TVShack Staff in U.S. Worked With Feds To Nail Richard O’Dwyer

Two individuals who worked with former TVShack admin Richard O’Dwyer on his now-defunct streaming links site helped ICE Homeland Security Investigations to identify him. The dealings of the unnamed individuals, one who did technical work on the site and the other who acted as a moderator, are listed in U.S. court documents obtained by TorrentFreak.

On many filesharing-type sites there is great camaraderie and friendship to be found between site operators and their staff. Because of this, some believe that security only exists to protect against outsiders. It’s a dangerous assumption.

The ongoing extradition battle of former TVShack admin Richard O’Dwyer has made big headlines recently, particularly due to the support he’s receiving from Wikipedia founder Jimmy Wales. What hasn’t received any attention is how O’Dwyer came to be identified and have evidence collected against him by U.S. authorities in the first instance.

Perhaps unsurprisingly considering the developments in the SurfTheChannel case, two people O’Dwyer appears to have trusted were working with ICE Homeland Security Investigations in the United States prior to the British student’s arrest.

The revelations appear in U.S. court documents which reference the activities of two individuals named “CC-1″ and “CC-2″. CC-1 worked as a moderator on TVShack while CC-2 worked on technical aspects of the site.

CC-1 told Special Agent Marcello Di Laura of Homeland Security Investigations (HSI) that he communicated with O’Dwyer on email and MSN via the address rjodwyer@hotmail.com, an address also linked to O’Dwyer’s Facebook page. CC-1, who received his TVShack login as far back as December 2007, gave HSI a copy of at least one email showing O’Dwyer’s Hotmail address, but he was to provide much more information.

CC-1 said that O’Dwyer lived and attended school in the UK and used the alias “Duffman” on TVShack. He also shared a picture given to him by O’Dwyer which showed the TVShack admin’s Mini Cooper. HSI inquiries with UK police confirmed that O’Dwyer owned such a car.

CC-2, who worked on the technical side of TVShack, was also very helpful to U.S. authorities. He too confirmed that O’Dwyer used the Hotmail account detailed above but also used a second Gmail account. CC-2 shared emails from that account with HSI which allowed them to cross-reference another website domain to O’Dwyer. This domain led to a second Gmail account and Google subsequently provided HSI with information including IP addresses cross-referenced to the first Gmail account.

According to the documents, O’Dwyer was aware that having a Gmail account might lead to his details being handed over to the authorities by Google. In September 2010 he wrote the following to CC-2:

hi, i’m looking to change the site email address from gmail as i think govt. can access that right? can you setup like info@tvshack.cc? also make it so i can reply without my ip going with the mail i reply to? atm i dont reply to any emails on the gmail account due to that.

But in addition to working with and getting paid by O’Dwyer, CC-2 was already working with HSI.

O’Dwyer allegedly owed CC-2 money for work he’d carried out on TVShack but had experienced some kind of problem with the bank. O’Dwyer told CC-2 he’d have to use PayPal to make the transfer – HSI were informed and Special Agent Marcello Di Laura told CC-2 to go ahead and accept the money. Subsequent HSI inquiries with PayPal revealed connections between several accounts allegedly operated by O’Dwyer.

Even though they are listed as O’Dwyer’s co-conspirators, court documents reveal that CC-1 and CC-2 worked with ICE Homeland Security Investigations with the aim of entering into “non-prosecution agreements” with the U.S. government. Whether they will walk away from this free men remains to be seen, but there is no indication thus far that either man has been charged with anything.

      1)  Don’t use email addresses comprising of your name, use disposable email addresses and be very careful with how you use social networking sites.

      2) Don’t trust Americans or the USA. Living in a country like that might eventually turn people evil, even if they were good to start with. Very tragic.

      And what a miscarriage of justice with his entire life being ruined and him being extradited. How the hell can it even be legal? When is Europe going to develop some spine and stand up to the bullyboy across the Atlantic?

    reasonably right to say then that these two were picked out because they were in the US and made deals with ICE etc to deliver a non-American in return for not being prosecuted. hope they can live with what they have done, seeing as how they were happy being paid for work they did on the site. this was just another sting operation. the US had and still doesn’t have anything on O’Dwyer but like the Mega case are trying to make the law fit the case, not the case fit the law.

    This news comes as no surprise to me whatsoever coz I’m “on the ‘senior’ Staff” of a well-established, busy and highly popular website as an “unpaid volunteer” – and have been on Staff for some 5 years now.

    But when push comes to shove and Police are at the door of your own home, AND very likely threatening you with all sorts of awful consequences from lengthy investigations, Court hearings, fines and possibly even time in jail – wtf would YOU do?

    Before I start jumping down the throat of these folks in the USA, what I’d like to see is exactly what threats Richard’s staff colleagues experienced – and from whom too.

    Bottom line is that his whole sorry episode in humanity stinks for a variety of reasons, and there’s now way the UK should agree to extradite Richard O to the USA for action that aren’t an offence in the UK.  And this whole issue with TVshack is utterly trivial too.

    Free Richard O from this on-going international debacle and travesty of justice NOW!!!

      But this is just common US strategy, make people scared to control them (like the stasi did) and when they are scared, take away their civil rights and justify that with the attempt to make everything safe again for all the afraid people.

      Then take away their money to pay for the making safe (taxes) and then explain that the food prices have to rise because you need to support your farmers from going bankrupt and killing the food industry.

      Then you take away more of their money by raising the cost of health care for everyone, then force them to take an insurance that only covers the basic which should be free anyway.

    Well this proves nothing beyond Richard had a bank account, PayPal accounts, car and his own website employing someone who could write site code and then various moderators.

    In other words there is no evidence that Richard believed he was doing something unlawful with his site. Sure he was concerned about his anonymity but then the USA did have a history of attacking such sites and owners.

    I am not surprised the DoJ used threats to rope in CC-1 and CC-2. You can hope they would have told the DoJ to “fuck off” but they had their reason. I am more appalled at the DoJ’s actions in aiming for a successful conviction instead of action against all those who broke the law while letting the rest go. They could then plea bargain in Court to minimise their punishment. So I expect DoJ just lied to them in that no action would have been taken against them anyway.

       Thank you! I’ve said this many times on different articles on this site.  Yes, what these site owners were doing was in a “grey area for a while” but as a person getting into something that could get you criminally prosecuted you better be prepared for the consequences.  I also did fed time for trafficking and had the opportunity to walk out after 6 months if I turned on a few people. I didn’t and ended up doing almost 5.

    I am thinking that these 2 guys who snitched feel that they have got more to lose than Richard and that they will come off far worse then Richard should it go to court and that Richard has got nothing to lose being in the UK and so they decided to blame Richard in return for charges to be dropped etc. because Richard lives in the UK and has got nothing to lose etc. You will find that most guilty people in a group of innocent people will blame the innocent persons in the group when caught out. However we all know that the site did nothing wrong and these people did nothing wrong in operating the site. I also think that the police have put pressure on these 2 guys.and lied to them to get them to squeal and sing, perhaps the police did their  good cop bad cop routine and that was enough for them to do a bargain because they wanted to get out of the police station. Something fishy is going on and if you are innocent then why do a bargain unless the cops are put the frighteners or scared tactics on them.

They tell you they can nail your ass with this long list of charges, then how many years you will get, a felony record that stays with you the rest of your life. The amount of money.           Jay, what I was trying to say, was that values can be very subjective. As an example, my values dictate that if I had a daughter and she was brutally raped, the perpetrator forfeits his life, outside of judicial and legal parameters, and not in a matter of his choosing. Now that example of values goes against what most people in a civalized culture would find acceptable. My value system also say’s that Rat’s (snitches) be dealt with in a manner of extreme pregudice (iced). Iced = Death, or at the very least treated to great bodily injury. My values also dictate that I treat most people with respect, kindness, patience and understanding, and if it is within my powers to offer someone help, I will do so without expectation of recompense. In most areas of life I am a law abiding citzen. In other areas of life, the legal structure would find me to be a criminal and woe be unto him that fucks with my freedom or well being.

          I’ll close with a few old sayings:

          “A friend will help you move. A Real friend will help you move a body…” – An old Sicilian Proverb.

          “Revenge is a dish best served cold.” – An old Klingon Proverb. (Star Trek II, The Wrath of Kahn, 1982)

          Jay, as to what the consequence should be for CC1 & CC2? After some thought, I don’t know what should happen other than whoever thought these two were worth hanging with should shun them forever. My initial response to what these jerks did was overkill.

          After way too many years hanging out in biker bars and running the streets I’ve become inculcated with a sense of street justice. Learned some good lessons and some bad, and some of the bad has helped me stay happy, healthy and best of all, free. I’ve run in to quite a few people that have done years in prison because either they couldn’t plan their way out an open door, had big mouths and bragged or someone else talked. We all know that the law see’s file sharing and most sites that facilitate file sharing as illegal. If the people involved in any grey or black activities can’t be trusted, that’s a damn big problem, and depending how big the problem is, is what dictates the response. I’m actually a pretty peaceful easy going guy, never needed to do a skull dance on anyone and hopefully won’t, and if I did, I’ll be the only one that ever knows. Another good lesson I learned in those biker bars was, keep your eye’s and your ear’s open, and your mouth shut.

          Jay, thanks for your responces back to me. I did think about what I had said in my (iced = Death) post over the last several hours, and it was totally hot-headed overkill and rifuckingdiculous on my part. When I hear that these two may have been working with the Feds all along it gives me a gutteral animalistic response, but in the end, the only thing that needs to be iced, is an ice cold glass of water. Gave up excessive drinking and biker bars over 20 years ago.

         True, but the current DOJ lets a lot of white-collar criminals get away with deals that have immediate consequences on billions of dollars of wealth.  Aggressively going after software pirates (whose actions have questionable effects) while ignoring more pressing crimes, tends to show where their priorities lie.

    What is the big deal?  He is getting it up the ass no question but a conviction in the US is not going to mean squat for his life other than he has to spend a few months in a jail here and might have a hard time getting a visa.  Like he is ever going to want to come back here.  I think the justice system is fucked.  Why spend money to import a jail some foreigner on such a charge that barely a crime if it is a crime at all.  Wouldn’t this money be better spent on chasing violent criminals.  

    The real criminals are those prosecutors that are wasting their time prosecuting this alleged crime if it is one.  The stupidity of this is that what was streamed on his site is being streamed on other sites and widely available for download.  Why would I waste my time streaming a tv show when I can download it almost the minute it ends and watch it commercial free.  Then again the police think they have saved the world every time they make a bust for a harmless plant and claim the value of what they have confiscated is more than all the drug dealers in the state will ever see.  If their estimates were even close then one shipment would set most people up for life.  The same bullshit is going on with pirating.  The wild estimates of loss or no where near reality if there is any.  I don’t see the mafiaa stepping up to cover all prosecutors and governments costs in this case.

    I made the mistake of talking to the police only once.  I was completely innocent in a case that could have landed a lot of people in prison for a long time.  I just happened to be in the wrong place at the wrong time, and even though I didn’t do anything, I still ended up being bullied by the police. 

    They tried to make me confess to crimes I didn’t commit and tried to make me tell them people I knew did things they didn’t.  I will never, ever answer a single question to those disgusting, vile individuals that are we call the “good guys”.  I can honestly say that I /HATE/ the police.  Every. Single. One.  I talked to probably 15 different cops.  They were all out for blood.  I still ended up getting in a little trouble.  I committed no crime and almost had my public record marred by their witch hunt.  FUCK the police.
