Vagueness About ‘Pirate’ Domain Seizures Disturbs US Politicians

Domain seizures of alleged pirate sites continue to be criticized in the United States. Two of the most outspoken politicians on the issue have asked the responsible authorities about the legitimacy of the seizures, but received insufficient answers. In a response both politicians characterize the seizures as censorship and claim that the authorities “demonstrate little if any understanding of the Internet’s value and function.”

The actions of the authorities were met with disbelief by the sites’ owners and their millions of visitors. But those directly involved weren’t the only ones complaining.

Several legal experts believe that the domain seizures may stifle free-speech, and have further pointed out that the lack of due process could be a violation of the U.S. constitution. In this assessment they were joined by several politicians.

Two of the most outspoken politicians are U.S Senator Ron Wyden and Rep. Zoe Lofgren. In an attempt to get some much-needed answers to their questions, they asked the responsible authorities to explain how effective the seizures are and whether they are legitimate.

This week they got a response, but not the one they were looking for. Although Homeland Security’s ICE unit finally responded after three months, the politicians found the answers to be insufficient, as all the major issues were simply avoided.

“It is hard to imagine that the administration can effectively deter online copyright infringement when they refuse to answer basic questions regarding what they believe constitutes infringement,” U.S Senator Ron Wyden commented.

“While the departments finally responded to questions that I sent them more than three months ago, the responses from ICE and DOJ reveal a single-minded determination to stamp out online infringement and demonstrate little if any understanding of the Internet’s value and function,” he added.

One of the hot topics has been the seizure of the Torrent-Finder website, a meta-search engine that doesn’t host or link to any copyrighted files directly. We previously pointed out that many mistakes were made during the investigation into this site, and Wyden and Lofgren specifically asked why this site would be deemed to aid in criminal copyright infringement.

How is Torrent-Finder different from other search engines like Google and Bing, and how does criminalizing hyperlinks effect free-speech, they questioned. But answers didn’t come.

“Particularly troubling is their refusal to explain how linking is different from free speech. Given that hyperlinks in many ways form the foundation of the Internet, efforts to go after one site for linking to another site – which the Administration is currently doing and the Protect IP Act would expand on – threaten to do much more than protect IP,” Wyden said.

“There are many actions that we can all agree the Administration can and should be taking to crack down on counterfeiting of U.S. goods and the illegal sale of U.S. IP products that don’t involve advancing novel and unsupportable theories like holding sites liable for linking,” the Senator added.

Rep. Zoe Lofgren was disappointed by the non-response from ICE as well, and characterizes the domain seizures as an act of censorship.

“ICE’s response fails to address legitimate concerns about ‘Operation In Our Sites.’ Domain seizures without due process are a form of censorship. In this instance, our government has seized domains with nothing more than the rubber stamp of a magistrate, without any prior notice or adversarial process, leaving the authors of these sites with the burden of proving their innocence,” she said in a response.

“While this might be enough for the seizure of stolen cars or knock-off handbags, it is not enough for web sites and speech on the Internet. It is disturbing that this administration is treating them the same,” Lofgren added.

The response from ICE shows that they have no intention of explaining their actions, and that they will continue seizing domains without answering some of the core questions that have been asked. And that’s not all – things may soon get much more disturbing.

Earlier this week we reported that the U.S. Government is working on a revamped version of the COICA bill, named the Protect IP Act. This bill is designed specifically to make the domain seizures most effective, and give the authorities even broader powers such as censoring search engines and ordering ISPs to block websites.

Last time around Senator Wyden was able to stop COICA from being implemented, but with a lot of backing in Washington and Hollywood the Protect IP Act might be harder to stop. There’s no doubt that yet more questions will be asked in the coming months, but it is doubtful that meaningful answers will follow.

        Relax, if they block things at the domain and the ISP level the internet will heal itself around what they damage – off the top of my head one solution would be to have p2p web servers (freenet being an example). All it takes is one person to solve the problem, then everyone benefits

      Easier to find stuff on Google sometimes than sites own search features. I think that’s the fight we’re all looking forward to isn’t it?

      You may care to note that ICE ignored all questions about RojoDirecta. Totally unacceptable attack on a Spanish website, only spotting and linking, who were found innocent twice in court.

      I’m not gonna lie, I try and ignore half the things any politicians say because frankly it’s ridiculous. I can listen to random idiots (I hate to use that word though) on the street spew the same rhetoric and there’d be no difference. But wtf?! Dude how have I not heard of that guy?         I have been saying a lot of what he is saying for years.  It’s really kind of funny to watch how some of the main stream media, has a difficult time dealing with such honest answers.  It’s also very sad.  Truth, ESPECIALLY in our media, should be one of the MAIN things we uphold, but in reality, it seldom is.

        We need to pull our heads out of our asses and do something about our loss of freedom, before it becomes harder and harder to be able to.

          On topic though, I’m glad there’s a few politicians who find all this not quite on the up and up and are concerned about our freedoms, particularly freedom of speech, which all this apparently seems to bulldoze right over. Censoring websites, seizing others. It saddens me to think how many people will ignore this issue or just go along with it because of the new terror words, “piracy” and “copyright infringement”. I don’t care to label this as a Democrat or Republican thing, it’s being pushed by those two groups but it’s being done so in order to appease corporations and the lobbyists they hire to push their agendas. When the government cares more about doing things for the benefit of corporations than it does for the people who it’s supposed to look out for, we have a serious problem. And when people can be fooled into giving up their rights with a bit of fear mongering (terrorism, piracy, etc.), it saddens me, in addition to showing we have a serious problem.

          I for one hope these two manage to get this thing stopped in it’s tracks. Just look, they ask questions and aren’t even receiving legitimate answers to their queries. That’s not just wrong, but ridiculous. And that ICE and DOJ are so gung ho about seizing “pirate” domains bugs the heck out of me. “No intention of explaining their actions, and that they will continue seizing domains without answering some of the core questions that have been asked.” That part in particular is very disturbing. I’m paying taxes which fund that kind of BS? Really? There’s nothing more important for them to do? Sweet buddha! (That’s my go to term for “how f*cking ridiculous”). Let’s spread the word on this bill and these actions and hope the people wake up. Because by the time you know it, we won’t have any freedoms left. Which may suit some, but definitely doesn’t suit me.

           I’m a Texan, but I’m not too keen on Ron Paul. Currently anyway… I do plan to do some research on him and the other candidates. Though, in a way actions speak louder than words. What they preach may not be what they seem to be. Look at Obama. He preached as a senator against many things when Bush was in power, and look at what he’s doing now. Doing a complete 180 on many things during his senate years. Many politicians have lost my trust for lying to no tomorrow, but that’s their job.. lie to get votes, then do stupid shit while having power. But don’t forget either, since the government took over public education, kids IQ’s have been getting dumber and dumber and crap that its getting deplorable… but that’s another matter.

          Who people vote for is not really my concern. If they like someone, so be it. I have my own opinions and quite frankly, Obama did not win me over, despite the fact I couldn’t vote at the time. Makes me glad I’m not registered to either party because at this point, BOTH sides are stupid dipshits that can’t do things right anymore. Wyden and Lofgren may be on to something and I commend them for that, but it’s going to take a LOT more to sway anyone in government since we still have that debt issue they keep bickering about…

          I would think that Paul has been consistent with how he votes, given that the 14th district (his) keeps voting for the guy.You make some good arguments.  Hell, I didn’t vote for Obama and thought he had done great on the campaign trail.  It’s mainly his administration, but Obama is just as implicitt in abusing the Constitution.

      By these people you mean the two politicians who ACTUALLY care about freedom of speech? Because that’s what this is about. Protecting people’s right to free speech. As usual all you focus on is copyright infringement, without looking at what censoring one thing leads to. If you censor/block one thing just to please one group, then you’ll have to do it for another group, and so on and so forth. Til eventually there is no speech, because it’s all been censored. Freedom of speech is protected by The Constitution. And that might mean d*ck to you compared to protecting “your” copyrights (which aren’t yours because you technically don’t create a single thing), but that is the law of the land.       No, actually, the one who is being an ignorant dumbass would be you there. A “torrent file” is nothing more than a set of numbers identifying a file. In the same way a library index or the cover page of a book will identify said work.

      If torrents are illegal, then so is mentioning the name of any copyrighted work sufficiently well to uniquely identify it. Get it now? You could re-engineer the bittorrent-protocol to use the Imdb classification and get roughly the same result, possibly with a bit more difficulty in sorting.

      So for God’s sake, Jack….at least stop embarrassing yourself by continually posting ignorant crap without relevance. What’s next on your failure mill? Learning to read and write endangering copyright protection?

     If the Dept of Homeland Security and their ICE subordinate considers itself able to avoid answering questions by elected representatives of the people, then to whom are they answerable?

    Do they truly consider themselves beyond reproach and above the law?

    US Departments and their agencies are treading a VERY dangerous line here, and it wont augur well for the general public if they’re permitted to continue in this vein.  There are GENUINE concerns of fascism emerging in the political actions of the USA’s governmental bodies – and it MUST be stopped NOW.

    ICE basically dodged answers throughout the letter and they should feel deeply ashamed. Their legal position appears highly suspect and this correspondence shows it.

    I commend Wyden and Lofgren for their engagement and asking very sensible and well considered answers.

    I ask them to keep going on this, to keep pushing and summoning homeland security heads to Congress to ask these questions again and to push for an admission that ice were wrong and they won’t be allowed to get away with it. We all need to write letters to the editor asking why ice failed to answer and acted in a way that seem in conflict with the interest of the comunity and the people who pay the ice’s wages.
