Harvard Prof: MegaUpload Shutdown is an Attempt to Kill Technology

In the wake of the MegaUpload shutdown Bloomberg interviewed Yochai Benkler, Prof. of Entrepreneurial Legal Studies at Harvard and faculty co-director of the Berkman Center for Internet and Society.

Benkler criticizes the actions of the Department of Justice, which he characterizes as “aggressive.”

“What is a surprise is how aggressive the move is, how much it uses extensions of criminal law enforcement and copyright liability to go after and seize assets and people in anticipation of a full trial,” he says.

According to the Prof. the shutdown of MegaUpload is yet another example of the copyright industry hampering technological innovation.

“When a new technology comes along [...] and destabilizes the way the industries have always made money, the first gut response throughout the 20th century has been; let’s shut down this technology.”

As has been demonstrated many times in the past, these lawsuits can kill technologies and companies, the prof adds.

“What’s chilling here is that a company can be served with a one-sided indictment that lists a whole set of quasi-legitimate and legitimate technological components that lots of other companies use.”

“By the time it will be finished litigating whether that’s enough or not it is dead, because these procedures for forfeiture during the trial will kill the company”

          You boycott the American government by pushing your own government to stop caving in to the US’s demands, this is why there’s such a big international push in copyright internationally (such as ACTA, as just one example), MAFIAA lobbyists pushing the US Gov to pressure other countries to fall in step.

          I don’t think the ONLY way to make a corrupt government work is the way you suggest, just look at Jan 18…The most effective way is to show them their own corruption, to shame them into doing the right thing. It takes just as much work and it has longer lasting results. Go after your government, not the guys pressuring the government. The government is the weak link. If they did their job as they were elected to do, they wouldn’t be as influenced by lobbyists (which shouldn’t even exist, IMHO)

        Only one problem: American business are the ones writing US laws. Sad, but true. “The fucking government” is just the enforcer, business makes the decisions.

        Once things start going to shit at a sufficiently catastrophic pace, that may change. Whether the politicians finally realize that they actually have to govern the selfish a-holes before the transformation to utter fascism is irreversible, or the selfish a-holes realize that their self interest is threatened by their greedy impulses, I don’t know. Nor does it matter; regardless which solution you prefer, profit is the weak spot for both politicians and business, and profit is where you attack them.

        The failure or “shut down” as you call it of these companies can contribute to a less than favorable economic environment. The stability and perpetuation of the global economic status quo is paramount not just for those businesses in question, but for the prosperity, or at the very least, the opportunity for prosperity, for everyone tethered to that system.

        Shutting down these companies will cause more short term chaos then you’re willing to tolerate or withstand.

        It’s a nice fantasy though…deprive the rich and by some miracle their fortune will be passed along to you.

        You’re not prepared for a world where Fortune 500 companies fail en masse.

          You’re either a sock puppet or don’t understand the point. It’s about sending a message, not destroying an industry. If Hollywood goes out of business, a lot of people will lose their jobs, not just wealthy actors and media moguls, but struggling people in that industry as well. If we send a message that we don’t tolerate this type of behavior, the more intelligent of them will get it, change their model, and outperform those that fail to adapt to the 21st century.

          I don’t think you’re right, to be honest. The copyright monopoly is not interested in changing, doing so would eliminate all the middle men, which accounts for pretty much the entire copyright monopoly. Rick Falkvinge does a great job of reviewing copyright history in the recent Pirate Party e.book, I’d recommend you take a look at it…changing for the masses is not something they’re ever going to be interested in, because to them change results in their financial extinction.

      That is nonsense. Without money, the only way to exchange scarce goods is barter. In trades, people always subjectively value (redundant by the way, as all value is subjective to the individual) what they are receiving more than what they are giving up. Money developed because it is very difficult to find other people who have what you want and also want whatever you have. Until scarcity ceases to exist, eliminating money will only lead to chaos.

      The problem with our monetary system is that governments have abolished sound money (the invisible hand chose gold and silver, which were money) and have replaced it with fiat money that is created by governments on a printing press (actually, these days the government just adds digits in a computer). The problem with fiat money is that it permits the government to artificially increase (“inflate”) the money supply, which causes prices to go up instead of down (yes, prices used to go down every year until around 100 years ago) and destabilizes the economy. By the way, increasing the amount of money does not actually increase wealth. An increase in the money supply merely redistributes wealth to whomever gets the new money and raises prices for everything (law of supply and demand). Governments like manipulating the money supply because it provides them with extra money without having to raise taxes. Every recession and depression in history was caused by an increase in the supply of money. To stabilize our monetary system, we need to outlaw fractional-reserve banking (a fraudulent practice where banks lend out your deposits and therefore are unable to repay depositors on demand if every depositor wants their money back at the same time) and eliminate all government control over money.

      Copyright (and IP in general) are means of creating an artificial scarcity. They are arbitrary grants of monopoly. We should not confuse Disney’s “intellectual property” in Mickey Mouse with real property such as your DVD player. When somebody “steals” (RIAA/MPAA’s words, not mine) Mickey Mouse, nobody is deprived of their copy of Mickey Mouse. When somebody steals a DVD player, its owner is deprived of his DVD player. Failing to recognize the difference between real property and imaginary “property” (real property is scarce, but IP is not) is the mistake that the RIAA/MPAA and their supporters make. Nobody should not be able to create an artificial scarcity and profit off of it. But, real scarcity does exist and therefore it would be disastrous to eliminate money.

      If you believe in eliminating money, you need to first prove that scarcity no longer exists.

    To those calling for a boycott of American services and companies due to horrible retention practices… This is why you First: Host all your own stuff. Host your own email server on encrypted drives. Second: When you can’t self-host… encrypt EVERYTHING. Use OTR on AIM/GTalk/Yahoo. Use GPG for email. Encrypt your harddrives with TrueCrypt (Windows) and DM_Crypt (Linux) or even Apple’s FileVault (If you trust that they don’t have back doors in it).

      Nice reply,I’d like to add something.

      Even if you host your own email server you’d be only wasting money for nothing because all unencrypted email can be easily read when sent from one side to another. Encryption does the trick, with gnupgp or s/mime. In my opinion, more people should adhere such practices, even if they have nothing to hide.
      It’s called being rebellious against oppressive regimes.

      As with encrypted drives, if you encrypt external drives, be sure to realise that no media will be able to open it, as with other hardware.

      The funny thing is that at this moment we are using an unencrypted American commenting service called Disqus to say our opinions.

    The reason that this professor thinks like this is probably because the learning environment of a college allows for the free flow of information. Many views and opinions are thrown around, and there are books all over the campuses. It seems that a lot of the people who make comments like this and get reported here on TF are college professors. Just a little thought there.

      I don’t disagree with you, but I don’t think that discludes the concern.

      There’s a reason DAT tapes never really caught on, the RIAA killed it. They threw so much red tape into its production that the technology essentially died.

      A lot of people have opinions, but empiric evidence supports that the MAFIAA are interested in maintaining the status quo, which will include killing any new technologies they can’t control.

The U.S of A won’t ever be “saved” by the political establishment and certainly not by any president.

    Encryption/decryption is boring to work with, but consider this: Megaupload would probably still be up and running if its users had encrypted their traffic.

    This shit with Megaupload indicates the USA has, albeit on behalf of its MAFIAA paymasters, effectively declared war on consumers worldwide.

    This isn’t just about protecting Hollyood and the MAFIAA’s out-dated business model. It’s about our freedom to choose; it’s about market manipulation (in a so-called free market economy!) And that’s why we each now MUST write a genuine complaint to our elected politician(s) in protest at this insanity.

    Here’s a rough draft (that you should change to suit your own circumstances):-

    Dear [name of your MP, MEP, etc],

    Please ask our government to protest against the USA’s seizure of the Megaupload site and ask the site be released without further delay.

    The site had 180 million users worldwide and the vast majority of people have now had their uploads unlawfully confiscated in an over-zealous attempt to protect an industry (ie the US recording and movie industries together) which has stubbornly refused to embrace the highly popular new technology of the 21st Century – namely the internet.

    I respectfully request you also ask our government to seriously consider using a very real threat of severe sanctions against the USA if they fail or otherwise refuse to reinstate Megaupload to full capacity, and to compensate all uploaders for their loss and inconvenience caused by the USA’s unfair and immoral actions.

    its good that they got busted. People should be pushing and arguing for a “merit society” rather than an “entitlement society”.

      Copying is not theft. Megaupload didn’t copy anything. All ‘infringing files’ were copied and/or uploaded by users that breached Megaupload’s terms of service.

      This idea that you’re entitled to intrude on peoples personal files, just because you’re a multibillion industry, making your money by leeching off the creative talent, is absurd.

      The idea that an industry is entitled to have it’s rights prioritized above the rights of citizens, by politicians and law enforcement, is disgusting.

      The fact you’re entitled to legally bribe politicians if you are rich enough, is sick.

      The notion that a narrow interest group, no matter how wealthy, should be entitled to stunt the development and twist the shape and use of the most effective, democratic, innovative and productive communication technology ever developed, is nothing short of a threat to democracy, civilization, progress and prosperity.

      I don’t have high hopes, though. The entitlement society for the benefit of corporations will go on. The thieves will keep bribing the politicians, using the law to stomp out anything that threatens the status quo of their extortion rackets. I take solace in the fact that no law can stomp fast enough to kill the Free Internet.

    What is required is a change in the industry; a change from residual income from one act to an award for each performed. The films, songs, images, are all one acts. Once produced they are the property of the public to enjoy as they will. To gain further awards, produce other worthy acts. The repetition of actions of the past causes the delay of the future. Work for the future you want to realise, not the future imposed upon you, which is the past with a new coat of paint. Create, improve, develop, promote the future. We are always at the crossroads and must always go forward. To turn around and attempt to go back is to stagnate and die. The only constant in the universe is change. Do it, do it now!     What a bunch of nonsense. Megaupload was a criminal enterprise that monetized content theft for its own benefit….this has nothing to do with “technology” and everything to do with “crime.” It’s about time that laws applied to “commerce” on the internet as well as in the brick and mortar world. Megaupload (had they wanted to go legit) could have followed Youtube’s lead and fingerprinted content, but that would mean less profit so they chose to continue their criminal ways. Jail is exactly where Kim Dotcom belongs.

    Have a listen to what the speaker is saying in the video. I think it makes a lot of sense..
    - MU being targeted at this timeframe which coincides with SOPA, PIPA.
    - MU being an easier target than the other filesharing sites.
    - The “aggressiveness” of the takedown actions.

    But i don’t like that the video was edited. Would have liked to see it unedited.

    The industry is blaming Internet for their losses, using the same politicians that brought the economy down (how convenient). The true is that the movie and music industry sucks and nobody wants to buy their crappy movies/music, with all their californacated moral values. People only watch their movies and hear their music because there’s no other option since the MAFIAA owns their soul.

    That’s right, MAFIAA guys! Keep up the war on technology! I’m sure you’ll win in the end; this whole Internet thing is just a fad. You’ll manage to get the genie back into the bottle. After all, how long can people keep up this whole “have your own computer and network connection” idea? How long can the hackers keep up with your lawyers? Sure, they’re doing alright for now, and for the last… jeez, always, but sooner or later you’ll have your customers beaten. Don’t let it get you down that there’s a whole array of technologies standing in line to be applied as countermeasures against anything you do.

    I mean, to give in and start providing decent products in decent formats at decent prices, that would be too humiliating! What kind of business strategy is that, anyway? Like the old saying goes: The customer is always wrong. Or something.
