Under UK law an organisation can persue a private criminal procecution against an individual. This is exactly what happened in the case of Anton Vickerman, CPS dropped the case and then FACT went after him with a private criminal prosecution.

FACT know that they would get very little from a civil case, however they may be able to get a prison sentance in a criminal case.

You mean a civil case… and yes, they can do that however any judge would be skeptical of any evidence gotten that was supposed to be used in a CRIMINAL case only for it to be used in a CIVIL case without even a trial in the criminal case.
