After Michael Moore encouraged everyone to download his latest movie 'Slacker Uprising' for free and do what they like with it, lawyers working for him have sent a takedown requestto a DNS company, for a torrent of the movie to be removed from BTJunkie. The problem? Well, several as it so happens.
Source: Slacker Uprising BitTorrent Takedown Sent to DNS Provider

When Michael Moore released his latest movie, Slacker Uprising, he made it clear that not only would the movie be completely free, but he also wanted everyone to “email it, burn it, and share it with anyone and everyone”. However, there was one rule – this generous offer from Moore would only apply to people living in the United States and Canada.

As we reported earlier, the decision to use BitTorrent for facilitating distribution of the movie made a bit of a mockery of the limitations of Moore’s offer, since using The Pirate Bay’s tracker sent the movie worldwide. So, even for a completely free movie, it seemed inevitable that the legal profession would get involved at some point, it was just a question of time.

It didn’t take long. In a letter dated September 25th, lawyers representing Westside Productions LLC, owner of the Slacker Uprising copyright sprang into action, demanding the removal of a torrent linking to the movie. However, they managed to make a novice error. Instead of contacting the host of the torrent site in question, the Swedish-hosted BTJunkie, they actually sent the US copyright takedown request (email & fedex) to their DNS provider, easyDNS.

easyDNS are based in Canada and, just like BTJunkie in Sweden, are not subject to the laws of the United States, although most lawyers don’t seem to understand this. Furthermore, since easyDNS aren’t even BTJunkie’s host, they are in no position to do anything about the torrent anyway.

Mark Jeftovic, a co-founder of easyDNS wrote: “But really, come on folks, please tell us that isn’t the basis for this take down request. Anybody with half a clue knows the net doesn’t work like that. In any case, I’ve sent them our standard ‘we’re not the web host, we’re just the lowly DNS service’, but I did point out this seeming contradiction in Michael Moore’s message vs his lawyer’s actions.”

Now that the lawyers managed to get a grasp of the role of a DNS server, they have withdrawn the complaint against easyDNS. They state that the problem is due to the fact that the infringing .torrent was hosted outside of the US and Canada, a situation which for some reason is unacceptable to their client and a ‘problem’ worth spending large sums of money on to remedy. Let’s be clear – no amount of money will solve this issue and it is absolutely absurd to even try.

“I’ve replied that they [the lawyers] should know it is highly impractical to attempt to impose geographical constraints on otherwise freely available files,” said Mark at easyDNS, “but I guess they want to give it a shot.”

Meanwhile, the admin of BTJunkie told us he has not yet received a takedown request.

Mo(o)re money down the drain….

Pioneer recently announced a prototype set-top box that supports BitTorrent streaming. The device already caught the attention of the BBC, as it opens up the possibility for TV-networks to offer their content via the Internet without having to spend millions of dollars on bandwidth bills.

Source: Pioneer’s Live Bittorrent Streaming Device

The new device from Pioneer R&D is still in the prototype phase, but it has the potential to change the future of TV. It is developed within the P2P-Next project, which is sponsored by the European Union, and includes partners such as the BBC and other TV-broadcasters.

The P2P technology inside the box is Open Source software, and allows the user to stream live content via BitTorrent (picture here, via NTV). Broadcasters will be able to stream to thousands of people, using around the same amount of bandwidth they would use to stream to one or two people. Recent tests have shown that it’s possible to offer high quality video via BitTorrent, which might change how on-demand TV is broadcast.

During a tutorial session at the P2P 2008 conference, Mark from Pioneer presented the new device, and said: “By leveraging the next generation of P2P networking technology, Pioneer is taking steps to bring scalable TV broadcasting and vast on-demand media collections into the Living room.”

The device is 4th generation P2P, which means that it doesn’t use central servers to distribute or moderate the content. Pioneer, nevertheless, made it clear that it will only be possible to access legitimate content with their box “Access to a vast range of on-demand content and broadcast TV in High Definition over the Open Internet is becoming more believable with the integration of 4G P2P technologies into consumer devices,” Mark said.

Worth mentioning, is that the box runs on a 266MHz processor with just 128MByte of RAM. By doing so, Pioneer has set a new standard for what a low-cost processor can deliver using BitTorrent. Several European TV broadcasters are watching the project closely, and we expect to see some consumer trials with this new BitTorrent box in the future.

After 2 years of silence the controversial Bitlord client just rolled out a new version which is not longer based on the BitComet core. The new Bitlord 2.0 Beta is "Vista ready" and one of the first BitTorrent clients to include eDonkey support, thereby allowing its users to download from both networks simultaneously.
Source: Bitlord V2 Released, Now Supports eDonkey

The 2.0 Beta is built on a new core so there are a few features missing on the BitTorrent side that are being worked on right now. The stable version will probably be ready within 2-3 weeks and includes UPnP support, a torrent creator and RSS Support, among other features.

Bitlord is now developing alongside Iphant which is also a BitTorrent / eDonkey client. The addition of eDonkey support makes it possible to use both networks to download a file which might speed up BitTorrent swarms that have only a few seeders. If the .torrent includes ed2k hash it is downloaded via BitTorrent and eDonkey, if not, it can be joined with the wizard you can find in the file context menu.

The fact that Bitlord is no longer based on BitComet 0.56 which by itself is a great improvement. The client is spyware free but it does contain adware. Currently is has a banner on the bottom of the application, and some advertisement for the Bitlord pro version, which is basically the UseNeXT client that is advertised on many BitTorrent sites.

Throughout its existence Bitlord has always been a controversial client. Like BitComet, Bitlord is banned from quite a few private trackers because it allegedly disobeys the BitTorrent etiquette, and bullies other clients. However, Bitlord is now moving in the right direction and according to the Bitlord developer it should absolutely be accepted by private trackers. We’ll see what the future brings.

The aim of BitFox is to make downloading a torrent as easy as downloading a file over HTTP or FTP, right inside your browser. With a large, and ever increasing marketshare, Firefox is the perfect place to introduce new users to the wonders of BitTorrent. Many novice users find the process of downloading and configuring a separate piece of software just to download a certain file complicated.

BitFox is still in the very early stages of development, and not currently available for download. The only way you can install it is from SVN. BitFox makes use of Libtorrent, the open source C++ BitTorrent library that aims to be CPU and memory efficient.

The extension, just like Firefox, is cross-platform and open source. Joshua Hendo, the developer, notes that BitFox has only been tested on Windows and Linux. He also asks anyone interested in contributing to the project to join the bitfox-extension mailing list on Google Groups.

Torrent Episode Downloader, or Ted, is a cross-platform Java application that lets you easily subscribe to TV shows. It gives you a list of shows that are currently popular on BitTorrent networks, and automatically downloads the latest episodes of the shows you choose.
Source: Subscribe to TV Shows with Torrent Episode Downloader

Torrent Episode Downloader simplifies the process of locating and downloading torrents of your favourite TV shows to a great extent. All you have to do is launch the application and hit the “New show” button. Once you choose which show you want to subscribe to, Ted will go out and grab the torrents of the latest episodes and drop them in a folder of your choice. I have it set to download the torrents to my Desktop.

Once a torrent is downloaded, Ted will automatically launch it in your default BitTorrent client, in my case, Transmission. If your BitTorrent client has the option to delete the original torrent once it has been imported, the whole process can be made very clean, with no traces or files left behind.

The simplicity of Ted is reminiscent of LimeWire, the P2P application that made downloading mp3s easier than surfing the web. The only problem is that you need to have a BitTorrent client installed. I’m guessing that the Opera browser with its built-in BitTorrent functionality would do. Ubuntu users might have it the best, since the OS comes with a version of the mainline client pre-installed.

Ted is not yet perfect, and still needs some work. Something funny I noticed was that while setting it up, it asked me whether I wanted it to start minimised in the system tray. Mac OS X doesn’t have a system tray! It’s quite obvious that Ted was originally written for Windows.

Torrent Episode Downloader (Ted) is completely free and open source, and can be downloaded from the official site.

The Pirate Bay, Torrentspy and mininova have entered the top 200 most popular websites on the Internet. The recent boost in traffic was caused by the downtime that Isohunt, another popular BitTorrent site is currently suffering.
Source: The Pirate Bay, mininova, and Torrentspy Enter the Alexa 200

Torrentspy is in the lead with a traffic rank of 153, followed by mininova (165) and The Pirate Bay (198). The huge amounts of traffic that these sites generate, and the fact that they keep on growing shows that the popularity of BitTorrent is still on the rise. Torrentz is currently in fourth place, but has not entered the top 200 yet.

It is hard to tell if these sites will ever stop growing, and if they will ever make it into the top 100 without one of them going down, but we’ll see what the future brings. Isohunt, the site that bumped the other sites into the top 200, is currently moving their servers from The USA to Canada, and will probably be up and running soon.

Note: Alexa’s data gathering is quite dubious. The exact figures may be not be completely accurate, but it is a great tool (especially the traffic rank) to compare sites within the same niche and to get a global impression of traffic shifts over time.

BitThief, the BitTorrent client that downloads torrents without uploading is spying on its users. Apparently the client is not only cheating on the BitTorrent community, it could also be a potential risk for the leechers that use the client.
Source: BitThief Spies on their Users

The Java based BitTorrent client continuously sends user data to their server. Currently it collects the torrent hash, total size of the download, the current version of the client, total number of pieces available, and the size of these pieces. Since the data is posted on their server, it is possible to link all this info to the users’ IP-address.

The current version of BitThief comes with a property file contained in the bitThief.jar. The actual data is posted to
http://dcg.ethz.ch/projects/bitthief/et.php
every time a torrent starts or stops.

It is unknown why the developers decided to collect the data. It could be that they collect these statistics for academic use, but I guess the more paranoid people among us could easily come up with other, more evil, motives.

The curious thing is that this “feature” of BitThief in not documented. The client is spying on you without your consent. Whatever the real motives are, it is yet another reason not to use this client.

Update: The BitThief homepage was updated a couple of hours after we posted this article. It now lists the spy feature.

One of the reasons people put down BitTorrent is because it can, at times, be slower than traditional protocols like HTTP and FTP. But the technology isn't at fault, it's the upload speeds of users that are capped, which prevents files from being shared more efficiently.

Source: Faster Uploads Key to Improving BitTorrent Efficiency

Until recently, Internet usage has been a one-way street. People accessed web pages and downloaded pictures, music and videos. The need to upload significant amounts of data was limited to e-mail attachments and files sent over IM. This has all changed.

Web 2.0 is interactive by nature. People are not only consuming content, they’re creating it too. From uploading photos and videos to sites like Flickr and YouTube to downloading files over BitTorrent and sharing them on P2P networks, traffic flow on the Internet is now bi-directional.

The problem is that most ISPs seem to be completely unaware of this phenomenon. Upload speeds offered are many times less than download speeds. Most ISPs in the U.S. provide largely asymmetric connections, upload speeds are on average 15 times slower than download speeds. Strange since the country seems to be the epicenter of the Web 2.0 boom.

Slow upload speeds directly affect BitTorrent transfers. If users aren’t able to upload bits as fast as they download them, a torrent requires more seeders than leechers to stay healthy. And for there to be enough seeders, a significant number of users have to have already downloaded the file. That’s why the speed at which you download a newly created torrent is normally much slower than a HTTP transfer. The speed of the BitTorrent swarm will always max out on the combined upload speed.

Also, because BitTorrent is a fair trade protocol, what you give is what you get. The more you upload, the more you’ll be able to download from others. So, for example, If you had to choose between a 1Mbit up – 1Mbit down connection and a 0.5Mbit up – 2Mbit down connection, the first option would be a better choice.

The Internet is slowly moving away from central servers that store data, towards P2P powered services like BitTorrent where content is dispersed over a large number of users. ISPs need to understand this and realize that users are soon going to start demanding symmetric connections, with upload speeds equaling downloads. After all, TIME Magazine’s person of the year is “You”. And there wouldn’t be a “You” without YouTube and other such services that allow us to get online and express ourselves.

Yesterday I browsed through the official BitTorrent site to see if there was some interesting stuff to download. My eyes fell on the “New York, New York” video clip by Moby and Debbie Harry. The torrent had around 20 seeders and 20 peers, so it was pretty healthy, and I assumed that it wouldn’t take that long to download…

Wrong, when I loaded the torrent file in uTorrent, I noticed that the videoclip was over 1GB! Wait a minute, 1GB for a 5 minute videoclip? That’s over 3MB per second! I know that BitTorrent recently expanded their server park, but this is just a waste of bandwidth. V2 Records probably never heard of “compression” because they offer a whole collection of oversized videoclips.

Just as many social bookmarking sites are said to be run by a small group of active users, the same seems to hold for BitTorrent communities where 10% of the users upload as much as the rest of the 90% put together.
Source: Comparing Sharing Behavior in BitTorrent Communities

This was concluded in a recently published article in the online journal ‘firstmonday’ compared the sharing behavior on 6 BitTorrent sites.

The article compares bt.etree.org, piratebay.org, torrentportal.com, easytree.org, btefnet.net and alluvion.org. The data appears to be a little outdated, because both easytree.org and the famous bt.etree.org were shutdown in spring 2005.

One of the main conclusions of the researchers is that a relatively small percentage of peers is responsible for most of the uploading. The top 10% sharers upload just as much as the rest of the people in the swarm.

Another interesting finding is that the highest percentage of seeders can be found at The Piratebay (29%), and the most sharers at easytree (59%). This can be explained by the fact that easytree is a private tracker, enforcing “healthy” share ratios.

Unfortunately, the authors make a big mistake when they suggest that RSS feeds might be responsible for the higher seed percentages at btefnet.net. At the time the data was collected (early 2005) only Azureus had experimental RSS support, and only a few people were actually using it.

Personally I think it it hard to make comparisons between there six torrent sites. It is nothing more than comparing apples and oranges, they offer different content, and target a different audience.

The award winning Canadian documentary 'The Corporation' has been released on BitTorrent for free. Filmmaker Mark Achbar just released an updated "official" torrent of it. Everyone is free to download, watch, discuss, and share it.
Source: Sundance Winner ‘The Corporation’ Released for Free on BitTorrent

The Corporation received more than 20 awards, including an audience award at the the prestigious Sundance Film Festival. The Film gives insight into the inner workings of large and powerful corporations, and how these affect our society.

The new torrent download includes a high-quality rip of the master DVD and a 40 minute interview with Joel Bakan, the author of the book and writer of the film. Mark Achbar actually dedicated a computer in his garage to do nothing but seed.

Although the torrent download is free, the filmmakers encourage people to donate a small fee if they like what they see. We asked Mark Achbar how the first round of donations went. He said, “since my initial torrent launch of The Corporation at the end of August, there have been $635.00 in contributions. They ranged from $2 to three very generous gifts of $100 each. All are very much appreciated.”

The makers of “The Corporation just launched a Campaign for Corporate Harm Reduction (C4CHR) in collaboration with Hellocoolworld.com. The purpose of this campaign is to collect stories about the impact of the film, asking people what they did, or something they’ve heard happened as a result of the film.

“We want to create a feedback loop on the “what you can do” front, and perhaps turn it into a book. The torrent is a great way to stay in touch with people about our current activities Achbar” Achbar explained.

He added, “my only regret is that I didn’t put up my own torrent sooner.”

Done the impossible is the story behind the rise, fall, and rebirth of the cult TV show Firefly. Firefly was ressurected thanks to efforts of the fans of this popular sci-fi show.

In the documentary “done the impossible” the fans tell their part of this success story. They explain why and how they managed to get their Firefly heroes on the white screen in the popular movie Serenity.

The makers of the documentary offer a free, Creative Commons licensed .torrent download of their film. They state:

In our opinion, the modern state of copyright is counter productive to creativity and free culture. It puts unnatural restraints on “fair use”, hinders the creative process and has fundamentally destroyed an entire industry before it was even born.

Personally I’m impressed with the quality of this documentary, I highly recommend this one if you are interested in the story behind Firefly and Serenity.

The great thing about the project is that the movie is made entirely using Open Source software.

The movie is 11 minutes, including the credits, and they offer an impressive high definition AC3 5.1 surround copy.

Targetpoint, an ad-company that is offering targeted ads is targeting BitTorrent sites. Targetpoint recognizes the potential that most BitTorrent sites have, and is already a partner of several torrent sites. Most of the time it stays with serving ads on a pay per click basis, but they sometimes go even further, and try to buy these sites.
Source: Targetpoint is buying BitTorrent sites

According to a respectable source TorrentFreak was told that Targetpoint tried to buy Meganova. Meganova is worth investing in since the site became extremely popular within a short period of time. Many people praise Meganova for its high speed, and the clean look.

TorrentFreak asked Meganova owner Bogaa if these rumors are true. And indeed, Bogaa confirmed the story:

Yes, Targetpoint made an offer to buy Meganova. They offered $20.000, 30% of the ad revenues and an additional $1000 per month. We do however prefer to continue working with Targetpoint on a pay per click basis.

Meganova is not the only BitTorrent site that Targetpoint is interested in. They are currently working with sites like Isohunt, The Piratebay and Mininova. And according to a our source they even have a 37% share in The Piratebay .

It started a couple of months ago when Targetpoint contracted two major adult content BitTorrent sites Empornium and PureTna. Empornium has approximately 650,000 active users; they moved their servers from the US to The Netherlands after the acquisition by Targetpoint in August 2005.

So it seems that Targetpoint is willing to invest in sites that have trouble getting advertisers through other channels such as Google’s Adsense because these sites are (assumed to be) associated with copyright infringement.

Targetpoint was founded in 2004 and is an Israeli company, with servers located in the Netherlands. In these countries offering .torrent files is not considered to be act of copyright infringement.

In November 2005 BitTorrent and the MPAA announced that they were going to cooperate in the "war against piracy". The agreement was called a "historic event" and a "major breakthrough". But now, 4 months later BitTorrent.com is still indexing pirated movies and other copyrighted material.

Source: Is BitTorrent Inc. messing with the MPAA?

It’s striking because the MPAA is filing lawsuits against sites like Isohunt and Torrentspy but not against their partner BitTorrent.com. And the funny thing is, they all index the same torrents.

BitTorrent inc. did change their search engine. They even improved the look and feel by covering it in a web2.0 sauce. But they are still not filtering out the pirated flicks. And that’s strange because in November Bram Cohen (BitTorrent founder) said:

“BitTorrent, Inc. discourages the use of its technology for distributing films without a license to do so. As such, we are pleased to work with the film industry to remove unauthorized content from BitTorrent.com’s search engine.”

The press release continued:

Cohen confirmed BitTorrent, Inc.’s commitment to removing links that direct users to copies of pirated content owned by MPAA companies from its search engine at BitTorrent.com. The announcement today is historic in that two major forces in the technology and film industries have agreed to work together and proactively identify ways to l and to promote constructive innovation in this area.

Bram Cohen (BitTorrent) and Dan Glickman (MPAA)

The MPAA was happy and said:

“We are glad that Bram Cohen and his company are working with us to limit access to infringing files on the BitTorrent.com website,” said Glickman. “They are leading the way for other companies by their example.”

However, it seems that nothing is removed from BitTorrent.com at all, or they do a very, very poor job. If you search for Universals latest blockbuster “inside man” the CAM rips will pop up. And if you try other piracy sensitive terms like “dvdrip“, and “dvdscr” you will see that there’s a lot of pirated content available. In fact, I believe that more that 90% of the users of BitTorrent.com uses it to search for pirated content.

So what’s going on here? Is BitTorrent just messing around with the MPAA? Why is the MPAA going after other torrent search engines and not after BitTorrent.com?

update April 5: in a follow-up on this post BitTorrent spokeswoman Lily Lin told TorrentFreak

Our MPAA arrangement is strictly about taking down links to infringing content from our search engine, nothing more, nothing less.

To slyck she stated

“Any copyright holder that believes our search engine links to an unlicensed version of their work can notify us. “We have a procedure in place which complies with the DMCA, and we follow that to the letter. Since the launch of our search engine, we have responded to every single take-down request sent to us.”

So they are not “working with the MPAA to limit access to infringing files on the BitTorrent.com”, like the press release stated. It is in fact the exact same procedure as other torrent search engines like Isohunt and Torrentspy have. So it sounds like a double standard to sue torrentspy and Isohunt, but leave BitTorrent.com unharmed.

Podtropoplis is the leading Ipod torrent site. Like they say “its grown from camp to village to bustling metropolis in no time”. Ipod formatted torrents are getting more and more popular every day, so there sure is a market for these content specific sites. Podtropolis is providing the service for a while now and its announcing a server change and a web2.0 ish redesign.

Podtropolis is asking for donations to keep up with the constantly increasing demand for iPod torrents.

increasing traffic?

But anyway, they deserve the support. The new design plans are great. Really true to the Ipod philosophy: We can sell everything, if it looks good.

The Dutch pubic TV broadcasting channels (omroep.nl) are going share TV shows using BitTorrent. The deal was announced earlier today on a workshop on P2P TV. They are going to experiment with the new “social” BitTorrent client called Tribler.

Johan Pauwelse (tribler) and William Valkenburg (omroep.nl) shaking hands

Johan Pauwelse, one of Triblers developers said that IPTV should move away from the old fashioned way of distributing files and embrace BitTorrent. William Valkenburg manager of omroep.nl said that the “social” aspect of tribler was essential for the deal. Tribler allows people to maintain buddy lists, and recommend files to friends. Tribler also gives recommendation based on your personal downloading history.

The Dutch public seems to be ready for P2P TV. On the Dutch site uitzendinggemist.nl that currently lists streams of nearly all shows of the public broadcasting channels, 4 million tv-shows were requested in December, compared to 250.000 at the January 2005. The site lists 400.000 shows good for 15 terabyte.

Boing Boing’s Cory Doctorow was also present at the workshop. He praised the Dutch Public Broadcasting Channel and the Tech People for discussing the legal opportunities of P2P technology. “He said: In the US half of the people would have left the room”.

Tribler is a new BitTorrent client that adds a social layer on top of the regular features. Tribler allows you to create groups, friends and it supports tags and profiles. The official release of this Social BitTorrent client is tomorrow, but everyone is free to grab a test version from tribler.org.

This first version is an extension of the existing ABC client and does not have all the proposed functionalities. However, the test version adds a new dimension to BitTorrent.

The extensions are :

-Strong peer authentication; enables groupware extensions and friends.
-Twice the download speed for ADSL users; you can donate your upload capacity to a friend
-Recommendation of files you may which to download
-Removal of .torrent files; replace by short Merkle Hashes which can be put in a URL.

Cooperative downloading (click)

But Tribler is still in its testing phase:

this is not a full public release. Only 1000 downloads will be allowed and then the link will be taken down. Please give it a try, so we can turn this into a public release soon. Please send the bugs you found or your comments to the Tribler sourceforge bugreport page.

Warning 1: For the internal test version, the software will output some debug text and error message to tribler.exe.log. Some of them are normal output, such as”secover: Handler registered for RESERVE_PIECES”, “buddycast: BuddyCast starts up”. If you see “Traceback (most recent call last):” in the log file, some errors may occur and please send your log file to us using the above bug report form.

With the uprise of digital cinema, movie companies are looking into different ways to distribute digital movies. One of the best alternatives is obviously BitTorrent. Using BitTorrent to distribute digital movies will reduce distribution costs to nearly 0$.
Source: The Movie Industry should embrace BitTorrent

This means that the movie industry could save up to 2000$ per copy. So sending out 1000 digital copies will save 2.000.000$ (cheaper tickets please).

This cost saving can be essential, especially for low-budget movies. Take a movie with a 2 million$ budget for example. Distributing the actual prints for wide release will be 100% or more of the total budget. This will never happen; the movie will go straight to TV or DVD instead. But by distributing the film though BitTorrent this will be no problem at all.

And it’s not only the distribution that’s cheaper (wiki):

Digital cinema has some big economic advantages over film, being very cheap compared to film. For instance Rick McCallum, a producer on Attack of the Clones, said that it cost US$16,000 for 220 hours of digital tape where a comparable amount of film would have cost US$1.8 million. Obviously this matters most to low-budget films which are often shot for a few million dollars or less.

Wait a second; am I going to watch a cheap xvid rip in a movie theatre?

No, not exactly. A proper digital movie will be around 120 GB per hour (33 MB/s). In order to send it the movie must be compressed and encrypted (see DCDM format). We need it to be save, we don’t want any 200GB movies showing up at mininova or the piratebay.

Proper specs.

But there is more. BitTorrent will not only be cost saving, it will be also a lot faster. Of course the movie theatres should get a decent line, but with a 100Mbps connection a 200GB movie would take less than 8 hours to distribute. Without BitTorrent online distribution would be nearly impossible, imagine 1000 theatres downloading a 200GB movie from 1 host.

So please stop complaining about piracy and decreasing sales and do something, welcome to the wonderfull world of BitTorrent.

The Big Four record labels are fighting tooth and nail to kill the French decision to make it legal to share music and movies online. MPs, who’ve already voted once on the matter, will debate it again next week and if they confirm the earlier decision, turning it into law, France will become the first country to make it legal to share copyrighted music online.

“The surprise vote caused outrage among record companies and film producers, who say illegal peer-to-peer (P2P) copying costs their industries millions of euros every year,” says the BBC. “It was an embarrassing defeat for the government, which had planned to introduce large fines and possible jail terms of up to three years for internet pirates.

“Seventeen year old Aziz Ridouan became so angry at the number of people already being taken to court that he started up his own pressure group.

“Today, the Audiosurfers Association has 6,000 members. It campaigns for a change in the law and helps defend those being prosecuted.”
Socialist MP Patrick Bloche, who helped draft the amendment, argues, “Rather than outlawing, punishing, and paradoxically maintaining to a certain extent an illegal system. Let’s make a different choice: authorising peer-to-peer downloading, but in return, putting in place a system allowing artists to be paid.”

Then the Big Four, Vivendi Universal (France), EMI, (Britain), Sony BMG (Japan, Germany) and Warner Music (US) pulled their well-worn trick of mobilising contracted performers such Johnny Hallyday, “to protest, arguing that revenue from a global licence wouldn’t compensate for the millions they say they risk losing through falling CD sales,” says the story.

Nonetheless, “The MPs’ vote in December sent the government scuttling off to redraft its bill,” says the BBC. “It has since spent two months in consultations with artists, industry representatives and internet users to try to reach a compromise. More than 13,000 musicians signed a petition in favour of the global licence. A website set up to encourage a debate on P2P copying was inundated with replies.”

France’s latest plan still rejects global licensing, “although it agrees that private copying should be allowed,” and, “The sanctions for illegal copying have been reduced considerably, with fines beginning at 38 euros (£26, about $46) ) for small-scale piracy.”

Meanwhile, people in France aren’t entitled to make personal copies of DVDs, even if they don’t distribute them, France’s highest court, the Cour de Cassation in Paris, has ruled, overturning an earlier decision by a lower court.

Ronnie Apteker, a dotcom millionaire, one of the founders of South Africa’s largest corporate ISP, a movie producer, and sometimes a stand up comedian talks about his love for BitTorrent and e-mule. Finally someone from the other side who writes something positive about BitTorrent.

Ronnie writes:

So what is the nature of all this traffic? Think big files… You guessed it: movies. And music files , entire albums in fact, computer games, TV shows, mini-series, you name it. I can go online and download the latest movies playing on circuit in America right now with this technology.

Yes, you need fast internet access and yes, it takes a while to download a one-gig file, for example, even with a fast connection, but it really is an idiot-proof proposition.

I can keep my BitTorrent running in the background while I bang away at the keyboard, and, a few days later, presto, there’s the latest entertainment, in solid digital quality.

He continues talking about legal issues.

Wait a minute. Is any of this legal? Well, er, the software is. And as far as I know I am allowed to write about it. But breaking copyright laws is not cool. I know a bit about intellectual property and about things like movies. Yes, I wouldn’t be happy if some of the film projects I have been involved with suddenly started showing up on BitTorrent. But this is progress, I think. And it is something we can’t escape.

Ronnie concludes

The message here today: share the love. And also shares the files. That way the torrent and the mule will live happily ever after.

BitTorrent inc. is planning a video download website to distribute movies online. According to BitTorrent’s spokesman Lily Lin her company is currently negotiating with several content owners. This move is not really a big surprise after the announced collaboration with the MPAA and a british cable company.

BitTorrent co-founder and President Ashwin Navin states:

“We want to aggregate video and other content and make it available in a legal and sanctioned area”

But they wont go into detail about the plan, and remain vague:

“It’s going to run the gamut because we don’t have limited shelf space” Navin says

We’ll see.

About BitTorrent:

Slyck: With your outreach to Bram Cohen, it appears that you are trying to bridge the gap between file-sharing developers and content providers. How do you think this interview can bridge the gap between file-sharers and the MPAA?

Garfield: “Stereotypes are often born out of silence and a lack of understanding. This dialogue, as well as our work with Bram and others, is aimed at creating greater understanding through conversation and action.

“The motion picture industry is working aggressively to take advantage of wide array of digital distribution platforms and to provide consumers a wide array of legitimate options for enjoying movies and television shows. Slyck is a great venue for sharing our plans for the digital future and gaining feedback.”
