There’s probably something in the contract between School Boy and UMG which states that any artist School Boy has signed to their label, and whose songs are distributed by Universal, UMG owns the copyrights to the songs.

Is it shady and borderline “are-you-f***ing-kidding-me” level bullshit? Yeah, but that is how legalese works, and wouldn’t surprise me if it’s actually true.

As for YG, it’s got a partnership with Warner Korea, which is managed by EMI, which was owned by Warner Music International, who sold EMI to UMG. However, nothing in the deal said that Warner Korea was part of the EMI deal, so things get a little bit murky from there (plus, the acquisition was during the height of the Gangnam style craze, and I doubt Warner would be stupid enough to hand over a rising star like PSY to its rival.

The thing to note here is that when you follow the money, everything seems to eventually lead back to the RIAA…

Although in practice it’s a defense, fair use law is typically an exception which limits the extent of the copyright owner’s rights. It says that there are certain types of uses over which the creator does not have the exclusive rights that other parts of copyright law otherwise entitle them to. Since there are no rights to infringe, in such cases, the word infringement does not apply. So to characterize fair use as a type of infringement (“allowed”, “justified”, or “excused”) is incorrect and plays into the hands of those who wish their rights did cover such uses.

It results in things like this video company thinking of fair use as saying they “committed a violation”, which is an unfortunate choice of words that no copyright lawyer would encourage their client to utter.

Wow, we know that the majors like to intimidate Average Joe with spurious legal claims, but going after political figures and companies which have legal representation by default, that’s pretty stupid. Four counts of infringement because there are four people in the video? That’s a new level of ridiculous even for them. With this incredible lack of understanding of how the law works, I can’t believe any actual lawyers were involved on Universal’s part. Or maybe the lawyers in question have had it with UMG, and they try to bring as many embarrassing losses on UMG as they can, before they are fired?
