FileSonic, Oron and Their Users Hit With Piracy Lawsuit

FileSonic and Oron, two prominent file-hosting services, have been dragged to court by adult entertainment company Flava Works. In a complaint filed at a federal court in Illinois, the cyberlockers are joined by 26 John Doe defendants who stand accused of sharing copyrighted material. These files were also allegedly shared on several other cyberlockers including FileServe, Hotfile and RapidShare.

After targeting hundreds of thousands of BitTorrent users, adult entertainment companies have recently expanded their legal efforts to file-hosting sites and their users.

Flava Works, known for winning a preliminary injunction (currently under appeal) in its landmark lawsuit against MyVidster, a case which involved Google, Facebook and even the MPAA, is now targeting two prominent file-hosting services and 26 of their users.

In papers filed at the District Court for the Northern District of Illinois last week, the company accuses FileSonic and Oron of several copyright related offenses.

Among other things, the complaint alleges that FileSonic and Oron are “websites that copy, store, distribute, display, profit from unauthorized copyrighted materials, and/or induce and assist others to infringe copyrighted materials.”

The two cyberlockers are joined by 26 John Doe defendants who allegedly shared links to copyrighted material with each other via several Yahoo groups. It is claimed that through these mailing lists the defendants actively traded links, some of which were uploaded by the defendants themselves.

oronAccording to Flava Works the file-hosting sites directly profited from these infringements through their affiliate programs.

The complaint characterizes FileSonic as an “illegitimate” outfit, a description repeated for Oron.

“On information and belief, at all relevant times, Filesonic.com is not a legitimate file storage company. Filesonic.com’s affiliates reward program offered members the opportunity to make money by uploading copyrighted videos.”

“Affiliates members are paid based upon the number of downloads of their posted materials and based upon how many other premium memberships were bought by users accessing Filesonic.com through the member’s links.”

Flava Works goes on to accuse FileSonic, Oron and the Doe defendants on several counts including direct copyright infringement, contributory copyright infringement and inducement of copyright infringement.

The adult company asks for a permanent injunction and temporary restraining order against the defendants. Flava Works further requests statutory, compensatory and punitive damages for the alleged infringements.

It is unclear why Flava Works has singled out these two file-hosting services as the complaint also mentions that Hotfile, Fileserve and Rapidshare were used to share files. Filesonic in particular seems to be an odd choice since the cyberlocker disabled public file-sharing months ago, which led to an exodus of users.

For Oron, this is the second lawsuit brought against the site this summer. Last month adult studio Corbin Fisher sued the company for no less than $34.8 million for alleged copyright infringements. As part of a settlement, Oron then offered to assist the studio prosecute its own users.

Both Oron and FileSonic have yet to respond to the complaint.

        My understanding is that porn, California, Nevada and Florida’s only form of folk art, is necessarily the documentation of prostitution and presumptive conspiracy to promote.  Counties in California occasionally crack down under prostitution rather than obscenity statutes when they’re bored or they’re not getting any at home.  So I’m not suggesting it be used as a countersuit, as this would be a criminal statue instrument, but I am suggesting that every file-sharing plaintiff I’m aware of is technically on thin ice, though only in a perfect world when blatant hypocrisy is  met with immediate public execution (when was the last time you downloaded an original song, an original movie, much less an original –HA!– TV show?  Perhaps Apple isn’t patent-suit happy because everything they peddle is based on stolen ideas, but it is at least an interesting coincidence, as is the RIAA, MPAA, et al.)

    I think the solution is easy, move yourself and the whole company including data / backup to a non US friendly country, including all payment and money flow.
    Maybe then in US, politics start to understand that it is a BAD idea to do these kind of lawsuits, it will cost jobs and money will flow to other countries instead of to US.
    The Us government should realize that soon companies will realize this too and start packing the remaining assets they have in US and move ALL to f.e. China.
    US will become a third world country with famine and tribal wars (uuehh, oh they already have those. hehe).

Under the One Country Two Systems program, Hong Kong is allowed the election of a chief executive who acts in a similar role as a governor to Hong Kong. However, Hong Kong and the chief executive still have to answer to the Central Communist Party, who retain the power to enforce whatever change they think is necessary. So long as the power remains for the CCP to enact change, Hong Kong can not be considered a democracy.

    Well i guess Flava Works has targeted Oron because the dollars signs lit up in their own eyes when they heard that Oron has settled the case against Corbin Fisher and as part of the agreement Oron is assisting the Studio to prosecute its own users. Flava Works will no doubt think lets sue Oron for money and also get them to provide the details of the users so that we can extort further money from all these users Kerching Kerching easy money and laughing all the way to the bank.

    WTF Filesonic is dead are these people mental?  Why sue a dead horse.  Oron is in russia goodluck with that.  They will settle then give them the middle finger when in comes to  payment.   When is a goddamn judge going to get some balls and throw these porn suits out?  They deserve no copyright protection.  But what makes me even more angry is why the bar is damn low when it comes to damages.  How can they get away with pulling millions of damages out of their asses?  Since megaload has been shut down have sales of music and movies drastically increased?  Fuck no which means their claims of loss are baseless.

    They covered pretty much covered everything in that statement.  Of course EVERYTHING on display, even in a store window could potentially induce a reproduction.  To allow that kind of language is dangerous considering how freely it can be interpreted.

    Flava Works owner should go to jail for that if you want my advice but it’s not going to happen because its well seen for a greedy company in the US to sue who they want because they have a better business model than yours.

           TOR is not as secure as everyone thinks it is. Trust me on that one. If you do a little homework, you will find that for yourself. Even TOR admits that it is not fol proof. It is more difficult to get the correct IP, but it can be found with not much effort if you know how to do it.

        They all give out the information when they are forced. They do it out of necessity because they feel vulnerable, because everyone’s attacking them for easy money, because no one defends them.
        When one is down, another one is next on the hit list.
        It won’t stop until there’s none to defend nd then it will be too late unless pre emptive action is taken but it would take unified force to make it effective.
        Like some International Filesharers Association IFA initiative or something to stand for all of them, eventually over time it could take up the standards for which filesharers can apply and be part of the program and they will stop giving information and even the little filesharers would be safe under the protection of a bigger association.
        It’s a proven formula that works.
        Filesharers, please get more politically involved.

      Why shouldn’t they? According to the user agreements of legal file-hosting services, the user shall obey the laws. The owners of such a service must be able to take action against those who violate the user agreements. If not, they risk their own business.

      Also note that if they assist someone in prosecuting its own users, the blame is on the user that has violated the user agreements and/or the law.

    I have a few questions, If these trolls can in fact identify the downloaders. Why can’t they use the same tools to identify the original uploader? Could it be they don’t want the uploaders identity to be known?

      Where did anyone mention downloaders? The oron settlement terms listed in the other articles say they are going after those who “distributed content”. The only thing I have seen mention downloaders is the original court records naming the does as co-defendents. This case is specifically targeting those who uploaded and/or made links available.

    Amazing how so many people think just because they want something for free, then it should be free and they have some kind of invisible, automatic entitlement to it.

    We all upload and download copyrighted material knowing full well it’s illegal.
    Just because it’s so quick and easy to make it digitally available doesn’t somehow magically remove the copyright.

    If I walked into a store, took a DVD movie off the shelf and walked out without paying for it, I’d be arrested.
    But just because the same movie is in an easily available digital copy somehow makes downloading and distributing it ok?

    The bottom line is cyberlockers like Oron, Filesonic, Megaupload, etc. and everyone who uploads/downloads the material all know damned well it is and always has been illegal.
    It boils down to a cat and mouse game of hiding behind proxy servers, fake accounts and moving around in countries that look the other way to copyright infringement, hoping you never get caught.

    Harmlessly sharing legitimate files between users doesn’t keep a cyberlocker in business.
    If it wasn’t for illegal material, those cyberlockers wouldn’t exist. And everyone damned well knows that’s the case.

    Make all the arguments you want to try and justify illegal file sharing, but it doesn’t change the facts or somehow magically remove the copyright.

    Most of the posts here are so fucking stupid it’s laughable. So many people think they know so much, but know nothing.
    Just grow a pair of balls and deal with the fallout when the shit finally hits the fan.

    It all boils down to “I want my free shit!!” and I don’t want to pay for it!
    Buncha clueless whiney babies…

      Newsflash, dummy: Filesonic doesn’t allow sharing anymore. They’ve stopped it for months and they’re still afloat. So what’re they getting sued for?

         It doesn’t matter if they allowed sharing the files before. That’s why it’s so ridiculous that, after the MegaUpload scare, so many filehosters have been scared into disabling their file sharing or affiliate features. It doesn’t matter that you stopped doing it if you’ve been investigated while doing it before. “But, I stopped now!” is not a defense if the police arrested you for serial murder.
