IP evidence: ISP&#039;s assign IP adresses and spoofing doesn&#039;t work for data transfers if the ISP controls which IP exists on which connection. The biggest reason the IPs are unreliable is that the ISP&#039;s keep unreliable administrations. Also mistakes like typing wrong IP addresses, copying wrong customer data and timezone settings or no timezone settings can have devastating effects on the reliability.

Another issue that could be addressed is the time between the so called offense and the moment to send the letter. It is impossible to prove or sometimes even remember what someone did or did not do on a certain time/date months ago. Should also have been an argument. 

The way ACS scam was setup, it would have been impossible to prove anything anyway as the victims have control of the evidence the whole time. Try encryption or deleting files followed by zero-ing free space.
