There is no way the MPAA or RIAA is going to want Hotfile to win.

The precedent that would be set would mean that others belonging to the MPAA and RIAA could also be held liable if they too send take down requests or remove material when they have access to some file sharing sites algorithms

The precedent would be detrimental as others could follow Hotfiles lead and sue for the various reasons Hotfile took Warner to task for.

The RIAA and MPAA are not going to want to risk an adverse ruling that may lead to thwarting their removal scheme and abuse of the DCMA process.

Google to could use a ruling in Hotfiles favor as a means to thwart the RIAA and MPAA trying to get Google to become unsearchable for torrents, torrent sites etc.
