Our client is a European Company based in France which provides a proof of anteriority on any kind of creations by time stamping the documents with digital certification at a public notary office and conserves a copy of the content for 30 years at the said office. This certified date emitted by the public officer of a country, member of the Bern Convention gives to the creator and if the creation is original, "A proof of anteriority on the creation", that is, "copyright on the creation". Any member country that signed the Bern Convention have legitimacy to give this kind of docu­ment, and the proof emitted and certified by official minister (public notary bailiff) is valid in all these countries. According to Article 5(2) of The Berne Convention for The Protection of Literary and Artistic Works (as modified in Paris in 1971)- "The enjoyment and the exercise of these rights shall not be subject to any formality; such enjoyment and such exercise shall be independent of the existence of protection in the country of origin of the work. Consequently, apart from the provisions of this Convention, the extent of protection, as well as the means of redress afforded to the author to protect his rights, shall be governed exclusively by the laws of the country where protection is claimed," Also to be noted is the fact that our client company works in total compliance with the International and Indian laws and its system is valid in the 172 countries which signed the Berne Convention. You, on the 6th of October, 2016, through a Press Release made false and baseless averments against our client, terming the Company as being "fraudulent" and -creating confusion among gen­eral public". We have evidence to prove that the said Press Release contains serious, untrue and highly defamatory comments towards our client. In doing so, defamatory comments are being com­municated to a lot of people throughout the world, posing a serious threat to the reputation of our client. The publication has also affected the business of our client. The redundant publication thread is available on http://pib.nic.in/newsite/PrintRelease.aspx?relid=151486. Following the said Press Release several other websites have also relayed the fake news which has grossly harmed the reputation and goodwill of our client. We, hereby inform you that the said redundant material from the government website be removed with immediate effect, failing which our client would be compelled to take legal action. The con­tents is not only defamatory but also violation of International treaty. The contents published on official Government Websites is defamatory, sending misleading, unlawful message to the pro­spective and future clientele of our client. Please note that our client suffered huge financial losses. We hereby called upon to remove the unlawful notes for all your official records and official web-site, you are also liable to pay for damages and business loss to our client for publication of defam­atory text on official website, for sending false and illegal message to the prospective and future customers of our client. We request you to kindly comply with the same or face the civil and criminal legal action as per law.
