				<content:encoded><![CDATA[<p><a href="/images/stop-blocked.jpg"><img src="http://torrentfreak.com/images/stop-blocked.jpg" alt="stop-blocked" width="200" height="168" class="alignright size-full wp-image-72076"></a>Website blocking has become one of the music and movie industries&#8217; favored weapons in their seemingly endless fight against online piracy. Blocks of torrent and other sharing sites are in place in many countries around Europe, mainly due to court injunctions forcing ISPs to take action against copyright infringement.</p>
<p>While legal action is one way of introducing a blockade, other methods require much less time, effort and money. This week the spotlight was placed on the UK, where the government has pressured ISPs to introduce default-on filtering for their subscribers, ostensibly for the protection of children. The result is <a href="http://torrentfreak.com/uk-porn-filter-triggers-widespread-internet-censorship-140702/">huge overblocking</a> and conveniently for the entertainment industries, hundreds &#8211; possibly thousands &#8211; of file-sharing sites wiped out with the correct settings.</p>
<p>With the right level of knowledge these filters can be turned off, but other more serious national anti-child abuse mechanisms cannot.</p>
<p>The UK&#8217;s Internet Watch Foundation (<a href="http://en.wikipedia.org/wiki/Internet_Watch_Foundation">IWF</a>) maintains a blocklist of URLs that point to sexual child abuse content. Over in New Zealand the Department of Internal Affairs maintains DCEFS, the Digital Child Exploitation Filtering System. Both are run in cooperation with the countries&#8217; ISPs with the sole aim of keeping the most objectionable material away from public eyes.</p>
<p>Today, however, it&#8217;s been revealed that Hollywood attempted to broaden the remit of New Zealand&#8217;s DCEFS in order to protect their own interests.</p>
<p>The Motion Pictures Distributors Association (<a href="http://www.mpda.org.nz/about/studios">MPDA</a>) has a familiar sounding name and unsurprisingly has some well-known backers. Fox, Sony, Paramount, Disney, Universal and Roadshow are all members of the group which coordinates the distribution of movies in New Zealand.</p>
<p>According to a <a href="http://www.radiolive.co.nz/">RadioLIVE</a> <a href="http://www.3news.co.nz/Hollywood-piracy-screening-rejected-by-Govt/tabid/423/articleID/351329/Default.aspx">report</a>, in order to prevent copyright infringement the studios requested access to the DCEFS child abuse filtering system.</p>
<p>After obtaining government permission, Hollywood hoped to add their own list of sites to DCEFS so that by default subscribers to New Zealand&#8217;s <a href="http://www.dia.govt.nz/Censorship-DCEFS-Internet-Service-Providers">main ISPs</a> would be prohibited from accessing torrent and other file-sharing type sites.</p>
<p>But in the face of objections from both the ISPs and the Kiwi government, Hollywood was forced to scrap its plans.</p>
<p>&#8220;[The ISPs] were not prepared to agree to that extension and in any case it would have shifted the mandate somewhat from [the Department of Internal Affairs'] primary focus on preventing sexual abuse of young children,&#8221; Internal Affairs Minister Peter Dunne told the show.</p>
<p>There can be little doubt that Hollywood believes web filtering is an effective mechanism to reduce infringement &#8211; MPAA chief Chris Dodd <a href="http://torrentfreak.com/mpaa-pirate-site-blockades-140613/">explicitly said so</a> during his speech at the International IP Enforcement Summit last month. But the notion that governments should treat the filtering of copyrighted content and child abuse in the same way is <a href="http://torrentfreak.com/the-copyright-lobby-absolutely-loves-child-pornography-110709/">not only controversial</a> but unlikely to win sympathy with the public.</p>

				<content:encoded><![CDATA[<p><img src="http://torrentfreak.com//images/mininova.png" align="right"alt="mininova">Starting today, Mininova will use a content recognition system that detects and removes torrent files linking to copyright infringing files. The system will also prevent the torrents from being re-uploaded to mininova later on. </p>
<p>Mininova co-founder Niek told TorrentFreak that the system will be tested for 12 weeks with only a few titles. With this trial Mininova collaborates with an association representing several TV/movie content owners. Niek couldn&#8217;t tell us which one, but our best guess would be that it&#8217;s the MPA(A).</p>
<p>The content removal system should be seen as an extension of the existing <a href="http://www.mininova.org/copyright">copyright policy</a> according to Niek, who also said that the current trial will be used to find out whether the content recognition system is a workable  and effective solution.</p>
<p>The system was selected by the copyright holders themselves who want an easier way to get torrent files removed than the current notice and takedown policy, and it is operated by an undisclosed third party. Interestingly, this collaboration does not mean that the <a href="http://torrentfreak.com/mininova-trial-due-in-two-months-090316/">upcoming court case</a> against BREIN is off the table.</p>
<p>Later this month BREIN hopes to convince the court that Mininova has to filter its search results, so that all .torrent files which may point to unauthorized content are removed. Up until now, Mininova refused to interfere with the search results, claiming that the DMCA take-down procedure they have is good enough. This has clearly changed now. </p>
<p>The response from Mininova&#8217;s users is mostly negative, with one commenter saying &#8220;Shame to see such a nice site decide to go hang itself,&#8221; and another adding &#8220;Wow, guess you guys are caving under the pressure. Too bad its all over now.&#8221; </p>
<p>The effectiveness of this filtering system, and how it will affect mininova&#8217;s popularity is yet to be seen, but it sure is a radical development.</p>

				<content:encoded><![CDATA[<p>Trials for the &#8216;great firewall of Australia&#8217; were due to start a couple of days ago but adding to other concerns, the testing has been delayed. Developed ostensibly for the protection of minors, there is widespread concern that not only will it fail in its stated primary aim, but will affect regular net users from going about their business by slowing everything down. The government even plans to attempt the <a href="http://torrentfreak.com/australian-internet-filter-will-target-bittorrent-081222/">blocking</a> of BitTorrent traffic.</p>
<p>According to a <a href="http://www.abc.net.au/news/stories/2008/12/24/2454789.htm">report</a>, the Federal Opposition says it is &#8220;not surprised&#8221; that the government&#8217;s filtering scheme has been delayed. The latest update is that the trial will commence mid-January 2009, with the ISPs involved being announced at the same point.</p>
<p>iiNet, one of Australia&#8217;s largest ISPs, has been most vocal about the minimal chances of success for the filtering scheme, even going as far as to say that it was only participating in the trials to show that it will fail. iiNet chief Michael Malone even labeled the architect of the plan, Broadband Minister Stephen Conroy, as “the worst Communications Minister we’ve had in the 15 years since the [Internet] industry has existed.”</p>
<p>An Australian Senate member since July 1993 and previously the Shadow Minister for Defense, Nick Minchin is the Shadow Minister for Broadband and he believes that the filtering system would drastically slow down the Internet.</p>
<p>He told ABC, &#8220;The laboratory trial that the Government conducted this year showed potential effect on speed of up to 87 per cent slowdown in the speed of the internet, he said, adding &#8220;And this is from the Government that wants to install a National Broadband Network so we can all have high speed broadband.&#8221;</p>
<p>&#8220;I think that&#8217;s a major flaw in the scheme but there are many, many others.&#8221;</p>
<p>So, three weeks from now the trial is supposed to start. It won&#8217;t take a fourth week to realize that it is doomed to fail.</p>
