				<content:encoded><![CDATA[<p><a href="/images/policedownload.jpg"><img src="http://torrentfreak.com/images/policedownload-150x150.jpg" alt="policedownload" width="150" height="150" class="alignright size-thumbnail wp-image-67910"></a>In June 2011, police across Europe coordinated to carry out the largest <a href="http://torrentfreak.com/kino-to-raided-in-massive-police-operation-admins-arrested-110608/">anti-piracy operation</a> the continent had ever seen. Their target was Kino.to and its affiliates, a huge illegal movie streaming operation with links to Spain, France and the Netherlands. </p>
<p>Ultimately several people <a href="http://torrentfreak.com/?s=kino">went to jail</a> and Kino.to disappeared, but it didn&#8217;t take long for replacement site Kinox.to to take up the slack. It&#8217;s been clear for some time that anti-piracy groups have had their eyes on the popular site and now action appears to have been taken.</p>
<p>Last week investigators acting on behalf of the Attorney General carried out raids in several regions of Germany looking for four main suspects.</p>
<p>A raid on a house in a village near to the northern city of Lübeck aimed to secure two brothers, aged 21 and 25 years-old. This pair, who reportedly live with their parents, are said to be the main operators of Kinox.to. According to <a href="http://www.spiegel.de/netzwelt/netzpolitik/kinox-to-grossrazzia-mit-durchsuchungen-in-vier-bundeslaendern-a-999250.html">Der Spiegel</a>, the raid drew a blank.</p>
<p>In total, six homes and businesses were searched and arrest warrants were successfully executed in Neuss and Dusseldorf. Two individuals, said to key players, were detained.</p>
<p>According to prosecutor&#8217;s office spokesman Wolfgang Klein, a Berlin-based payment service used by the suspects was also raided to ensure their &#8220;tax liability&#8221; &#8211; a <a href="http://www.heise.de/newsticker/meldung/Staatsanwaltschaft-gibt-weitere-Details-zur-Razzia-bei-Kinox-to-bekannt-2432236.html">reported</a> 1.3 million euros &#8211; is met.</p>
<p>In addition to commercial copyright infringement and tax evasion, the defendants are accused of a range of other crimes including fraud, extortion and arson. </p>
<p>Klein said the defendants had &#8220;made great efforts&#8221; to get rid of their competitors in the piracy market, utilizing verbal tactics and those of a more direct nature.</p>
<p>&#8220;They used all means and also carried out threats,&#8221; he said. &#8220;Sometimes even a car burst into flames.&#8221;</p>
<p>And from here the plot only thickens.</p>
<p>According to a letter sent by anti-piracy outfit GVU to its members, the people behind Kinox.to are also behind a string of other sites including streaming giant Movie4K.to. The ring of services is said to extend to pirate linking sites Boerse.sx and MyGully.com, and GVU even connects file-hosting services FreakShare.com and BitShare.com to the operation.</p>
<p>The prosecutor&#8217;s office says &#8220;lots of data&#8221; and &#8220;assets&#8221; were secured following the raids but at this point the location of the missing brothers remains unknown. Some reports suggest that they may have even left Germany a while back. Adding to the confusion, Lars Sobiraj at <a href="https://tarnkappe.info/meinung-kinox-war-wird-und-die-offenen-fragen/">Tarnkappe</a> says his sources suggest that the brothers in control of Kinox are in fact much older and 21 and 25.</p>
<p>Nevertheless, whether it was published by the brothers or someone else, an update has appeared on Kinox.to mocking GVU and thanking them for the attention.</p>
<p>&#8220;GVU: You make yourself more ridiculous than you are. But THANK YOU again for the extreme (priceless) advertising !!&#8221; the post reads.</p>
<p>And that&#8217;s one of the key points. Along with all of the other mentioned sites, Kinox.to and Movie4K remain operational. In fact, as far as we can see, not a single site is down.</p>
<p>Perhaps inevitably this has led to speculation that some kind of honey pot could be in operation, but according to lawyer Christian Solmecke, that seems unlikely.</p>
<p>&#8220;From my perspective, the users of kinox.to have committed no offense, because the pure consumption of streaming services is not illegal [in Germany]. This is certainly the case whenever any copy of the stream is produced on your own computer,&#8221; Solmecke says.</p>
<p>&#8220;In addition, the GVU &#8211; which here apparently launched the criminal complaint &#8211; is also known normally to tackle the problem at its root. This means that the company is going in against the big fish, which has been shown again with the current raids too.&#8221;</p>

				<content:encoded><![CDATA[<p><img src="http://torrentfreak.com/images/pirate-card.jpg" width="250" height="210" class="alignright">Kino.to, at the time one of the world&#8217;s largest illegal streaming portals, was shut down in 2011 as part of Europe&#8217;s largest ever action against piracy sites.</p>
<p>However, just a month before Kino.to was dismantled, Austrian ISP ‘UPC’ was served with a preliminary injunction ordering it to block subscriber access to the site. The order had been obtained by the Hollywood-affiliated anti-piracy group VAP but it was called into doubt by the ISP. This led to the Austrian Supreme Court referring the matter to the European Court of Justice.</p>
<p>Earlier this year the ECJ handed down its <a href="https://torrentfreak.com/eu-court-isps-can-be-forced-to-block-pirate-sites-140327/">widely publicized decision</a> which stated that yes, in reasonable circumstances, pirate sites can indeed be blocked by European ISPs.</p>
<p>On the back of this ruling, VAP subsequently <a href="http://torrentfreak.com/block-the-pirate-bay-within-3-days-austrian-isps-told-140729/">wrote</a> to several local ISPs (UPC, 3, Tele2 and A1) demanding blockades of Movie4K.to and Kinox.to, a site that took over from Kino.to. This would become the test case on which all future blockades would be built.</p>
<p>When this formal request for the ISPs to block the sites <a href="http://torrentfreak.com/isps-face-lawsuits-failing-block-pirate-bay-140818/">was rejected</a>, in August VAP <a href="http://torrentfreak.com/four-isps-sued-for-failing-to-block-pirate-movie-sites-140830/">sued the providers</a>. And now, after more than three years of wrangling, VAP have finally got their way.</p>
<p>In a ruling handed down yesterday by the Commercial Court of Vienna, UPC, 3, Tele2 and A1 were ordered to block Movie4K and Kinox with immediate effect. According to <a href="http://derstandard.at/2000006347840/Provider-muessen-unverzueglich-Piratenseiten-kinoxto-und-movie4-sperren">Der Standard</a>, UPC and A1 placed blocks on the sites within hours, with 3 and Tele2 expected to comply with the injunction today.</p>
<p>But while another important hurdle has now been overcome, there is some way to go before VAP will have achieved everything they initially set out to do. At issue now is how far the ISPs will have to go in order to comply with the court order. It&#8217;s understood that VAP requires DNS and IP address blocking at a minimum, but whether the ISPs intend to comply with that standard remains to be seen.</p>
<p>It&#8217;s important for VAP, and other anti-piracy groups waiting in the wings, that these technical steps are workable going forward. Both VAP and the IFPI have lists of sites they would like blocked in the same way as Movie4K and Kinox have been, so it&#8217;s crucial to them that blockades aren&#8217;t easily circumvented.</p>
<p>Once this issue has been dealt with, in the next few months it&#8217;s likely that attention will turn to legal action being planned by the IFPI. The recording group has taken on the task of having torrent sites blocked in Austria, starting off with The Pirate Bay, isoHunt.to, 1337x.to and H33t.to.</p>
<p>IFPI is expected to sue several ISPs in the hope that local courts will treat torrent sites in the same way as they have streaming services. Once that&#8217;s been achieved &#8211; and at this stage it seems likely &#8211; expect long lists of additional domains to be submitted to the courts.</p>

				<content:encoded><![CDATA[<p><a href="/images/pirate-card.jpg"><img src="http://torrentfreak.com/images/pirate-card.jpg" alt="pirate-card" width="250" height="210" class="alignright size-full wp-image-86520"></a>Favorable rulings in both the European Court of Justice and the local Supreme Court earlier this year gave Austrian anti-piracy groups the power they needed to move forward on site-blocking.</p>
<p>What transpired was an attack from two directions. The first involved VAP, the anti-piracy association of the Austrian film and video industry. The second was launched by the local branch of IFPI, the International Federation of the Phonographic Industry.</p>
<p>In late July, VAP <a href="http://torrentfreak.com/block-the-pirate-bay-within-3-days-austrian-isps-told-140729/">wrote</a> to UPC, Drei, Tele2 and A1 with a request for the ISPs to block ThePirateBay.se plus streaming sites Movie4K.to and Kinox.to. Days later in a letter dated August 4, the IFPI asked five local ISPs to block access to four torrent sites &#8211; ThePirateBay,se, isoHunt.to, 1337x.to and H33t.to.</p>
<p>Unfortunately for VAP and the IFPI, the ISPs were going to need more than just a letter to begin censoring the Internet. By mid August, with their deadlines expired, none had initiated blockades. That led to <a href="http://torrentfreak.com/isps-face-lawsuits-failing-block-pirate-bay-140818/">threats of lawsuits</a> from both anti-piracy groups.</p>
<p>With August now drawing to a close, VAP has made good on its word. CEO Werner Müller confirmed to German media that his organization has now sued four Austrian ISPs. Müller would not be drawn on their names, but <a href="http://derstandard.at/2000004884081/Netzsperren-Verein-fuer-Antipiraterie-klagt-vier-Provider">DerStandard</a> spoke with UPC and A1 who both confirmed receiving letters.</p>
<p>&#8220;[The decision on blocking] should be left to the judgment of a judge, since in a specific case the rights of Internet users and the movie / music industry can be weighed more,&#8221; said A1 spokeswoman Livia Dandrea-Böhm. &#8220;We will now take a position in the time allowed by the court. Thereafter, the judge has to decide.&#8221;</p>
<p>Of further interest is VAP&#8217;s decision to exclude The Pirate Bay from their legal action and only sue for blockades against kinox.to and movie4k.to. There are suggestions that this could prove an easier legal route for VAP as the local Supreme Court is already familiar with the operations of Kinox and Movie4K, sites similar in structure to the now defunct Kino.to, the site which originally prompted calls for blocks in Austria.</p>
<p>However, The Pirate Bay will not escape so easily. The IFPI will tackle the infamous torrent site alongside others including isoHunt.to, 1337x.to and H33t.to. The music group is expected to sue several ISPs to force a blockade, although papers are still being drawn up. </p>

				<content:encoded><![CDATA[<p><a href="/images/pirate-bay.jpg"><img src="http://torrentfreak.com/images/pirate-bay.jpg" alt="pirate bay" width="200" height="207" class="alignright size-full wp-image-53470"></a>Kino.to, one of Germany&#8217;s largest illegal streaming portals, was <a href="http://torrentfreak.com/kino-to-raided-in-massive-police-operation-admins-arrested-110608/">shut down</a> during  2011 following the largest law enforcement action against of its type in Europe. But even with the site long gone the disruption it caused is about to affect The Pirate Bay and two other major sites.</p>
<p>Just a month before Kino.to was dismantled in June 2011, Austrian ISP &#8216;UPC&#8217; was served with a preliminary injunction ordering it to block subscriber access to the site. Verein für Anti-Piraterie der österreichischen Film und Videobranche (VAP) – the anti-piracy association of the Austrian film and video industry &#8211; had been on the warpath <a href="https://torrentfreak.com/anti-piracy-group-seeks-isp-level-block-of-movie-streaming-portal-101105/">since 2010</a> and had finally got their way after UPC refused to comply voluntarily.</p>
<p>But would blocking the site be legal? UPC insisted that it couldn&#8217;t be held responsible for a site it had nothing to do with. The ISP also maintained that there had been no court ruling determining that UPC customers who accessed Kino.to were breaking the law.</p>
<p>To settle the matter once and for all the Austrian Supreme Court asked the European Court of Justice to clarify whether a company that provides Internet access to people using an illegal website could be required to block that site. On March 27, 2014, the ECJ handed down its decision.</p>
<p>On UPC&#8217;s first point the Court said that EU law does not require a specific relationship between the person infringing copyright and the intermediary against whom any injunction had been issued. On the second point the Court said that proof of illegality was not necessary as the law exists not only to bring an end to infringement, <a href="https://torrentfreak.com/eu-court-isps-can-be-forced-to-block-pirate-sites-140327/">but also to prevent it</a>.</p>
<p>The key point of the ruling was that ISPs can indeed be required to block access to infringing sites provided that injunctions are both balanced and proportional. As a result, earlier this month Austria&#8217;s Supreme Court found that the blockade against Kino.to, even though the site is long dead, was correctly applied.</p>
<p>On the back of this ruling, this week VAP wrote to several local ISPs, UPC included, demanding a new blockade of three domains – ThePirateBay.se, Movie4K.to and Kinox.to, a site that took over from Kino.to.</p>
<p>&#8220;Letters dated yesterday have been sent to four large ISPs containing a request to block a small number of websites,&#8221; VAP Managing Director Werner Müller <a href="http://futurezone.at/netzpolitik/heimische-provider-muessen-the-pirate-bay-sperren/77.377.461">told</a> Future Zone.</p>
<p>On behalf of three local movie companies (Allegro Film, Wega Film and Epo Film) VAP has requested IP address and DNS blocks of the three sites but has given the ISPs very little time in which to carry them out, by this Friday August 1, to be exact.</p>
<p>The Association of Internet Service Providers Austria (ISPA) feels the deadline is far too restrictive.</p>
<p>&#8220;The period given to the providers to act is ludicrously short. We see this as very problematic. Extreme pressure is being exerted,&#8221; Secretary General Maximilian Schubert said.</p>
<p>&#8220;Two working days during the holiday season is just too little. To implement this by Friday we deem too difficult.&#8221;</p>
<p>Interestingly, Schubert also sees differences between The Pirate Bay and the pair of streaming portals listed in VAP&#8217;s blocking request.</p>
<p>&#8220;There is also legal content on The Pirate Bay,&#8221; Schubert said.</p>
<p>Discussions between VAP and the ISPs are scheduled for later in the week, so whether the anti-piracy group will get its way immediately will remain to be seen. They&#8217;ve waited years already, another few days shouldn&#8217;t make much difference.</p>
<p><strong>Update:</strong> The ISPs were given <a href="http://futurezone.at/netzpolitik/galgenfrist-fuer-netzsperren-in-oesterreich/77.815.521">two more weeks</a> to block The Pirate Bay.</p>

				<content:encoded><![CDATA[<p><img src="http://torrentfreak.com/images/movie2klogo.jpg" width="180" height="158" class="alignright">Over the past few years we&#8217;ve witnessed quite a few instances of sites disappearing under pressure only to reappear on a new domain with fresh management. These reincarnations are understandably viewed with an element of suspicion.</p>
<p>Is the replacement site the real deal? Is it endorsed by the original site&#8217;s former owners? Maybe the former owners are still behind the wheel? Or is the new site suddenly going to start serving up malware? The answers to these questions are always hard to come by for good reason, and the current Movie2K case is no different.</p>
<p>As previously <a href="http://torrentfreak.com/movie2k-down-the-mystery-and-possible-reincarnation-revealed-130531/">reported</a>, last week the site inexplicably disappeared leaving millions of former users without a home. One of the main theories is that some kind of legal pressure &#8211; or the threat of it &#8211; caused the site&#8217;s operators to jump ship.</p>
<p>However, very quickly a new site appeared &#8211; <a href="http://www.movie4k.to/">Movie4K.to</a> &#8211; looking very much like the now-defunct Movie2K.to and accompanied by all the usual questions. Is it the real deal? Is it sanctioned by the former operators of Movie2K? Is it a trap?</p>
<p>We tried to unravel the mysteries right at the very start and one of our findings raised a few eyebrows. The old Movie2K domain had begun using the DNS servers of the German Pirate Party. Were the pirates somehow involved? They told TorrentFreak that they were not, but now they appear to be using the site&#8217;s demise to spread their political message.</p>
<p><a href="http://torrentfreak.com/images/piraten1.jpg"><img src="http://torrentfreak.com/images/piraten1.jpg" alt="piraten" width="190" height="90" class="alignright size-full wp-image-71466"></a>This morning Markus Drenger, a member of the Piratenpartei Deutschland press team, emailed TF to advise us that they are now taking advantage of the Movie2K.to redirect to spread the Pirate message.</p>
<p>&#8220;This isn&#8217;t our domain, and we don&#8217;t know who owns it. However, they apparently redirected it to our servers. We don&#8217;t know exactly why, but we assume that the people responsible for it wanted to allow us to inform the visitors about the issues with current copyright law. For this reason, we are now displaying this <a href="http://www.movie2k.to/#en">info page</a> here,&#8221; the Party explains.</p>
<p>Already the DNS issues have caused problems, with the police contacting the party and the party&#8217;s webhost. However, referencing an earlier raid on their infrastructure, the party says that this time the police didn&#8217;t seize their hardware.</p>
<p>The party&#8217;s latest position is that if the redirect to their DNS continues then they will possibly put up some Creative Commons movies for former Movie2K users to enjoy. However, while that might prove entertaining for a while, people are obviously looking for more varied content. It seems that Movie4K &#8211; whoever they are &#8211; intend to fill that gap immediately.</p>
<p><a href="http://torrentfreak.com/images/movie4kpolice.png"><img src="http://torrentfreak.com/images/movie4kpolice.png" alt="movie4kpolice" width="163" height="164" class="alignright size-full wp-image-71463"></a>&#8220;Nobody should have the power to suppress somebody just because of money! This site is the result of the need of many Human Beings. Everyone wants Movie2k.to/Movie4k.to back,&#8221; they state in a broken English announcement.</p>
<p>&#8220;We, the Citizens, have to make clear that a &#8216;copyright infringement&#8217; cannot be compared to a violent crime. How come bootlegger get five years of jail time while child abuser are free on a 22-month probation? That is because money is way more important than an unique human life.&#8221;</p>
<p>&#8220;You cannot suppress the will of the People!&#8221; they continue. &#8220;One website goes, the next day five new appear. Did not the time come to overthink your marketing concepts and accept the new media?&#8221;</p>
<p>In a parting shot, Movie4K attack the entities they suggest are behind the demise of Movie2K.</p>
<p>&#8220;FU Hollywood, FU GVU, FU Anti-piracy and FU Police. But we love Obama!&#8221; they conclude.</p>
<p>As a final note, Movie4K is currently using AS44571 (Akrino Inc). <a href="http://urlquery.net/report.php?id=2810979">Records show</a> that five out of the last six times that was used it was inhabited by a site called kinox.to, a site that took over from the now-defunct Kino.to, the subject of the <a href="http://torrentfreak.com/download-site-founder-receives-4-5-year-jail-sentence-forfeits-4-7m-120615/">biggest ever</a> anti-piracy action in Europe.</p>

				<content:encoded><![CDATA[<p><img src="http://torrentfreak.com/images/movie2klogo.jpg" width="180" height="158" class="alignright">While the world&#8217;s largest torrent indexes tend to grab most of the headlines, a relatively new range of sites have been scooping up huge numbers of users during the past few years.</p>
<p>Avoiding the relative complexity of torrent clients, streaming portals offer movies and TV shows in a YouTube-like environment, with video embedded in a page and ready to watch &#8211; no traditional downloading required.</p>
<p>Offering all the latest movies and TV shows for immediate viewing after just a couple of clicks, Movie2K was one of the most popular streaming sites around. Back in February it was the 240th <a href="http://torrentfreak.com/google-refuses-to-index-huge-streaming-movie-portal-homepage-130220/">most popular</a> site in the world and in Germany ranked 19th, making it more popular than Twitter, Amazon, Apple, PayPal and Microsoft.</p>
<h2>Movie2K &#8211; gone</h2>
<p>However, on Wednesday Movie2K became unresponsive. We were first alerted to the problems by the operators of PirateReverse and ProxyBay, sites which set themselves up to reconnect users with Movie2K after the UK Hight Court <a href="http://torrentfreak.com/uk-isps-block-huge-movie-site-movie2k-proxy-immediately-unblocks-130520/">ordered it blocked</a> earlier this month.</p>
<p>Something was clearly wrong &#8211; Movie2K first began redirecting to Google and then later to <a href="http://en.wikipedia.org/wiki/Localhost">127.0.0.1</a>. We emailed Movie2K immediately but after receiving no response we began asking questions elsewhere, starting with the site&#8217;s former host.</p>
<h2>Romanian host shut down Movie2K</h2>
<p><a href="http://voxility.com/">Voxility</a> is a Romanian-based company that houses quite a few file-sharing related websites. It is also the last known host of Movie2K so we wrote to the company and asked them what had happened to the site. Voxility failed to respond to our questions, but we weren&#8217;t about to give up.</p>
<p>What we do know is that Movie2K had been doing business with Voxility for a long time using the IP address 109.163.226.18. The records for that IP address have now been changed and allocated away from Movie2K and back to &#8216;reserved&#8217; status with Voxility.</p>

<p>We spoke with a person familiar with Voxility&#8217;s operations who told us that &#8216;reserved&#8217; indicates that the server has been canceled by the host and is no longer in use.</p>
<h2>Was Movie2K raided or was the shutdown voluntary?</h2>
<p>Ever since Movie2K disappeared earlier this week there have been rumors that the site (or its admin) had been raided. Most seem to be based around a statement last week by anti-piracy group GVU that a former top uploader to the now-defunct Kino.to had been raided in Germany.</p>
<p>The individual, said to be called &#8220;Hologram&#8221;, is alleged to have uploaded more than 100,000 movies. GVU said that he was &#8220;cooperative&#8221; and later &#8220;confessed.&#8221; The raid took place early on May 22 according to GVU, but TorrentFreak received an email later that evening from the Movie2K admin, so it seems moderately unlikely he was raided that same morning.</p>
<p>However, what we do know from a source inside Voxility is that the operator of Movie2K voluntarily closed down the server this week and canceled his business with Voxility. And in the past few minutes there are suggestions that there might indeed be some connection, not necessarily directly though, between the shutdown of Movie2K and the raid last week.</p>
<p>While stating that they don&#8217;t really know why Movie2K has disappeared, GVU are suggesting that the site&#8217;s operators may have seen the ongoing Kino.to investigation and decided that enough is enough. That&#8217;s possible of course, but we still aren&#8217;t finished.</p>
<h2>Updated DNS entries &#8211; </h3>
<p>Movie2K used to operate via many different domains such as .com and .net, but the prime URL for the site over the years has been Movie2K.to. Now, .to is the top-level domain (ccTLD) of the island kingdom of Tonga and is handled by the Tonic domain name registry.</p>
<p>Tonic have a policy of keeping domain registrants&#8217; information secret so there is no traditional WHOIS that will reveal names and addresses etc. There is however a limited search that can be done to find out DNS entries etc, which revealed something interesting. An update this morning&#8230;</p>

<p>Piraten Partei is the German Pirate Party and the addresses listed above certainly <a href="http://website.informer.com/forum.piratenpartei.de">match</a> the party&#8217;s DNS server addresses. So, are they involved?</p>
<p>&#8220;We have nothing to do with this and our DNS servers do not serve this domain,&#8221; Markus Drenger of the Pirate Party&#8217;s press team told TorrentFreak.</p>
<p>So with the Pirate Party denying knowledge we will have to wait a short time to see what happens next with the Movie2K domain. Tonic update their nameservers once a day at (GMT +13) so the next move might become apparent then. However, . com updates sooner&#8230;.</p>
<h2>Movie2K is dead, long live&#8230;..Movie4K?</h2>
<p>Visitors to Movie2K.com are now being redirected to a server in the Virgin Islands playing host to a new site called Movie4K. There&#8217;s nothing there at the moment but there are signs that something might be about to burst into life. The DNS entries for that domain were updated last evening.</p>
