There is a problem however. If most people really want denial because the reality is too scary or complicated. In Sweden it is bloody obviously that in several parts of politics - maybe not explicitly illegal file sharing... That people allow themselves to be scared into accepting a certain politics. Or maybe they know better but just don't think it's worth to bother.

Yes Nietzsche wrote about such an übermench, however if everyone fears or despises or does not take that übermench seriously... what can he really accomplish in the world?

The constructed "deity" is not quite omnipotent, but it sure has become damn close to omniscient.

It is actually a quite "right wing" idea to Invest in creation of culture. That's how it was done before copyrights, at least in Europe : Rich individuals supporting promising creators. Usually noblemen or rich businessmen.

Today that is entirely possible, on a totally different level: I can pay for 1 in 1000 of an artists work. Together with 1000 other fans All Around The World. No longer has to be a rich fucker but could be 10000 poor fuckers splitting the bill.

At large I agree with you. That old monopolies go down now and then is inevitable.

Let us just aim for the old monopoly will go down smoothy with reforms in a controlled and non-dramatic fashion and not violently with riots and dissolution of nations...

"But we know how such a society with too extreme monopolies / "legal rights" ended up. " Here we finally come I think to conclusion where you might understand the Legalshark I hope. His standpoint is somewhat same as point of one good (but unknown) economist named Schumpeter. His point is that all business is about monopolies and monopoly position and that every entrepreneur is not trying to do some development, public good etc, but every business has just one goal: to get and maintain a monopoly share. The market shares then always destroy the monopoly position, but during the endless game another monopoly - in completely new envirovenment - is created.

So yes, we see the end of one monopoly, but this is not something new. It happened in the past and will happen in future. And there will be new monopoly even now and because the physical economy is less and less important, the new monopoly will be within IP area. How exactly it will be is yet unknown.

Yes, that is true. Same goes for individuals too. Hardly anyone with a bostadsrätt in Sweden could pay the rent if it suddenly skyrocketed. And then something like the early 90s crisis would happen again. Countries and people never learn from history... It is so depressing, but what can one do..?

What you are forgetting is that the main majority of the marketplace is NOT made up of people such as yourself. I'm sure you must have noticed that already - or your described career would have been one hell of a lot tougher.

See, what you describe holds true for so-called "collector's editions as well". Essentially exactly the same as the plain vanilla DVD except in a more fancy case.

And yet their ability to sell is generally such that a popular movie can generate as much revenue again from just collector's boxes as it does from the normal run of DVD's.

In spite of the fact that the movie and all extras already exists in five different HD versions on the nearest torrent site.

So who are the ones spending like mad in order to collect the merch, the collector's editions, the "making of" etc? Pirates.

The same kind which downloads a Doctor Who workprint just to have it next to their collection of the finished movie. Even when they already have the gathered works gathering dust on a lovingly sorted shelf.

Surely you must be aware of that aspect of human nature.

"GDP is important for economers and politicians, not for the citizens."

True only as far as current individual expenditures go. A nation which is so deep in debt it can't cover paying the interest without borrowing more money is a nation hip-deep in trouble though.

At the end of the day GDP tells us the fiscal soundness of a country. Both the US and the EU are not having good days there.

" If I take his money and he gets my vote, a sale has been made. The sale can only be defined when it's all over."

Only in the same way you can similarly con someone out of his cash by telling them putting 100$ in the till will salvage their immortal soul. Indulgences seem quite similar to "Intellectual Property" in that regard.

"What could or could not happen and the non-enforceability of the agreement doesn't matter."

Except that where an agreement can not be enforced it's called a "donation". Are we heading down the common-use road again? If so, your definition doesn't hold up. Again.

"I'm tired of playing this game. We have our separate opinions (and that's all they are, really) about intellectual property and it's time to stop batting this ball around."

Facts aren't opinions. What you essentially say is that your opinions trump my facts. That only backs up my statement that one must be religious in order to believe in IP. Past the point of fanaticism.

"I'm done with this."
