Warez Scene Members Facing 5 Years in Prison
Written by enigmax on April 03, 2008Five so-called ‘warez scene’ members have been indicted on charges of conspiring to commit copyright infringement. For the unauthorized sharing of tens of thousands of files, the men face five years in prison and fines of $250,000 on each count.
U.S. Attorney for the District of Connecticut Kevin J. O’Connor announced that a Grand Jury returned a three-count indictment, charging five men with copyright offenses they committed as members of the so-called ‘warez scene’.
The five, using names such as iced, kidzapped, niterangr and tcut, were caught as part of ‘Operation Higher Education’ - a component of ‘Operation Fastlink‘ - and are all charged with conspiracy.
According to a report, Dominic Tymorek, a 53 year-old from Woodstock, Georgia, and 57 year-old Robert Hardick, of Getzville, N.Y., face three counts. Steven Fiatarone, a 55 year-old from Spring Hill, Florida and 43-year-old Michael Uszakow, of Oakdale, Minn., face two counts and William Parrott, of Roanoke Rapids, N.C., faces one count.
If convicted, the men face up to five years in prison and fines up to $250,000 on each count.
At the same time, 25 year-old Daniel Jaeger, aka ‘Microeguy’ of Wappinger, New York, waived his right to indictment and pleaded guilty before Magistrate Judge Donna F. Martinez in Hartford. Jaeger admitted to being a ’scene member’ for two years and building and running an FTP server known as ‘DataStream’ (DS), used for the distribution of pirated material.
Jaeger admitted that he knew that those accused along with him had uploaded pirate material to both ‘DataStream’ and another FTP site known as ‘Arakis’ (AKS)
Jaeger also faces five years in prison and a fine of $250,000.

Shrug. These guys were probably just careless. The Scene’s paranoia has increased tenfold since Fastlink, so these cases will become rarities pretty soon.

Five years is a bit ridiculous. Put this in context with other crimes in which the offender can get five years.
Lets say they stole candy/movie from a candy/movie store…and shared it they wouldn’t get five years!

Just a common question (I think), but don’t the U.S. have a law, or something, against the media writing the not-already-convicteds’ names? I’m asking cause I recently got aware of it because in Sweden the media have to censor it like “the 25-years old man” or “the known tv-doctor” (that last one actully failed cause everyone knew his name just from that desc.).
Don’t worry, I’m sure the scene will release some nfos explaining how people at torrentfreak and rlslog and torrent kiddies are to blame for the jackasses not knowing enuff to protect themselves.

5 years is a lot… you can comit embezzlement and only get 27 months in a federal minimum security prison!

How come the law allow prison term for non-profit supposed copyright infrigement? If it is part of the DMCA it does not apply because since the DMCA is uncosntitutional it is a nul law non enforcable and non applicable.
It seem to me that these governement tugs are corrupted by corporates and are now shiting at the law game. Find with us! We will not be playing this game anymore with all the resulting consequences!

i dont agree with the ways many things are done during wars but im starting to see the reason why the so enjoy the pratice of putting sniches and traitors before a firing squad…

Nope, no law against printing the names of accused people in the US, as long they’re over the age of 18. See, here in the “land of the free”, the media is free to ruin a person’s reputation and their life by dragging their name through the mud at the first accusation.

As much as I hate the scene and their outdated, overprotective ways, it’s not right that these guys may go to jail and pay fines. Attempted copyright infringement? Give me a break! Not a crime. Information wants to be free.
It is interesting that most of the members are 40+. They may have started doing warez back in the old days on BBS’s, when the scene was cool. I bet they have some great stories.

Now I can’t get this show where i live, I now have a hatred for the show and network because they did this. They have lost a follower, who used to spend money on some of thier merchandise!

It is one screwed up system when someone faces more prison time for sharing music then committing an actual crime. Talk about corruption! This makes me sick. We have real crimes being committed and overcrowded prisons yet our politicians care more about copyright laws. All I have read and seen in the last year has secured me never ever buying anything that might support the MPAA/RIAA. There seems to be so much corruption it is a wonder we have any rights left at all.
