				<content:encoded><![CDATA[<p>Having been established in 2005, the SceneTorrents (ScT) tracker was very well known in the BitTorrent community.</p>
<p>However, after four-and-a-half years of operation it all came to an end. On November 28, 2009, site members were informed that there were “pending legal issues” and with immediate effect the site would shut down.</p>
<p><img src="http://torrentfreak.com/images/scenetorrents-shutdown.jpg" alt="SceneShut"></p>
<p>What followed was an information vacuum. No one from the site made a public statement until TorrentFreak published an interview with an ex-admin of SceneTorrents at end of May 2011. The details of <a href="http://torrentfreak.com/scenetorrents-the-untold-story-of-raids-and-arrests-110528">his story</a> came as little surprise.</p>
<p>Police had arrived at &#8220;Feeling&#8217;s&#8221; house some 18 months earlier at 6am on November 27, 2009, accompanied by operatives from the Hollywood-backed Federation Against Copyright Theft. FACT had become more active in recent times, building cases against <a href="http://torrentfreak.com/tv-links-triumphs-with-landmark-e-commerce-directive-ruling-100212/">TV-Links</a> and another torrent site, FileSoup.</p>
<p>“The police handcuffed me and arrested me for copyright theft and money laundering,” Feeling explained.</p>
<p>Down at the police station a familiar picture began to emerge. FACT, not the police, were running the show. They had carried out the investigation against SceneTorrents and the police were there merely as support, despite this being a criminal case with &#8220;six figure&#8221; sums allegedly at stake.</p>
<p>After being released, Feeling was told to answer bail in February 2010. Just two days before that date, police informed him that they were still waiting for a response from the Crown Prosecution Service (CPS) on how to proceed. A new bail date was set for May 2010. That date was also canceled, as was a subsequent one arranged for July.</p>
<p>Feeling was told that by early 2011 things should be progressing but the year came &#8211; and went &#8211; with no decision from the CPS. However, in February of that year the Crown Prosecution Service were <a href="http://torrentfreak.com/court-drops-filesoup-bittorrent-case-administrators-walk-free-110224/">forced to drop</a> the case against FileSoup. A sign of positive things to come?</p>
<p>As it turns out &#8211; yes.</p>
<p>Some three-and-a-half years after the original raids, TorrentFreak has learned of a significant development. According to sources close to the case, during the past month the police made the decision to drop all charges (criminal copyright infringement, conspiracy to defraud, money laundering) against both Feeling and a second individual who was arrested on the same day in 2009.</p>
<p>Intrigued as to how this conclusion was reached, TorrentFreak fired off questions to both FACT and lawyer David Cook, who we believed to have been defending at least one of the SceneTorrents admins.</p>

<p>Cook successfully defeated prosecutions in previous cases against both FileSoup and <a href="http://torrentfreak.com/fifth-oink-uploader-walks-free-100330/">OiNK</a> and was part of the pro-bono defense team acting for <a href="http://torrentfreak.com/u-s-pirate-streaming-site-operator-gets-amnesty-130226/">Richard O&#8217;Dwyer</a>. He often chats about tech and copyright issues <a href="https://twitter.com/cybersolicitor">via Twitter</a> but on this occasion declined to comment.</p>
<p>FACT did respond, however, initially questioning why we were interested in such an old case. We pointed out that we knew that in recent weeks the police had dropped the case but FACT said that both Feeling and the second defendant had instead been handed police cautions which &#8220;usually&#8221; means admitting guilt.</p>
<p>TorrentFreak is informed by sources very close to the investigation that neither admitted guilt and the police simply chose not to take matters further. So why has such a big case collapsed yet again?</p>
<p>A definitive answer to that is a matter for the UK&#8217;s Crown Prosecution Service, but one only has to look at earlier cases to see a repeating pattern of problematic behaviors.</p>
<p>FACT, a privately-owned commercial organization, conducted the investigations against both FileSoup and SceneTorrents and were later given possession of computer equipment and evidence seized when both sites were raided. This made them not only the alleged victim in the case, but also the prosecutor and expert witness.</p>
<p>Furthermore, TorrentFreak is informed that FACT&#8217;s presence on the sites (apparently at times in an &#8220;agent provocateur&#8221; role) and other evidential issues combined to play a role in the undermining of both cases, ultimately contributing to the decision by the Crown not to pursue the case.</p>
<p>With City of London Police now <a href="http://torrentfreak.com/uk-police-launch-campaign-to-shut-down-torrent-sites-130604/">threatening torrent sites</a> around the globe claiming that crimes are being carried out in the UK, one has to wonder what lessons have been learned from the cases of FileSoup and now SceneTorrents.</p>
<p>Considering four years have passed, with a <a href="http://torrentfreak.com/surfthechannel-owner-sentenced-to-four-years-in-jail-120814/">successful prosecution</a> of SurfTheChannel in the meantime, one has to presume that the answer to that is &#8220;quite a few.&#8221;</p>

				<content:encoded><![CDATA[<p>While sites like The Pirate Bay grab most of the headlines in the BitTorrent world, there is another thriving part of the eco-system which attracts much less attention. The Internet currently plays host to many hundreds, probably thousands, of so-called private BitTorrent trackers.</p>
<p>These sites usually require an invitation to become a part of and tend to be much more organized than their public counterparts. Not that public sites are disorganized as such, but with limited resources and means of generating funds for survival, admins on private sites tend to keep a relatively tight leash on members and content availability in order to keep their sites healthy.</p>
<p><center><br>
<h4>SceneTorrents &#8211; The Untold Story</h4>
<p></center></p>
<p>One such site, SceneTorrents (ScT), had been working the private scene for nearly 4.5 years but on 27th November 2009, it all came crashing down. Filling an initial information vacuum in which rumor spread like wildfire, staff eventually said that the site would close forever, citing &#8220;pending legal issues.&#8221;</p>

<p>&#8220;Well ScT started in 2005 and apart from the odd take down request by Warner and a few others, things were plain sailing!&#8221; ex-owner of ScT &#8216;Feeling&#8217; told TorrentFreak.</p>
<p>&#8220;Roll on 27th November 2009, the police turn up at my door at 6am &#8211; two detectives, a few police and a <a href="http://www.legislation.gov.uk/uksi/2009/2707/contents/made">Proceeds of Crime</a> officer.&#8221;</p>
<p>Of course, for those growing ever more familiar with anti-piracy enforcement in the UK &#8211; particularly those following the failed legal actions against TV-Links and FileSoup &#8211; the police were not on their own.</p>
<p>Along with the police came two investigators from FACT &#8211; the Hollywood-funded Federation Against Copyright Theft.</p>
<p>&#8220;The police handcuffed me and arrested me for copyright theft and money laundering,&#8221; Feeling told us.</p>
<p>&#8220;They then asked me to show them every room in the house before leading me off down my driveway and then into the back of a police van. In the mean time I see more FACT officers enter my home to search it while I was in the back of the van. At 6am in winter it is mighty cold, I can tell you that!&#8221;</p>
<p>Feeling was then driven a few miles to the nearest big police station where he was taken into custody and held in a cell. Several hours later his questioning began.</p>

<h4>Interrogation</h4>
<p></center></p>
<p>Led by a Detective Chief Inspector and joined by a Proceeds of Crime officer and one investigator from FACT, Feeling was accompanied by a duty solicitor.</p>
<p>&#8220;The police started off asking me about ScT, how long it had been running, my part in it and my knowledge of what was going on. They also questioned me about other sites I had no part in but they thought I did,&#8221; Feeling explained.</p>
<p>&#8220;The FACT guy sat there most of the time just listening, and he would chirp in now and then with his limited knowledge of BitTorrent and P2P.&#8221;</p>
<p>While Feeling notes that FACT had limited knowledge of what they were investigating, the police had even less idea.</p>
<p>&#8220;The police did not know a single thing about BitTorrent, P2P or anything else like that,&#8221; he explains. &#8220;I found it quiet disappointing that FACT had told the police that I was a major criminal to get them to arrest me and search my house.&#8221;</p>
<p>Convincing the police that file-sharing site operators are major criminals is a speciality of FACT &#8211; they have managed that in many cases already including TV-Links, FileSoup, SurfTheChannel and AradiTracker, to name a few.</p>

<h4>Hunted down by Hollywood, with help from unlikely allies</h4>
<p></center></p>
<p>The FACT officer present had a file in his possession which contained photographs of Feeling, but quite how they tracked Feeling down to his home address has never been revealed &#8211; he didn&#8217;t have his name or address on the site&#8217;s server bills or PayPal account.</p>
<p>However, TorrentFreak put it to Feeling that enemies of SceneTorrents were perhaps not to be found exclusively at the MPAA, but also in another &#8216;group&#8217; a lot closer to home. From 2006 to 2009, the Warez Scene had waged an on/off campaign to compromise SceneTorrents and its staff. The information revealed by them, although it wouldn&#8217;t stand up in court as-is, would certainly have been welcomed by FACT. Some of it was incredibly sensitive.</p>

<h4>Running a criminal case is no problem for Hollywood</h4>
<p></center></p>
<p>&#8220;At the time of the arrest I thought it was the police that were running the whole thing, but I have later learned through the police telling me that it is FACT that are running the show and it is them who have my stuff up in Scotland,&#8221; Feeling explained.</p>

<p>At one point FACT, a private company, actually got involved in the interview.</p>
<p>&#8220;The FACT officer asked if I downloaded TV shows and if so, which ones?&#8221; Feeling told us. &#8220;I replied with &#8216;one or two&#8217;, and named Top Gear. He then went into a rant about stopping a DVD sale.&#8221;</p>
<p>Feeling asked the FACT guy about the free availability of these shows on the BBC iPlayer and how they may or may not affect DVD sales. &#8220;He didn&#8217;t say much after that,&#8221; he said.</p>
<p>Once the interview process was completed, Feeling was required to give a DNA sample and have his picture taken. He was then released on bail and given a date in February 2010 to return.</p>
<p>At home he discovered items had been taken by FACT &#8211; two Xboxes, a PC, portable hard drives, a phone, and even cash. Later that evening the phone and money were returned but Feeling was required to sign documents granting access to his bank accounts.</p>

<h4>The End of SceneTorrents</h4>
<p></center></p>
<p>&#8220;After they had left I logged onto MSN on a friend&#8217;s PC and told djgrrr [a trusted staff member] to shut SceneTorrents all down,&#8221; Feeling explained.</p>

<p>As in the FileSoup case, Feeling was not ordered by the police to close SceneTorrents. This enabled staff to post up a message and leave the forums open to give the members some information and allow them time to find new homes.</p>
<p>However, the fact that the site had remained up, at least partially, caused issues among some site members. ScT had just completed a donation drive to get money for new hardware and some felt that having successfully pulled in money, shutting down had always been the plan. Of course, Feeling would&#8217;ve liked to have set the record straight, but due to his serious legal position, he couldn&#8217;t do that at the time.</p>
<p>While Feeling was getting arrested, another ScT staff member was also suffering the same fate. Discussions between the pair ended in a shared conclusion &#8211; no more torrent sites. &#8220;It just wasn&#8217;t worth it anymore,&#8221; Feeling told us.</p>

<h4>The endless wait for justice</h4>

<p>Then in February, just two days before Feeling was due to answer his bail, the Detective Chief Inspector (DCI) handling the case contacted him. The police were still waiting for a response from the Crown Prosecution Service (CPS) on how to proceed and a new bail date was set for May 2010.</p>
<p>In May the same thing happened again, and a new date was fixed for July. But while July duly arrived, the same could not be said about a decision from the CPS. No new date was set and several months later Feeling was wondering what on earth was going on. </p>
<p>&#8220;Christmas 2010 came and I called the DCI to find out what is going on and what was taking so long,&#8221; he explained. &#8220;They told me they were waiting on advice from the CPS but it was nearly resolved and we would find out more information in the New Year.&#8221;</p>
<p>But then in March 2011, Feeling read an article on TorrentFreak about <a href="http://torrentfreak.com/police-return-seized-hardware-to-victorious-bittorrent-admin-trashed-110313/">the mess</a> surrounding the <a href="http://torrentfreak.com/court-drops-filesoup-bittorrent-case-administrators-walk-free-110224/">now-failed</a> case against FileSoup, again with FACT at the helm.</p>
<p>With cases failing all around them, FACT don&#8217;t have a good record when it comes to successful file-sharing site prosecutions so Feeling&#8217;s lawyers are now pressing the police to get something done about these continuing delays.</p>
<p>TorrentFreak has learned that admins of another UK-based torrent site are in the same position as Feeling. We have a hunch who that could be, although we could not get that confirmed at this stage. When we have the news of the outcomes in both cases, we&#8217;ll post an update.</p>
<p>As <a href="http://torrentfreak.com/police-seize-83000-in-internet-piracy-raid-110527/">reported briefly</a> yesterday, FACT continue with their drive to close down UK-based file-sharing sites with the assistance of the police, but without a successful prosecution to their name despite many arrests, one wonders for how long this can continue.</p>

				<content:encoded><![CDATA[<p>SceneTorrents (ScT) has been a respected and well-connected private BitTorrent tracker for more than four years. An invite for the tracker was hard to find, but the lucky few that did get in had little to complain about, until today that is.</p>
<p>A few hours ago ScT put up a sad and unexpected announcement for its 20,000 members, as the site&#8217;s operators have decided to close the site for good tomorrow. Thus far the staff refuses to comment on the reason for the shutdown, which has resulted in widespread rumors among the site&#8217;s users.</p>

<p>Some rumors say that the end of ScT may be related to the raid of a <a href="http://en.wikipedia.org/wiki/Topsite_%28warez%29">topsite</a> in The Netherlands earlier this week. According to the Dutch news site Tweakers, the &#8216;ranked&#8217; topsite LOOP had its servers <a href="http://tweakers.net/nieuws/64021/brein-haalt-amsterdamse-topsite-offline.html">raided</a> in Amsterdam, where 40 terabytes of data was stored. LOOP was (supposedly) one of SceneTorrent&#8217;s main content provider according to insiders. </p>
<p>According to other rumors, the shutdown could be a planned operation instead of a response to the raided topsite. In the last weeks the site has encouraged its members to donate, offering double rewards for those who pay up, allegedly raking in as much as $10,000.</p>
<p>Thus far both rumors remain unconfirmed, and the same is true for an eBay auction of the site that went up a few hours ago. Since the staff of the site is not talking, it will probably remain unknown why the site will close its doors now, or what their underlying motivation is.</p>
<p><strong>Update:</strong> FSF <a href="http://filesharefreak.com/2009/11/28/scenetorrents-shutting-down-for-good-confirmed/">published</a> a short chat with ScT owner &#8216;Feeling&#8217; who confirmed that the shutdown is not a hoax.</p>
<p><strong>Update:</strong> A new staff message claims that the shutdown is due to legal issues. </p>

By now most of you already know that ScT will be going offline permanently. </p>
<p>However, due to pending legal issues, we are not at liberty to speak freely about why we&#8217;ve chosen to take down the site.<br>
Members of our staff were arrested and will be undergoing the entire length of the judicial process.<br>
Obviously, in the case of criminal proceedings, it would be downright foolish to comment any further on the situation; </p>

<p>There have been several theories as to where the donation money (of the recent months) has gone. We&#8217;d like to take this opportunity to put all skepticism to rest.<br>
The money was used to purchase new hardware that would ensure our spot as the fastest tracker on the net.<br>
You are free to perform whatever calculations you feel necessary, but in doing so it should become very clear that running a site of this stature costs money.<br>
We feel the overwhelming cynicism is just a product of bad timing compounded with general frustration caused by the current situation.</p>
<p>We sincerely hope that you&#8217;ve enjoyed being a part of our wonderful community over the past 4 1/2 years.<br>
We&#8217;ve certainly enjoyed our members letting us be of service. We&#8217;ve always felt our user base played an equally important role in making SceneTorrents.org a model environment in the torrent world. </p>

				<content:encoded><![CDATA[<p>A private tracker is a site which tracks/indexes torrents in the same way that a public one does but requires the user to become a registered member first. Depending on a site&#8217;s popularity and growth strategy, the work involved in becoming a member can range from &#8216;easy&#8217;, right up to &#8216;almost impossible&#8217; &#8211; there are even <a href="http://torrentfreak.com/get-into-private-bittorrent-sites-with-tracker-checker-2/">tools</a> <a href="http://torrentfreak.com/now-mac-users-can-easily-get-into-private-bittorrent-trackers-too/">available </a>to automate the task and sites to trade <a href="http://www.inviteshare.com/">invitations</a>.</p>
<p>Why would anyone bother accessing a private site when you can get great stuff from PirateBay or Mininova? Most users cite better download speeds, great timing and availability of content while others believe they have better security. Most private trackers require that the user maintains a good &#8216;ratio&#8217; &#8211; i.e he uploads back to the community the amount of data that he took. Because this behavior is monitored and enforced by a range of punishments, the user tends to seed more to avoid them. The ultimate punishment for not sharing is banning, which means the member can no longer access the content indexed within, well &#8211; that&#8217;s usually the case.</p>
<p>Information has been published showing a method for non-members to access and download stuff from private sites, using the (optional) Azureus <a href="http://azureus.sourceforge.net/plugin_details.php?plugin=azpeerinjector">Peer Injector</a> plug-in and lists of peers (BitTorrent users IP addresses and ports they use) harvested from well known private trackers. Usually it&#8217;s the tracker on a site that decides if you can join the swarm or not (while recording your stats/ratio) but by using this method it&#8217;s theoretically possible to enter the swarm of a particular torrent without ever connecting to the tracker. The theory says that as long as you can access a .torrent file originating from the site (via a torrent dump site such as mininova, a friend or the site&#8217;s unprotected RSS feed for example) plus an accurate and up to date peerlist, you can download without being a member, ratio-free.</p>
<p>However useful this might sound to some, there is a cost. For the method to work, the group needs to harvest user&#8217;s IP addresses from each tracker they wish to exploit and make them available for people to download. They appear to have already compromised the privacy of users of TorrentLeech and SceneTorrents by publishing their IP addresses in a <a href="http://deshtept.org/2007/08/18/using-peerlists/">peerlist</a>, at the same time claiming the method improves the individual&#8217;s privacy.</p>
<p>Its common on P2P forums for people to debate the benefits and drawbacks of public and private sites. Some feel private sites restrict, while others understand that a site&#8217;s growth sometimes needs to be artificially limited due to technical, staffing or budget issues. Some feel it&#8217;s wrong to ring-fence the available media and that it should really be &#8216;set-free&#8217; while others feel that it&#8217;s neat being a member at a fast tracker with great image and they&#8217;re quite happy at being part of an &#8216;exclusive&#8217; club.</p>
<p>In any event, I guess both parties are on <em>roughly</em> the same side in the end and they would likely agree &#8211; although of limited use on their own, the user&#8217;s IPs on sites like TorrentLeech, SceneTorrents and any other tracker should definitely be kept as private as possible, even if others believe the torrents shouldn&#8217;t be.</p>
