Anti-Piracy Law Firm Will Publicly Humiliate The Clergy, Police & Arabs

A German law firm will hit a new low next week, even for companies engaged in the file-sharing settlement letter business. The company says that from September 1st it will begin publishing the details of individuals it claims have infringed their clients’ copyrights by sharing hardcore pornography online. To make matters worse, they’re threatening to target churches, police stations and Arabs first. Neither the Pirate Party nor Anonymous are happy and now the latter are threatening action of their own.

When the RIAA embarked on its file-sharing settlement letter campaign last decade it unwittingly created a monster. Although the music industry group discontinued its actions in this field some time ago, dozens of other companies – notably in the porn business – followed in their footsteps.

The exact figures aren’t clear, but several hundred thousands individuals have been pursued for cash settlements for file-sharing in the United States and around Europe the problem is even worse. Germany has been hit by the trolls particularly hard, and it is from there that a new horror story is developing.

In a statement on its website the Urmann law firm explains that a large number of the file-sharing cases it is involved in end in settlements, a situation that is “often more useful than going through the courts.”

However, the company says that if necessary it will go to court to get justice for its clients, but there are things it can do to persuade stubborn individuals to pay up instead of having a hearing.

Starting September 1st, Urmann says it will begin publishing the personal details of Internet account holders it claims have violated their clients’ copyrights. The exact number is unknown, but Urmann previously claimed to have the identities of 150,000 individuals.

According to comments made by the law firm to Der Spiegel, the bulk of the firm’s clients aren’t record label owners either – they’re sellers of German hardcore pornography.

But the worst is yet to come. According to comments an Urmann insider made to Wochenblatt, the law firm is planning to target the most vulnerable people first – those with IP addresses registered to churches, police stations and – quite unbelievably – the embassies of Arab countries.

Urmann insists that it is completely entitled to take this action because the law is on its side. The company is leaning on a 2007 Federal Constitutional Court ruling that deemed it legal for law firms to publish the names of their clients’ opponents in order to advertise their services. However, there is some debate if the ruling applies since it was targeted at commercial opponents, not regular citizens.

Bernd Schlömer of the German Pirate Party describes the law firm’s threats to undermine the privacy rights of individuals as “shocking” and says that Urmann’s actions could be construed as “legal coercion.”

Perhaps not surprisingly, the loose-knit activist collective Anonymous are also unhappy and are hinting at action of their own.

“A law firm has announced that shortly it will publish a so-called enemies list on the web,” the group said in an announcement.

“Once the list of Urmann and colleagues is online, we will take care of it!”

Urmann courted controversy last year when it started an auction to sell the unpaid settlements of 70,000 alleged file-sharers to the highest bidder.

          Just imagine some of the victims going ballistic on those extorting “lawyers”! And it doesn’t have to be exclusively Arabs: some Christian fundies can be just as rabid as the Islamists, and some exposed policemen are carrying firearms and would also have quite some power to screw up the live of those lawyers.         I still don’t understand how or why an attack from a small cell of people gives everyone such a “get out of jail free” card to racism. Even some of the nicest people I knew turned into full-blown racists after 9-11 occurred, and I had to drop my head in shame of them.

        The few don’t always represent the many. If you want to hate an entire race, then don’t be shocked if they hate you in return; however, be surprised if they turn the other cheek and ask forgiveness for the actions taken by a select few, and actually mean it.

      It’s not even ‘legal’ here. Since an IP address, by settled law in most countries, does not point to a specific person, doing this is akin to defamation. In some countries, defamation is a CRIMINAL offense.

          Um, have you read the article? There are no dynamic IP’s in this case, these are static IP’s registered to police station, churches and embassies. And at least in police stations I suppose all network activity by users is being logged, so by comparing the timestamps of the claimed infringement with these logs it could be possible to tie a person to the download.
          And even if that’s not possible, the claimed infringements would still be linked to police stations/churches/embassies, which would be embarrassing for everyone employed there.

        All they are saying they will do is file a suit against you, and then
      publish the details of that suit, saying that you are named as a
      defendant being accused of downloading porn.  Of course, it’s only true because they are accusing them.  You could still make a defamation case if the accusation were made in bad faith, i.e, that they knew before making the accusation that it wasn’t true.  Presumably, since they plan to take them to court, at least in theory, the accusation is being made in good faith.

      Kind of a bullshit argument, but at the same time, if they couldn’t publish this, the police could be accused of defamation for telling newspapers when they’ve accused someone of murder on the same logic, in both cases, good faith is the important standard.

    And there is no indication the internet companies gave that info away – hence they go after generic domains found on sites like http://whatismyipaddress.com when typing numbers.

    i dont think that the way to go here is the Anonymous way. surely governments are not bribed so much and/or not so totally blind as to be unable to see the damage this type of company and the actions taken will do/is doing? the way to address this must be via a clampdown by the authorities on what they know is nothing less than an illegal practice, a shakedown of what could be thousands of innocent people, all on accusations using IP addresses as ‘evidence’. i think however, accusing the police and the clergy could produce some really interesting results. by that i dont mean the release of lists of people in those professions being accused, i mean the fight could easily backfire!

    this is the best outcome, publish and be damned, if it ever gets that far, and i hope it does, because this will show how futile it is to try and prosecute on isp alone. you need physical evidence, in your hand. i cannot believe the stupidity in the thinking that this should be so, we all want a free and open internet, this is the way to go about it. besides, i want to see what sort of porn the pope likes when he visits Germany, and ambassadors download while on the taxpayers money they lavish in lush residences in the most prime buildings in the city. bring it on

      that’s what it should be. the trouble has been that the judges in so many of the cases that have gone to court have just basically rubber stamped the conviction after believing everything from the prosecution side when the evidence is unprovable (an IP address only) and nothing from the defending side, even when the evidence is backed by proof. i hope there will be a few of those judges targeted themselves now. that could make life very interesting!!

    This won’t happen. Germany has some of the most stringent personal information protection laws with regard to the Internet. The appeal will disallow it, their mentioned 2007 precedent wasn’t applicable.

    Most people definitely fear from doing anything to those lawyers, but don’t take it for guaranteed. Just think about the “log murder” in 2008… A stupid kid threw a piece of wood log on the highway, killing a 33 years old mother. There were several copycats – even after his life sentence was announced (and widely reported by the media). Or think of the several school shootings happened there, for reasons like bullying… This would be definitely a thing to consider for those lawyers that engage in such dirty business…

    I’m against any kind aggression, but will laugh out loud, should something happen to them. Like their computer hacked by a victim or Anonymous, maybe CP planted on it or a lot of copyrighted stuff uploaded through their WLAN… They would just get back what they gave to lots of people.

    Of course I don’t encourage anything illegal, I just tell what I think more than likely to happen eventually, what these lawyers seem to overlook or ignore… And that I’ll only laugh at them…

    I am not surprised this is happening in Germany when the infringement law there is based on Guilty until you prove yourself Innocent. As anyone can charge people with any bullshit they want then people are screwed when IP tracking data proves nothing one way or the other.

    I would in fact like to see them publish this name and shame list when then their butt would be toast. Beyond many following libel cases then the EU has always been good on data protection laws even down to cookies. So there is no way they can start streaming off people’s names and addresses in public without the axe soon falling.

    Then them targeting Arabs would awfully racist. If they want to target embassies then they should be publishing them all and not just those from Arab countries. I can only think that statement well highlights what an idiot this person is.

    Well go ahead an publish if you are that stupid. It would only prove yet more evidence that file sharing happens everywhere in every location and job. Sharing is caring and the people want to be entertained.

    Touch of deja vu here? Isn’t this very reminiscent of “speculative invoicing” (extortion by another name in my book) practised by the now defunct ACS Law firm and others previously here in the UK? That was very firmly sorted in the UK courts. Surely German courts will take the same view?
