Unfortunately this penalty for filing a false DMCA notice has never been tested in court. The nearest to it being tested in court was when Hotfile filed a brief against Warner Bros stating that Warner Bros committed perjury with filing DMCA notices and giving examples but they both agreed to settle the case so the penalty of the DMCA was never tested in court.

Actually there is a penalty for filing false DMCA claims. It’s called Perjury, which is a felony offense in the United States that can carry a sentence of up to 20 years in prison.

Google really isn’t helping the situation by filtering out the links to authorized content. When they do this, it’s just encouraging the companies who are sending out the notices to be as reckless as they want to be, and let Google fix the mistakes.

They should process all the notices and then send notes to the various companies telling them that links to their content were taken down and making them go through the counter-claim process to restore them. Maybe then they would start to realize how broken the system is.
