Additionally, they have a takedown tool that the complainer didn’t even bother to use, according to the article. Of course, the takedown tool is the only method that would have a reasonable expectation of informing the service of a copyright issue regarding a file, AS THAT IS IT’S ENTIRE PURPOSE!
Only a complete moron would send a message to the janitorial division to complain about a payment issue which would make as much sense as ignoring the takedown tool and sending an email to the general contact address which will not only get bogged down with the normal filters and all the other general email, but NOT even be sent to people that even know what the heck to do with it, even if they believe it’s real, because only a stupid idiot would sent it general email instead of using the takedown tool.

Ah! The famous regional court in Hamburg again. Same old same old. These people don’t understand the difference between a real mailbox (legally delivered when the Mailman drops the letter off since the mail box is physically attached to the house you live in) and an email inbox (which you typically don’t own and sometimes rejects emails due to spam which is out of your control). In fact, in Germany emails are NOT considered a legal form of communication, only real letters and fax, so WTF?

How does this affect Uploaded? If they take down what is on this complaint and be more careful that notices are not deleted as spam are they going to be alright? Are we looking at another Megaupload take down or a Hotfile suit that shuts them down? Maybe just some kind of settlement payment? There is nothing in the story about what penalty the court will give.

Appeal coming in this case. Seriously, if someone has not been notified of something, if the notice has gotten lost in the mail or in the bowels of the internet, they CANNOT by settled jurisprudence in numerous countries be held liable for not correcting an issue with that thing in question.
