				<content:encoded><![CDATA[<p><a href="/images/expendablespiracy.jpg"><img src="http://torrentfreak.com/images/expendablespiracy.jpg" alt="expendablespiracy" width="275" height="203" class="alignright size-full wp-image-92859"></a>Over the past two months movie studio Lionsgate has rolled out an unprecedented anti-piracy campaign to stop people from sharing <a href="http://torrentfreak.com/expendables-3-leaks-online-100k-copies-down-in-hours-140725/">leaked copies of The Expendables 3</a>. </p>
<p>Aside from dragging <a href="http://torrentfreak.com/lionsgate-sues-filesharing-sites-expendables-3-leak-140801/">six file-sharing sites to court</a>, Lionsgate sent out hundreds of thousands of takedown notices to websites that linked to pirated copies of the leaked movie. </p>
<p>While this campaign had <a href="http://torrentfreak.com/major-torrent-sites-and-google-purge-the-expendables-3-140819/">some success</a>, the studio has yet to identify who first published the leaked copy online. In a new court request filed at a California federal court Lionsgate states that the weblogs of file-hosting service Swankshare.com may provide more details. </p>
<p><a href="http://web.archive.org/web/20140625035110/http://swankshare.com/">Swankshare</a> is one of the sites that was targeted in Lionsgate&#8217;s lawsuit. Following a preliminary injunction the site&#8217;s servers were taken down by its hosting company FDCServers. However, the Expendables makers now want to gain access to the server logs to see who uploaded the leaked copy of the film. </p>
<p>&#8220;Lions Gate is informed and believes that as the website host for Swankshare, FDCServers is likely to have weblogs and other data evidencing traffic on Swankshare that will be useful to Lions Gate in its investigation of the source of the infringement at issue in this lawsuit,&#8221; Lionsgate&#8217;s lawyers inform the court.</p>
<p>The request suggests that there is reason to believe that Swankshare may have been used by the initial leaker. However, it&#8217;s currently unknown whether the movie studio has any concrete leads to proof this or if it&#8217;s merely grasping at straws.</p>

<p>The court filing also shows that the movie studio has been able to track down the owner of Swankshare, Mr. Lucas Lim. They are currently trying to resolve their dispute, and as part of these discussions Mr. Lim agreed that Lionsgate can access the sites server logs.</p>
<p>&#8220;Lions Gate and Mr. Lim have discussed whether a resolution of the dispute between them might be possible, and to further those discussions Mr. Lim has stipulated that Lions Gate may seek authority from the Court to serve a subpoena on FDCServers for the production of weblogs and other data evidencing traffic on Swankshare,&#8221; they explain.</p>
<p>Hosting provider FDCServers is willing to cooperate but requested clarification from the court that it&#8217;s permitted to grant access to the servers, as they were ordered to take them offline in the previous injunction.</p>
<p>Whether the server logs will indeed expose the initial leaker has yet to be seen, but Lionsgate has clearly not given up the effort to track down the source.  </p>
<p>Meanwhile, the movie studio continues to stop the distribution of The Expendables 3 via various file-sharing sites. </p>
<p>Earlier this week the court approved a request to add Limetorrents.net and Torrentdownload.biz to the injunction as these sites are connected to the owner of Limetorrents.com. Both sites currently remain online but no longer list any copies of Expendables 3. </p>

<p>To prevent their IP-addresses from being visible to the rest of the Internet, millions of people have signed up to a VPN service. Using a VPN allows users to use the Internet anonymously and prevent snooping.</p>
<p>Unfortunately, not all VPN services are as anonymous as they claim.  </p>
<p>Following a high-profile case of an individual using an &#8216;anonymous&#8217; VPN service that turned out to be not so private, TorrentFreak decided to ask a selection of VPN services some tough questions.</p>
<p>By popular demand we now present the third iteration of our VPN services &#8220;logging&#8221; review. In addition to questions about logging policies we also asked VPN providers about their stance towards file-sharing traffic, and what they believe the most secure VPN is. </p>

<p>What follows is the list of responses from the VPN services, in their own words. Providers who didn&#8217;t answer our questions directly or failed by logging everything were excluded. Please note, however, that several VPN companies listed here do log to some extent. The order of the lists holds no value. </p>

We absolutely do not log any traffic nor session data of any kind, period. We have worked hard to meticulously fork all daemons that we utilize in order to achieve this functionality. It is definitely not an easy task, and we are very proud of our development team for helping Private Internet Access to achieve this unique ability.</p>
<p>2. We operate out of the US which is one of the few, if only, countries without a mandatory data retention law. We explored several other jurisdictions with the help of our professional legal team, and the US is still ideal for privacy-based VPN services.</p>
<p>We severely scrutinize the validity of any and all legal information requests. That being said, since we do not hold any traffic nor session data, we are unable to provide any information to any third-party. Our commitment and mission to preserve privacy is second to none.</p>
<p>3. We do not monitor any traffic, period. We block IPs/ports as needed to mitigate abuse when we receive a valid abuse notification.</p>
<p>4. We do not host any content and are therefore unable to remove any of said content. Additionally, our mission is to preserve and restore privacy on the Internet and society. As such, since we do not log or monitor anything, we&#8217;re unable to identify any users of our service.</p>
<p>5. Once again, we do not log any traffic or session data. Additionally, unlike the EU and many other countries, our users are protected by legal definition. For this reason, we&#8217;re unable to identify any user of our service. Lastly, consumer protection laws exist in the US, unlike many other countries. We must abide by our advertised privacy policy.</p>
<p>6. We do not discriminate against any kind of traffic/protocol on any of our servers, period. We believe in a free, open, and uncensored internet.</p>
<p>7. Bitcoin, Ripple, PayPal, Google Play (Mobile), OKPay, CashU, Amazon and any major Gift Card. We support plenty of anonymous payment methods. For this reason, the highest risk users should definitely use Bitcoin, Ripple or a major gift card with an anonymous e-mail account when subscribing to our privacy service.</p>
<p>8. We&#8217;re the only provider to date that provides a plethora of encryption cipher options. We recommend, mostly, using AES-128, SHA1 and RSA2048. </p>

TorGuard does not store any IP address or time stamps on any VPN and proxy servers, not even for a second. Further, we do not store any logs or time stamps on user authentication servers connected to the VPN. In this way it is not even possible to match an external time stamp to a user that was simultaneously logged in. Because the VPN servers utilize a shared IP configuration, there can be hundreds of users sharing the same IP at any given moment further obfuscating the ability to single out any specific user on the network.</p>
<p>2. TorGuard is a privately owned company with parent ownership based in Nevis and our headquarters currently located in the US. Our legal representation at the moment is comfortable with the current corporate structuring however we wouldn’t hesitate to move all operations internationally should the ground shift beneath our feet. We now offer VPN access in 23+ countries worldwide and maintain all customer billing servers well outside US borders.</p>
<p>We would only be forced to communicate with a third-party in the event that our legal team received a court ordered subpoena to do so. This has yet to happen, however if it did we would proceed with complete transparency and further explain the nature of TorGuard’s shared VPN configuration. We have no logs to investigate, and thus no information to share.</p>
<p>3. Our network team uses commercial monitoring software with custom scripts to keep an eye on individual server load and service status/uptime so we can identify problems as fast as possible. If abuse reports are received from an upstream provider, we block it by employing various levels of filtering and global firewall rules to large clusters of servers. Instead of back tracing abuse by logging, our team mitigates things in real-time. We have a responsibility to provide fast, abuse-free VPN services for our clients and have perfected these methods over time.</p>
<p>4. In the event of receiving a DMCA notice, the request is immediately processed by our abuse team. Because it is impossible for us to locate which user on the server is actually responsible for the violation, we temporarily block the infringing server and apply global rules depending on the nature of the content and the server responsible. The system we use for filtering certain content is similar to keyword blocking but with much more accuracy. This ensures the content in question to no longer pass through the server and satisfies requirements from our bandwidth providers.</p>
<p>5. Due to the nature of shared VPN services and how our network is configured, it is not technically possible to effectively identity or single out one active user from a single IP address. If our legal department received a valid subpoena, we would proceed with complete transparency from day one. Our team is prepared to defend our client’s right to privacy to the fullest extent of the law.</p>
<p>6. BitTorrent is only allowed on select server locations. TorGuard now offers a variety of protocols like http/socks proxies, OpenVPN, SSH Tunnels, SSTP VPN and Stealth VPN (DPI Bypass), with each connection method serving a very specific purpose for usage. Since BitTorrent is largely bandwidth intensive, we do not encourage torrent usage on all servers. Locations that are optimized for torrent traffic include endpoints in: Canada, Netherlands, Iceland, Sweden, Romania, Russia and select servers in Hong Kong. This is a wide range of locations that works efficiently regardless of the continent you are trying to torrent from. </p>
<p>7. We currently accept payments through all forms of credit or debit card, PayPal, OKPAY, and Bitcoin. During checkout we may ask the user to verify a billing phone and address but this is simply to prevent credit card fraud, spammers, and keep the network running fast and clean. After payment it is possible to change this to something generic that offers more privacy. No VPN or Proxy usage can be linked back to a billing account due to the fact we hold absolutely no levels of logging on any one of our servers, not even timestamps! </p>
<p>8. For best security we advise clients to choose OpenVPN connections only, and if higher encryption is called for use AES256 bit. This option is available on many locations and offers excellent security without degrading performance. For those that are looking to defeat Deep Packet Inspection firewalls (DPI) like what is encountered in countries such as China or Iran, TorGuard offers “Stealth” VPN connections in the Netherlands, UK and Canada. Stealth connections feature OpenVPN obfuscation technology that causes VPN traffic to appear as regular connections, allowing VPN access even behind the most strict corporate wifi networks or government regulated ISPs.</p>

<p>8. OpenVPN generally provides the strongest encryption algorithm, so that is the recommended encryption protocol. IPVanish also allows a choice between TCP and UDP, and UDP is generally recommended for better speed.</p>

The only event in which we would even communicate with a third-party is if we received a court order. We would then be forced to notify them we have no information. This has not happened yet.</p>
<p>3. If serious abuse is reported we enable tcpdump to confirm the abuse and locate the user. These dumps are immediately removed. If the user is abusing our service they will be terminated permanently but we have never shared user information with a 3rd party. </p>
<p>4. We do not have any open incoming ports, so it’s not possible for us to “takedown” any broadcasting content.</p>
<p>5. We take every step within the law to fight such an order.</p>
<p>6. Yes, all types of traffic our allowed with our services.</p>
<p>7. We accept PayPal and Bitcoin. All payments are linked to users accounts because they have to be for disputes and refunds.</p>
<p>8. 256-bit AES is the most secure. However 128-bit blowfish is plenty good. If you&#8217;re concerned about surveillance agencies such as the NSA, their capabilities are shrouded in secrecy and claiming to be able to protect you is offering you nothing but speculation. As far as what&#8217;s publicly available for deciphering encryption, both of the encryptions I mentioned are more than sufficient.</p>

The only scenario is if a technical issue arises, but we request permission from the user first, and we only do it for the duration of the job, and then it is removed.</p>
<p>2. We are in the process of moving jurisdictions away from Australia at present as we are unsure what our current government plans to do in regards to our privacy. We have not decided where yet.</p>
<p>3. Only SMTP port 25 is filtered to mitigate spam, but we are working on some tools to make it easier for users to send mail.</p>
<p>4. Any DMCA request is ignored, as we have no logs to do anything about them.</p>

We go out of our way to make sure that PayPal transactions are not linked to the users, we generate a unique key per transaction to verify payment for the account is made, and then nuke that unique key. Bitcoin and Litecoin are also on the agenda.</p>

<p>2. United States, they don&#8217;t have data retention laws, despite their draconian surveillance programs. The only information we share with anyone is billing information to our payment gateway. This can be anonymized by using a pre-paid anonymous card. If asked to share specific data about our users and their habits, we would be unable to do so, because we don&#8217;t have any logs of that data.</p>
<p>3. That is mostly confidential information. However, we can assure our users that we do not use logging to achieve this goal.</p>
<p>4. In the event of a DMCA notice, we send out the DMCA policy published on our website. We haven&#8217;t yet received a VALID DMCA notice.</p>

Our USA network providers are required to inform us of each copyright infringement and are required to process our response putting undue strain on their support resources (hundreds per day). No information relating to a customers payment account is stored with the exception of automated PayPal subscriptions where we are required to store the subscription ID in order to assign it to an invoice (only for the duration of the subscription after which it is deleted). Of course PayPal will always maintain a record that you have sent funds to IVPN but that is all they have. If you need to be anonymous to IVPN and don&#8217;t wish to be identified as a customer then we recommend using Bitcoin or cash.</p>

The combination of having absolutely no logs at all and multiple customers per IP, wipes our customers digital footprint</p>

<p>7. Customers can pay with Visa, Mastercard and Debit. On top of that we also use PayPal. We use hash keys and tokens to identify a payment but it’s not logged or linked to the customer. We had to do this anyway hence we are a PCI Level 1 compliant merchant. Therefore we are not allowed to store any card or payment data with the records of our customers. These keys are pointless for anyone else so there is no chance to build a connection.</p>
<p>8. We offer PPTP, L2TP and OpenVPN, while out of nature OpenVPN comes with the highest encryption and algorithm. L2TP and OpenVPN are 256bit SSL  encrypted while PPTP comes with a solid 128bit. Although our customers are individual and have their own sense of why and what to use, we recommend L2TP as solid protocol. It’s less geeky and more secure than PPTP, but our customers can pick any of them in all the 47 network nodes around the globe.</p>

				<content:encoded><![CDATA[<p><a href="/images/expendablespiracy.jpg"><img src="http://torrentfreak.com/images/expendablespiracy.jpg" alt="expendablespiracy" width="275" height="203" class="alignright size-full wp-image-92859"></a>Over the past few weeks movie studio Lionsgate has rolled out an unprecedented anti-piracy campaign to stop people from sharing <a href="http://torrentfreak.com/expendables-3-leaks-online-100k-copies-down-in-hours-140725/">leaked copies of The Expendables 3</a>. </p>
<p>Aside from dragging six file-sharing sites to court, Lionsgate sent out hundreds of thousands of takedown notices to websites that linked to pirated copies of the leaked movie. </p>
<p>As a result all traces of the movie were <a href="http://torrentfreak.com/major-torrent-sites-and-google-purge-the-expendables-3-140819/">completely wiped</a> from many file-sharing sites. However, the movie studio still isn&#8217;t satisfied and is now going after individual downloaders as well.</p>
<p>Lionsgate has started sending takedown notices targeting people sharing the movie via BitTorrent. The notices are being sent to various ISPs who are urged to forward them to the customers whose accounts were monitored sharing the movie.</p>
<p>Interestingly, this also includes those who use remote servers known as BitTorrent seedboxes. While many believe that seedboxes keep them safe from the prying eyes of piracy monitoring firms, this is not always the case. Yesterday, a customer of the Canadian seedbox provider <a href="https://whatbox.ca/">Whatbox</a> received the following notice. </p>

<p>Via an email Whatbox urged the customer to delete the file in question, or face account suspension. </p>
<p>&#8220;A copyright complaint has been received for content existing on your account. To prevent account suspension, please delete the affected content within the next 24 hours,&#8221; the notice reads.</p>
<p>TorrentFreak contacted Whatbox, who explained that this takedown procedure is standard policy. As an Internet access provider it properly processes all incoming requests form copyright holders.</p>
<p>&#8220;When we receive a notice we check for the infohash and email the appropriate customer asking them to remove the file(s). Nothing is passed along to the copyright enforcement group except to confirm that the content was found and subsequently removed,&#8221; Anthony Ryan of Whatbox says.</p>
<p>&#8220;If a customer causes a large number of copyright complaints, we reserve the right terminate their service with a prorated refund and 24 hours of complimentary service to backup all their non-infringing files,&#8221; Ryan adds.</p>
<p>The above notice confirms that Lionsgate&#8217;s takedown efforts are now targeting individual downloaders, through their ISPs. The action appears limited to warning letters and at least for now there are no signs that Lionsgate will drag file-sharers to court. </p>
<p>Nu Image, another studio involved in the production of The Expendables 3, hasn&#8217;t taken any legal action either. However, they are more familiar with the topic than Lionsgate, as they sued a <a href="http://torrentfreak.com/23322-expendables-downloaders-accused-in-bittorrents-biggest-lawsuit-110510/">record breaking</a> 23,322 U.S. Internet users for downloading a copy of the first Expendables film.</p>

<p>Many insiders blame <a href="http://torrentfreak.com/expendables-3-leaks-online-100k-copies-down-in-hours-140725/">the pre-release leak</a> of the film for the disappointing numbers. Millions of people have downloaded pirated copies and skipped the box office, they argue. </p>
<p>Over the past several weeks Lionsgate has countered the leak by sending <a href="http://torrentfreak.com/lionsgate-fights-expendables-3-piracy-with-thousands-of-takedowns-140804/">tens of thousands</a> of takedown requests. The movie studio even went as far as <a href="http://torrentfreak.com/lionsgate-sues-filesharing-sites-expendables-3-leak-140801/">suing</a> the operators of six websites that allegedly failed to remove the infringing files – Limetorrents.com, Billionuploads.com, Hulkfile.eu, Played.to, Swankshare.com and Dotsemper.com.</p>
<p>This pressure resulted in drastic actions at several of these sites. Faced with a <a href="http://torrentfreak.com/lionsgate-can-seize-assets-filesharing-sites-court-rules-140809/">preliminary injunction</a>, cloud hosting service <a href="http://torrentfreak.com/hulkfile-shuts-down-following-expendables-3-lawsuit-140813/">Hulkfile shut down</a> its website, for example, and Swankshare did the same. LimeTorrents remained online, but <a href="http://torrentfreak.com/major-torrent-sites-and-google-purge-the-expendables-3-140819/">removed all</a> expendables torrents, including the trailers. </p>
<p>TorrentFreak spoke with the operator of the torrent site who says he installed a filter that blocks everything related to the Expendables franchise. He hoped that this would be enough to appease the movie studio, but thus far Lionsgate has no plans to back down without compensation.</p>
<p>In an email the movie studio&#8217;s lawyer notes that the preliminary injunction stays in place. Interestingly, however, the torrent site operator is invited to discuss a potential settlement.</p>
<p>&#8220;Thanks for the email. As you know the court has entered a preliminary injunction, and the lawsuit is going to continue unless we can reach a settlement. I think it would be helpful to set up a time to talk by phone,&#8221; Lionsgate&#8217;s lawyer writes.</p>
<p>Whether Lionsgate is serious about settling or whether it merely wants to know more about the identity of Limetorrents&#8217; operator remains anyone&#8217;s guess. It&#8217;s very unlikely that the movie studio will settle for anything short of a few million dollars in damages, something the torrent site owner can&#8217;t afford. </p>
<p>So for now, this means that the lawsuit is destined to drag on. </p>
<p>Yesterday LimeTorrents&#8217; domain registrar eNom had to hand over any information it has on the site&#8217;s owner. With the domain name at risk LimeTorrents has decided to move its website to a <a href="http://www.limetorrents.cc/">new .CC domain name</a>, where it will continue serving torrents, minus the Expendables. </p>

				<content:encoded><![CDATA[<p>With The Expendables 3 now officially released in theaters, the autopsy over its leak last month and the potential effects on box office figures has begun. </p>
<p>Many news outlets reported yesterday that the first weekend&#8217;s takings represent a flop for the third in the Expendables franchise and, of course, those closest to Hollywood are pointing the figure firmly at piracy.</p>
<p>But on the ground, on some of the very sites accused of facilitating piracy of the action movie, there are signs which suggests that this leaked title is being treated somewhat differently to any that have gone before.</p>
<p><strong>LimeTorrents</strong></p>
<p>Noting that the site was named in a <a href="http://torrentfreak.com/lionsgate-can-seize-assets-filesharing-sites-court-rules-140809/">Lions Gate lawsuit</a>, TF monitored for the presence of The Expendables 3 torrents on popular torrent site LimeTorrents. The result is shown in the image below.</p>

<p>While the site lists 14 torrents, not a single working Expendables 3 torrent appears in the search results. The three that do appear are sponsored links that do not lead to anything useful.</p>
<p>But while LimeTorrents are clearly doing all they can to comply with the terms of a lawsuit, other sites that have not been named by Lions Gate also appear to have been taking action.</p>
<p><strong>KickassTorrents</strong></p>
<p>KickassTorrents is the world&#8217;s second largest torrent site and the go-to place for many looking for fresh content. However, anyone searching for leaked Expendables 3 torrents will be going home disappointed. There are currently nine torrents returned in results, all of which are trailers. The leaked movie cannot be found.</p>

<p>It&#8217;s worth noting that like many of the leading torrent sites, Kickass removes torrents following copyright holder requests, so that goes someway to explaining why the Expendables 3 torrents have all disappeared. What is notable, however, is that no fresh ones seem to be reappearing as is usually the case.</p>
<p><strong>Update:</strong> KickassTorrents sent us the following comment. </p>
<p>&#8220;We have a person dedicated to read all incoming DMCA requests carefully and process those which are formatted according to the DMCA requirements. At the same time this person ignored requests that are wrongly formatted.&#8221;</p>
<p>&#8220;We believe that most DMCA requests are automatically generated because we frequently receive requests to remove forum topics where a movie name specified in the title.&#8221;</p>
<p><strong>RARBG</strong></p>
<p>There&#8217;s a similar story over at RARBG, the site placed 10th in our <a href="http://torrentfreak.com/top-10-popular-torrent-sites-2014-140104/">Top Torrent Sites 2014</a> post. A search produces the two torrents shown in the screenshot below and as they clearly point out, these definitely ain&#8217;t The Expendables.</p>

<p><strong>BitSnoop</strong></p>
<p>The effect of these takedowns, whether from rightsholders or introduced on a voluntary basis, can also be seen on torrent sites that specialize in indexing torrents found elsewhere. BitSnoop, the 9th most popular torrent site online with an index of 23 million torrents, currently has none related to The Expendables 3.</p>

<p><strong>Torrentz</strong></p>
<p>Over at Torrentz, a meta-search engine that indexes content on other sites, we can see that just four torrents are returned following an Expendables 3 search, none of which are the movie in question.The links at the top are sponsored and don&#8217;t relate to torrents.</p>
<p>The note at the bottom reveals that 41 torrent links have been removed following DMCA notices and their euro equivalent. Again, no more torrents seem to be reappearing.</p>

<p><strong>Google</strong></p>
<p>While torrents disappearing and not reappearing within major torrent sites is quite unusual in itself, perhaps the most dramatic effect can be seen in Google search results. </p>
<p>As previously documented, Lions Gate has put in a <a href="http://torrentfreak.com/lionsgate-fights-expendables-3-piracy-with-thousands-of-takedowns-140804/">herculean effort</a> to have listings removed. This, combined with any torrent site self-censorship efforts, has resulted in a tiny number of usable entries in the first 20 pages of Google results for common searches such as &#8216;The Expendables 3 + download + torrent&#8217;.</p>
<p>Of course, more experienced downloaders and those who persevere through a few searches can still find torrents and other ways to watch the movie. Torrents still remain on The Pirate Bay too, but there are clear signs that the leak of this movie is being treated differently from any other in recent memory, and not only by those involved in its legal distribution either.</p>

<p>Against the odds, in 2012 the GIF celebrated its 25th birthday, a fitting tribute to a format that has not only endured but also enjoyed a resurgence alongside today&#8217;s meme culture. However, the tiny video clips available in today&#8217;s GIFs aren&#8217;t appreciated by everyone.</p>
<p>On the eve of the new season, the UK&#8217;s Premier League has been putting fans on notice that it will no longer tolerate the unauthorized distribution of its copyright works. In addition to going after those who live stream full matches, the football giant says it now intends to tackle individuals who post short clips online.</p>
<p>According to the League, the problem is being caused by fans who record goals and upload them as GIFs and Vines within a few minutes of the event. These spread virally around blogs and sites such as Twitter and are enthusiastically consumed, especially on mobile devices.</p>
<p>&#8220;You can understand that fans see something, they can capture it, they can share it, but ultimately it is against the law,&#8221; Dan Johnson, director of communications at the Premier League, told the BBC.</p>
<p>These over-enthusiastic fans sharing a few seconds of footage &#8211; often at particularly low quality &#8211; are apparently causing financial hardship for the most-watched football league in the world. So, to bring that to an end, the Premier League are looking towards a technological solution.</p>
<p>&#8220;It&#8217;s a breach of copyright and we would discourage fans from doing it, we&#8217;re developing technologies like gif crawlers, Vine crawlers, working with Twitter to look to curtail this kind of activity,&#8221; Johnson <a href="http://www.bbc.co.uk/newsbeat/28796590">said</a>.</p>

<p>Going after those who place short video clips online is not new. There have been several reports in the past few months of UFC owner Zuffa taking action against individuals who upload GIFs, with a recent purge in July against content hosted on popular hoster GfyCat.</p>
<p>While fans insist that GIFs of goals and knockouts are simply free promotion, the rights to show such things don&#8217;t come cheap. UK tabloid The Sun <a href="https://play.google.com/store/apps/details?id=com.newsinternational.sungoals&#038;hl=en_GB">has an app</a> which shows Premier League goals within two minutes of the moment, but fans have to pay £7 per month ($11.68) to access it. </p>
<p>As the UFC have no doubt realized by now (and the Premier League soon will), taking down GIFs will be a huge resource drain and will do little to stop availability of content. The files are too tiny, far too easily shared and come from potentially thousands of directions. Add to this the problem of having to nuke content in near real-time, and this becomes an unsolvable problem, at least by enforcement means.</p>

				<content:encoded><![CDATA[<p><img src="http://torrentfreak.com/images/mpaa-restricted.png" alt="mpaa-restricted" width="250" height="146" class="alignright size-full wp-image-55207">Earlier this week the MPAA <a href="http://torrentfreak.com/movie-studios-demand-millions-megaupload-new-lawsuit-140408/">filed a lawsuit</a> against Megaupload, Kim Dotcom and two former employees of the defunct file-storage service. </p>
<p>In their complaint the movie studios repeat many of the claims that were laid out in the criminal case while demanding millions of dollars in damages.</p>
<p>But according to Dotcom the lawsuit is just a desperate attempt at an asset-grab by the MPAA because the criminal case against Megaupload is going to fail. </p>
<p>&#8220;The criminal case is failing. There will be no extradition. They are now trying to get at our seized assets with civil forfeitures. It&#8217;s a move of desperation,&#8221; Dotcom tells TF. </p>
<p>MPAA General Counsel Steven Fabrizio disagrees, and has told his side of the story to many news outlets this week. Dotcom and Fabrizio are usually not heard at the same time, but in a rare interview with <a href="http://www.radionz.co.nz/">Radio New Zealand</a> the two bumped heads.</p>
<p>Fabrizio was seemingly under the impression that he was doing a solo interview, but that changed when the reporter informed him that Dotcom was listening in on a second line. When she asked the MPAA lawyer whether he wanted to discuss the case with Dotcom there was a brief silence, but he eventually agreed. </p>

<p>First MPAA&#8217;s General Counsel had the opportunity to explain what Megaupload did wrong and why. In line with their complaint, Fabrizio described the file-storage site as a business that was set up to facilitate and encourage copyright infringement. </p>
<p>&#8220;Megaupload was never a cloud storage service to begin with,&#8221; Fabrizio noted. &#8220;From its birth to its death, it was a service that was designed to profit from copyright infringement, and in fact, it did profit handsomely from copyright infringement.&#8221;</p>
<p>&#8220;The proof of the pudding that it was not a storage service, is that almost 98 percent of the people who used Megaupload were not premium users. If you weren&#8217;t a premium user, and your content wasn&#8217;t downloaded frequently enough, then Megaupload would delete it,&#8221; he added. </p>
<p>Dotcom, who in private refers to the MPAA&#8217;s counsel as &#8220;Fabricatio,&#8221; because he is &#8220;script writing and &#8216;fabricating&#8217; Hollywood&#8217;s science fiction lawsuits&#8221;, later refuted the claim that Megaupload deleted files uploaded by free users. </p>
<p>&#8220;That is a blatant lie,&#8221; Dotcom said. &#8220;We have not purged any files from Megaupload for many years. If you were a non-premium user and you had an account with us that was free, your files would not be deleted.&#8221; </p>
<p>Fabrizio&#8217;s second argument was that Megaupload offered a rewards program which encouraged people to share large video files. Again, Dotcom contested this claim by pointing out that people only got paid for files smaller than 100 megabytes. Megaupload&#8217;s founder conceded that users could circumvent the limits by uploading split archives, but he stressed that the restriction was specifically put in place to discourage copyright infringement.</p>
<p>The third allegation Fabrizio made was that Megaupload employees had private conversations where they allegedly discussed the &#8220;pirate&#8221; status of their work. </p>
<p>&#8220;Internally they referred to themselves as modern pirates. Some of the employees and some of the co-defendants actually uploaded infringing popular movies themselves, so that they could be downloaded by others,&#8221; the MPAA&#8217;s top lawyer noted. </p>
<p>Again, Dotcom disagreed and explained that the &#8220;pirates&#8221; the employee referred to were Steve Jobs and Bill Gates. </p>
<p>&#8220;Yeah, well that&#8217;s complete nonsense, right. One of our employees who was admin staff and a developer has chatted with our CTO and he watched a documentary called Pirates of Silicon Valley. That was a movie about Steve Jobs and Bill Gates and how they stole the ideas from each other,&#8221; Dotcom said. </p>
<p>&#8220;He then made this remark to [the CTO] saying we are modern-day pirates, comparing himself to the attitude those guys had, simply because they were copying from each other and we were copying from our competitors and vice versa,&#8221; he added.  </p>
<p>Responding to the reporter&#8217;s question on why he wouldn&#8217;t go to the U.S. voluntarily to stand trial, Dotcom said that he <a href="https://torrentfreak.com/kim-dotcom-will-go-to-the-us-in-exchange-for-legal-funds-120710/">offered to do so</a>, but only on the condition that he would get access to his funds as well as bail, which the Department of Justice refused.</p>
<p>The reporter then switched back to Fabrizio, who didn&#8217;t seem to believe much of what Dotcom was saying. </p>
<p>&#8220;Mr. Dotcom can talk all he wants about his excuses, but the reality is that you can say anything you want if you&#8217;re not constrained by the truth of the facts that you&#8217;re saying,&#8221; Fabrizio said.  </p>
<p>Of course, the same also applies to the MPAA and Mr. Fabrizio&#8230; </p>
<p>The interview is an intriguing face-off, and the first time ever that the MPAA and Dotcom have gone head-to-head. It probably wont be the last time either, although the venue will very much depend on how the criminal proceedings and the civil case progress.</p>
