Canada Fast-Tracks Draconian Anti-Piracy Law

Following pressure from the US Government, Canada is preparing to ram through a revamped copyright bill that will have disastrous consequences for consumers. The Government is hereby ignoring the public consultation held last year, where many Canadians spoke out against harsher copyright legislation.

In 2008, Canadian lawmakers proposed a new anti-piracy bill dubbed C-61. The plans met great opposition from the public and were eventually wiped from the table later that year prior to the federal elections. Last year, the Government decided to consult the public on what they would want from a new copyright bill.

In that consultation the public made it clear that stricter copyright laws are not welcome. However, it seems that this has had very little effect as Canada’s Prime Minister is about to announce a ‘new’, even more draconian law. Michael Geist, prof. E-commerce Law in Ottawa, described the bill as “the most anti-consumer copyright bill in Canadian history.”

The owner of isoHunt, one of the largest BitTorrent sites that will be directly affected by the law, is rallying opposition against the new bill. IsoHunt’s Gary Fung is warning of the effects the bill will have on Canadians.

“The effects of a draconian copyright bill in Canada can be far reaching. Things Canadians take for granted, like copying your music from your computer to your music player and vice versa, can be deemed illegal with this new bill,” Gary told TorrentFreak.

“ISPs can be forced to handover private information of users on a whim without due process. They may be further encouraged to throttle P2P traffic, even for entirely legitimate uses like game files distribution. The new bill also is unlikely to provide fair exceptions for breaking DRM for purposes that doesn’t violate copyright, which unfairly prohibits one’s tinkering with electronics he owns,” Gary added.

Gary’s warnings are justified. Although it is not completely clear what the details of the new bill will be, it is expected that it will be the Canadian equivalent of the US Digital Millennium Copyright Act. This means that copyright takedown request become a censorship tool while consumers lose several ‘fair use’ rights.

IsoHunt is currently hosted in Canada and involved in a lawsuit against the Canadian Recording Industry Assicoation (CRIA). If this new bill is passed, this would mean that isoHunt’s chances of winning that long standing legal battle will decrease significantly.

Gary further told TorrentFreak that he is worried that the new bill will lead to increased censorship by copyright holders. “We need laws that support our neutrality and our ability to operate a search engine free of censorship and unreasonable constraints,” Gary told us, adding that the new bill would provide the opposite.

“We’ve seen record labels sending us takedown notices mixed with links to porn, and the new Canadian bill should provide recourse against rights holders providing false identification information. Unless music companies are really switching to distributing porn,” he added.

Once again, we have to encourage all Canadian readers to speak out against the bill before it’s too late. Although the Government ignored the people’s opinion during the consultation, doing nothing will mean that the war is lost for sure. Michael Geist encourages all Canadians to write a paper letter to their Member of Parliament and provides some further pointers.

    If what Gary says about the law potentially where “ISPs can be forced to handover private information of users on a whim without due process.”, it kind of contradicts the beloved Personal Information Protection and Electronic Documents Act (PIPEDA) that we have here in Canada, where companies are not allowed to pass information to third parties without consent of the individual or a court-order.

    If they create a loop hole here, then that legislation becomes nothing more than the paper it was written on.

How the hell are they going to know if I transfer my music onto my ipod from my computer? And to enforce such silly laws? What a joke! More than half the people in Canada are going to be fined, thrown in jail, or have their internet cut off if they really try to enforce such garbage. I don’t know one person (elderly and children excluded) that has never taken at least one song from limewire, skydownloader, torrents, etc.. Has anyone ever checked Harper’s ipod to see what he has on there? Or the rest of the government for that matter. Actually, come to think of it, they probably pay for their music…with our tax dollars.

    It’s likely the bill won’t pass but at the same time this enrages me. Especially the horse crapp about not legally being able to modify your own console you purchased. Last time I checked I bought consoles, I didn’t rent them. I actually bought a couple DVDs last week. I’m either going to return them or download several to make up for it. I won’t buy another DVD or music cd again if this passes. The stupid governments and record labels need to think that maybe, just MAYBE they are doing something wrong. There are too many arguments for this, such as the ol why buy a whole cd for 2 good songs on an album and such. You wanna get paid then do your job right or consider yourself not getting a raise… Or fired!

    While writing a paper to the government might not be a totally bad idea, paper is just paper and words of protest are just words. The real thing we all should be doing (and which we are) is working on new copying and sharing technologies and forming great communities.

    No matter what they law says, it will always be outdated relative to technology. They wanna scan our IP addresses? Okay. By the time the law passes and all the processes are in place, IP addresses will be irrelevant.

    Yes, I love downloading my tv shows, I haven’t had cable in over a decade. Even if it undoes several privacy protections. Even if we already pay a tax for a right to do something this will make illegal, again, or more, or whatever. This is lunacy.     No proof will be required, they can just send complaints and get you shut off. They can hand your info over without a warrant without proof.

    I don’t think you get it, some of this bill, potentially, is WORSE than the us.

    Beyond the bill, it shows that this government is Rouge, and doomed. Doomed governments do some pretty f*cked up sh*t, ask Bush, before 9/11 there were several scandals linked to the whitehouse and his approval ratings were the lowest ever, until Obama of course.

    We need to get up and do something, send your letter, go get a face to face with your MP. I work for my provincial government, and live in the capital city, I see the Premier most weeks down town and can just run up and corner him, maybe with a camera if i can get one.

    Take this to youtube, contact by phone, letter, email, in person on camera. If you can afford it, bet your ass there will be a march on Ottawa.

    Even if this thing goes through in full force, people here will just resort to he same tactics as those in other countries with these types of laws. Staying out of the public torrent channels, using “invite only” private trackers, and/or a VPN service. In my case, I can rip music directly from sites like Grooveshark and Deezer so I rarely even touch torrent sites for music.

What’s the point of purchasing a disc that’s got a built in dictatorship? If this bill passes I will never buy a CD or DVD again.

    Artists/actors/writers etc. all need a donation site. I have NO problem supporting their work, but I will NOT fund the distribution companies and media industries that are lobbying to strip the people of their rights.

Let them build jails for 10% of the population, and financially ruin 20% of it, if that’s their intention.

    I find it amazing how government officials waste there time with this. This is an insult to people because they rather take bribes from the industry than help the growing real problems. All things will be reckoned though when they run out of support and dragged into the street.

    Each time I read about another country dropping their pants and bowing down for the entertainment / corporate @ssh0l3s, my blood starts boiling.

    It’s sooo simple!

    1) Just make (all!!!) media better available online and for really reasonable prices on fast servers… this will decimate their problem. Yes, there will always be people who will only go for the “free” stuff but really, in percentages, about how many people are they really worrying??? Come on?!
    2) Do they really think that all that gets downloaded illegaly will be bought on a 1 to 1 ratio when this bill passes? NOOO, of course not! That all downloaders become buyers?? NO man!! NOO! Think!

    We need to step up, not on a local or national level but on a global level! Don’t wait for the other to do something about it, ’cause it ain’t gonna happen and this is why nothing has been done about it yet.
