UK’s Terrifying Anti-Piracy Plans Leak

Tomorrow morning Lord Mandelson will present the Digital Economy Bill to the public, which among other things is aimed at reducing illicit file-sharing. According to parts of the bill that leaked today, the legislation could lead to jail terms for file-sharers and unprecedented power for the entertainment industries.

Over the past months the UK government has tried to tackle the issue of online piracy. This has resulted in a proposal from Lord Mandelson, who plans to disconnect alleged file sharers without any judicial process.

Tomorrow the exact text of the bill is expected to be made public, but according to early reports, the legislation will open all doors for a digital police state where alleged pirates will be crucified by private companies.

Judging from some of the plans that leaked earlier today, the endless lobbying efforts of the entertainment industry by anti-piracy outfits including IFPI and the BPI have definitely paid off.

Cory Doctorow has the scoop on BoingBoing and he told TorrentFreak that the information comes from someone “very close to the Labour government” who he trusts implicitly.

If accurate, the new legislation will be a disaster for the privacy of all Internet users while giving unprecedented powers to the entertainment industry. Under the new bill the Secretary of State would be able to pass secondary legislation without Parliamentary oversight in order to protect rights holders.

Three reasons are given:

1. The Secretary of State would get the power to create new remedies for online infringements. (for example, he could authorize jail terms for file-sharing, or create a “three-strikes” plan that costs entire families their Internet access if any member stands accused of infringement)

2. The Secretary of State would get the power to create procedures to “confer rights” for the purposes of protecting rightsholders from online infringement. (for example, record labels and movie studios can be given investigative and enforcement powers that allow them to compel ISPs, libraries, companies and schools to turn over personal information about Internet users, and to order those companies to disconnect users, remove websites, block URLs, etc)

3. The Secretary of State would get the power to “impose such duties, powers or functions on any person as may be specified in connection with facilitating online infringement” (for example, ISPs could be forced to spy on their users, or to have copyright lawyers examine every piece of user-generated content before it goes live; also, copyright “militias” can be formed with the power to police copyright on the web)

The leaked information mainly shows that the Secretary of State will have the power to introduce all kinds of draconian measures without Parliamentary oversight. More details on concrete policy dealing with alleged file-sharers and the proposed three-strikes system have yet to be announced.

This “law” doesn’t matter. Simple fact guys, they wont start locking up 75% of their population along with 99.9% of children ages 13-19.

Main reason is the courts could never handle it.

This will just end up being another failed attempt to stop piracy that wont even slow down its growth. Thankfully, nothing can stop file-sharing.

This isn’t even the government doing it; there’s an EDM signed by 57 MPs including 32 members of the Labour Party opposing this. This is Lord Mandelson – unelected, riddled with scandals and ignoring everyone barring a few content industry representatives (and not even all of them). The Queen’s Speech didn’t mention disconnection, nor did the original summary at commonsleader.gov.uk, but it has mysteriously creeped in since then.

Perhaps the Pirate Party needs a Corrupt-politician-finder-general? Although the problem doesn’t seem to be finding them.

seems to me that all invasion of privacy rights are to go, along with being ‘innocent until proven guilty’ as well. coupled with the introduction of a police state and things should do the UK government proud when it comes to election time. just hope that when their is a change of government, these rules (if they come in) will immediately be quoshed under human rights grounds, if nothing else. as for mandelson, if this isn’t proof of what happened whilst on holiday in Greece, i don’t know what is. how do you know when this pr**k is lying? look to see if his lips are moving!!

The simplest reason is that people need to start paying for what they own again. Can you blame them? Pirates have thrive on people’s trust and sympathy. We tried to give them their privacy and how did they thank us? By creating dozens of torrent sites with which to circumvent payment. An economy in which half (or even a quarters of people) steal things off the internet is simply not viable one. Nor does it endear itself to Britain’s artists, movie industry, etc. Anyone who creates or wants to create content faces a huge threat from piracy, and that’s why something must be done about it.

Rest assured you have nothing to fear if you pay for your things. They are only concerned with catching people who commit infringements and those who promote it.

I doubt this law would exist if it weren’t for how out of control piracy has become. How many torrent sites are there? Dozens im guessing. How many people use bittorrent and other services to acquire content without contributing to it’s creators? Studies have shown that close to half of the data transferred on the internet is piracy. Anyone who thinks that content just falls out of the sky for them should remember this law next time they think that there is no harm in not paying for things.

1)They don’t need to involve the courts in order to send people to jail. (no right to a fair trial)

2)They can be given the power to monitor your internet activities..even if your not a pirate…at any time…without a court order. (an invasion of privacy)

3)They can force ISPs to send anything that is uploaded to a copyright review law firm before it actually goes onto the internet. (no freedom of speech)

Reduce copyright protection to 3 years max on all music,movies,tv and maybe then people will respect it. But then again with laws like this people will just laugh at the music industry and hopefully stop going to the cinema and stop buying music, use vpn and other ways to hide what they do online.That is if they can force the ISP’s to spy which i believe is illegal in the EU.

Well shouldn’t it be legal then if the internet is being used efficiently? It would be great for content to be abundant rather than limited. If content was limited, I would probably never have any tv or video or audio. I have been pirating since a kid on Kazaa Lite K++. I remember how the mafia corrupted that program and sued all these people. I said at that point that I will not support criminal organizations such as them. Did they ever get in trouble for corrupting Kazaa? I don’t remember anything if they did. Anywho, I will encourage everyone I know now and in the future to pirate everything they have such as music and audio and whatever else they would like and to stop supporting the cartel. I would any day rather have pirate goods that actually work rather than crap that doesn’t on my pc. I would also rather have stuff that won’t take over my pc rather than the rootkits the mafiaa puts out.

I’m not too worried about this, there are only have around 70 days left in the current parliamentary session and a lot more important legislation to get though (as well as a reform bill if the backbenchers press hard enough).

Without Mandy in the commons to try and push this though and with the Government looking at a massive electoral defeat I can’t see Labour trying to make many of their supporters criminals.

This sounds way too extreme to be true. In other hand media industry has been throwing so much money into getting rid of filesharing and gaining back the control that was lost due internet so nothing is impossible.

One thing is certain: if people have been expressing their anger in the web so far then this will bring it to the streets. Scary thought but in some way it would be fun to watch how government manages to screw himself in the whole new level.

Also i expect the priateparty soon to have a loads of new votes thanks to this.

BTW, given there’s only a month or so of parliament sitting left before it has to dissolve for the general election, and the opposition want to use every opportunity to damage Labour before the election, it’s highly unlikely that any but the most mundane of all the bills mentioned in the Queens speech will get passed.

This one doesn’t stand a cat in hells chance, but Mandy will save face in front of his industry chums by saying “Well at least I tried”.

Who really cares, everything in the real world is so slow and as long as they stay one step behind what difference does it make… so the filesharing revolution started with Napster in 1999 and in 2009 they are trying to pass a bill.. which probably will take a few more years to implement. As long as tech stays 10 years ahead of the real world then it will never be a problem.

Good. Good. I’m just waiting for some country to implement something like this. The chaos it will create will be awesome. A lot of innocents will be screwed though, that’s a bad thing. But if this is what it takes to get people to wake up and really do something about the media industry and to deter other counties to implement anything remotely similar, then those screwed people will not be screwed in vain. I still believe that content creators, if given the choice, would still rather have people see their work than not see it at all.

If, for example, I have no money, I clearly will not be buying a movie, game, cd, etc. Now, if I still have no money, but I choose to pirate it (and therefore expose myself to it), I clearly will not be buying a movie, game, cd, etc. I clearly haven’t spent money either way, but I have been exposed to their content. Now, perhaps later, when I do finally have money, I would be more willing to buy the next rehash of IP that gets released.

Although, I am lying to myself a little bit. I wouldn’t be more likely to buy a DVD, but to make a greater effort to get to the theater to see the next rehash. Before my discovery of filesharing, I rarely bought DVD’s. A matter of fact, you’ll only be able to find a few DVD’s in my house (and these were ~$5 used DVD’s from the bargain bin at that).

If I never got a chance to go to the theater and see a movie, I wouldn’t wait for it until it came out on DVD, I would wait for it until it came on a television channel (like TBS, TNT, Comedy Central, etc.), hence why I have such a low number of DVD’s. It was most often years until the movie reached TV, and then I would say to myself “Gee, I remember this movie came out a few years ago, but I never got a chance to see it!”.

I was (and still am) an avid movie-goer, however. I WANT to be able to see movies on the big screen in HD with great surround sound. Circumstances just sometimes present themselves that prevent me from getting to the theater. When this happens, I will bypass the multi-year wait for the movie to come on TV, and instead grab a copy through filesharing.

Believe me, the industry isn’t losing my money when I download, but are in fact still getting some of my money, when I go to the theater and buy snacks, pay for my ticket, etc.

offering internet access is risky, but tunnelling thro the net to link other similar hot spots around the country wud be good.

just think of what we could share outside of the internet proper if thousands do this. Implement a mesh system where appropriate, and even drill through neighbours walls for cat5 cabling, and get them to do the same. Later when there are enuf nodes, anomyous proper net access could be layered on top of Tor, exited through vpns.

The funny thing is when you have a look at the majors’ business model.

Compared to the production costs, most movies create a 2 or 3 times more important income.

“Honest” industries target 3% benefits. Meaning for 100 as income, they consumed 97 to make 3.

Now have a look to those industries (big movies, big studios) and see their margins. This has a name : speculation; this has a tool : advertising overfeeding.

So talk about lack of morality when people download stuff for free ? I’d say have a look at your dealer’s methods first maybe.

Personally, I think the music industry should offer a VPN service – where for a monthly fee, you could download as much music through their VPN for free as you like – it would be a nice easy to set up way for them to introduce a flat rate service – the costs would be minimal and they wouldn’t need to worry about distribution models etc as the existing sites such as TPB would do it for them!

I have never bothered with file sharing. I don’t buy music or video or any other kind of entertainment software as I’ve absolutely no interest in it. I read books and I can play music for myself, for free, if the mood takes me. Moving images just make me feel mildly dizzy and disorientated.
This issue is, as usual, being used by the UK government (who are a disgrace to humanity), as another lever to backdoor their plans for a total surveillance state. Why they think this is such a good idea I cannot fathom. Why don’t they go and live in China if that’s what they like so much?
Unfortunately large numbers of people in the UK are more than happy to accommodate themselves to life in a totalitarian police state. Their credit cards and relatively pampered lifestyles notwithstanding, many are less philosophically sophisticated than the average peasant, and care for little beyond bread and circuses.

Disregarding the few trolls, there is alot of passion here, the government would be insane to pass these new laws, there would be anarchy! Not to mention the complete disregard for human rights.

Don’t kid yourself that your any better off in the United States, since shortly after 9/11 all traffic coming, and going to all major hubs has been duplexed. This is why the head of the NSA put the amount of data they were recording a month at petabytes(PBS “The Spy Factory”) A raw stream of information is copied over to the NSA’s computers where it is run through the machines. E-mails, texts, and voice conversations that get flagged then get a listen by analysts who either pass it on for further review or mark it as non-threatening. The key being that a warrant is not required until that first human analyst looks over it. Even then they can hold off obtaining a warrant for quite some time under new FISA terms. That’s if your a citizen. If you can be classified under section 802 of the patriot act your rights pretty much go out the window. They already have the system to look at everything you’ve ever done that travels by unencrypted packet. They’ll just hold onto that until they need it, if they never actually read it then they don’t need a warrant unless the supreme court rules differently.

Uhm, printing a book manually by hand and transporting it is much harder than downloading something off a .TORRENT. Internet piracy is much, much more user friendly and thus much more of a threat. In case, it never occured to you, with bittorrent everyone serve’s as a distrobuter, where as in your example there is only one distributed which is much less efficient. Books could not be converted into a digital format, effectively marginalizing their creators.

People who illegally download music and films could have their internet connection slowed down or cut off altogether under new legislation.
New law to curb illegal downloads .The Government said its Digital Economy Bill would ensure the UK was at the “leading edge” of global online industries.

Under the proposed legislation, Internet Service Providers (ISPs) would be required to notify users accused of online piracy.

They would also have to record how many times each subscriber receives one of these notifications.

This would allow the copyright holders to apply for a court order to get the name and address of serious repeat offenders so they can take legal action against them.

But the Bill, announced in the Queen‘s speech on Wednesday and published on Friday, also makes provision for the Secretary of State to direct communications regulator Ofcom to develop tough sanctions for illegal file-sharers.

These could include bandwidth capping – where the user‘s internet connection is slowed down – or temporary suspension of their online account.

The Bill would give the Secretary of State power to require ISPs to impose these technical measures.

Anyone who feels they have been unfairly penalised could complain through a “clear and effective appeals mechanism”.

The Bill also includes a power to amend copyright legislation to deal with any new technologies that emerge in the future.

I feel so sorry for the artist, actors and the companies losing revenue because of illegal file sharing (NOT).
It makes me sick to watch programmes like MTV cribs and see some of the poor singers (some of them second rate) living in such poverty with thier small houses and thier 20 year old ford escorts, no swimming pools or cinema rooms.
living on the minimum wage.
Life must be so hard for them.
I for one would agree that file sharing should be made illegal,but durimg the last ten years has there been really been a great decline in record sales and lower cinema goers.
In fact cinema audiencies have grown and when you see million pound record deals being signed it m

The statement was based on how the UK would like the Telecoms Reform Package to be interpreted by Member States (MS) and contained a few paragraphs twisting the intent of ammendments to Article 5(3) of Directive 2002/58/EC with regards to informed consent.

Today I have been sent the final statement which is now supported by 13 Member States along with some explanations of what this all means. My source within EU Parliament states:

The relevant part, not crystal clear but presumably meant to bless the current practice of silent placing of 3rd party cookies etc, is: “However, as indicated in recital 52( a) {66} , amended Article 5(3) is not intended to alter the existing requirement that such consent be exercised as a right to refuse the use of cookies or similar technologies used for legitimate purposes.”

They go on to explain that the lobby pushed the statement to be published on behalf of the entire Council (as mentioned above) but that the final statement has only been made on behalf of 13 states after Council refused to accept it on behalf of all member states:

However the introductory text to the statement is almost a carbon copy of the draft UK statement I received over a week ago, so it is clear that the UK have been the driving force behind the declaration.

My source goes on to explain that from a legal standpoint the statement is “without value” as all member states are required to change their national laws to reflect the revised text of Article 5(3) and also enforce those laws. I have also been assured that should a case go before the European Court of Justice relating to issues covered under 5(3) the EU Court of Justice will not take such a unilateral statement by some Member States into account, further:

EU law applies equally across the EU, not differently in different MS. It’s also bad practice – all MS adopted the text unanimously almost a month before the statement and the statement was issued in connection with another Directive.

The only stake the statement has in the overall gameplay is that it:

may give the lobby some leverage when they proceed to discuss the new text and its implementation with national DPAs etc, so the focus is now shifting on transposition of the revised text, possible Commission and DPA guidelines and ultimately enforcement.

In closing, I would like to add that I am dismayed that the UK Government is displaying such blatant regulatory capture even when dealing with matters in the Council of Europe. It has been suggested to me that the IAB may have initiated the call for this statement from the UK Government, who are already the subject of infringement proceedings by the EU Commission for failing to protect consumer’s rights to privacy with regards to Phorm Inc.’s behavioural advertising technology.

It is clear that the UK Government place a higher priority on the convenience of companies to be able to make money from personal data than the fundamental right to privacy of the people who elected it. I am relieved that this statement did not win full support of the Council and represents just under half of the entire Council of Europe – but it is clear that the UK Government have allies within the Council and the public will need to continue lobbying very aggressively in order to continue to be heard.

[UPDATE]

It would seem that Commissioner Vivian Reding is displeased at the attempts by the above Member States to change the interpretation of the ammendments to 5(3). In a speech given yesterday on the matter the Commissioner stated:

Second, the question of cookies. Now the Commission was, like Mr Harbour, surprised that certain Member States appeared to call the agreed text on cookies into question. Let me be very clear: we agreed with Parliament, and we believe that the final text is unambiguous. First, there must be clear and comprehensive information to users on the basis of which second users must give their consent. That is that and that should be applied now in the Member States. I do not appreciate it that after everything has been agreed, some like to manoeuvre in order not to keep 100% to the agreements pacta sunt servanda in politics.

The Commission seem to be very clear on the matter that informed consent must be obtained, regardless of the statement by the 13 member states listed above.
