This is a GREAT decision to the extent that it merits a full-blown YeeeeeHaaaaaaaa lol

It’s so refreshing to see some Court judges still have a decent grip on reality, equity and fairness – specially when the current Canuckistani government is so right-wing and anti-freedom.

If the basis for this ruling (as I read it) are that hyperlinks are the same a reference point then linking to copyrighted material might be allowable if done correctly and not for profit and have the correct disclaimers on it.

Either way this is very good news for the internet and especially I’d imagine, for all search providers everywhere.

If everyone who wrote a webpage had to double and triple check every hyperlink to an external site every day to make sure the content of that 3rd party site hadn’t suddenly become copyrighted material. Well… then the world would finally be run by retards. As it is they only run most of it.

It’s ironic that this case was about content that a guy didn’t like, when Newton regularly deletes any comments from his site that he disapproves of. Seriously, post anything pro-Google and your comment will be gone within the hour. Ask him to explain his double standard on issues like using photos without permission and your comment is history. Point out where he’s posted contradictory viewpoints. Gone!

When it comes to linking to copyrighted work, I have a feeling that someone like TPB would get themselves in trouble, because, they sort of, endorse it, so to speak. But, I really don’t know, maybe they don’t; I could imagine a justice looking at the “legal threats” section of the site and saying they do endorse it.
However, some site like Ninja Video probably wouldn’t get in trouble, because they don’t necessarily endorse the links.

Indeed, odd how the MAFIAA is going after people that link to videos as if they’re the people that ripped/recorded the content themselves, when all they did was embed hyperlinks in a page on the internet!
