Porn Company Rejects Mass Lawsuits, Goes After Torrent Sites

The growing trend for some porn companies is to get into bed with a law firm and go down the mass litigation route against users in the hope of extracting millions of dollars in cash settlements. However, one leading company says that the process has difficulties and is not as straightforward as advertised. So this year, instead of chasing file-sharers they will go after torrent sites instead.

pinkPink Visual is a prominent adult entertainment studio based in Van Nuys, California. Unlike some of its competitors, Pink Visual started providing content online and then later moved into physical distribution. It also provides content for cable and pay-per-view.

Pink Visual’s holding company, Ventura Content, is no stranger to anti-piracy litigation. In February 2010 it filed suit against the owner of Brazzers claiming that so-called ‘tube sites’ owned by the company were offering unauthorized copies of their content. Brazzers went on to describe the $6.75m suit as “‘fatally defective“.

Despite high value warning shots such as this, the growth of both tube and torrent sites continues to be of concern to the wider adult industry. Now, in a move designed to reverse the trend, Pink Visual has just made its 2011 anti-piracy strategy public.

Part of the company’s strategy will be educational, with reminders sent to subscribers informing them of their responsibility not to spread Pink Visual’s content and the consequences for doing so. The company has also hired a monitoring company called Degban to scan the web for infringing content and issue takedown requests.

interestingly, what Pink Visual will not do is enter the end-user mass litigation market. Last week president Allison Vivas said that her company had been approached by law firms specializing in this type of work, but had turned down the opportunity to get involved.

Vivas said she had anticipated that the EFF would get involved and that the courts would question the legal tactics being used. She was of course correct, as the recent Batman XXX case shows.

“It wasn’t as straightforward as advertised,” Vivas said about the model.

But that doesn’t mean that Pink Visual won’t litigate – they will. In addition to going after several ‘tube’ sites, the company says it will also start targeting BitTorrent trackers.

“In addition to taking legal action against some site operators on our own, there are several other companies preparing to file multiple-plaintiff lawsuits against such site operators in the coming months. We anticipate that these lawsuits will be officially announced within the first quarter of 2011,” said Vivas.

While Pink Visual will seek damages, they will also try to force site operators to employ filtering technologies. While it seems clear that this will be a requirement for ‘tube’ site operators, it is uncertain how this will relate, if at all, to torrent sites.

    See youporn.com for an example. Donated free clips for people to freely view and download.

    Then this site links back to their own sales site in case the viewer liked what they saw and wants to see and buy more.

    It can also be a source of good ideas to make better porn.

    When they were forced to show the jury what was shared. I bet the jury would really feel take the side of the smut peddler after seeing what they sell.

    The funny thing is these companies started the warez scene. Smut companies for years used the warez scene to sell their wares. There were tons of warez sites the offered free games, movies and apps and all you had to do was sign up to some smut site.

    The are nothing but a bunch of hypocrites complaining about piracy when they started and encouraged it in the first place.

    Too bad the snake they thought was their pet has bit them. I say reap what you sow scum.

    I will say one thing about porn that’s been on my mind for a while now.

    Their bluray and 1080p rips are just Junk compared to regular movies. Even movies restored from 20 or 30 years ago to 1080p are still better quality then most of the bluray porn out there. They need to consider upgrading their hardware to make better use of high definition. For some reason, I’ve found that the 1080p porn clips from siterips (By groups like KTR) in like .wmv typically have really decent quality; Whereas full-length blurays are garbage.

    And seriously, what the hell is up with all of those bluray movies with Jesse Jane? Got to be at least 15 of them already! Get creative, there are other pornstars out there besides her, most of them without more plastic surgery then Michael Jackson! I swear, Digital Playground is going to ruin everything with them saturating the market with the same old junk.

    Copyright trolls. Got to hand one note of support off to the PV – Good thing Allison reads the news once in a while and probably figured out those chickenhawks are in it for the money and dont give a damn either way.
    But, trying to take down a torrent site never worked out in the past if you arent rich and employed by a 3-letter organization. And even then, its still a cat-and-mouse game.

    Suing the public makes basically everyone a pirate. Thanks to the RIAA, people sympathize with the pirate sites rather than the record companies.

    Pink Visual learned from the RIAAs mistake and are wise to target the site admins rather than the public at large.

    And anyway – this company is a muppet. They can only sue American companies anyway, unless they get the American government to threaten trade sanctions in Europe, like with the Pirate Bay prosecution which was started under threat of santions. I think that even the US gov’t draws the line at running the errands of porn providers.

    Hence – the only ones affected by this are those few trackers that are stupid enough to operate out of the US.

    If these self-entitled mongoloids have half the contention that they advertise, they’re in for a big disappointment. If behemoth movie corporations who have the means to put forth ground-breaking, critically acclaimed major motion pictures continue to fail at even hindering the bittorrent regime, then what chance does some sleazy porn company whom half of the time doesn’t even know what their consumers want have? Pink visual will eventually have three options.

    1. target the really small and vulnerable torrent sites and impress no one
    2. join the rest of the tried and failed clique to cheer at the sidelines like us
    3. retract their statements and proceed to file thousands of lawsuits.

    These guys won’t be appearing here again.

    Leave the pages up with torrent links removed and maybe the magnet links removed. Keep the file hases up though. You can’t be sued for a random string of 40 characters… We can find torrent from those OR make our own magnet links…

    So if one file is used through a tracker, take the whole tracker down? That is equavalent to someone using the highway to do something bad (use it to get away from a robbery, rob bank, etc) so they shut down all the hightways that millions of people use because of that one person

    it isn’t about piracy. It’s about competition. There is a whole adult genre called gonzo, which is basically pro pr0n made to look like amateur, because the amateur stuff is more in demand than the pro junk.
    That’s the real reason they are in an uproar over tube sites, because random people filming themselves at home is more in demand than the broken down plastic broads the industry supplies, and it’s stealing attention away from their product.
    Same as the music industry fearing underground bands recording and promoting their own music online and bypassing the established industry.

    EDIT: I’m a Mod at both TnA and EMP. We received an email today saying the sites were hacked and the owners will not spend the money to fix the security holes and have decided to shut down BOTH sites.

    EDIT 2: For security purposes all the HDD’s have been wiped clean by the owners. They (owners) are not willing to sell the sites. They will not be back.
