If GN dropped everybody that downloaded CC content would they even have a business left? Also, with there new VPN service they are facing a lot of infringement letters that are tough to trace back to the offending user. They know that and there legal department does too. All they can really do is APPEAR to respect the CC laws, they know and we know they don’t. Like others have said this move might help in a court room some day. Time will tell.

Don’t get your panties in a bunch, people. By sending the letter, Giganews is protecting itself legally from any stupid reaction that could possibly come from any mpaa action based on the screenshots.

Both sides are completely correct on this one – this isn’t an either or – and it has absolutely nothing to do with free speech protections, as those only refer to government action to abridge it.

very interesting, in case its not clear to you here’s that important bit again “as determined by Giganews in its sole and unfettered discretion ”
that is clearly an unfair one sided contractual term and so is legally null and void, as in Not enforceable in a court of law, not “in good faith” to the other party without any come back, if your contract has a “we say so” , “at our sole discretion” type wording then that whole section and its sub sections are legally null and void , remember that….

that second reply from unzbin was fairly rude. it’s best to maintain the image of a clean, legal tool to use (ie Usenet). most of us understand what ‘steal this film’ means, but not the general public, and this will be the point of misunderstanding when **AA guys start going after them… so better to just to comply.
