Holding the account holder liable has always been a flawed concept but they do say that the account holder is responsible for all that happens on their connection including strong security to keep hackers out. Hackers being vastly more skilled than the average home user is a fact that gets ignored.

In France HADOPI has only ever taken one person to Court and where he was fined even if his pending ex-wife confessed to the infringement and hid the letters from him.

I have no doubt people do fight these stupid laws because very many people are falsely accused.

If the system is anything like Australia’s, then it depends on whether he’s being sued civilly or being charged criminally.

A criminal court (government vs individual) requires you to be “proven guilty beyond a reasonable doubt” (ie: innocent until proven guilty)

A civil suit (individual vs individual) simply uses the “balance of probability” (ie: who’s story is the most likely story”)

Except France has been bashed upon for that because grandma might not know that someone has hacked into her connection and therefore, she cannot be held responsible.

As to Germany, they ALSO have been being bashed upon for the same reasons as France.
