It is the venue that must pay those fees… in this case the investigator was just listening for songs by Artists that they (BMI) represent… The KJ may or maynot have been using licensed music, but BMI will start with the Venue because they have the deeper pockets!

The KJ has a responsibility to check and make sure the PRO licenses are current, before performing publicly in a commercial establishment, or run the chance of also being named in the lawsuit!
