IP-Addresses of the Canadian Hurt locker ‘Victims’

hurt lockerEarlier this month we reported that The Hurt Locker lawsuits hit Canada as well.

Three Canadian ISPs have been ordered by a court to hand over the personal details of their subscribers to Voltage Pictures.

However, unlike in the United States where tenst of thousands of downloaders were targeted, the Canadian case only covers 30 IP-addresses for now.

Or we should say 29, as the list that was cent to Cogeco includes 2 identical IP-addresses.

If none of the subscribers connected to the IPs appeals the Judge’s decision, their personal information will be handed over by their Internet providers.

* 10 Bell IPs
* 10 Cogeco IPs
* 10 Videotron IPs

    So how can they prove that these downloads were even completed? Say I just download the file’s header to obtain statistical information? I have then downloaded no copyrighted data, but I was indeed in the torrent’s swarm… Some retard just comes along, writes down my IP, now I can be sued?

    …and what kind of proof do they have that those IP’s were indeed in the swarm? Please don’t even say a screenshot… Add in the whole notion of open wifi/passphrase hacking & blam-o… Fucking reasonable doubt. How they are able to get a ruling on any of this shit is beyond me….

      Try say that in court. Not only will your lawyer cost a ton of money, but you will probably want to settle before that bill gets out of hand and you need to remortgage the house.

      depends on if the Judge has been ordered to convict you, even with a reasonable doubt on your guilt, based on very minimal evidence of how much of a crime was committed(if it was even you in the first place).
      People need to make sure that all information that was sent to the Judge, to get details on you, are legal. It’s like a guy on the street saying you took his $20 and he makes a cop search you to get his $20 back, even though you never took his imaginary $20. But because you had $20 and the cop is being a ass-hole, you are convicted and robbed by a fraud artist(China has people like that, of a cop and shill, that prey on tourists).

    An IP address is like the address off an apartment block, without even the apartment numbers. It in no way identifies the individual concerned. It would be lucky if it even identified which computer was involved.

    Sure they can track an interaction back to an IP address but to sue the owner of a connection without identifying them would be like suing the landlord of an apartment block on the basis they are responsible for the tenants.

      because of that “nation within a nation” BS they have some extra laws and are exempt from some others and because of the other laws and past precedence in place making downloading files legal in the rest of canada
      quebec is probably the only province with any legal loop whole they have to use to be able to prosecute

    How do they verify that the files were the actual film? Did they download them? Did they then reseed?

    If a party acting on behalf of the studio seeded the film how can they bitch if people downloaded it? Is that any kind of entrapment?

    If they didn’t seed how can they tell that it was copyrighted data? Or is downloading a file with the same name as a film now illegal? I feel there’s an opportunity to really show up a studio by lots of people all seeding and d/ling a decoy file titled like a film that’s really popular and see if they’re stupid enough to bite and end up with a mouth full of ass.

    Well, I feel for these poor souls who are being thrown under the bus, so-to-speak. This slimy-ass law firm is standing on very shaky ground and is obviously just testing the waters in Canada while the Conservatives have their majority, and Bill C-32/ C-11 is presumably right around the corner from being implemented.

    The problem with their foray into Canada is not only are we less controlled by the lobbyists, but we actually believe in appropriate penalties. Therefore, without the possibility of $150,000+ awards per infringement, as is the case in the US, the reward is not going to be worth the risk for these money-grubbing Yanks. That, and the fact that it has already been established in the Doe vs BMG case (2005), an IP address is NOT a person, and sharing a file from a ‘Shared’ folder, does not constitute willful infringement.
