LimeWire Shuts Down After Losing Court Battle With The RIAA

The Gnutella-based download client LimeWire has ceased all its operations after a U.S. federal judge granted a request from the RIAA. Limewire was ordered to disable all functionalities in the current application to prevent users from sharing copyrighted material. The verdict is expected to have an unprecedented impact on the P2P file-sharing landscape.

limewireA few months ago the RIAA asked a New York District Court to shut down the world’s most installed file-sharing application, LimeWire.

The record labels argued that the Gnutella-based download client might have caused billions of dollars in lost revenue and that it’s therefore one of the largest threats to the music industry’s revenue. Today, RIAA’s request was granted by a federal judge.

According to the injunction, Limewire “intentionally encouraged infringement” by Limewire users, it is used “overwhelmingly for infringement” and it knew about the “substantial infringement being committed” by its users.

The evidence further showed that Limewire marketed its application to Napster users and that its business model depends on mass copyright infringements.

The New York District Court demanded that Limewire shuts down its entire operation, including all searches and uploading and downloading that occurs through the client. LimeWire users who start up their client will immediately notice that it is no longer usable.

The outcome of this case could potentially change the file-sharing landscape for good. Despite BitTorrent being the leading file-sharing protocol for several years already, LimeWire is most likely the most installed P2P application on the market. In 2008 LimeWire was the most installed P2P application with an impressive market-share of 37%, compared to 14% for runner-up uTorrent.

Now the RIAA has scored a victory in court against LimeWire, millions of people will have to seek an alternative download client, which might mean a significant boost in user numbers for some of the major BitTorrent applications.

On the other hand, software that’s similar to LimeWire might be affected negatively by today’s judgment. In the injunction software such as FrostWire and MP3Rocket, but also BitTorrent clients including uTorrent, Vuze and Transmission are described as “similar software”. Could one of these become the next target?

In a response to TorrentFreak, the RIAA didn’t want to speculate on future targets. Instead, we were told: “The court has now signed an injunction that will start to unwind the massive piracy machine that Limewire and Gorton used to enrich themselves immensely.”

“In January, the court will conduct a trial to determine the appropriate level of damages necessary to compensate the record companies for the billions and billions of illegal downloads that occurred through the Limewire system,” the RIAA added.

Although today’s decision is the end of Limewire as we know it, the brand is expected to reappear soon with a “non-infringing” service.

    The reason Limewire is still working is because all they succeeded in doing was take the site down, the client will still work and so will many others. They should have gone for the Gnutella networking but being a bunch of idiots, they didn’t.

    I dont think much will change as far as Gnutella Limewire was just one of many clients operating on the Gnutella network. The network is still up and running as if nothing changed. Previous versions of Limewire will continue to operate. The result of a decentralized network

    LimeWire is free software (GPL) and the code will live on in Frostwire and others.

    With the company, one of the biggest driving forces but also one of the biggest hindrances to the development of Gnutella disappeared. It is by far the biggest player in Gnutella. With it shut down, the smaller clients can add more of their own innovations again.

    This move attacks a company, but it doesn’t kill the software. There’s no reason for people not to use Gnutella. But the case sets a dangerous precedent for anyone developing a filesharing program.

    LimeWire are the guys who took a stand in the courts. If they should not be able to push the case back, every US-based p2p developer will face similar dangers (the joy of case-law). The founder of LimeWire has been branded as responsible with his private money…

    anyone that thinks the demise of Limewire wont affect the use of other p2p applications must be in cloud cuckoo land. with this ‘victory’ under their belt, the entertainment industries are going to try to stop all other means of downloading.
    this type of action is not going to stop until those industries have everything exactly how they want it! when they control the downloading of music, movies and games etc, p2p, especially torrenting, will become the poodle’s privates, but only because they will be controlling it’s use and be able to charge whatever they want for the ‘privilege’, whilst ripping off customers as usual! i bet this judgment will be used to influence the outcome in TPB (ahem) retrial as well. Sweden will not dare to do anything to upset the USA, masters of the whole universe!

    The injunction will not harm, but rather will serve, the public interest. The public interest
    is served by upholding copyright protections.

    WRONG

    The public interest is served by mass distribution of any kind of file. (even if limewire was crap)

    Only a handful of illegal kartells that seem incompetent to adjust their business model and rely on far stretched undemocratic laws and treaties from the past are still served by upholding copyright protection.

    Furthermore, downloading of copyrighted content is not illegal AT ALL in the Netherlands and several other countries, irrelevant to that, as Copyright is OPT-OUT rather than OPT-IN, it also is not illegal if the creator just so happens to give permission to do so (or not uses his “right” to prevent it), which applies to MOST works, maybe not including the ones you claim to represent.

    Limewire was a place people were able to go to get the great music they love. The reason people used limewire is because no one wanted to pay a ridiculous amount of money for one dang song, or a CD when they are only going to listen to like five songs on it. Not everyone has money this day and age. Especially not for music. Times are tough are certain people. Fir those of you who are so happy about it leaving, think about about people. Yes, it took away from the producers, yet it takes away from the people. This is going to fix the money the singers will loose. they will still loose money because no one will want to pay for there music.

    It is a loss, probably only because for so many, it was the only way they could download things. Converting them easily to better tools, torrent clients, and frostwire, I hope. I found it handy for singles, but I suppose torrenting for those works as well? Is there a better way than filetype:torrent songname to structure a query to google?

    Since the Limewire firm is held responsible for all infringments (billions) according to the judge it would be logical that the (current) users are now free to keep sharing.

    Different to harming another being physically, if the total bill has been given to Limewire then nobody else needs to pay.

    Like in a car accident caused by someone else, you don’t get paid twice the damage to your car just because there was also a passenger present in the other car who was talking with the driver (although the extra weight does increase momentum). And if the driver can’t pay, the passenger still doesn’t need to pay.

    Unfortunatelly in reality logic doesn’t count.

    A friend of mine who said he was using Limewire about 2 years ago mentioned a “bandwidth fee” that they charged like xx dollars per 20 GB worth of downloads, sort of like “Rapid” share (molasses-share). not exactly peer to peer. They started out as p2p then changed. sort of a bait & switch thing if I’m not mistaken. anyone else know anything about current protocol for Limewire?

    Sets a twisted precedent. MAFIAA will try to compare the case with e-mail clients that allow attachments since they can (and are) used for infringement (much more than they imagine). Jokes aside, even though the precedent is there, all they have done is to spark interest for other applications and forms of downloading AND the use of open source stuff (which can still receive donations for their hard work while being safe from stupidities like this one since many are developing and there are plenty of free alternatives).

    In the end, the precedent might be a shot in their own feet. Ppl adapt to new times and environments, unlike MAFIAA…

    Add Limewire employees to the list of ppl MAFIAA needs to give jobs when piracy vanishes. How many now? thousands? And ppl sharing and buying the works afterwards are causing the loss of jobs. Yeah….

    The shutting down of the Limewire website by the RIAA is a hollow victory when the application itself and the Gnutella network still remains.

    And in a way, yes it is good riddance. Gnutella lately has become a cesspool of fakes, spam and malware.

    Sure, it won’t be as easy, or as public as it is now, but it still will be done. And don’t forget that we are talking about U.S. companies and court systems. As long as there are internet servers, there will be illegal content to download.

    Not that Limewire’s shut down will effect p2p or downloading anyway, since people either download off direct download sites or they use bittorrent. I just watch music videos on YouTube if I want to hear a song anyway.

    I used it for a few weeks years ago and between connection issues and bogusly named files I decided that paying for stuff was easier than using limewire.

    @jordan1794, just because it doesn’t end in .exe, doesn’t mean it isn’t packed with something…i’ve come across .mp3s that unloaded malware, some of them had no bitrate, some of them had a bitrate…gnutella is junk, gnutella2 isn’t much better…

    @#9, at least with bt there’s a commenting system that one can use to help filter garbage, and in some cases a good mod that will del the trash.

You sit there thinking “Who cares, *I* didn’t use it…” Maybe next time they’ll go after a program or service that you do use. And there will be some other moron to post “Good riddance! It sucked anyway.” Eventually, they’ll succeed in getting file sharing declared illegal, at which time, the ISPs will happily start filtering all P2P traffic. Is that what you want?

    I love Limewire! PRO was the best deal cuz it was inexpensive. The record companies have made enough money but sorry CD’s have gone extinct! The economy sucks and times change but everyone has to change with the times. Now the recording studios are pissed off because they have to work harder instead of sit on their ass and bank off the artist. The artist has always had to make money by touring so that is nothing new but don’t expect to live the rich lifestyle by selling CD’s anymore. Those days are gone and the internet is King! Paying $1 or more for one song on iTunes and others is a rip-off. Someone is definitely making money so don’t give me that shit!

    while the riaa can claim a victory, the reality is that this won’t affect anything. it’s similar to what happened to kazaa years ago – some sh*thole p2p network gets taken down, it becomes news for a while but ultimately no-one gives a f*ck since piracy is still rampant and you can get movies/tv/mp3/porn/etc from better and more secure sources.

    This is good, and bad. One, it was a “safe haven” for pedophiles, I think not, police agencies watched the Gnutella network heavily. So, you loose a MAJOR way of hunting down pedos, but, we also loose our rights to use software of this manor for other things such as sharing music.

    In a way, it’s a double loss for some, a single loss for others, it’s not a win what so ever. That, and I can’t remember how many cleanups that I have had to do where someone got vundo or smitfraud from downloading fakes from limewire, and frostwire is just as bad, though, I rarely saw frostwire.

    If anything, P2P has leveled the playing field: now, anyone can get out there, and needs not sign a soul-sucking contract to do so. Most artists would rather give their work away for free anyway, than have YOU profit off of it, or adopt your business-like ways…

    How is uTorrent similar to LimeWire except that both use bittorrent-protocol? LimeWire has subscription, a pro version and other things that fill the pockets of its developers. uTorrent is nothing like this. If you haven’t noticed, the entertainment industry’s targets are in most of the cases applications and/or sites that in a way make money. uTorrent doesn’t sell anything. LimeWire one the other hand does. And I’m not talking about T-Shirts and mugs.

    Successfully killed a virus ridden file-sharing program that real pirates would never use. Good on them. Another app will replace it in a few days.

    The only way they can even come close to stopping P2P file-sharing is to get an entire country to make ISPs actively block downloaders. Even then, they have to be able to prove they are using it for illegal reasons.

    Maybe if they attempted to save some money, make their products cheaper to the public, and be a little friendlier, they might get some customers.

    Alternatives: Phex, FrostWire (for Windows, GNU/Linux, Mac), Cabos (Windows, Mac), gtk-gnutella (GNU/Linux), Shareaza (for Windows, the real, open source Shareaza at http://shareaza.sourceforge.net/ not the fake version). All free, open source stuff. Gnutella simply rocks, you just need to use some commons sense to avoid spam because it’s a decentralized network, that’s all.

    Note that BearShare is no longer a Gnutella client, it’s a clone of iMesh, a centralized music store which got borged by the mafiaa.

    Just FYI, the last working version of LimeWire is 5.5.10, although it will display the homepage of LW saying that it was shut down blahblah. More recent versions had remote kill switches and have been disabled. Expect to see 5.5.10 being seeded on P2P networks, even if it would be better to switch to maintained alternatives.

    Sharing legal files with your neighbors is a right!

    I didn’t read all posts, but there is something that most people are overlooking.
    As it is now, the Music Production Studios/Labels are the ones that make all the money, not the artists.
    The artists may take this oportunity to get away from those parasites and start producing there own cd’s on a PC, which could then be marketed on their own sites @ a very reasonable price.

    Not everyone who downloads a free song is taking money from the artist, quite the contrary. If I can not get the song for free, it does not mean that I am going to go out and buy it. Instead I just may never listen to it.

    If they relied solely on legal sales there would be far less listeners of their music. Equaling far less people going to their concerts.

    In reading all the posts there is one thing being missed. (Some posters get it) Limewire does not equal Gnutella. In going through the source code, Limewire took numerous steps to limit the success of the other clients. Arguably they wrote unscrupulous code (in the world of open source) to sort of push out the others. It did work. They became the most prevalent. In doing so, they made themselves the target.

    Well, this reminds me of eigth grade…when I switched from WinMX to LimeWire fro a couple of years because WinMX was made into a paid/IP logging client. Since then I have been using uTorrent/KTorrent/Fuze/Transmission/etc.

    This is good/bad news…RIAA now has a feather in their cap because they shut down a program that uses the Gnutella protocol which means that they will be onto bigger/better things, and let’s face it, they have the money to do so, as this picture illustrates so well the breakdown of monies from media sales… http://bit.ly/bwWRZB (blameitonthevoices). Also, this means that either Frostwire will become as bad as LW was, or we get even more leech and logoffs on the public trackers (not that that will bother me any, as I only use private trackers except in very rare cases).
    But the nice thing about FOSS, GNU/Linux (well, one of the multitude) is that most Distros/Packages use the BT protocol to distribute their software to save bandwidth on their servers…this means that BT will (hopefully)
    always be safe, as that its “business model depends on mass copyright infringements.” In fact, there is no business, since it is not a business…

    When i was new to filesharing the first thing I got running was limewire as all my friends used it. It was on my computer for about two days, untill i found out about bittorrent and proptly removed Limewire.

    The Gnutella network still works people. What this court case merely says is that no more new Limewire versions will be created anymore.

    Limewire has NO RIGHTS or power over the Gnutella network. Hence why your applications still work.

    And apps such as Frostwire and Shareza still are able to function as well.

    Furthermore, TorrentFreak posts misleading stories all the time. Any egregious story about “innocent” file-sharing victims or torrent sites being “raided” and such are usually EXTREMELY over exaggerated…

    A lot of you righteous computer users really are underestimating how popular Limewire is among teenagers. It’s the application of choice for most people I know. Just because you don’t use it, doesn’t mean other people don’t.

    Torrents, however simple they may be to you, are quite difficult for some people. Limewire was an easy way to download music. Although I agree that teenagers will just move on to other applications.

    I don’t see the music industry winning this without destroying themselves in the process. The simple fact is MOST people don’t want to pay for music. Spotify, Pandora and other “freemium” models, will personally provide the blueprint for the future.

    BTW, Freenet + Frost work pretty well and you’re 100% anonymous. You need to leave it running for a few hours (the price for strong encryption and strong anonymity) but after a while the speed will increase and download speeds are acceptable.

    Another “potential profit” argument, huh? What an unsurprising turn of events! I wish the average citizen was aware that it is not only likely impossible to steal money that only exists in the future of an alternate dimension where the artist/business made more money (which is what ‘stealing’ potential profit really means), but that everyone is guilty of doing so. If you decide not to buy a product from a store, you’ve taken profit that they could, potentially, have had. They would have bought it otherwise.

    In reality, pirates are not taking anything or harming anyone.     Sorry to hear you where duped by some fraudsters Wthr but winmx has never been a pay or subscription based program, the developer simply took his peer cache client connection system offline to close the whole network and the users threw up many new ones, winmx is open for business and has been for the last 5 years since it was supposedly shut down, its one of the few networks where fakes are filtered out by the new connection patches.

    Glad to see the back of it tbh. There was a documentary on some time ago and it alluded to the fact that Limewire made it 80% more straightforward for people to download CP. And afair there are dozens of viruses hidden within inconspicuous files which when installed on your machine download CP to it so it can be shared without your knowledge over the Limewire network

    If I recall correctly, it was LimeWire itself that originally championed Frost Wire as a backup, just in case something like this happened.

    I seeded my first torrent in 2006, and have never gone back to LimeWire even once.

    It was great 10 years ago, when people first started sharing in large numbers. But it has just been a virus machine for the last five.

    Hate to see the RIAA win, but the took down the least important file sharing program out there.

    Whos with me in saying Good Job RIAA, you just took out one of the Hundreds of other P2P programs that still run like Limewire…WOW, They won a lawsuit over lost money…Sing me another sad song cause thats a load of crap! The Music Industry isnt losing money because of Limewire, their losing money because of all the money they dish out in these useless lawsuits on programs that have every right to exist…You all may now, the makers of Limewire made a failsafe for just such an occurance to stupidity, FROSTWIRE…It is the same thing as Limewire and was made by the same people who made limewire and uses the same P2P network as Limewire…REALLY RIAA, REALLY…I bet your all proud of your NON-VICTORY!!! Yes I said non-victory…Limewire does still exist in another form so for everyone wondering what program to turn to next, use Frostwire…You wont have to learn anything new, just migrate over to the second-hand project provided by Limewire LLC. or not refered to as Frostwire LLC. It took the RIAA 5 Years to shut down Limewire, well, I guess we have another 5-10 years with Frostwire before it goes and then probably another form of Limewire will be avalible to the public and then another and then another…LIMEWIRE WILL ALWAYS BE AROUND JUST IN A SOMEWHAT ALTERED FORM!!     they aren’t going to shut down the internet, this ‘dangerous precendent’ stuff is garbage and an excuse. I work in the music industry. Not everyone is bottomlessly rich in this world like people think. While i did not play or sing on anything shared on Limewire, my long hours of hard work and dedication has been downloaded hundreds of millions of times with no regard. When you go to work, you rely on someone buying something from your company so you can get paid. How would you feel if you still had to do all the hard work, but no one bought your product because they found a way to get it for free? We are all very proud that our work is so well loved that so many people want it, but please pay for it like everything else you use. Do you steal gas, food or clothes?

    If the music industry was as inovative as the artists they starve they would find a more consumer friendly bussiness model.

    Humans are social creatures. Sharing art and ideas is why we don’t live in caves anymore. It’s gross to see an entire industry selling what it didn’t make.

    I think its bullshit! If these artists and record labels wouldn’t charge so much it wouldn’t be a problem!!! We are in a recession and people can’t afford to pay all that money they are asking! Even at $1.00 a song you will still pay $10.00-$20.00 a cd! That my friends is way to much for me!!!

    If piracy was SO bad… movies would not be #1 in sales over all past movies. There would be no more #1 selling songs breaking records days after release. They only want to control everything. At the peak of Napster Britney Spears (yummy) :) had a top selling cd shattering records. And many more artists after her have broken sales records and movie records etc…

    Its all a bunch of crap. I agree that they should be suing individuals to “get the point across that it’s illegal” since I know a LOT of people who ONLY pirate and will not buy music. If its really good, i’ll buy it. If its marketing crap I’ll download it.

    Ah well – who cares. We will eventually just have private FTP sites or Sneaker express like the good ole days :)

    What a bunch of idiots! Took all of 2 minutes to switch to Frostwire which is faster. They aso tried to shut down pirate bay which resulted in them moving their server. Still going strong!

    i Just downloaded LimeWire Pirate Edition (its the last version based on the 5.6 beta with all the rules removed and its pro :)) Works like a charm . if you miss it like i do , i recommend to go for it.
