Kim Dotcom Lashes Out Against “Corrupt” US Government

The US judge handling the Megaupload case noted today that it may never be tried due to a procedural error, a comment that has sparked the anger of Megaupload’s founder. Kim Dotcom is furious with the US Government for destroying his businesses and rendering hundreds of people unemployed. According to Dotcom the case is the result of “corruption on the highest political level, serving the interests of the copyright extremists in Hollywood.”

dotcom freeEarlier today the news broke that a Megaupload trial may never happen because the US Government failed to serve the now defunct file-hosting company.

While some defendants might respond with relief upon hearing such news, Megaupload founder Kim Dotcom is only becoming more furious at the people who destroyed his businesses.

“The US government has terminated Megaupload, Megavideo and 10 other subsidiaries, including a company called N1 Limited that was developing a clothing line,” Dotcom told TorrentFreak.

“They destroyed 220 jobs. Millions of legitimate Mega users have no access to their files.”

If Judge O’Grady is to be believed all this damage could very well have been for nothing because the authorities simply can’t serve foreign companies. This could lead one to wonder whether the whole setup was to simply destroy Mega’s businesses.

This is certainly a theory Dotcom subscribes to, and it’s not the only dirty trick Megaupload’s founder believes the US Government is playing. The US is structurally denying Megaupload the chance to put up a fair fight.

“We are refused access to the evidence that clears us, we are refused funds to pay our lawyers, we are refused to pick the lawyers we want to represent us and have any chance for a fair trial,” Dotcom says.

For Megaupload the worst part is that the damage can’t be undone. The site has been completely destroyed as well as the plans to become a publicly traded company.

“We have already been served a death sentence without trial and even if we are found ‘not guilty’ which we will, the damage can never be repaired,” Dotcom says.

And why?

According to Megaupload’s founder it is quite clear that the Mega investigation was a ‘gift’ to Hollywood, facilitated by corrupt forces.

“This Mega takedown was possible because of corruption on the highest political level, serving the interests of the copyright extremists in Hollywood,” he says. “Mega has become a re-election pawn.”

Nevertheless, Dotcom is confident that these forces will eventually be exposed.

“It is just a matter of time until the truth comes out. We are working on that and we are making good progress,” Dotcom concludes.

          There were plenty of legitimate uploads too. Problem is that it would be virtually impossible for any service provider to preview each and every file they host. It would also likely be illegal for them to do so in most jurisdictions. The USA would likely be an exception, as many legal processes were suspended indefinitely (permanently) under Department of Homeland Security and various 9/11 acts.
          Mega provided a service not much unlike BOX or DROPBOX. People can and do use these accounts for purposes contrary to MPAA as well. Do you want a cloud service provider going through all your files, assuming they even had the resources to do so?

          I’ve heard that tired old argument that “I’m not doing anything wrong, and have nothing to hide”. In that case, be one of the first to volunteer to have cameras and microphones installed inside your home. Have sniffers and keyloggers installed on your computer equipment. Have tracking and transmitting equipment installed in your autos. After all, you’re not doing anything wrong

          Truth is there are so many draconian laws on the books, especially in the States, that everyone breaks at least a few laws a day.

    I for one know how he feels and that anger will certainly last a very long time. MegaUpload was certainly a market leader and when you are pushed off your highest tower it is a long way to fall as the market moves on and your rivals take over.

    My best advice should Mega win this fight, as seems more likely as each day passes, is to well work out your plan to fight back and to obtain some justice. Don”t just plan what to do but to work out a time-frame and to stick to it.

    Yes their goal as always is to destroy your business using every trick in the book and yes to deny you justice. It is very easy to get tied up in the mess and chaos they have caused so you always need a good plan to fight back and to not let problems cause delays.

            Yes. The US government is bankrupt. Has been for years. Oil hegemony is the current scam supposedly backing the US FIAT currency since the gold standard was abandoned. The issue with Iran has absolutely nothing to do with nuclear weapons tests or even threats to block the straight of Hormuz. It has to do with the oil bourse that the Iranians opened up that is trading in anything BUT the reserve currency, which of course is the US dollar. This is a real threat to the Federal Reserve cartel (about as “federal” as Federal Express) and the US Dollar. This is the real reason there is talk of war. The US government is by far the most corrupt institution on Earth and the current crop that is running it is all bought and paid for by the special interests and big corporates. Hollywood has lined the pockets of these people and when they needed a “favor” ( Megaupload brought down) they had no problem convincing these corrupt entities to ” Get the job done”. Yes, it was illegal, but these entities knew that they could destroy the entire Megaupload empire simply because the wheels of justice crawl slowly and cost a lot of money. By closing it down and freezing his assets, they effectively doled out the sentence before he could get a fair trial. Even if Dotcom prevails, the damage done is irreparable. This is the new way it is done here in the US. Exactly the same as most criminal allegations now resulting in plea bargains due to the fact that the defense does not have the financial resources available to defend themselves. Justice my ass! The USA is hardly a “Free” country anymore.

      With all due respect, MegaUpload could come back VERY easily. All the data is still on the servers as far as I know (correct if wrong) which I think that will make it very easy to bring MegaUpload back AND give some “Okay, it’s time to just move out of the United States, we don’t have to ban the United States users!” to these companies like Filesonic.
      They will do this once all this legal brouhaha is over.

    The DoJ’s actions were certainly to destroy Megaupload’s business model
    but they must have thought they had a case because even though
    Megaupload is destroyed, the DoJ now look like incompetent morons. They’ve certainly exposed the US taxpayers to the strong possibility of future lawsuits.

    Trying to deny a defendant his choice of lawyer is also indicative of their desperation.

    I’ve always thought the DoJ’s actions after the SOPA/PIPA protests were their way of saying FU to those of us who were worried that businesses would be easily destroyed by those laws by showing that they don’t even need those laws to destroy a business that their masters in Hollywood don’t like.

       Governments are supposed to represent their people, when did this stop happening at a global level ? 50 years ago ?, 100 years ago ?, 500 years ago ?, 1000 years ago ? Or in reality this was this never the case. Governments around the world in no way represent the people.

      Similarly with laws, they are meant to protect the weak from the strong and make all equal, not be bigger clubs to beat people lives into a bloody pulp. Making rich richer and making everyone else poor.

        The US and other Western “democratic” governments stopped representing their people when the people stopped participating in government.
        Nobody wants to count ballots anymore, so a few companies make machines to count them — in a black box hidden from public view.
        Nobody wants their representatives to represent their views to congress/parliament, and instead use those representatives to address local issues or as a last-ditch ombudsman to get government processes to work properly for the complainers.  All elected representatives have split loyalties between their constituents and their parties, and when the election is over, most of that loyalty is with the party.

        We will have democracy back when people start, in large numbers, to demand regular collective interaction (eg. town-hall meetings) with their Members of Congress/Parliament.  Without this, representatives will listen too much to their parties.  Parties are corrupt and centralise power too much.  But constantly pushing representatives to vote on bills in a way that refects the explicity-stated wishes of the constituency, we shave down party power, and gain back a large measure of democratic power.

        The basic structure still exists for democracy to work.  We just have to get up off our butts and make use of it the right way.

    His first priority should be to get his customers files back before they are (accidentally) deleted. Make the U.S. absorb their storage costs. This move will reinforce his position and corporate ethics and honest customer base. The next is to start a new company using this circumstance of negative publicity to fuel moving on and new growth. These fellows should not get bogged down in this squabbling with this entity.

        Lawyers willing to work pro-bono? There’s real blood in the water now. If they think they have a strong case, they’ll come out of the woodwork in droves. Some will do it for the potential rewards, others to simply make a name for themselves.

          The US Government gets to decide if they will allow a lawsuit to go forward or not.  If they say, “No, we don’t feel like getting sued today,” then you’re SOL.

If proof of corruption is out there, someone will find it eventually. The government loves keeping records and records of records so it’s entirely within the realm of possibility.           That’s what I don’t understand. They should either accuse them of something serious that justifies the takeover of megaupload.com, or let them go. I don’t get how they are not mutually exclusive. 

          Either way, why don’t know why Dotcom doesn’t just put up megadownload.eu or something like that back up, outside of the dirty US government’s hands. And with all this publicity, they would be back bigger than ever!

    If this was indeed a setup to destroy “Mega Business”, then it is already failing. Despite Kimble’s typical histrionic claims, it is very clear that his share of companies ain’t dead yet. If he reopens shop now, many customers will return, either to show the U.S. the finger or simply because their data is still stored there and moving is a hassle.

    I would say even if Kimble loses his companies, he should still be able to make a shitload of money by working in Marketing. He is really superb in giving his statements the right (and deceiving) spin.

    Interesting point is that as the USgov had no juristiction over Megaupload as shown by being unable to serve criminal papers, they also did not have juristiction to seize the servers.

    Not only would it be difficult if not impossible to get over the 5yr prison theshold required by NZ without the company as one of the conspirators (without the company all they would be left with is a civil infringement case)

    The very server content they are relying on as evidence  can be justifiably be argued as inadmissable due to it being illegally obtained by the FBI.

    The other thing it puts a huge dent in is the ‘uSGov’s claim of juristicion merely on the use of a ‘.com’ address.

    These comments from the judge might also give grounds for appeal to non US owners of offshore gambling sites that are currently doing time for accepting US bets on sites licensed and run outside the usa.

      the conspiracy were the true owners of all the assets attributed to the
      corporation and that the corporation was just a shell to further the
      conspiracy. So, the government’s argument is that the “corporation” did
      not truly exist, it is just the conspiracy that existed, and a
      conspiracy is just individuals who were all served in this case.

      Megaupload will obviously argue otherwise. Notice the facts that have
      been released by Megaupload recently. An IPO was planned. 220
      employees. Many divisions, including a clothing division – all facts
      related to showing that Megaupload was a real corporation and not just a
      shell to further the conspiracy. These facts were probably recently
      briefed and argued to the court.

      The judge has hinted as to how he is going to decideThese are all just educated guesses on my part, though. Where did you hear that they need the corporation for the criminal charges? My understanding is otherwise, but I could be completely wrong. As long as there is a conspiracy under US law, that is 5 years in the US, which is what is needed under NZ law. I don’t *think* it matters what the penalty is in NZ, just what the penalty is in the US. But I may be wrong, I’m just going under what I’ve heard around.

It may only matter that the prison term is 5 years in the US for a NZ defendant to be extradited to the US. It could be that this is what they are arguing over in the NZ extradition case. Whose prison term counts for determining the 5 year threshold under the NZ extradition law?

          I believe all the defendants have had criminal charges filed against them. There is no civil case, so they would not be “defendants” unless they were criminal defendants.     I’m happy for Kim and the rest of his crew that this won’t go any further than kiwi courts but it stirs images in my mind of a more frightening concept. Without Megaupload to pin to the copyright cross there are now softer targets in the market that the army of lawyers can chose from. Many of which are without the same financial backing or legal defense that MU could muster even with the resources they have been limited to.

    While services like Youtube and Rapidshare are safe for the moment there are hundreds of sites that popped up overnight after the MU shutdown. If one where to step back and observe their activities it would seem that they only exist to take advantage of the absence of MU in providing content to the masses by violating copyright. Removing Megaupload may have been a tactic to expose better candidates in the precedence setting case of Copyright vs. Cloud storage that would move quickly threw the courts. 

    While it has become all but certain that the charges brought against the Mega-conspericy won’t see the inside of a court room the reality of a similar case seems likely. One that would be more of a threat to our social and personal privacy and possibly cripple the Cloud Storage industry. It will be interesting to see what happens from here, if not tragic. I imagine it will be like watching a train crash or a bridge collapse…

        no it means that if you set up a company its more likely that you can be exported directly to the US door step just on the principal that you did incorporate yourself. if you owned and operated a business under your name they couldn’t extradite you but in the case of MegaUpload since it was registered as a private company he opened the door for the US to come and take him hostage because they didn’t like the type of business he was running. simply put, becoming incorporated means you are legaly accessible anywhere in the world.

      A key part of a file storage service is trust in that file storage and the perception of reliability. This has been seriously damaged by the US government and will scare off many users. 

      Even if everything is put back as it was, you can’t repair the fear that it could all be ripped down again. Who’s Hollywood won’t take another swing at megaupload in a year or 2?

      My guess is that the Megaupload corporation had to be named in the US criminal indictment so that its assets could be seized in NZ by the NZ authorities. But because the corporation will not be served, the charges must eventually be dismissed against the corporation and the corporation will no longer be part of the case (even though the individuals will still be part of the case). Then NZ will have to return the assets of the corporation to the corporation. Also, the NZ officials will look pretty stupid as they will have been tricked by the US government into seizing the assets of a corporation based on a criminal indictment that the US knew could not stand.

        I just read that: “an individual cannot conspire with the corporation for which he works or with another officer, employee or agent of his corporate employer.” Page 68 of “Jury Instructions in Criminal Antitrust Cases 1976-1980.” I don’t know if this is still the law, or ever was for a case like Megaupload. But, the US is relying on the “conspiracy” charge to get the 5 years for extradition, so if it is the law, the US would seem to have an uphill battle. As far as I understand, everyone charged in this case worked for Megaupload, so they possibly could not have conspired under US law. No conspiracy, no extradition. The US will argue that the Megaupload corporation was a shell to further the conspiracy, not a real corporate entity. Megaupload with argue otherwise, which may explain why we are seeing facts about their corporate existence (number of employees, IPO planned, etc.).

     i sincerely hope Kim can get justice out of what has happened here and a great big wad in compensation. i think the thing he needs to be really careful over is, regardless of what evidence he gets to support his case, having to go to the USA to present it in court. the US will do whatever they have to do keep him there! in fact, he may be abducted and never found again once ‘in the Feds system’! everyone knows the only law the US government has is the one it goes with at the time. however, atm, given what has happened now, how can the US keep Mega shut down? how can the US keep hold of Mega’s assets? how can the US keep Kim’s movements restricted to NZ only? how can the US stop Kim or the other Mega employees under arrest from doing whatever the hell they want?

    i assume the answer to all the questions is the same. just keep threatening him and the NZ government!

      As things stand now if he doesn’t get the trial he obviously himself wants, then what happens is that the DOJ will have opened themselves to a civil walkover suit of epic proportions from which he’ll walk with gagging bagfuls of money.

      So this way, if he doesn’t get a court hearing and a fair trial then everyone loses EXCEPT for Dotcom personally and the MPAA/RIAA who managed to scare the cyberlockers.

      If he really is a swindler he wouldn’t protest the lack of a court case at all.

Maybe the USA labels ARE unfairly practicing, but they still pay artists based on agreements those artists struck for financing them, and they keep to their contracts. MegaUpload paid the artists zero. So if you hate the music industry because you believe “they screw artists with monopolistic tiny royalties” then you should hate Megaupload more. Choose a different argument for being pro-MU.

I think this kind of stuff that the US gov is pulling is a good thing as businesses (outside of US) are getting destoried, eventually other countries will see that the US gov is a bully.     1) Abandon the Domain Name System
    in its current form. The USA has just to much control. A P2P type
    alternative might be a good idea.

    2) Don’t host your content in USA
    jurisdiction; you might bitterly regret it.

    3) Federal agencies in the USA is
    most likely all over your data; legal of illegal. If they will break
    US law to spy on US citizens; what will they do to foreigners ? How
    can you be sure your trade secrets do not land up in some US
    companies computers ?

    4) Finally until such time that the
    US can show its acting in good faith; just steer clear of them where
    possible.

    People aren’t going to stop creating art (movies/music/etc) because this shit gets shared for free online. IF ANYTHING it will keep hollywood from making horrible remakes of shitty movies. Real artists make art because they’re artists, not so they can get a fat paycheck. Sharing content online will create a more sophisticated environment for artists to share their wares!

      They ARE going to stop creating art, you dimwit… a moviemaker has to pay for cameras, lighting and editing equipment. A recording artist has to pay for instruments, a mixdesk, microphones and monitors. Even touring requires a sizeable initial outlay, sometimes more than is actually recovered. If your art makes no money, you have no resources. Without resources, ideas remain in the head. Many artists work full time, and their jobs don’t provide them with money for the materials they need. What are they to do? Sponsorship is hard to find, and usually comes in the form of investment. Who will invest in something that makes no money?

      Then there’s the question of skill: music making requires years of practice, simply in order to become competent. Most musicians know that there isn’t (and never has been) much fiscal reward for most performers. But they should at least expect to break even – I know musicians who made no money, some of them brilliant; most have now given up, under the pressure of life’s demands. Soon, people like you will complain about the lack of skill and inventiveness coming from people who are starved for time and money - precisely because of your selfish exploitation of internet freedom. If the majors started to kill the most challenging and interesting musical acts, you’re making their demise final. And you’ll continue to blame the majors, rather than having the maturity and decency to examine your own role in this decline.

      You complain about the ‘suits’; as a budding scriptwriter I use my evenings after work to patiently research, execute and refine my work. I might one day be able to give up my day job, or I might not. But if not, the fatigue of working day and night could easily force me to choose between work and creativity – and I have this need to eat and live under a roof. In a world where creativity doesn’t pay, I would be smarter to spend my free time reading business textbooks and getting a qualification, especially given my low pay as a sales assistant. If I do that, there’s one less creative in the world and one more suit. Your mouth says you care, your actions say you don’t. And stop going on about ‘Hollywood’ and ‘the majors’: they’re not the only ones losing money. You’re stealing the revenue of many, including some desperately poor (and talented) artists, and your talk of evil corporations is the flimsiest disguise for your guilty, self serving conscience.

        It’s bad enough to be forced to pay for good art (art should be a hobby) but to pay for BAD art is economic sabotage: art does not feed, clothe, or shelter anyone and thus cannot be justified economically in a world where millions still die of starvation and could of been fed, say if RIAA didn’t own the Congress and if the artist worked a real job on a farm. I have a brother who failed as an artist and ended up working on a farm and helping feed the poor.

        I think it must be a sick irony that the most “emotional” people in society who are “aspiring artists” are also one of the more likely people to work in charities helping the poor if they get turned down that job.

        The end of Hollywood would probably mean about 1 million “aspiring artists” start looking for REAL jobs and would be a major boon to our economy.

Also, to people here using the argument “it’ll finally get rid of all the crappy USA movies and corporate music”:
          If you truly hated all the entertainment content these companies put out, nobody would bother pirating it. If you’re going to download via torrent and believe files should be shared and free, whether it’s moral or not at least it’s a defensible argument. So is “I just pirate, I know I’m causing damage but I’m fine with it.” But “The USA can suck it and all this content sucks anyway” has a million pound evidence anvil hanging over your head, by the plain fact everyone is yelling the sharing was shut down. I’ve yet to see someone who says “I only pirate Norwegian art films.”

A friend recently told me that he buys the CD versions of albums he downloads illegally, if they’re any good. Yeah, right. Because we all love to pay for something we already have, don’t we. I asked him to point out some of the stuff he has purchased after falling in love with the MP3 version on his hard drive. He blushed, then laughed. And don’t bother with the absurd claim that ‘lack of originality’ is the cause for all this freeloading. It isn’t; lack of willing to part with one’s money is the cause. If this was the greatest age for musical and cinematic creativity, you would still opt for the free ride.       That’s why the judge THREW out the case and said the US has no authority over Megaupload  as it is a foreign corporation! Yet the US authorities destroyed the corporation (including clothing lines and things that had nothing to do with copyright) in what cannot be denied to be political repression and possibly even government exacting retribution on behalf of a third party.

      And it’s not like RIAA will be arguing against corporate personhood (the only way to claim any laws were broken would be to argue for piercing the corporate veil and claim it’s owners were liable), most of the corporate members of RIAA themselves use the corporate personhood argument to bypass various laws and to lobby politicians.

    I’m the features editor on the UK edition of FHM. I’m currently working on a story centering around PIPA, SOPA, the UK’s upcoming Digital Economy Act, and the current global crackdown on piracy as a whole.
    I’m speaking to people such as the BPI, the Electronic Frontier Federation, the Open Rights Group, and the Pirate Party. 
    I’m also really keen to speak to someone from the ‘frontline’ of piracy, i.e. a seasoned and unrepentant uploader of copyrighted material. I want to know why they do what they do, and whether the current crackdown has them considering packing it all in.

    The credit card fraud should have been dealt with by the German government much earlier. Dotcom has obviously cleaned is act up and the U.S. is just working for corporate crooks as usual. He wasn’t part of the right country club so he caught the shit-end. They’ll pry end up making him fly drone planes over people like me to just so that he can afford his expensive diet.

    Megaupload had a complete site rip of ours on there we sent a DMCA and they removed the links but not the files. They are copyright thieves and they profit from other people hard work. Take him down and ruin him and those out there who do exactly the same. Sharing something that is not yours to share is illegal end of.

      So I have a huge pile of money in front of my house(kind of close to a busy road and a parking lot).  I put up a sign telling people that it’s mine and it’s illegal for them to take it.  I don’t protect it in any other way than the sign. Now for some reason people are taking it.  I contacted the government about protecting it for me and was told that if  I made a huge donation to the governments officials they would hunt down the people taking it.  They never said I should try something different to protect it.

    Oh, also the government said that I could sue the people they catch with my money for a lot more than what was taken.  Simply by saying that  i was going to invest it and in theory make even more money.   Also,  I didn’t need to prove how much I was gonna make, I could just make up a huge number and sue for that.
