P2P Site Operator Appears in French File-Sharing “Show Trial”

The owner of a file-sharing site active more than 5 years ago went on trial today in the French capital, Paris. Vincent Valade is accused by entertainment companies of profiting heavily from the unauthorized distribution of more than 7,000 movies. If convicted he faces up to 3 years in jail, 300,000 euros in fines and compensation settlements running to millions of euros.

Following two adjournments, the trial of file-sharing site operator Vincent Valade got underway in France today. Scheduled to run for 3 days, the Paris Criminal Court will hear evidence that claims between 2005 and 2006, Valade “provided films without the permission of copyright holders.”

Now aged 25, Valade was the owner of ed2K link site Emule Paradise, which at the time was one of the most popular sites of its type. Indeed, the claims from the movie company plaintiffs including Association of Film Producers, the National Federation of Film Distributors, the Association of Independent Producers, Universal, Galatée Films and Pathé Rennare, are that the site attracted around 300,000 visitors every day.

From this traffic, say the plaintiffs, Valade generated a sizeable advertising income. During the two year period in question it’s claimed he had revenues of more than 416,000 euros which were placed in bank accounts in Belize and Cyprus. Five other defendants including the Future Net (Net Avenir) advertising agency will appear alongside Valade at the trial.

Valade, now aged 25, is accused of facilitating the illegal distribution of 7,113 copyright movies, some of which were pre-release, between 2005 and 2006. He is also accused of the illegal copying of 19 films which were found on his computer following his December 2006 arrest.

It is by no means certain that Valade will lose his case. A similar case brought by 20th Century Fox, Columbia, Disney, Paramount, Universal and Warner against link site see-link.net failed last year after the plaintiffs presented no evidence to show that even a single infringement had taken place due to the site’s links.

“The underlying question is, can Vallade be held liable for links that are Uniform Resource Identifiers (URI), and not Uniform Resource Locators (URL),” Guillaume Champeau of file-sharing news site Numerama told TorrentFreak this afternoon.

“That is, if there is no evidence that the referenced content was actually shared when the .ed2K files were created, can you say it is infringement? Even if the content is shared, is it second degree infringement?”

In addition, one of the core arguments of the plaintiffs is that eMule Paradise offered the eMule file-sharing software for download – complete with how-to guides – alongside links to infringing downloads.

“[The plaintiffs] say that given ‘the context’ of eMule Paradise, with lots of links enabling the downloading of infringing content, the act of offering eMule for download is criminal,” Guillaume explains.

“Since the DADVSI law passed in 2006, it is forbidden in France to ‘knowingly and by any form, publish, make available or communicate to the public a device clearly intended for making available copyrighted works and material without authorization’.”

If found guilty Valade faces a 3 year jail sentence, fines of up to 300,000 euros and damages payouts potentially running to millions of euros.

Update: According to Guillaume, the trial has been postponed.

“The defense lawyers have shown flaws in the order of reference, and the court agreed that the case had to go back to the investigation judge. When the flaws are fixed, a new date for the trial will be decided. It should take months, if not years.”

    I wonder what these same courts would say if they were asked to put all gun owners in prison without parole because guns have been used in murder. Seems to me that this is all on shaky legal ground to begin with.

    Laws are circular in nature, they tend to be written to be circumvented. If company A says Company B’s product circumvents data. Company B did nothing wrong. Company B can then say Company A’s software can be used to get around this problem. Each company is not advertising its own product for illicit activity. Computational compression is bringing the level of compression down to a single page of ascii characters. Movie A = aCgve%sces.mpg How do you stop that when the internet will not even be needed? You could Fax a movie. It would take some time to decompress but what the heck. It is getting time to change the revenue model for films. Include the advertising in the movie, and demand that everyone watch it.

      Faxing a movie. That sounds interesting… And actually it’s completely do-able. I mean it’s probably be like 1,000 pages in hexadecimal, but it can be done, & like you said compression algorithms are getting more & more advanced. And people with scanners/software that can interpret text from document images wouldn’t even have to type it all in, thereby making the process much less painless & more efficient.

      Imagine searching Google images for a downloadable copy of a movie! I mean Base64 is already used for images in webpages & stuff. Movies are obviously just the next step.

        That would be… Epic in a not very useful way. Somehow it reminds me when I used to use a soft called Camouflage to hide pieces of rar files containing animation related stuff behind picture files in free sites like geocities on multiple accounts…

    Sue Xerox for copying machines, AT&T for conference calling, etc… It is not that people are sharing information, it is “What” they are sharing that they want to stop. If someone doesn’t want you to share information, they shouldn’t put it into the public arena. Make a movie and don’t release it. Or accept it as a fact that you will make less money and change, put your content on Netflix and make millions rather than billions. File sharing will stop. $8.00 a month to watch what I want, when I want. Why would I waste my time sharing files.

    That doesn’t apply to most of the current file-sharing software. But it’s still an idiocy as we can see from the trial in question. They should sue [insert computer manufacturer here] for making available to the public devices that WILL make available copyrighted stuff without authorization. Seriously, I started paying some attention and I can’t do shiet on my PC without infringing some copyright law.

    I hope they fail epically. Although France isn’t what I’d call a sane and fair country… In fact, I have yet to see such country.

    On a side note, I’ve just added another few points in my hatred towards MAFIAA. Which means I’ll be making more effort into making ppl not buy their stuff to compensate for those points. Srsly, I’m doing some pretty nice damage to the bastards =D

      The industry’s sole argument on piracy in general is that every download is a lost sale. I download because I want to, and because I can. If every torrent site disappeared tomorrow, you still won’t see me in the video store, or any other location picking up a disk of any sort. I’m not costing anyone anything… they never had their hand in my pocket in the first place.

    So, someone who did the good thing of providing movies to the people who can’t spend 15 euros for a movie in the theaters and/or a dvd of 10 euros is going in jail more than people who have raped or murdered innocent people. And for what? For depriving Brad Pitt and Joli and every Holywood guy of the opportunity of having a 3d Porsche. Baaad file-sharers!

    I help absolutely every single person I know find their media by alternate means now. In fact, with the recent push on anti-piracy, show trials, and ruining the lives of innocent people and those who simply can’t afford it(Jamie Thomas-Rasset), I’m going the extra mile and offering new movies and music to friends that I know buy them from retail outlets before they have the chance to make the purchase – at the same time educating them as to why I’m doing this, and scalding them for even the mere thought of buying it. I have changed literally countless amounts of people from those who buy, to those who download for free. If you know these types of people, the ones that still buy media at retail prices, they are the real enemy – media middle men are using this money against us, the very money we use to purchase the products from them in the first place. The only way to stop this behavior is to take the money supply away, every last bit of it. Tell all your friends, and help them to get the media they want without contributing to the machine that bites the hand that feeds.

        Incorrect. You’re being too literal in your thinking. There are plenty of people today who make all kinds of things for free and provide those to others at no cost, legitimately. Why is your mindset that of anything valued/desired by others must have a price tag attached to it? This is one of the major problems with people today, we’ve come to expect to have to pay for anything we see value in.

        Art is used as a form of expression, not as a business venture for monetary gain. Those who are truly enthusiastic about it will produce it regardless of the bottom line. Art is not a business, despite what you may have come to think.

        I must disagree. They could offer services (read it: services). That enabled us to have legal access to all the content for a monthly fee (a sane fee) using the current P2P technology. They wouldn’t be selling what they made but a service providing access to what they made. Legal access that is.

        I’m with mr “embrace changes” here. Although I’m not a fundamentalist and I do buy content I tell ppl about how moronic and evil is MAFIAA. You know, their actions are enough to outrage ppl so I actually have very little work with the argumentation. At the same time I speak against buying physical media with movies and so on..

        Anyway..

      I agree. I am doing the same thing. Installed xmbc on my parrents / best friends computers (people i trust) hooked into my seedbox (encrypted). If there is any show / movie they want to see they email me. And i will make sure they can see the content for free that way, without a risk. I’ll make sure no one can trace the seedbox ip and that they would have to jump hurdles of international law before they get it. And even if they do get it the seedbox is registered to a fake name payed for by an unregistered paypal account that gets donations from many other paypal accounts. And all related/needed sites are always visited with tor browser bundle over open wifi’s.

    Hadopi-France and it’s three-strike policie needs a precedent and confirmation for the public, that infringing copyright is worse than raping kids…

    he will be convicted simply because the judge(s) have been told to convict him, just as TPB guys were. no evidence introduced, all speculation. i expect there is a lot of USA influence behind the scenes, same as in Sweden.

      These are indeed politically-motivated “show trials” in which the MAFIAA and their Political Puppets on The Hill demand results in their favour or the Country faces trade sanctions.

      So much for justice, freedom (of speech, to share, etc), and national democracy in which the politicians represent their voting constituents and not some faceless, greedy asswipes from a foreign Country who desire profit, cash, and national laws to obtain it.

      Their attempts to have this concept included in ACTA (the Anti-Counterfeiting Trade Agreement) failed. So they now rely on their USA ‘diplomats’ to brutalise Countries Worldwide with threats of trade sanctions if they don’t implement laws and act against people who simply share files for no cash, no profit, and no gain.

    This is awful news for Vincent V.
    To have this hanging over your head for even longer is utter crap and abuse of due process. I thought trials etc were supposed to be heard as quickly as possible, or forced to be dropped.

    No. This is a travesty of justice, and my sympathy for V.V. has increased tenfold. What a freakin’ sham.

      Actually, this is some major win. They recognized the process is flawed and needs reviewing. I mean, they didn’t take some lousy accusations and evidences thrown at them.

        I’d like to think it was good sign too Ninja, but I’m a cynical old pre-teen (I was accused of being a 12 yr old elsewhere on TF) who thinks that these sorts of delays in the legal process is unacceptable, unfair, and unjust.

        Now Vincent V. has this bs charge and trial hanging over his head for possibly years to come, and the related stress and worry that causes is immense.

        Until someone points out just exactly where the good is in this delay, I’m going to remain bitter, angry and hateful toward the copywrong trolls who clearly want to Rule the World instead of their increasingly profitable little pond.
