				<content:encoded><![CDATA[<p><img src="http://torrentfreak.com/images/swebits.jpg" width="222" height="132" class="alignright">In 2011, popular private BitTorrent tracker Swebits announced it would close down, just a week after one of its users was arrested.</p>
<p>The then 25-year-old was a moderator and uploader and between April 2008 and November 2011 allegedly obtained huge quantities of content from the warez scene and shared the titles with the site’s users.</p>
<p>The investigation, carried out by anti-piracy outfit Antipiratbyran (now Rights Alliance), involved the uploading of 518 movies and TV shows. The case concluded in the Västmanlands District Court last month.</p>
<p>Rightsholders dubbed the man Sweden&#8217;s &#8220;worst ever&#8221; individual movie pirate and for that the prosecution demanded at least one year in jail.</p>
<p>The district court has now handed down its verdict and while an immediate custodial sentence is off the table, the damages award is huge by any standards.</p>
<p>This morning the court ordered the now 28-year-old to pay $652,000 in damages for the unauthorized distribution of just one of the movies in the case. For the other 517 the man was handed a suspended jail sentence and ordered to complete 160 hours of community service.</p>
<p>In comments to TorrentFreak, Rights Alliance lawyer Henrik Pontén says that the damages award is the largest ever for a Swedish movie.</p>
<p>&#8220;[The $652,000] refers to compensation and is equal to what the man would have paid if he had bought a license to distribute the movie for free downloads,&#8221; Pontén explains.</p>
<p>&#8220;The man also has to pay damages for other losses such as disturbing the market and goodwill losses. This shows what damages are caused to the creators and rights holders by the illegal file-sharing of one movie.&#8221;</p>
<p>Needless to say the Pirate Party are outraged by the decision, which exceeds the $150,000 per title statutory damages possible in the United States, a territory infamous for its tough infringement penalties.</p>
<p>&#8220;To receive such a harsh penalty for doing something carried out by millions of Swedes shows how outdated our legislation is. The only way forward is a radical reform of copyright law that allows for the sharing of culture,&#8221; says Gustav Nipe, chairman of the Young Pirates.</p>
<p>But before any overhaul can take place, Rights Alliance have their eyes on other targets.</p>
<p>&#8220;In the future a number of criminal cases are up for trial and damages will be brought forward for one or several movies,&#8221; Pontén concludes.</p>

				<content:encoded><![CDATA[<p><img src="http://torrentfreak.com/images/swebits.jpg" width="222" height="132" class="alignright">In 2004 during some of the early days of the Swedish BitTorrent scene, a new private tracker appeared online. Swebits maintained a membership of up to 40,000 and was very popular with locals.</p>
<p>Seven years later in February 2011 the site announced it would close. News from the site suggested it had been targeted by a DDoS attack and alongside had suffered a catastrophic hardware disaster. Perhaps coincidentally, just a week before the site&#8217;s closure a Swebits user was arrested at his home following an investigation carried out by anti-piracy outfit Antipiratbyran (now Rights Alliance).</p>
<p>It transpired that the then 25-year-old was a moderator on Swebits and between April 2008 and November 2011 had allegedly shared huge quantities of content with the site’s users. The prosecution in the case insisted that he had uploaded many thousands of movies and TV shows after obtaining them from so-called ‘topsites’ affiliated with the warez scene.</p>
<p>The final case, which involved the uploading of 518 titles, concluded yesterday afternoon in the Västmanlands District Court after being reduced to &#8216;just&#8217; 517 titles on a technicality.</p>
<p>&#8220;A film was dropped [from the case] because the statute of limitations expired,&#8221; explained prosecutor Henrik Rasmusson.</p>
<p>However, out of the significant remainder the defendant confessed to just 13 of the charges, the number of titles Antipiratbyran / Rights Alliance said they downloaded directly from the man and later tested. As more than 500 titles remained untested, the former Swebits moderator believes he is innocent of those charges.</p>
<p>Despite the reduction and counterclaim, Rasmusson <a href="http://salaallehanda.com/nyheter/1.2285891-fildelande-salabo-kravs-pa-miljoner">said</a> that never before had a court dealt with someone who had uploaded so many movies and TV shows online. In what is generally seen as an aggravating factor, the court heard that many of the uploads took place before the products were officially available on DVD.</p>
<p>Although more than 500 titles were involved in the trial, it appears only one producer is seeking damages from the now 28-year-old. Nevertheless, they are substantial.</p>
<p>Represented by infamous pirate-hunter Henrik Pontén of Rights Alliance, Nordisk Film AS are trying to recover more than a million dollars in damages after their title &#8220;Buried Alive&#8221; was released onto the Internet two days before its official DVD release.</p>
<p>According to the prosecutor, a request for a custodial sentence will be the likely outcome.</p>
<p>&#8220;I will probably insist on imprisonment,&#8221; he concludes.</p>

With its predominantly Swedish userbase, the site maintained a membership of between 35-40,000.</p>
<p>At the end of February 2011 the site announced its shock closure. The official line was that the site had suffered a DDoS attack and hardware disaster from which it could not recover, but behind the scenes something more sinister was afoot.</p>
<p>Around a week before the site&#8217;s closure an investigation carried out by anti-piracy outfit Antipiratbyran reached a climax when authorities arrested man at his home in Sweden. The 25-year-old was reportedly a moderator on Swebits and between April 2008 and November 2011 had shared huge quantities of content with the site&#8217;s users.</p>
<p>According to reports at the time the man uploaded as many as 1,000 movies and TV shows after obtaining the video from so-called &#8216;topsites&#8217; affiliated with the lively warez scene.</p>
<p>“Previously, we have focused us on The Scene, but now we have directed our focus to individual BitTorrent users,” said Henrik Ponten of Antipiratbyran.</p>
<p>Traditionally &#8216;Scene&#8217; members have proven harder to catch, but apparently the capture of this individual came about much more easily. Friction between the man and members of The Scene led to his identity being made public online, but prosecutor Henrik Rassmusson has since revealed that the uploader&#8217;s static IP address was easily traced back to an ISP.</p>
<p>This relaxed attitude to security has now lead to the man becoming the most prolific BitTorrent uploader ever to be arrested and charged, anywhere in the world. That&#8217;s despite prosecutors downgrading their original estimates by 50% to &#8216;just&#8217; 500 movies and TV shows in the charges just announced.</p>
<p>&#8220;It is the largest legal case in which an individual has uploaded movies. There is a precedent, but it is only about 60 films,&#8221; <a href="http://sverigesradio.se/sida/artikel.aspx?programid=2054&#038;artikel=5512189">says</a> Rassmusson.</p>
<p>There&#8217;s no doubt that there have been more prolific uploaders in the BitTorrent scene, but most continue their activities without repercussion. That seems unlikely to be the case here.</p>
<p>&#8220;My understanding is that the damages can be expected to be very large for this type of activity, in terms of volume of uploaded material,&#8221; Rasmusson adds.</p>
<p>&#8220;I think it&#8217;s about prison level, and I will likely push for a prison sentence.&#8221;</p>

The tracker, which limited access to Swedish users only, amassed more than 40,000 members during its active years. </p>
<p>But yesterday, instead of being welcomed by the usual list of freshly uploaded content, visitors to Swebits found an unexpected and ominous message posted on the site&#8217;s homepage.</p>
<p>&#8220;As we all know everything has a beginning and an end. This is the end of Swebits. During the last day there has been a lot of speculation, some with hope and some with less hope,&#8221; Swebits staff informed the site&#8217;s users.</p>
<p>The notice went on to explain that the site had suffered a major DDoS attack and hardware failure last weekend, problems that are too time consuming and costly to fix. In addition, the site had a lack of donations recently, which according to the staff is a signal that the users don&#8217;t want the site to survive.</p>
<p>&#8220;It&#8217;s been a pleasure to be a part of Swebits and being able to influence Sweden&#8217;s best tracker. We know that it will be hard to fill the void that Swebits will leave after closing, but it isn&#8217;t impossible to replace it. Take care, whatever happens in the future,&#8221; they add.</p>
<p>However, this official message doesn&#8217;t take away all the speculation among users. Indeed, there appears to be an additional motive ignored by the announcements. </p>
<p>Today, the Swedish authorities and local anti-piracy outfit Antipiratbyran revealed that someone close to the site was <a href="http://www.aklagare.se/Media/Nyheter/Fildelare-erkanner-brott1/">arrested</a> last week. The 25-year old man, who allegedly was a major uploader to Swebits, had his house raided and was later arrested by the police. </p>
<p>The man reportedly uploaded more than 1000 films to the site during a two week period last fall, and the authorities say he confessed his involvement during interrogations. The man is portrayed by the authorities as a central figure in the community and they link the closure of the site to his arrest.</p>
<p>The number of films the man allegedly shared in just two weeks appears to be unrealistically high, but the prosecution seem confident in that claim. &#8220;This person is suspected of having made the original uploads and then sharing out the works via torrent files,&#8221; prosecutor Henrik Rasmusson commented.</p>
<p>&#8220;Previously, we have focused us on the &#8216;scene, but now we have directed our focus to individual BitTorrent users,&#8221; said Henrik Ponten of Antipiratbyran in a comment. Interestingly enough the arrested man was &#8216;outed&#8217; by the scene in the past, which might have tipped off the anti-piracy outfit.</p>
<p>This is not the first time that Swebits has shut down. In 2008 the site&#8217;s users were also led to believe that the site had ceased operating, but at the time it was a stunt to promote the revamped design that launched hours later.</p>
<p>This time, however, all signs suggest that Swebits wont be returning anytime soon, not in its current form at least. What role the arrest played in the shutdown is impossible to say without an official confirmation, but we have to assume that it caused concerns among the site&#8217;s staff members.</p>
