Makers of ‘The Expendables’ Sue 6,500 BitTorrent Users

With worldwide box-office grosses totalling $274 million since its premiere in August of last year, The Expendables can be classified as a modest blockbuster. The film also did well on file-sharing networks such as BitTorrent, but thus far without any direct revenues. In an attempt to cash in on these unauthorized downloads, the makers of the film stood by an earlier warning and sued 6,500 BitTorrent users in the United States.

expendablesIn the last 12 months filmmakers and licensees have sued well over 100,000 alleged file-sharers in the United States alone. The purpose of these lawsuits is to obtain the personal details of the alleged downloaders, and use this information to negotiate a settlement offer ranging from a few hundred to a few thousands dollars.

This scheme was pioneered in the US by the law firm Dunlap, Grubb & Weaver, aka the U.S. Copyright Group (USCG), but recently it has been replicated by several other lawyers across the country. A few days ago, USCG filed a round of new lawsuits on behalf of another major client, Nu Image, the studio behind the action flick The Expendables.

After The Hurt Locker, The Expendables is the first major film release associated with this type of legal action. It is also one of the largest mass P2P lawsuits that was ever started, with a total of 6,500 unidentified defendants (Does). All defendants are suspected of having shared The Expendables on BitTorrent in recent months.

The complaint, filed by Dunlap, Grubb & Weaver at the District Court of Columbia, further appears to be copied from previous cases. It starts off with describing how BitTorrent works, and goes on to explain how the defendants have used this technology to distribute The Expendables without permission of the copyright holder.

As with previous cases, the true purpose of the lawsuits is not to start a full trial, but to obtain the personal details of the customers who are linked to the “infringing” IP-addresses. A classic pay-up-or-else scheme, or exploiting the legal system for commercial gain as others have described the process.

There is no doubt that involvement in this type of lawsuit will lead to the creation of a negative image for the studio among the general public, but on the flip side the revenue potential is enormous. If 80 percent of all defendants pay a $2,000 settlement, the plaintiffs would earn more than $10 million, which equals 10% of the total box office grosses in the US.

And there is potential for even more revenue.

Even today, five months after a high quality copy of The Expendables became available on BitTorrent, the movie is still being downloaded by a few thousand people every day. This means that there’s enough potential to sue tens of thousands additional BitTorrent users in the future, if the courts permit it of course.

The latter is a question that is likely to be answered in the months to come. Already, law firms involved in these mass lawsuits are meeting resistance from consumer rights organisations and judges. With more cases being entered month after month, the pressure on the legal system is increasing at a rapid rate too.

In the UK, where these pay-up-or-else practices began back in 2007, legal setbacks, incompetence and pressure from the public eventually led to the fall of the most prominent anti-piracy law firms ACS:Law. With the spotlight now on the US, Dunlap, Grubb & Weaver and the other law firms that are involved better brace themselves.

BitTorrent users who receive a subpoena are advised to contact a legal representative, the EFF has some good advice to start with.

    Believe it or not, if each “defendant” had adequate legal representation to challenge these bloodthirsty vampires, their entire basis will quickly go to total shit – just like the crappy movies they incessantly produce.

    There is a service, which I have, that actually covers you in the event you ever get named in any kind of lawsuit (along with many other legal situations) with a pre-determined number of hours of attorney time for trial and pre-trial legal proceedings.

        It’s just my own opinion, of course, but I think the “original” (if that term can be applied) Rambo: First Blood Part II wasn’t actually a bad film. It might be brainlessly stupid and violent, but in it’s day, it was a genre-defining action film.

        I think it’s suffered more than any other movie of it’s time from having it’s formula endlessly reproduced by legions of inferior directors working with non-existent budgets.

        It suffers even more from comparison with modern actioners, many of which strive to be much smarter and funnier, largely in reaction to the general stupidity and brutality of the genre Rambo inspired. :)

        If you check your history then the War of Independence began with the Boston Tea Party. It happened to be the case that England was spending a lot of money supporting the colonies in North America that they decided to impose a tax on shipping to help reduce their costs. The locals who had been enjoying a free ride of zero taxes objected and in a colourful way dumped some tea.

        This lead to non-democratic independence when the majority were still loyal to England. Local opinion only really began to change after the English Army invaded and the successful assault on an arms depot left many of the locals dead.

        Your county and constitution is founded on English laws and values which were in many cases copied.

        Also if you know about the Slavery Triangle then the slaves almost always went from Africa to America in fast ships. These ships after delivery then picked up American good for delivery and sale in England. Yes some slaves were sold on Southamption docks in England. The English court ruled that slavery was unlawful in Britain in 1772 but slavery was only fully abolished by Parliament on the 25th of March 1807 when a large fine could be imposed for every slave found on a ship. Then in 1833 slavery was abolished in all of England’s colonies.

        France abolished slavery in 1849 and the United States was the last to do so in 1865.

        As to oppression then you may recall the American Civil War 1861-1865. So after successful independence from England the Southern Confederate States wanted to form their own country away from the United States. A fair and democratic choice but one unacceptable to the United States leading to invasion, conquest and oppression.

        Now I am not saying that England is perfect but if you want to make claims then try to be accurate. For example it was English ships which transported more slaves than any other country to North America namely 2.5 million Africans or 41% of the entire slave trade.

        And now you live with your purchase. No refunds and no returns. LOL

          Just a quick correction. Slavery was only made illegal in the UK a handful of years ago – the Repeals act (1998) in fact. the 1807 act only banned the slave trade itself.

          Well back in 1772 the English court system did rule that keeping a slave was unlawful but you are correct that the law created in 1807 was an attack on the slave trade by banning the transportation of slaves.

          The Repeals Act you mention is clearly an European Union integration step by removing our old laws for EU law harmony. I don’t think revoking an out-of-date law to obtain better is quite the same.

          If you desire more history then the African Slave Trade was only the second great slave trade when the first could be called the Pagan Slave Trade.

          As we know long ago Pagans the followers of Wicca were common in Europe but then Christianity took over. What is less well known is that early Christians believed that it was acceptable to keep a Pagan as a slave. The Bible is not kind to Pagans and the whole Witches idea proved a big problem as well. This former slave trade only ended once the last European country converted to Christianity.

          At least some Wiccans live on mostly in the United States.

    When i saw a commercial of the Expendables, I was wondering how my governor, at the time, found the time in the middle of a huge budget crisis, to be in a movie. I downloaded it thinking old Schwarenegger had a big role in it but he was in 1 scene that was short. Still pissed me off seeing him take time off to be in it.
    I thought the movie was OK and nothing more.

    How about this solution for these cases:
    The monitor company can only prove that the defendant has downloaded the movie and they where in the pool but it’s impossible to prove of how much data the defendant uploaded from the downloaded data, so the defendant has the right to claim that they are only downloaders to get the movie for watch only and no one can prove them wrong.
    This way IMO they are only eligible to pay the price of the movie, and since the download is probably DVD quality the price shouldn’t be more than 20-30$.
    What is the legal thought about this?

    Piracy is going to go main stream with all of these court cases. I really dont think that they can sue people out of pirating movies. I dont have the exact statistics but i really dont know any one who does not use pirated material.

    The way i see this playing out is, they will sue the hell out of people, they will win a few cases and loose a few. They will keep on trying though. Eventually they wont really accomplish. Someone will come up with an even better sharing technology and that will be the final nail in the coffin for such copyright trolls. ..
