Person A has a hard drive. Legally anything on that hard drive is the property of person A. Person A allows person B to make a copy of what is on person A’s hard drive.

That copy is the property of person B.

The only way something can be “stolen” is if person A or B actually took the hard drive from someone else.

So no, filesharing isn’t stealing anymore than jaywalking is murder.

It is indeed shameful to “steal”.

When person A allows person B to make a copy of their own property it is NOT stealing, however. The only way the term would apply is if a pirate broke in to your house and physically removed something. Or robbed a bank.

If it were then in the same vein it would be “theft” to cook a meal for yourself identical to what a restaurant would sell you. Hell, the only thing which can theoretically be taken is “potential business” – but if so then actual competition is also theft.

And what the insanely huge notices sent indicates is merely that an unscrupulous bunch of con artists have found themselves lucrative work which consists on sending meaningless notices about something no one in the real world even cares about.

And that’s using only casual security.

If torrent indexing sites, filelockers and streaming sites can make a killing on ad revenue alone then there’s no reason it wouldn’t work for the copyright industry.

Oh, they won’t be able to charge a 99% margin for their offers anymore, but that’s just a sign that the market niche for distributors has changed. Like the stagecoach drivers when the automobile came around it’s time for the industry to adapt.

Obviously the solution is to be rid of any tenets of copyright law which enable third parties to interfere with communication between two or more consenting parties.

I’m sorry, but the “alternative” to allowing a group of immoral shysters to abuse a bad law in order to extort millions of people without reason or evidence is quite clear – highway robbery, mob shakedowns and protection rackets are illegal, and this should be as well.

Especially since there are no fringe benefits to be found. The only thing a DMCA warning will ever accomplish is in generating more pirates. Angry ones.

Think about that for a second – copyright holders employ, in order to get their message out, the most unscrupulous and heavy-handed con men on the planet. And they expect the response to be positive?
