1. Nope. This is a civil case, and just having that code is more than enough preponderance of evidence. So the defendant has to prove it was not him at that point.

As in, would a REASONABLE person (of which you are not one) think that this guy did it. And actually..for civil cases, it is not even that. It is “it is more likely than not that this guy did it.”
