QUOTE
AFACT refer to the Federal Court iiNet judgment which noted that ISPs should take steps when it is proven that a subscriber is infringing copyright,
UNQUOTE

Proving that a subscriber is infringing means that the matter has been tried in court. Should that be a civil court, where proof is simply that something is more likely than not; or a criminal court, where proof must be 'beyond a reasonable doubt?

More likely though when AFACT talk of 'proof', they just mean an unsubstantiated allegation.

Oh yes, I don't remember when it became an 'obligation' for ISPs to do AFACT's dirty work for them. That's what the iiNet case was all about.

The problem AFACT has is that the government is now effectively siding with the ISPs after their largest ISP refused to implement blocks no matter how trivial they are to evade and effectively put the blame onto AFACTs ;lobbying of the government in the first place.

Rightly in my book, by pointing out that net users are being radaicalised by such censorship attempts and is what has given rise to Anonymous and Lulzsec and the resultant attacks on Aus and worldwide govs and corporations and that the aussie ISPs are in fear of infrastructure attacks.

The letters to ISPs are a last roll of the dice by a discredited organisation (bearing in mind 2 of its global counterparts are already facing fraud charges).

AFACT has turned on the ISPs because the aussie government is no-longer listening to them.
