Copyright Trolls Order WordPress To Hand Over Critics’ IP Addresses

In what is becoming one of the strangest, most unbelievable and over-broad farces in the history of United States copyright trolling, the ante has just been upped yet again. In a direct attack on the troll defense blogs FightCopyrightTrolls and DieTrollDie, Prenda Law has just ordered WordPress to hand over all IP addresses of users who accessed either site in the last two years. Just to be clear, that’s everyone’s details.

Copyright trolls, wherever they try to do business in the world, meet resistance.

Their work is appreciated by few outside of their inner circle and often frowned upon by fellow law firms, copyright owners and the public, who see their work as one step away from outright extortion.

While they have enemies everywhere, some of the trolls’ greatest adversaries are their victims. Once you’ve threatened to turn someone’s life upside down with a claim for thousands of dollars, pounds or euros, relationships aren’t really the same ever again. And an enemy empowered by the Internet, one of the greatest game levelers today, soon gets momentum.

In the United States some of the most motivated troll fighters are to be found on two sites, FightCopyrightTrolls and DieTrollDie. Their aims are simple. To keep the public and fellow victims informed and to ensure that through activism, trolls make as little money as possible.

Needless to say, trolls do not like this kind of opposition. It hurts their bottom line. And now, in the middle of what is probably the most bizarre case there has ever been in troll history, one outfit is coming out fighting – possibly for its life.

Prenda Law is in the middle of a mess so massive that to adequately describe the case in enough detail one needs to write many thousands of words. Fortunately, for those who want to catch up, the sites mentioned above have been keeping up to date, complimented brilliantly by Techdirt’s Mike Masnick and Ken’s excellent summary over at Popehat.

The TL;DR is that there is going to be an unprecedented showdown in a Los Angeles court on Monday that could lead to someone associated with Prenda going to prison.

“Based on the evidence presented at the March 11, 2013 hearing, the Court will consider whether sanctions [for Prenda Law] are appropriate, and if so, determine the proper punishment. This may include a monetary fine, incarceration, or other sanctions sufficient to deter future misconduct,” Judge Wright explained.

But while the blood of trolls may indeed flow on Monday, in the last few days Prenda have been going on the offensive.

Earlier this week FightCopyrightTrolls and DieTrollDie had a nasty surprise. Prenda decided to file three defamation lawsuits which according to FCT’s SophisticatedJaneDoe are “designed to chill free speech by burying [Prenda's] critics in massive legal fees.”

Two of the targets in the lawsuit are people involved in the proceedings due to go ahead on Monday, but also listed were a total of 10 John Does. So who are these mysterious characters?

Well, none other than the operators of DieTrollDie (DTD), FightCopyrightTrolls (FCT) and commenters on their sites. The beef? Seems Prenda don’t like criticism, or ‘defamation’ as they prefer to frame it.

On Wednesday, one of the cases – John Steele v. Paul Godfread, Alan Cooper and Does 1-10, FLSD 13-cv-20744 – was dismissed without prejudice by John Steele. The other two remain. Then yesterday, more surprising news.

It transpires that Prenda Law have sought information about DTD’s and FCT’s readers and commenters from WordPress, and not just the odd detail either.

“Dear Custodian of Records,” the Prenda subpoena to WordPress begins.

“Enclosed, please find a subpoena issued in the above-referenced matter, which is currently pending in the Circuit Court of the Twentieth Judicial St. Clair Couty, Illinois.

Our client is requesting all Internet Protocol addresses (including the date and time of that access in Universal Coordinated Time) that accessed the blogs located at diretrolldie.com and fightcopyrighttrolls.com between January 1, 2011 through the present.

Please provide this information in an Excel spreadsheet.”

That’s right, somehow Prenda want *everyone’s details*, whether they are involved in the lawsuit or not. DTD hope that WordPress won’t comply but are preparing their readers for the worst.

“As there is a possibility that a release could occur, the public IP address (date/time stamp) could fall into the hands of Prenda. I would expect that they would then try to cross-reference the IP address with their list of alleged BitTorrent infringement IP addresses,” DTD warn.

“If you have ever gone to this site or Fightcopyrighttrolls.com since 1 January 2011, you may want to contact WordPress and tell them you want them to refuse this overly broad request and at least wait until the issue of the case being removed to the Federal court is answered, before releasing ANY information,” DTD concludes.

So, faced with organized opposition from DTD and FightCopyrightTrolls, Prenda now appear to want to shut them down and quieten the critics. History tells us it won’t work.

This attack against all readers of those sites will only add fuel to the fire and serve to make the possibility of a terrible outcome for Prenda on Monday an even more delicious prospect.

          A lawsuit is a civil matter, and people in the public sphere often cannot win defamation or libel suits simply because they are in the public sphere.           Studios already use the DMCA to censor away bad reviews. There is no stated punishment for filing false DMCA take-down requests so it is a free for all for rampant censorship.

          Suing them in Court would be much more costly.

          Take-down requests are filed under penalty of perjury, which is a felony. Assuming of course its a legal order, and not a backroom handshake deal (as YouTube takedowns from studios are, as are ‘takedown’ services from hosters.)

          It’s an issue with only the host of the content getting the takedown (not the poster of the content), and most citizens aren’t going to dedicate their life savings trying to take a large studio to court over it. Technically the punishment does exist.

      Anyone can sue anybody for pretty much any reason (there are exceptions of course). If the suit is unfounded (like this one) it will either be dismissed or the evidence will fail. There is no violation of rights going on here–at least not yet–and I doubt there will be, as the court seems to be throwing these cases out.

        Even if the case is eventually thrown out, its still a harassment for innocent people to have to deal with these lawsuits. Lawsuits are being increasingly used as intimidation tactics by the trolls and it needs to stop. Isn’t there any penalty for the plaintiff if the suit is unfounded?

      Agreed – there are a lot of stories on TorrentFreak that sound bad, but are actually just sideshows. The right to sue someone in a civil court is fundamentally a good thing.

      This is not a good thing. This is a wonderful and rare example of a bunch of disreputable motherfuckers not only stepping over the line, but taking a running jump and slamming into the far wall.

      This is the sort of thing that gives the pro-copyright camp a bad name.

      They’d only sue if they were able to use the info to identify one of their “infringing” IP addresses. Not sure how it would help with that identification … but even if it did, I doubt that would play in court. Visiting DieTrollsDie is not an admission of guilt regarding one allegation. But it would force added stress onto random people, which at this point seems to be their only MO.

    OK, so, where and how do you contact WordPress.com? (not .org)

    They do everything they can on their website to avoid hearing directly from people. Sure, you can find “community support”, but that’s not what’s needed… you need to talk to an actual WordPress rep who can pass your concerns on to the company’s lawyers.

      Is this even a legitimate request by the copyright trolls? On what grounds are they asking for IP addresses? You can’t take someone to court for being a critic. WordPress should keep quiet and not give them the time of the day. If they comply, this is the end of WordPress. Nobody will use a service that gives zero privacy to users.

          But WordPress could also toy with them for a while.

          - Ask troll to buy Excel as they don’t use Excel.
          - Ask troll to write the import filter from png to xls.

          - Give troll encrypted file with random data in a 7z file
          (without password, they didn’t specify that)

          - Ask for at least 1000 man hours of work to gather the data.

          - Send a TPB alike reply.
          - Send a bill for receiving request/sending a reply.
          - Send only their own IP’s accessing the site (they must have been there)
          - Block Prenda IP’s access to WordPress all together.

          People shouldn’t E-mail WordPress to stop them from giving IP addresses but instead send in ideas how to troll the trolls.

      While, of course, the average voter conveniently forgets that even though he may not care that the bill his representative just voted for may give permanent extrajudicial powers to third parties right now, he certainly will find to his detriment just what he has allowed to pass in his name when it’s clear that precedent has been set.

I asked where is the jury and they said oh we don’t do that anymore for traffic cases and I said what do you mean.     they have been pulling a scam, have been found out and called out. they have lied continuously to the court and have been called out again. shit is about to hit fan in a very serious way for these suckers and they are now clutching at any straw they can to try to get some credence to what they have been doing. remember, the chances are this is all off the back of Steele, as he was the original troll, but the others must have been willing partners. i doubt if the judge is gonna fall for this and treat it as yet another delaying tactic. i can see some serious jail-time coming to them and they deserve every bit of it!

    The end of 2011 and throughout 2012 these sites were like my home. Not a day went by I didnt visit them. I was under threat of a lawsuit. I learned a lot about trolls and how they operate. Without these sites I may have caved in.

    Cross ref IP addresses? Many are dynamic and change regularly. Without the corresponding ISP logs(another subpoena) you can’t match them in any way that makes any kind of sense. I suppose the trolls don’t care, but the judges should take a technology course so they do.

    Our judicial system is 20th century. Judges in many cases don’t understand the technology, so how can rulings make any sense? They will eventually catch up, but in the meantime this is a clown show that tarnishes our judicial system.

But this resulted with more publication and the exposure of the troll business.     Well if they request only the US IP’s that visited thats fine… If they offer any IP’s located outside the US, I would assume that it would be illegally distributed information. I being in Portugal have nothing to do with US law nor do US laws have any pull in my country. What I do know is that if my IP is handed over it won’t be the copy write trolls WordPress needs to worry about.

      You are right there when it is an attack on free speech and user anonymity when any Judge will only see this as a direct attempt to try and suppress their strongest critics.

      You can rest assured that the Judge will soon pull out this subpoena and point out to Paul Duffy the flaws with it.

    As TF has not been covering this troll fraud progress story much compared to others then this news today seems more a forerunner to prepare locals for the big news due on Monday when Judge Wright slays some trolls in what should prove to be a very bloody Court fight.

    Trolls in the US have been slowly failing for months but Monday is indeed the beginning of the end for them unless they can magically conjure up one Alan Cooper before then. As that is unlikely then Judge Write has sweeping powers to put this speculative invoicing to an end and to punish those responsible.

    WordPress I expect will ignore this subpoena when no matter how you want to look at it this subpoena is invalid and only awaits some Judge to strike it down. That is why they tried to make this an emergency subpoena and to cut the uncuttable 20 day response time when they just hope WordPress messes up and reveals the data before it is shut down.

    This though makes a good reminder to people when if you do infringe copyright it is then not a good idea to boost about what you did on a public forum that others can use as evidence against you.

    Anyway stock up in the popcorn when Monday is going to be so explosive that I can only say “enjoy the fireworks”

The sentence says that based on evidence presented on the 11th, the court will decide if & what type of punishment should be applied to Prenda Law. I’m still not seeing how evidence could have already been presented at a hearing that won’t happen for another 3 days….

          Yeah, the court is going to decide, at a later date, what punishment is suitable for the evidence that *was presented* at the hearing on March 11 – a date still 2 days in the future…. That’s the bit I’m having issue with – how could a hearing have been held and evidence presented at said hearing on a date that hasn’t happened yet….

          I wouldn’t tell my theoretical kid “I’m going to have to decide on a punishment for you based on your actions at the party on Friday” when it’s only Wednesday….

    This is why I use firefox IPFlood and set it to loopback. Send the trolls running around in circles trying to find an IP address that doesn’t go anywhere. Also, on another note, while I have never visited either of those two sites, it’s not slander/libel if it’s the truth.

    if they’re gonna get the ip addresses, perhaps eventually… get as many people to visit as possible, get enough ip addresses, it’d take a heaving legal effort to do it, LOT of people suing prenda and wordpress that have never been to wordpress in their life. maybe a tiny gif linked to the sites added to facebook, as part of the ‘yo, look what they’re doin, bad shit’. anyone have a logo that’s linked directly to them?

    What a joke of a subpoena — they can object to this as overbroad and unduly burdensome and not have to give them anything. Any lawyer worth his salt could easily get them out of this, and any judge with the slightest understanding of what Prenda is actually requesting won’t compel shit.
