Stop threatening and extorting people over exaggerated claims and distortions from the music industry.

You cannot prove that anyone you are suing had distributed even one unit of product to another person who is not covered by “fair use” or “fair dealing” exemptions.

You cannot accurately state the degree of infringement (in most cases it is equivalent to LESS than one unit of one product – ACTUAL losses totalling between £1 and £20 per infringement in most cases).

Losses can be projected at zero (because many people wouldn’t have bought it anyway!) just as much as they can be projected to meet your wild, inflated figures based on the assumption that every downloader would buy a product if they couldn’t get the junk for free.

The connection owner isn’t necessarily the infringer. The infringement could be due to authorised or unauthorised use of the defendants internet connection or by many people authorised to use that connection.

Without a court order, you cannot force compliance to any of your demands and so people are quite within their right to state they know nothing about the infringement, that there are many people who could be the infringer and that they are not willing to provide details of all people using their connection as it’s a breach of privacy if not supported by the aforementioned court order.

This means your threats are usually difficult to enforce, can be seen as a waste of court’s time for the infitecimal degree of the infringement and will often be a waste of time if consumers are tech-savvy and know your limitations (compared to your over-exaggerated claims of authority… such as is typical with DCAs)
