UK Rejects ACTA Calls To Criminalize Illicit File-Sharing

Following revelations from a leaked ACTA document that participating countries would be expected to bring in a system of monetary fines and jail sentences for those who share files without authorization, the UK has ruled out such a response. The government has announced that it feels such penalties are inappropriate for dealing with petty copyright infringers.

A leaked ACTA document published by citizen advocacy group La Quadrature du Net revealed the intention to introduce criminal sanctions into the Anti-Counterfeiting Trade Agreement (ACTA) for file-sharing offenses.

The ACTA Chapter 2 Criminal Provisions document (.pdf) stated that “each party shall provide for effective proportionate and dissuasive penalties” to include “imprisonment and monetary fines”.

“The ACTA agreement, by its opacity and undemocratic nature, allows criminal sanctions to be simply negotiated,” commented Jérémie Zimmermann, spokesperson for La Quadrature du Net. “The leaked document shows that the EU Member States are willing to impose prison sanctions for non-commercial usages of copyrighted works on the Internet as well as for ‘inciting and aiding’, a notion so broad that it could cover any Internet service or speech questioning copyright policies.”

As noted by Zimmermann, the ACTA text includes proposals to apply criminal sanctions to “infringements that have no direct or indirect motivation of financial gain”. There are suggestions that “financial gain” could simply be obtaining anything without paying.

However, it seems that at least one country is showing a reluctance to go along with suggestions that file-sharers should feel the full weight of a criminal court. The UK Government has now said that it feels that criminal sanctions are an inappropriate way to deal with this type of copyright infringement.

“Acta should not introduce new intellectual property laws or offences. Instead, it should provide a framework to better enforce existing laws,” a UK Intellectual Property Office representative told ComputerActive.

Currently, personal-use file-sharing on a non-commercial scale is almost always considered a civil offense in the UK. However, there have been exceptions. In the case of the OiNK uploaders (who actually uploaded very little indeed), their cases were heard in a criminal court and they ultimately received fines and community service orders. This proves that when powerful enough people get involved, it’s trivial to escalate an offense way above its standing.

That said, it would be ridiculous to have small infringements dealt with by the criminal courts as a matter of course, so hopefully the UK Government stands strong. Jim Killock, Chief Executive at the Open Rights Group said the Government now needs to make its opposition to these proposals both public and clear to the US and EU.

    i sincerely hope that the UK government isn’t ‘persuaded’ (ie, threatened in some way) by Obama. it’s about time that the USA realised that they are not the rulers of the world, as they think they are, and cant intimidate and threaten other countries, just to satisfy those that have been ‘bought off’ to do the bidding of the entertainment industries. trouble is, we know already how gutless governments are when confronted by powerful corporations and how money talks louder than any individuals rights. just hope this isn’t purely a ‘token gesture’ to appear to UK citizens that their rights are being looked after, before giving in yet again!

    The British government is going ahead with its budget regardless of what US econimists and leaders say. I don’t think the Conservatives really care too much about the US and more about the EU relationship.

    The jails are full enough without over populating them with needless crimes like this. The UK is right on that point. When a person goes to jail 1 of 2 things happen they leave never to commit again, or they learn to be a better criminal. If someone goes to jail for downloading a movie, the leave jail a full blown lets sell as many dvds as possible pirate.

    Seems like a very slippery slope for politicians to start down. The US GAO said there was no real damage from file sharing. On the basis of real damage, what do they say to regulators who look the other way, corporations that file fraudulent financial statements(think MCI), Pharma members who have been defrauding the world for decades. The recent revelations of Oil and Mining shenanigans. And let’s not overlook politicians taking illegal contributions and voting in damaging ways. I can spot a lot of candidates for some jail time before we make room for file sharers.

    Civil Servants are doing the same as the public. Piracy has been going on since the days of magnetic tape for film and audio.

    They will call it disproportionate because they watch the films and listen to the music for free too. Of course they do, and no one got hurt doing it either. The film studios and distribution channels are still there.

    @ #9. by going ahead with the budget that will hurt the lower paid in the Uk more than anyone else, i dont think the Conservatives care too much about their own people anyway. however, i am extremely curious to know what Obama and Cameron discussed during their recent meeting. i bet you a dollar to a piece of crap that copyright/3strikes etc was in there somewhere and was brought up by Obama.

    I must say in any country in the civilized world making the mere act of sharing without any intent to profit financially a criminal offense, in order to protect the profit margins of a greedy corporate entity is or should be a criminal act in itself! Sharing is a natural human response. Modern societies generally regard crimes as offenses against the public or the state, distinguished from torts (offenses against private parties that can give rise to a civil cause of action).

Sure, the US is full of those rotten bastards, and the sooner they starve to death the better, but look around – it’s a sure bet you have an abundance of greedy robber barons in your own borders.     Sanity in the UK not coming from Lord Lucas? Well, doesn’t matter, just like in the US, those sane voices will be ignored.

    I do hope they aren’t ignored though. Sharing is human nature, when there wasn’t internet we shared physical goods and, just like in the online case, not all ppl that shared/copied ended up buying it but the ones that liked it did. Same happens in the digital world but in a massive scale.

    And what’s worse is that it is clear that MAFIAA is losing millions of sales with DRM or limiting releases to regions. Now I ask you, are the file sharers the real culprits for any loss here? You need to be really myopic (if the word exists) not to see the truth here.

In addition to the War on Drugs, the War On Porn, the new War on Health Insurance Scofflaws and minor dust-ups against speeders, students with bad attitudes etc. we will now have the War on Downloading, formerly known as the War on Uploading and the only people to benefit will be those in the prison construction trade. We hoped and hoped that wiser heads would prevail, restrictions would loosen, maybe even pot made legal so we could stop locking up just about anybody involved in a traffic stop. Well forget it. Now even our Pres is in on it. IT doesn’t get worse than that. Personally, I wouldn’t believe our government if they told me the sun was shining unless I looked outdoors first. I always thought Bush looked at the China civil rights crackdown rather wistfully and wondered if there was a lesson for him there. Well now it doesn’t matter if its Bush, Obama or Palin. We are going to all wear political stratejackets in the future. Might as well get used to it.

    that is and always has been my opinion and i have posted saying so on this forum multiple times. if, however, they dont give a ‘flying f..k about copyright’, why is it that it is on the agenda so many times and is the basis of the ACTA proposals instigated by the US? couple that with ‘bought out Bidden’ and his one sided views, makes me think they definitely do give a ‘flyin f**k’, but for the internet control reasons, not the copyright reasons.

    I am an American and 54 years old.When I was young I was one of the protesters at the Anti-Vietnam War Rallies.Since I was young I have been disgusted with our government.I protested and supported many good causes like enviroment issues.I try to vote but I find every election I only cast a vote to stop someone I perceive as not good.For instance I voted for Obama so we would not have McCain/Palin.Every damn election that is all I do.It is high time to stop both the democrats and republicans.Both parties are corrupt and cater to big content/big industry.We need to all try and cast our vote for some independent or other party.Better yet we should have the Pirate Party here and get as many as possible to vote for them.Fuck the Demos and Reps I say.Look at the BS both parties have doen to all of us USA’ers.

    As soon as the new government is elected their first task shall be to purge all the government administration including the FBI the CIA and the defense department.

    Their second task shall be to pass very strong laws, making illegal and punishable by very sever penalties any attempt by corporations and foreign entities to control the US government.

    Their third task will be to restore the constitution in it’s pristine state reinstating the bill of right. This will consist in officially abolishing all the federal unconstitutional laws and banning any states laws that infringe the constitution such as the plea bargain practices, the restriction to the right to bear arms the encroachment of the right to peaceful assembly by repressing peaceful demonstrations or demanding a permit to demonstrate, restoring the unimpeded access to the court and justice to all by stopping the practice of raising attorney and court costs in front of the justifiable.

    They will also have to prosecute previous war crimes committed by former administrations and restore the reputation of our country by doing so.

    Although the ACTA treaty is downright illegal by any American standard, there is a legal clause that states that a treaty “shall be the law of the land” once it is ratified. If the courts do not block it, this is definitely happening in the United States.

    If the majority of Americans knew what was going on with ACTA, they would vehemently oppose it. Then again, if the majority of Americans knew what actually went on in our capitol, they would probably take up arms and march on Washington, DC. Sadly, our big content controlled media is will not ever report the truth. The will continue to paint this as an “issue of national security” and employ typical FUD tactics against people who speak out against them.

    If you voted for Obama, take a good look. His administration is no different that Bush’s. In fact, it may even turn out to be worse in the end. In 2012, I urge to to support a third-party or independent candidate to end the current Democrat/Republican regime. They have ruled for long enough.
