That’s what we said. They are ignoring precedent. Historically, judges from all states tend to look askance at this, and where copyright trolls are concerned, Prenda Law has certainly blazed a long trail of ill will among the judiciary for judges to follow.

It’s pretty damn obvious that Rightscorp is actually trying to evade the legal requirements by way of a loophole here, and as Prenda displayed, that is not a good way to test how much you can get away with.

Except that there IS ample precedent in US courts stating emphatically that the account holder/ip adress is not enough to identify an infringer with.

So they aren’t just exploiting a loophole. They are also in direct violation of a stronger precedent by far. Or will be, the very first time anyone actually calls their bluff and goes to court.

Because from where I’m standing, all I see is a cocky copyright troll saying they believed the court was wrong so they’ll go ahead and ignore the ruling.
