Google is a giant because they've observed good business practice - which is to spend as little resources as possible on things irrelevant to their market model. Even their 20%-projects are an effective investment in their brand name and functionality which more often than not leads to more services.

The massed copyright cult assault on Google right now amounts to a concussed chihuahua barking around the sleeping bear in a useless frenzy. And Google's response has, so far, been to toss it a kibble every now and then to keep it happy.

If the copyright cult ever tries to do something which would actually hurt Google - such as trying to implement SOPA-style legislation or any other copyright enforcement tool which would actually be effective - Google will sit up and swat. Once. Probably using the money in the coffee till to do it. And that'll be IT for copyright.

The copyright cult is effectively inimical to any information/innovation company today. The only reason it survives is because it currently harms only the minority fringe. That will change.

I keep saying we really don't need to fight the copyright cult in order to kill it - given enough rope they will hang themselves as is. What we need to do is mitigate the damage caused by their erratic and increasingly desperate flailing.

It is misguided for the UK to have an "IP advisor", because the
concept of "IP" is incoherent. It lumps together laws that do
different things and raise different ethical issues. Using that term
as the basis for your thinking is a recipe for bad thinking.

See http://gnu.org/philosophy/not-ipr.html for more explanation.

That's not all that's wrong with Weatherley's thinking. He is trying
to stop sharing when the government really ought to legalize it.

1) "Where google goes other follow":
So if Google jumps of a Cliff all the others will follow like lemmings? Restrictions will only hurt a search-engine in the long run. Thinking that google is and always be the largest is kinda silly. Even the greatest fall eventually and then a less-restricted will happily take over.

2) Demoting sites.
Past attempts already showed that such a system is far easier said then done and even then would take a whole lot of fine tuning be correct. its not a simple "Take this IF statement and it works". If it was that simple it wouldn't be a problem. Another thing is that demoting is ineffective if the pirate results are the ONLY results as pointed out by the "Licensed services should help..." part!

3) Voluntarily Complying.
The Google system is already burdened by web-spiders throwing millions of links to them. Now you want them to immediately respond to injunctions issued by every country in the world? Again would take a lot of work and indeed some law changes here and there. a bit too much probably for an instance that is providing its service on a global scale.

4) implement Warnings.
The reference is nice and all that, but hardly relevant. That warning was cause the systems detected malicious software originating from the links, not cause of a blacklist (Nice try but its not the same by a long shot), If you used the current system of automated takedown requesting ALL sites in the world would have a warning...that is unless you decide to be a dictator and dictate exactly what is and isn't good. That would be a PR nightmare!

5) Licensed should do more to help themeselves.
That sounds actually reasonable. Many "pirate sites" gain a position in the results cause the legal solutions dont allow google's spiders to crawl and identify the legal results. If google was allowed to do this the results would have links to them rather then only to "Download FULL at ".

Except for the last part the UK-IP-Chief doesn't make a very good case with its rather generic solutions that sound easy on paper, but near impossible in practice.
