‘Yes Men’ Use BitTorrent To Avoid Censorship

The Yes Men are a culture jamming activist duo who expose the lies and social problems caused by governments and corporations. In their much awarded films they impersonate people in power to bring out the truth. Because the US Chamber of Commerce is suing their asses, they have now turned to BitTorrent to get their message out.

With millions of daily users BitTorrent is a great outlet for filmmakers to promote their work, but there are more advantages to this 21st century distribution platform. After their first film turned into a huge success, The Yes Men don’t have to worry too much about promotion. However, it is still much-needed to avoid censorship from governments and corporations and to raise funds for future endeavors.

In 2009 The Yes Men hijacked a United States Chamber of Commerce press conference, declaring a U-turn on their climate change policy. In a response to this “identity correction” the Chamber filed a lawsuit against the duo, claiming that they misled the public. Due to this legal battle no TV-station wants to take the risk to run some of the most controversial material, so The Yes Men took matters into their own hands by releasing an updated P2P-edition of their latest film today.

In addition to avoiding censorship, The Yes Men are looking for donations to fund their upcoming projects. This is where the BitTorrent-powered distribution platform VODO comes in. With free promotion from uTorrent, Limewire and a variety of prominent torrent sites including The Pirate Bay and EZTV, this release will instantly have an audience of millions of downloaders.

To find out more about their motivation to get the film out on BitTorrent and to find out whether they were also this excited about BitTorrent when their first film was pirated by more than a million people, we caught up with Mike Bonanno, one half of The Yes Men.

“There are a few reasons why we chose BitTorrent. First off, it’s a way to avoid censorship,” Mike Bonanno told TorrentFreak. “This version includes video of an action against the US Chamber of Commerce that we are being sued for. No commercial outlets will touch it. We had a TV show scheduled on Planet Green and their lawyers nearly wet themselves when they heard we wanted to use footage of us making political mince-meant out of the largest lobbying organization in the world.”

“It’s unlikely that anyone would distribute this material before we get out of court,” Bonanno continued. “But we don’t want them to win a de-facto censorship case, so P2P is a great workaround. Another reason we are doing this is because this is the way people see movies these days, and we made this movie for people to see it. We would love it if people bought our DVD, but we also want people who don’t do that to see it. And last of all: we do hope to generate some donations: we are broke and there are not so many funders for our new project, especially given that they are all spooked by lawsuits, no matter how stupid!”

Although the benefits of BitTorrent are clear in this case, The Yes Men’s previous film was also pirated by more than a million people. When we asked Mike Bonanno how he felt about this we found out that he’s more upset about the stranglehold that the ‘copyright mafia’ puts on indie productions than the people who grab a copy of their movie on BitTorrent.

“It’s great that people are watching our films! We are very happy that they are getting seen. But that having been said, we do wish that a few more people were paying for it. We borrowed a shit-load of money from friends to make our latest movie and we still can’t pay them back. Also, the way the industry is set up, if you want your stuff on TV or delivered through any official channels you have to spend a massive amount of money clearing rights and paying for legal stuff and that is just silly.”

“For us to get our ‘errors and omissions insurance’ required for any distributor to take it, we had to clear the rights on all sorts of stuff we should not really have had to… including music written in the 17th century, which apparently because of some kind of law in Austria was not public domain according to the interpretation of insurance industry lawyers! Anyway, that’s just one example… so what happens as a film maker – especially a documentary maker – is that in today’s market we are fucked.”

“Because to get it on TV we still need to act like we have deep pockets and can pay for rights for all sorts of shit, but then with the collapse of the indy film market distributors won’t pay for it. And of course most people file-share it rather than pay for it. So yeah, we are happy that people are watching it but not so happy that we are financially screwed! But we also see that it’s the system that is screwing us: we are not blaming the pirates, we are blaming casino capitalism!”

This comment from Bonanno led us to ask the question whether The Yes Men would ever consider exposing the ‘copyright mafia’ and anti-piracy groups. These outfits have turned copyright into a cash cow while pretending to protect the rights of artists, something we address here on TorrentFreak every week. As it turns out, The Yes Men are siding with us in this regard.

“I think in some ways most of our work is about targeting ideas about the rule of private property… so this is related,” Bonanno said. “Our first four years as The Yes Men was dedicated to attacking the World Trade Organization, which has historically supported the idea of proprietary media. Overall, I think that in some ways everything today, every major issue facing us can be seen through the lens of what role it plays in the commons… or lack thereof, as many a government and corporation would have it.”

“If copyright was actually working the way it was supposed to, and protecting the authors that would be great. But that’s not how it works anymore – it just protects money; whoever has the most of it. And usually that means that the authors are fucked anyway!”

    what a shame there isn’t a law suit filed against the copyright industry every time they ‘mislead the public’. if that were to happen, they would be so busy, in and out of court every couple of days, they wouldn’t have time to worry about how many files were being shared or how much money they were supposedly losing. perhaps then the real truth would come out as well, instead of the constant, corporate lies and bull shit!

    Well, I hate to say it, but I 100% agree with the chamber of commerce. You can’t pretend to be an organization, and then make up fake press releases in their name. You have to expect to get sued because of that.

    Not sure what they were trying to accomplish, but that was a pretty bone headed thing to do. I have a feeling they are going to have to pay out in court…

    I dont want to pay the middlemen, that have been screwing both consumers and artists since for ever. Because they could.

    Buying at Itunes for example, is screwing the consumer and the artist (their share is laughable), while rewarding the middlemen.

    Pirating is screwing the artist and the middlemen, while rewarding me.

    Pirating while donating, screws the middlemen, while rewarding me and the artist = Bingo!

    So get your donate on, and the Yes Men is a fine place to start. Im pretty broke, but still found 25$ to help them do what they do fulltime.

    There’s thousands of seeds but also thousands of leechers so much interest. I’ve watched 2 films by the Yes Men and really funny and ballsy. That clip above would make more sense to some who have never seen them if shown from the begging and lead up to that press conference. So it’s not exactly in proper context but merely showing the guy come in stopping it but that’s funny. Donate to the Yes Men but watch the movie 1st and you’ll see why what they do is important.

  • First I’d like to say that Torrentfreak is simply bringing us news to read through. I enjoy articles like this, and when there isn’t much going on between the mass torrent site and tv site take downs, this is definitely something worth reading.

    In regards to “The Yes Men”. To be honest I already dislike them. It sounds to me that they are only good at political attacks, and when they took it too far and nobody wanted to air their footage, they decided to come to Torrent users for what little money they could get out of donations.

    Good actors or artists shouldn’t have to constantly mention donations and having people buy their DVD. They shouldn’t have to pray on guilt by saying, “Yes I posted this for free… but maybe a donation would help.”, because if your work is good, the donations will come freely.

    To me, “The Yes Men”, are no better than any “greedy” man. They are simply cycling through all of their money making options, and just happened to target the Torrent community and the donations that they could bring while their court case, or legal standing is cleared. I guarantee that once they are able to air their product publicly again, they will stop posting their work on Torrent sites.

    The bottom line — We don’t need your guilt trips or life story about how broke you are. You’re suppose to be doing this as something you enjoy, and if you do something good, donations will come, because you will have supporters and fans. I on the other hand, will not donate to you, and will download your work just to spite you. You don’t deserve a donation when you pray on something such as guilt, just as any other law firm looking for a quick buck by sending out “pay up or else” notices that have been mentioned so many times on this site.

    I’m the author of SmoothWheel – one of the most highly rated Firefox addon (top 10 out of tens of thousands), with about a million downloads over the years and about 2000 downloads a day.

    I advertise donation modestly (no popups etc, just a link at the web site and a link at the configuration panel). Wanna guess how much donations I get? about $100 (hunderd!) a YEAR! That’s about $5 for every 20 thousands downloads.

    So while I don’t like pushing it into the users’ throats, I understand those who do. For the most part, donations just don’t work. People use, enjoy, and get on with their lives.

    So instead of your ideological non-donations-advertisements mumbo jumbo, just donate or stfu. No need for nonsense you clearly have no clue about.

    Although you’re mostly a troll with no manners, you do raise some valid issues.

    1. Post 49 was a respond to the claim that people will donate if the product is good enough. From my experience (and others’ which I haven’t stated), it’s just not true (and I tried to provide relatively objective measures for the quality and usefulness of it). That was the main point of it.

    2. “Writing” my extension has taken and is taking much time, effort, knowledge etc. It’s quantifiable, and in a professional environment this kind of effort and result is usually worth several orders of magnitude more than that. It hasn’t “cost” much, but it does have proven value.

    3. I do it for fun, and it IS distributed as OSS, in the hope that others find it useful as much as I do. Do you really consider it wrong to hope that people who use it will appreciate the efforts and product and give something back? Don’t answer.

    4. As for the rest of your claims, it’s against my religion to comment. rili sori ’bout dat.

  • I will just say this from the start — I respect anyone who programs, even if it’s a simple add-on for a web browser.

    However, add-on’s definitely aren’t something worth donating for. Who deserves the donations? Fire fox, for allowing your add-on to work on it.

    In regards to people simply not donating. While this may be true for web browser add-on’s, it certainly isn’t true for music, independent films, software, or video games. Most people who /have/ the money to spare, will spend it on buying the actual product (given it’s reasonably priced) thus it would remove the need for donations.

    If someone then posted something saying, “I hope you enjoyed the first song/game/version/film, please donate so that we may have the funds for a second”, then I’m sure /fans/ that have money to spare would donate.

    You will not get a fan base for a add-on to a web browser, because as you said, there are tens of thousands of these, and probably a few that mimic yours or do exactly what yours does.

    Maybe if you created an actual web browser, implemented the smooth scroll feature into it along with features to compete with competitor browser, you would get actual donations.

    Now — don’t think I’m saying what you do isn’t important. You said it yourself that you get thousands of downloads a day. That’s important. But without fire fox, your add-on wouldn’t be useful.

    This is exactly like video games charging $30 for a game that simply adds a small story onto the original. I’ve /always/ bought the original game, and downloaded the expansion packs, because I feel it’s a waste to spend money on something that should have been implemented in the first place. Instead the developers were lazy and decided, “We’ll get $30 for adding this so lets wait.”.

    I wouldn’t be surprised if video game developers started charging for program patches soon.

His comment merely pointed out that donations might not bring in as much as you might hope. He shared some interesting information with us based on his own experience.

    If the Yes Men need money to continue their work, I see no wrong in them asking for donations.

    Perhaps if you feel guilty when you do not support the things you enjoy, you deserve to feel guilty.

    I watch the movie and now I respect the YES MAN project. The movie is very good and worth to watch. It is pretty nice to see how our “real” world think. Let’s fight against these bastards. I am sure that We all together can contribute something for a better and fare world. I also donate for this torrent not because the request, but because they deserve it. And it is not a shame to ask for donations, donate who want to! Keep the nice work, YES MAN!

    What an incredibly simplistic movie! The story is at the level of a cheap porno (an excuse to show certain scenes).

    Some of the things they pull off are funny I agree, but it get’s old quickly. You’d think that by the second or third prank they’d have learned to print some fake business cards too, but no.

    For all the pranks they’ve pulled impersonating companies and organizations they only got sued once. I am surprised it’s not more. Hardly like a witch hunt against them.

    Some particular points:

    - How can Dow be responsible for Bhopal when they purchased Union Carbide some 2 decades after the accident and after Union Carbide had settled with the Indian government? Maybe the Indian government screwed over the people of Bhopal by settling with Union Carbide, that seems to be a bigger story to me.

    - Also, exactly how does their “theory” explain Chernobyl? Apparently there is more than merely corporate greed at play here. I’d venture the idea that most people just don’t give a sh*t about anyone else and are quite happy to put other people at risk, regardless what system you are in. It’s a problem with human nature.

    They bought the company knowing full well the history and they still refuse to clean up the area. As far as your second point goes you’re comparing apple to oranges just to further your point which is juvenile.

I’ll take a guess that you’re probably right though, in that the government sold out their people for a quick buck, and Union Carbide were plenty smart enough to know to shift accountability across during that deal.

    2. Yep, truth is most people have little care for the welfare of others if it’s not perceived to affect themselves negatively. Lots of people like to pretend to care – it’s fashionable – but when it comes down action, actual personal sacrifice, then you’ll see the truth of what most people really believe. Human nature; #1 above all else.

    I still have a lot of respect for The Yes Men though. They actually stand up and act, and in the face of monsters. The likelyhood of getting pulled to pieces is high, yet still they stand for what they believe in. And I happen to think they’re most right, for me, in that the side they fight for is by far the better of the two options.

    The only part of the movie that appeared to be spot on was the part about HUD, if that sh*t is really happening it definitely needs to be addressed. But because of them being rather economical with the truth before and jumping to wild unfounded conclusions, doubt now lingers in my mind if there is not another side to the HUD story, that they omitted to tell us.

    As for their character assassination of Milton Friedman. I found this about him:
    “Along with sixteen other distinguished economists he opposed the Copyright Term Extension Act and filed an amicus brief in Eldred v. Ashcroft. He supported the inclusion of the word “no-brainer” in the brief.” (Wikipedia)

    Sounds like Friedman would more likely be on our side of the debate about copyrights.

    I downloaded a copy from home and was ready to watch it at work but the sound was REALLY quiet. Even with the VLC scale turned up to 400%.
