/">Fulvio Sarzana</a>, who acts as lawyer for several of the accused sites including Mega, told TorrentFreak that the sites in question can now be accessed again.</p>
<p>The lawyer took up the case with the local Prosecutor, and pointed out that the blockades are overbroad. Instead of blocking access to a single file it makes entire sites unreachable.  </p>
<p>In addition, Sarzana noted that the measures are not needed as the file-hosting sites have strict takedown policies in place which allow copyright holders to remove infringing content. </p>
<p>The Prosecutor was receptive to these arguments and after a settlement agreement with several of the affected services was reached last month, local ISPs were ordered to lift the blockades. </p>
<p>&#8220;For Mega we negotiated a court settlement with the Office of the Prosecutor of Rome, which recognized the legitimacy of Mega&#8217;s activities and ordered the removal of the blockade. The same is the case for other hosting services,&#8221; Sarzana tells TorrentFreak.</p>
<p>For another site, which prefers not to be named, it was necessary to take the case to the Appeals Court. In common with a <a href="http://torrentfreak.com/court-orders-isps-to-unblock-pirate-site-140403/">similar case</a> earlier this year, the Court held that the blocking order was indeed too broad. As a result this blockade was also lifted. </p>
<p>&#8220;The Court held that the ISP blockade of the website was disproportionate because the copyright infringement occurs on individual pages. The entire website can therefore not be blocked for copyright reasons,&#8221; Sarzana notes.</p>
<p>The lawyer expects that the Appeals Court ruling will have implications for the Communications Regulatory Authority (AGCOM), which currently has the power to block allegedly infringing sites without a court order. </p>
<p>Considering the recent Appeals Court decision, this procedure may be unconstitutional. This possibility has also been raised by several consumer groups who have asked the court to review AGCOM’s legitimacy. </p>
<p>Last week the Court of Rome <a href="http://cyberlaw.stanford.edu/blog/2014/09/italian-constitutional-court-decide-whether-administrative-enforcement-online-copyright">referred</a> these complaints to the Constitutional Court. Here it will be examined whether the current procedure violates right to freedom of expression and free speech, among other things.</p>

				<content:encoded><![CDATA[<p><a href="/images/dotcom-laptop.jpg"><img src="http://torrentfreak.com/images/dotcom-laptop.jpg" alt="dotcom-laptop" width="233" height="170" class="alignright size-full wp-image-76556"></a>When it comes to the online space, Kim Dotcom is undoubtedly one of the most polarizing personalities around. From Megaupload to Mega to his fledgling music service Baboom, everything touched by the man has been bathed in publicity and heated opinion.</p>
<p>It is this ability to attract attention that undoubtedly played a key role in his creation of the Internet Party, a political movement with a stated aim to shake up New Zealand politics and put Dotcom-affiliated politicians in Parliament.</p>
<p>Last month, however, the elections failed to go as planned. The Internet Party <a href="http://torrentfreak.com/dotcoms-internet-party-fails-to-enter-new-zealand-parliament-140920/">conceded defeat</a> without winning a single seat, with its founder honoring tradition by politely congratulating Prime Minister and arch-rival John Key on his success.</p>
<p>After endless appearances and endless daily tweets, Dotcom essentially disappeared from public life, only breaking his silence to comment on the video game Destiny and his <a href="http://torrentfreak.com/kim-dotcom-baboom-sever-all-ties-141002/">exit from Baboom</a>. Today we catch up with the controversial entrepreneur to find out what happened.</p>
<p>&#8220;Baboom is this great idea of unchaining the artists from major record labels, allowing them to deal directly with their fanbase and using groundbreaking new ways of monetization that pay artists even when fans access content for free,&#8221; Dotcom told TF.</p>
<p>&#8220;But Baboom is facing tough opposition from the labels. Baboom has had to deal with unfair and deliberate efforts to make us fail. I won&#8217;t go into details.&#8221;</p>
<p>Dotcom says that for the sake of the artists he wants Baboom to succeed. But, in order for that to happen, a sacrifice needed to be made.</p>
<p>&#8220;The best way to achieve that success was to take me out of Baboom completely. We have a great management team and some brave investors in place. The brand &#8216;Kim Dotcom&#8217; is toxic and a major distractor to what Baboom is trying to achieve,&#8221; he concedes.</p>
<p>While sometimes problematic, Dotcom&#8217;s branding is clearly a double-edged sword, one only needs to look at the 2012 launch of Mega.co.nz to see that. On the tiniest of budgets, Dotcom managed to rally the world&#8217;s press to witness the launch of his new cloud-storage site. And without him it&#8217;s doubtful that Baboom would&#8217;ve achieved the profile it has today.</p>
<p>But while those same strengths allowed the Internet Party to became a news event every day leading up to the election, Dotcom&#8217;s profile and history &#8211; by his own admission &#8211; became a millstone around the party&#8217;s neck. Every aspect of his private life became a point of leverage for his political opposition.</p>
<p>&#8220;The Internet Party failed to deliver meaningful change in New Zealand at the last election because of the media spin by our opponents,&#8221; Dotcom says.</p>
<p>&#8220;They have successfully turned me into a villain, a German Nazi, a horrible employer, a political hacker, a practitioner of prohibited digital voodoo magic and nothing short of a monster. I would hate that guy too if I didn&#8217;t know that it wasn&#8217;t true.&#8221;</p>
<p>Dotcom says that part of the problem is that he has powerful enemies who in turn have friends in positions of influence, including in the press.</p>
<p>&#8220;When you have the US Government, the NZ Government, all Hollywood studios and all major record labels fighting against you, you don&#8217;t have a lot of friends, especially in the media,&#8221; Dotcom says.</p>
<p>&#8220;They either own the media (like in the US) or control the media with their significant advertising spending. Their passion to destroy me and everything I do, because of a copyright disagreement, is almost as fanatical as some of the religious extremism I see on TV.&#8221;</p>
<p>So with the election over, and maybe even Dotcom&#8217;s entire political career with it, the entrepreneur still has huge adversity to overcome. As he cuts Baboom free and wishes the company every success, Dotcom thoughts and energies turn to his pending extradition case. He knows it&#8217;s not going to be easy, especially given the mauling he received at the hands of New Zealand&#8217;s political heavyweights in the run up to the election.</p>
<p>&#8220;If I was a judge in New Zealand I wouldn&#8217;t think too highly of &#8216;Kim Dotcom&#8217; after months of prime time media bashing by the Prime Minister personally and his media helpers,&#8221; Dotcom says.</p>
<p>&#8220;John Key constantly made the Internet Party and its goals for Internet Freedom about my extradition case and he accused me of attempting to subvert the New Zealand judiciary. He basically told the judiciary every day that I&#8217;m a selfish, criminal man who &#8216;has to go away&#8217;.&#8221;</p>
<p>While Dotcom insists his motives were altruistic, there can be little doubt that if the election had gone his way the words of John Key and friends might have meant just that little bit less. As it stands, things went pretty badly.</p>
<p>The details of that <a href="http://torrentfreak.com/kim-dotcom-extradition-hearing-delayed-until-2015-140707/">extradition fight</a> will become clear during the months to come, but in closing Dotcom shared with us an interesting development.</p>
<p>&#8220;After 1000 days of waiting we finally got access to our own data (copies of our personal computers / hard drives). Remember, the Government made us wait this long for a single reason only: They demanded access to our <a href="http://torrentfreak.com/dotcom-encryption-keys-cant-be-given-to-fbi-court-rules-140702/">encryption codes</a>,&#8221; he says.</p>
<p>&#8220;But here&#8217;s the twist: It turns out that the Government had access to the encryption codes all along. Who would have thought that they didn&#8217;t install a trojan on my computer while they had the GCSB / NSA spying on me.&#8221;</p>
<p>Kim Dotcom&#8217;s extradition hearing is currently scheduled to take place in February 2015. Expect the media circus to get going again soon.</p>

				<content:encoded><![CDATA[<p><a href="/images/baboom.png"><img src="http://torrentfreak.com/images/baboom.png" alt="baboom" width="207" height="157" class="alignright size-full wp-image-89980"></a>On January 20, 2014, Kim Dotcom celebrated the two-year anniversary of the raid on his New Zealand mansion by releasing his brand new album &#8216;Good Times&#8217;.</p>
<p>In addition to being the first Dotcom collection distributed commercially, the album was also notable for <a href="http://torrentfreak.com/dotcoms-baboom-launches-with-good-times-for-free-140120/">soft-launching Baboom</a>. The fledging music service was to provide the platform for the entrepreneur&#8217;s assault on the major label-controlled recording business.</p>
<p>From the beginning Baboom&#8217;s stated aim was to disrupt the music industry by closing the gap between artists and fans, rewarding the former with most of the profits. The latter would be put in a win-win situation via free ad-supported music streaming.</p>
<p>The one constant that remained throughout was Kim Dotcom himself, a person with whom the service was inextricably linked, both financially and from branding and marketing perspectives. Today, however, that has all come to an end.</p>
<p>According to a new Particulars of Shareholding document filed this morning, Coatesville Trustee Services Limited &#8211; Dotcom&#8217;s family trust &#8211; has sold all of its shares in Baboom.</p>
<p>Before the sale Michael Sorensen&#8217;s Vig Limited, which also holds 13044 shares (9.97%) in Mega.co.nz, held 45% of Baboom&#8217;s shares. Company documents reveal that Vig now owns 90% after Dotcom&#8217;s family trust shares were transferred to the company.</p>

<p>As can be seen above, the remaining 10% is held by Xavier Buck of Dicé Invest. In November 2013, Buck, who is also a director at Domaintools, <a href="http://www.wort.lu/fr/economie/la-dropbox-cryptee-star-du-lu-cix-528f9c2de4b0fdd7bf3b44ed">said</a> he would be heading up MEGA Europe.</p>
<p>Perhaps the most curious element of Dotcom&#8217;s exit from the business is the language being used by Baboom chief executive Grant Edmundson. While he wishes the Baboom founder well, a single sentence distances Dotcom from the company in every possible way.</p>
<p>&#8220;The transaction means Dotcom no longer has any equity or role in Baboom, nor any relationship with the company,&#8221; Edmundson <a href="http://www.stuff.co.nz/entertainment/10571753/Dotcom-sells-out-of-Baboom">said</a>.</p>
<p>&#8220;Kim is moving on to focus on other projects and both camps wish each other well with future plans.&#8221;</p>
<p>TorrentFreak spoke with Edmundson and asked if Dotcom&#8217;s exit from the company had been his choice alone, Baboom&#8217;s, or by mutual agreement. He told us that he would not comment on matters between shareholders. However, when questioned on whether Baboom&#8217;s brand would be affected by the departure of its founder, Edmundson was more forthcoming. </p>
<p>&#8220;In terms of the impact on Baboom, my view is that the Baboom service will now be able to be judged on its own merits rather than being assessed on the brand equity (or otherwise) of its shareholder base,&#8221; the Baboom CEO said.</p>
<p>Kim Dotcom did not immediately respond to a request for comment. </p>
<p>Baboom is currently trying to raise US$3.98m (NZ$5.05m) and a listing on the Australian Securities Exchange. The company sought to raise the funds from investors in return for 11.5% of its shares with the offer closing in July, but that deadline was amended to make it open-ended.</p>
<p>Baboom is scheduled to debut in the fourth quarter of 2014, although no firm launch date has been provided by the company.</p>

<p>An official copy of the album was posted on the cloud hosting service <a href="http://mega.co.nz">Mega</a>, which is linked from <a href="http://kim.com/">Dotcom&#8217;s homepage</a>. This has never caused any issues, until a few weeks ago, when various copyright holders started sending unusual takedown requests to have the content removed. </p>
<p>IFPI, representing the major music labels, submitted several DMCA notices to Mega claiming that the file infringed the rights of various artists. This resulted in a game of whack-a-mole in which the album was removed and reinstated a few times. Currently it&#8217;s <a href="https://mega.co.nz/#!fNFSiJxa!ePxcgzjVYy6fxt0ep15iUyhnOgedIOcXQUs7U5myurE">unavailable yet again</a>.</p>

<p>When we <a href="http://torrentfreak.com/record-labels-take-down-kim-dotcoms-official-album-from-mega-140903/">previously covered</a> the issue, Mega stressed that the takedown requests were clearly mistaken. The company accused IFPI of not doing their homework and doubted the accuracy of their notices in general. </p>
<p>However, since the takedown notices kept targeting the same link, there was a good chance that these mistakes were orchestrated in some way. Assuming that someone was making IFPI and others believe that the link pointed to albums of other artists, we decided to do some research. </p>
<p>Eventually we stumbled upon a series of <a href="http://pastebin.com/search?cx=013305635491195529773%3A0ufpuq-fpt0&#038;cof=FORID%3A10&#038;ie=UTF-8&#038;q=https%3A%2F%2Fmega.co.nz%2F%23%21fNFSiJxa%21ePxcgzjVYy6fxt0ep15iUyhnOgedIOcXQUs7U5myurE&#038;sa.x=0&#038;sa.y=0&#038;sa=Search">Pastebin pages</a> where the URL of Dotcom&#8217;s album is linked to titles of other artists. Several of the artists mentioned in the pastes are the same as the one&#8217;s IFPI listed in their DMCA notices, so this would explain the mistakes.</p>

<p>The above is concerning for several reasons. First of all, it shows that IFPI and others don&#8217;t verify the legitimacy of their takedown notices. This means that pranksters can easily get them to censor legitimate content. </p>
<p>Secondly, Mega usually can&#8217;t check the validity of a claim, or it simply doesn&#8217;t know whether or not a user has permission to publish it. So they have very little options to stop the abuse.</p>
<p>&#8220;Mega aims to process all takedowns promptly, within a few hours. It is impossible to verify the claims as the files are encrypted so we don’t know the contents (unless the full link is provided with the key included), and we can’t verify if the person has a valid ownership/license or not,&#8221; a Mega spokesperson told us.</p>
<p>Despite these restrictions, the cloud hosting provider says it&#8217;s setting up a system where repeated takedowns can be flagged to prevent this type of abuse in the future.</p>
<p>&#8220;We are improving our systems to monitor the takedown process and will eventually be able to identify repeated incorrect notices,&#8221; Mega says.</p>
<p>Until then, Dotcom&#8217;s album will most likely disappear from Mega a few more times. Luckily for the fans, there&#8217;s also a <a href="http://baboom.com/kimdotcom/downloads">copy hosted</a> on the soon-to-be-released music service Baboom.</p>

				<content:encoded><![CDATA[<p><img src="http://torrentfreak.com/images/profit.png" width="222" height="175" class="alignright">Yesterday the Digital Citizens Alliance released a new report that looks into the business models of &#8220;shadowy&#8221; file-storage sites.</p>
<p>Titled “Behind The Cyberlocker Door: A Report How Shadowy Cyberlockers Use Credit Card Companies to Make Millions,” the report attempts to detail the activities of some of the world&#8217;s most-visited hosting sites.</p>
<p>While it&#8217;s certainly an <a href="http://torrentfreak.com/report-brands-dotcoms-mega-a-piracy-haven-140918/">interesting read</a>, the NetNames study provides a few surprises, not least the decision to include New Zealand-based cloud storage site Mega.co.nz. There can be no doubt that there are domains of dubious standing detailed in the report, but the inclusion of Mega stands out as especially odd.</p>
<p>Mega was without doubt the most-scrutinized file-hosting startup in history and as a result has had to comply fully with every detail of the law. And, unlike some of the other sites listed in the report, Mega isn&#8217;t hiding away behind shell companies and other obfuscation methods. It also complies fully with all takedown requests, to the point that it even <a href="http://torrentfreak.com/record-labels-take-down-kim-dotcoms-official-album-from-mega-140903/">took down its founder&#8217;s music</a>, albeit following an erroneous request.</p>
<p>With these thoughts in mind, TorrentFreak alerted Mega to the report and asked how its inclusion amid the terminology used has been received at the company.</p>
<p><strong>Grossly untrue and highly defamatory</strong></p>
<p><a href="/images/mega4.png"><img src="http://torrentfreak.com/images/mega4.png" alt="mega" width="240" height="85" class="alignright size-full wp-image-87644"></a>&#8220;We consider the report grossly untrue and highly defamatory of Mega,&#8221; says Mega CEO Graham Gaylard.</p>
<p>&#8220;Mega is a privacy company that provides end-to-end encrypted cloud storage controlled by the customer. Mega totally refutes that it is a cyberlocker business as that term is defined and discussed in the report prepared by NetNames for the Digital Citizens Alliance.&#8221;</p>
<p>Gaylard also strongly refutes the implication in the report that as a &#8220;cyberlocker&#8221;, Mega is engaged in activities often associated with such sites.</p>
<p>&#8220;Mega is not a haven for piracy, does not distribute malware, and definitely does not engage in illegal activities,&#8221; Gaylard says. &#8220;Mega is running a legitimate business alongside other cloud storage providers in a highly competitive market.&#8221;</p>
<p>The Mega CEO told us that one of the perplexing things about the report is that none of the criteria set out by the report for &#8220;shadowy&#8221; sites is satisfied by Mega, yet the decision was still taken to include it.</p>
<p><strong>Infringing content and best practices</strong></p>
<p>One of the key issues is, of course, the existence of infringing content. All user-uploaded sites suffer from that problem, from YouTube to Facebook to Mega and thousands of sites in between. But, as Gaylard points out, it&#8217;s the way those sites handle the issue that counts.</p>
<p>&#8220;We are vigorous in complying with best practice legal take-down policies and do so very quickly. The reality though is that we receive a very low number of take-down requests because our aim is to have people use our services for privacy and security, not for sharing infringing content,&#8221; he explains.</p>
<p>&#8220;Mega acts very quickly to process any take-down requests in accordance with its Terms of Service and consistent with the requirements of the USA Digital Millennium Copyright Act (DMCA) process, the European Union Directive 2000/31/EC and New Zealand’s Copyright Act process. Mega operates with a very low rate of take-down requests; less than 0.1% of all files Mega stores.&#8221;</p>
<p><strong>Affiliate schemes that encourage piracy</strong></p>
<p>One of the other &#8220;rogue site&#8221; characteristics as outlined in the report is the existence of affiliate schemes designed to incentivize the uploading and sharing of infringing content. In respect of Mega, Gaylard rejects that assertion entirely.</p>
<p>&#8220;Mega&#8217;s <a href="https://mega.co.nz/#affiliates">affiliate program</a> does not reward uploaders. There is no revenue sharing or credit for downloads or Pro purchases made by downloaders. The affiliate code cannot be embedded in a download link. It is designed to reward genuine referrers and the developers of apps who make our cloud storage platform more attractive,&#8221; he notes.</p>
<p><strong>The PayPal factor</strong></p>
<p><img src="http://torrentfreak.com/images/paypal.png" width="200" height="118" class="alignright">As detailed in many earlier reports (<a href="https://torrentfreak.com/paypal-bans-major-file-hosting-services-over-piracy-concerns-120710/">1</a>,<a href="https://torrentfreak.com/paypal-bans-usenet-providers-over-piracy-concerns-121121/">2</a>,<a href="https://torrentfreak.com/paypal-demands-invites-to-private-bittorrent-trackers-130108/">3</a>), over the past few years PayPal has worked hard to seriously cut down on the business it conducts with companies in the file-sharing space.</p>
<p>Companies, Mega included, now have to obtain pre-approval from the payment processor in order to use its services. The suggestion in the report is that large &#8220;shadowy&#8221; sites aren&#8217;t able to use PayPal due to its strict acceptance criteria. Mega, however, has a good relationship with PayPal.</p>
<p>&#8220;Mega has been accepted by PayPal because we were able to show that we are a legitimate cloud storage site. Mega has a productive and respected relationship with PayPal, demonstrating the validity of Mega’s business,&#8221; Gaylard says.</p>
<p><strong>Public apology and retraction &#8211; or else</strong></p>
<p>Gaylard says that these are just some of the points that Mega finds unacceptable in the report. The CEO adds that at no point was the company contacted by NetNames or Digital Citizens Alliance for its input.</p>
<p>&#8220;It is unacceptable and disappointing that supposedly reputable organizations such as Digital Citizens and NetNames should see fit to attack Mega when it provides the user end to end encryption, security and privacy. They should be promoting efforts to make the Internet a safer and more trusted place. Protecting people&#8217;s privacy. That is Mega’s mission,&#8221; Gaylard says.</p>
<p>&#8220;We are requesting that Digital Citizens Alliance withdraw Mega from that report entirely and issue a public apology.  If they do not then we will take further action,” he concludes.</p>
<p>TorrentFreak asked NetNames to comment on Mega&#8217;s displeasure and asked the company if it stands by its assertion that Mega is a &#8220;shadowy&#8221; cyberlocker. We received a response (although not directly to our questions) from David Price, NetNames&#8217; head of piracy analysis.</p>
<p>&#8220;The NetNames report into cyberlocker operation is based on information taken from the websites of the thirty cyberlockers used for the research and our own investigation of this area, based on more than a decade of experience producing respected analysis exploring digital piracy and online distribution,&#8221; Price said.</p>
<p>That doesn&#8217;t sound like a retraction or an apology, so this developing dispute may have a way to go. </p>

<p>In the early days he became somewhat of a cult figure thanks to his polite style and trademarked <a href="http://torrentfreak.com/images/web-sheriff-mistake.jpg">letterhead</a>. This set him apart from other anti-piracy crusaders who usually sent DMCA takedown requests with a more aggressive lawyer-like style.</p>
<p>The Sheriff once had a lively discussion with The Pirate Bay folks, who then sent him <a href="http://thepiratebay.se/static/interweb.pdf">this invoice</a> fax. Not much later relationships deteriorated even further after Giacobbi announced he would sue the site&#8217;s operators in  the US, France and Sweden, but not much came of that. </p>
<p>In recent years things have quietened down a bit, but The Web Sheriff and his deputies are still active. In recent years they have taken down over half a million URLs from Google alone. Most recently, the Sheriff has been targeting several Reddit.com pages. </p>
<p>In one of the most recent complaints the Sheriff demands the takedown of <a href="http://www.reddit.com/r/megalinks/comments/20loav/movienymphomaniac_2013_vol_1_and_2_pt2_in_comments/">a submission</a> in the r/megalinks subreddit, linking to two parts of the movie Nymphomaniac hosted on Mega.co.nz.</p>

<p>The request for removal was sent to Google last week but the search engine decided not to remove the URLs. It&#8217;s unclear why, but one reason for the inaction may be that the Mega links are no longer active.</p>
<p>Not all links reported by the Web Sheriff are &#8220;infringing&#8221; though. Another recent submission shows that he also tried to get <a href="http://www.reddit.com/r/AlanPartridge/comments/1ku0ws/alan_partridge_alpha_papa_has_a_north_american/">this submission</a> take down, which points to a perfectly legitimate news article from Variety.</p>

<p>This year copyright holders have increasingly targeted allegedly infringing Reddit links, Google&#8217;s data shows. The Web Sheriff is currently <a href="http://www.google.com/transparencyreport/removals/copyright/domains/reddit.com/">ranked second</a> in number of URLs sent, placed after LeakID and before Disney.  </p>
<p>Even the MPAA went after Reddit a few weeks ago. The Hollywood group <a href="http://torrentfreak.com/mpaa-targets-reddit-movie-piracy-140624/">tried to take down</a> the subreddit r/fulllengthfilms, but failed and drove <a href="http://www.reddit.com/r/FullLengthFilms/about/traffic">hundreds of thousands</a> of eyeballs to the page instead. </p>
<p>Thus far the Web Sheriff hasn&#8217;t booked any real successs either, but Reddit users are warned. The Sheriff is watching and will shoot down your submissions whenever he can.</p>

<p>Considering the controversial reputation of its predecessor Megaupload, copyright holders have been keeping a close eye on the site. Thus far, however, the number of takedown requests received by the company has been relatively small. </p>
<p>Perhaps not completely unexpectedly, among the takedown requests that do come in are many that wrongfully request the takedown of perfectly legitimate files. This was illustrated earlier this week when Kim Dotcom&#8217;s official album Good Times was removed following a complaint. </p>
<p>The album was released by Dotcom earlier this year and he has been sharing it <a href="http://kim.com/">via his website</a> ever since. The link in question points to Mega where people can download it for free, but a few days ago it suddenly disappeared.</p>

<p>To find out why the album was removed we contacted Mega for an explanation. The company informed us that music industry group IFPI requested the removal of Dotcom&#8217;s album through a takedown request sent on September 1.</p>
<p>Representing the major record labels, IFPI claimed that the link infringed on the copyrights of one of their artists. IFPI listed several musicians but Kim Dotcom was not one of them.</p>
<p>&#8220;It&#8217;s clearly an incorrect takedown request,&#8221; Mega&#8217;s Chief Compliance Officer Stephan Hall tells us.</p>

<p>TorrentFreak also contacted Kim Dotcom, who asked Mega to reinstate the album, which they did. All in all the album was unavailable for about a day.</p>
<p>While a mistake is easily made, this is not the first time that IFPI has tried to remove Dotcom&#8217;s album from Mega. A similar request was sent on August 18, this time claiming that it was a copyright infringement of Kimbra&#8217;s &#8220;The Golden Echo.&#8221;</p>
<p>IFPI&#8217;s actions have been sloppy, to say the least, and Mega&#8217;s Chief Compliance Officer has little faith in the accuracy of the music group&#8217;s other takedown requests.</p>
<p>&#8220;This is an indication that someone at the IFPI is not doing their homework and that their takedown notices in general cannot be trusted,&#8221; Hall tells TorrentFreak.</p>
<p>Unfortunately these kind of mistakes are not an isolated incident. For example, before Kim Dotcom’s Megaupload was shutdown early 2012 the site received many erroneous takedown notices.</p>
<p>“During the Megaupload days over 20% of all takedown notices were bogus,” Dotcom <a href="https://torrentfreak.com/hollywood-studios-want-google-to-censor-dotcoms-mega-130528/">told us</a> previously.</p>
<p>“We analyzed big samples of notices and most were automated keyword based takedowns that affected a lot of legitimate files. The abuse of the takedown system is so severe that no service provider can rely on takedown notices for a fair repeat infringer policy.”</p>
<p>A policy to punish copyright holders who make repeated mistakes, on the other hand, might be worth considering.</p>

				<content:encoded><![CDATA[<p><a href="/images/dotcom-laptop.jpg"><img src="http://torrentfreak.com/images/dotcom-laptop.jpg" alt="dotcom-laptop" width="233" height="170" class="alignright size-full wp-image-76556"></a>Back in 2012, millions of dollars of Megaupload and Kim Dotcom assets were seized in New Zealand and Hong Kong, action designed to bring the Internet entrepreneur financially to his knees.</p>
<p>That hasn&#8217;t been the case since, however. Dotcom has continued with his very public displays of wealth, living in one of New Zealand&#8217;s most expensive houses, flying around the country in helicopters, and bankrolling a brand new political party. </p>
<p>All this, 20th Century Fox, Disney, Paramount, Universal, Columbia Pictures and Warner Bros insist, are clear signs that Dotcom is disposing of wealth that will transfer to their hands should they prevail in their legal action against him &#8211; if there is any left of course.</p>
<p>Last month the High Court&#8217;s Judge Courtney agreed with the studios and ordered Dotcom to reveal all of his global assets “wherever they are located” and to identify “the nature of his interest in them.”</p>
<p>Needless to say, Dotcom has been putting up a fight, and has filed an appeal which will be heard in the second week of October. However, that date falls way beyond September 5, the date by which Dotcom has to comply with Judge Courtney&#8217;s disclosure order.</p>
<p>During a hearing today at the Court of Appeal, Dotcom&#8217;s legal team argued that their client should not have to hand over a list of his assets in advance of the October appeal as several legal points needed to be aired during the hearing.</p>
<p>According to <a href="http://www.stuff.co.nz/national/politics/10430597/Court-reserves-Kim-Dotcom-decision">Stuff</a>, lawyer Tracey Walker said that the 2012 restraining order covered assets generated before that date, but have no scope moving forward.</p>
<p>“The assets that they are talking about now are new assets that were created because of my entrepreneurial skill after the raid,&#8221; Dotcom explained previously.</p>
<p>Dotcom has remained extremely active in the business sector since 2012, helping to create cloud storage service Mega.co.nz and then generating cash by selling shares in the company. The authorities and Hollywood are clearly trying to keep an eye on the money.</p>
<p>In Court, Walker said that since $11.8 million was seized from Dotcom in 2012 and other funds are currently frozen in Hong Kong, the studios have a fund to draw on should they win their case. Revealing more about his current financial situation would breach Dotcom&#8217;s privacy, Walker added.</p>
<p>Appearing for the US-based studios, lawyer Jack Hodder said the disclosure order was fully justified.</p>
<p>Ending the hearing, the Court of Appeal reserved its decision on whether Dotcom will have to comply with the High Court ruling and disclose on September 9, or whether he will indeed be able to wait until after the October hearing.</p>
<p>In the meantime the political mudslinging continues in New Zealand, with Kim Dotcom now preparing <a href="http://tvnz.co.nz/national-news/kim-dotcom-preparing-case-against-whaleoil-6063706">legal action</a> against controversial blogger Cameron Slater who he accuses of publishing &#8220;200 plus smear stories&#8221; as part of a &#8220;character assassination&#8221; campaign handled by the ruling National Party.</p>

				<content:encoded><![CDATA[<p><a href="/images/mega4.png"><img src="http://torrentfreak.com/images/mega4.png" alt="mega" width="240" height="85" class="alignright size-full wp-image-87644"></a>While facing an extradition to America for his role in the so-called &#8220;Megaupload Conspiracy&#8221;, Kim Dotcom launched a new cloud storage venture, Mega. Now, this new service is being indirectly linked to a crime ring by local authorities. </p>
<p>Today <a href="http://mega.co.nz">Mega</a> announced that one of its major shareholders William Yan, also known as Bill Liu, is suspected of having connections to a large crime ring. Pending further investigation the police has put the 18.8% share held through Yan&#8217;s companies under restraining order.</p>
<p>Yan has not been formally charged and through his lawyer denied any wrong-doing. Mega itself is not believed to be connected to the alleged crimes. </p>
<p>“The Police have commented that their action does not affect any innocent third parties (such as Mega) who have had business dealings with Mr Yan,” Mega CEO Graham Gaylard says commenting on the news. </p>
<p>“Mega has been extremely diligent to ensure that all its operations are fully compliant with all legal and regulatory requirements. Mega does not undertake any illegal activities and does not wish to be associated with any such activity,” Gaylard adds.</p>
<p>Kim Dotcom says that William Yan was properly screened before he became a shareholder. The New Zealand entrepreneur, who himself is accused of money laundering by the United States, said that no alarm bells went off at the time. </p>
<p>&#8220;He is an investor who put money into Mega because he believed in it. I had no idea he had any problems or issues,&#8221; Dotcom told <a href="http://www.nzherald.co.nz/business/news/article.cfm?c_id=3&#038;objectid=11313978">the Herald</a>.</p>
<p>The news comes at an unfortunate time for Mega, which intends to go public on the New Zealand stock exchange through a backdoor listing. As a result of the restraining order the trading in shares of the backdoor listing vehicle TRS has been <a href="http://www.sharechat.co.nz/article/6ea86b81/update-trading-in-trs-shares-halted-as-william-yan-related-mega-stake-under-restraining-order.html">temporarily halted</a>. </p>
<p>Despite <a href="http://www.nzherald.co.nz/nz/news/article.cfm?c_id=1&#038;objectid=11313119">the problems</a> of its shareholder, Mega&#8217;s CEO doesn&#8217;t believe the company will be affected. Gaylard stresses that all funds received by Mega were paid by Yan’s lawyers through banks that operate under stringent anti money laundering policies. </p>
<p>“Mega has never had any reason to suspect that such funds resulted from any illegal activity, and the Restraining Order will not affect the operations of Mega,” Gaylard says. </p>
<p>“For us it is business as usual.”</p>

<p>In fact, it&#8217;s becoming apparent that aside from isolated instances, once websites get put on national blocklists in the UK or Italy, for example, it is unlikely that they will become readily available again.</p>
<p>Since no one in power is lobbying for blocked sites to be removed from censorship filters, sites such as The Pirate Bay and KickassTorrents will probably remain blocked indefinitely. There are no immediately obvious time-out events attached to these injunctions and there&#8217;s certainly no one prepared to go to court to argue over the details.</p>
<p>Such sunset clauses are important though, as India is finding out.</p>
<p>Back in July a TV network owned by Sony <a href="http://torrentfreak.com/google-services-among-472-sites-blocked-for-world-cup-piracy-140707/">went to court</a> in India to have hundreds of sites blocked at the ISP level after they allegedly made World Cup matches available online without permission.</p>
<p>The 472 sites requested was reduced to 219 after an appeal by ISPs, but the injunction was still one of the broadest to date anywhere in the world. Whether it reduced piracy or placed money in Sony&#8217;s back pocket is anyone&#8217;s guess, but now &#8211; long after the World Cup ended &#8211; the blockades are still in place.</p>
<p><a href="http://www.medianama.com/2014/07/223-filesharing-piratebay-block-india/">Medianama</a> says it has carried out tests and discovered that The Pirate Bay, Mega.co.nz, TorrentHound, LimeTorrents and TorrentFunk among dozens of others are still inaccessible through local ISPs.</p>
<p>The news outlet also contacted Multi Screen Media, the Sony company behind the blocks, asking whether the company had asked for the blocks to be removed and why Dotcom&#8217;s Mega was targeted. The company did not respond.</p>
<p>While some will argue that having sites blocked is a legitimate response to online piracy, it is difficult to maintain that stance long after any infringements cited in court cases have ended. That said, ex parte hearings are by their nature one-side, so it&#8217;s unlikely anyone will be looking out for the rights of their rivals anytime soon.</p>
