Plenty of my torrents download at near my connection speed. Many factors such as time of day, etc would come into it.

If I was an ISP I would probably prioritise time sensitive connections over file transfer ones. What’s more important, that a web page loads in good time and you are able to use Skype, or your torrent file completes in 10 minutes compared to 12?

Given that iinet DOESN’T pass on copyright infringement notices to their customers, it doesn’t seem likely that they would shape torrents, except maybe for bandwidth management reasons.
