Over the last year Microsoft asked Google to censor nearly 5 million webpages because they allegedly link to copyright infringing content. While these automated requests are often legitimate, mistakes happen more often than one might expect. In a recent DMCA notice Microsoft asked Google to censor BBC, CNN, HuffPo, TechCrunch, Wikipedia and many more sites. In another request the software giant seeks the removal of a URL on Spotify.com.

windows In recent months the number of DMCA takedown requests sent out by copyright holders has increased dramatically, and it’s starting to turn the Internet into a big mess.

One of the problems is that many rightsholders use completely automated systems to inform Google and other sites of infringements.

That these automated tools aren’t always spot on is nicely illustrated by a recent DMCA notice sent to Google on behalf of Microsoft.

Claiming to prevent the unauthorized distribution of Windows 8 Beta the software company listed 65 “infringing” web pages. However, nearly half of the URLs that Google was asked to remove from its search results have nothing to do with Windows 8.

This apparent screw up in the automated filter mistakenly attempts to censor AMC Theatres, BBC, Buzzfeed, CNN, HuffPo, TechCrunch, RealClearPolitics, Rotten Tomatoes, ScienceDirect, Washington Post, Wikipedia and even the U.S. Government.

Judging from the page titles and content the websites in question were targeted because they reference the number “45″.

Unfortunately this notice is not an isolated incident. In another DMCA notice Microsoft asked Google to remove a Spotify.com URL and on several occasions they even asked Google to censor their own search engine Bing.

The good news is that Google appears to have white-listed a few domains, as the BBC and Wikipedia articles mentioned in the DMCA notice above were not censored. However, less prominent sites are not so lucky and the AMC Theatres and RealClearPolitics pages are still unavailable through Google search today.

As we have mentioned before, the DMCA avalanche is becoming a bigger problem day after day.

Microsoft and other rightsholders are censoring large parts of the Internet, often completely unfounded, and there is absolutely no one to hold them responsible. Websites can’t possibly verify every DMCA claim and the problem will only increase as more takedown notices are sent week after week.

Right now rightsholders and the anti-piracy outfits they employ have absolutely no incentive to improve the accuracy of their automated takedown systems, so perhaps it’s time for them to be punished?

on top of which, the actual checking and removal is done similarly by automated systems too. the only ways to stop this type of ridiculous censoring and overreach is to fine those that make false take downs, mistakenly or not (the ‘mistakenly’ bit is never considered when someone downloads something ‘mistakenly’, is it?) and for governments to stop caving in every time to the demands of so-called rights holders, relax and then totally change the copyright (and patent) laws, stop trying to make the internet useable in the ways that only rights holders and governments want it to be used and start considering the public for a change! the internet worked perfectly fine before the US entertainment industries tried (and are still trying!) to take control of it, so leave the fucking thing alone already!!!!

  This. Also make the human definitively identify him or herself. Ditto for implementing the requests. Then make the identified human legally liable for errors. Let the employer indemnify the employee if willing to assume that risk. I call BS in advance on the “too slow” argument. If take down requests are limited to those that pose the risk of a real loss of revenue (the only even halfway sane argument for this law even if you support the concept of copyright) I don’t think it is possible for the volume to be too large for human entry.

  With Peer Guardian, I discovered back in about 2004, in the middle of the night that someone with an IP address assigned to the White House was trying to leach chunks of a torrent I was downloading. Was it Dubya or the Bush daughters or one of the White House security details? Who knows.

I always do independent IP range checks if I see an IP range I suspect may be government related and do some IP range blocks in the Windows 7 firewall, such as: DOD Network Information Center 21.0.0.0-21.255.255.255 & 28.0.0.0 – 28.255.255.255, Halliburton 34.0.0.0-34.255.255.255. It’s none of the DOD’s or Halliburton’s damn business what I do or don’t do on the World Wild Interwebz..

      While that may be true, I think it’s a double standard for the government to say it’s illegal for me to download copyrighted material while supporting the MAFIAA’s attempts to ruin peoples lives with $150,000 per song fines and then turn a blind eye to their employees and servicemen downloading copyrighted material. I actually stopped at the local National Guard place and asked if I could make up some audio CD’s to send to the enlisted guys serving in Afghanistan in 2003 and was told that would be illegal, so it was a no go.   To have standing, they have to say that being delisted in Google has harmed them somehow, and there has to be a law that was broken and that has some kind of “you can sue over this” provision. The DMCA only added a very weak provision of that sort to the law…if the plaintiffs can’t prove that Microsoft “knowingly”, intentionally sent out a false takedown notice, they won’t prevail.

This means the copyright holder has a good chance of the takedown being successful even if it is bogus.

I know 5 million requests sounds a lot, but if it’s in a year, how many people would it *really* take to manually look through this list?
Sort it by url and you can instantly knock out sites such as the BBC site and similar, then you manually check those that are left.

If you worked 220 days in a year you’d have to check 25000 sites a day (at 5m requests), so employ 10 people to do it and that’s 2500 sites a day, which is nothing.

Damn it you could even farm it out online to people and pay per link checked, which would cost you even less.

For the sake of 10 lowish wages, MS are pissing off everyone they bother with false requests, and possibly committing perjury.

Totally nothing unexpected here when DMCA law is only causing rampant and unfounded censorship.

As I said before until you start punishing right holders for their abuse of DMCA law then they just won’t clean up their act. So put Microsoft’s nuts in the vice and start turning that handle until they squeal like little girls. Maybe then after some major testicular pain they will actually pay some attention to what they are doing and clean up their act.

You do have to wonder though how much of this censorship was actually done to filter out negative Windows 8 news? That is indeed the stage we are at now when they can censor away anything they like with zero punishment.

Anyway, I always said Google should never accept DMCA takedowns via internet. They should only accept by fax or mail. That would prevent lots of abuses. In such cases, they could also use a software to convert the paper to digital format (to read the URLs).

  That’s exactly what’s happening. The takedown notices are telling Google to stop listing these sites in search results. Google is the main entity being censored. By not being listed in Google, the sites can’t get their message out as far and wide as they’d like, so they are being censored, too.

I can’t see it happening but technology and media monopoly regulations need to be tightened and enforced to prevent the small number of oligopoly’s from perverting competition by artificially inflating prices with artificial scarcity of often poor quality products which in a truly competitive market would have to be better quality easier to buy and cheaper in order to sell.

Also without regulation the targeted DMCA notices (along with archaic copy wrong laws ) can be used as a weapon by these already massive bully companies to prevent websites from distributing and promoting their competitors goods and services e.g. RIAA against Megabox further protecting their oligopoly.

Digital products and media are exceptionally abundant and virtually free to distribute in massive quantities their is no justification for the ludicrously expensive price of media especially when the quality of the most expensive media i.e. films often bears little relation to the production cost which often isn’t even genuine when corrupt film companies are contracting other companies which they secretively own and are effectively overcharging themselves to reduce the perceived profit and therefore tax bill and to justify excessive cinema tickets for (over 100 million dollar – so they say) films that are often formulaic and unentertaining when an amateur with a home camera makes a movie for a few million which is often far more entertaining, whats wrong with that ?!!? .

  Tor is getting faster and faster every day and it’s now my prefered over I2P. I2P can be real slow and has a long way to grow. Back when more people had dial up, Tor was unusable. Whenever I’m connected to Tor I’ll first go to IP Chicken to get the Tor IP address and Port number I’m going through and then enter that into µTorrent’s proxy settings before starting any torrents, so that I’m at least 4 IP’s away from my own IP address. You have to occasionaly check back because by nature, Tor nodes regulary change and reroute traffic. I’ve experienced faster download speeds many times when going through Tor nodes than when going through a VPN alone. Even though people bitch about the ethics of using TOR for TORrenting, I’ll take some safety over a boatload of ethics any day. Ya gotta do what ya gotta do, if you don’t want to be a MAFIAA statistic.

    TOR is pretty damned fast for anything but connections to .onion websites. Connections to those are slow and have a habit of coming up with “The website is not responding!” on a regular basis, so you have to refresh until the website comes up.

There is an untapped revenue source here.
Google ought to charge a handling fee, in the range of $20 to $50, for each DMCA takedown notice it has to deal with.
After paying those charges for a while, the organizations that spew out computer generated bullshit takedown notices will likely clean up their act.

It’s a service you pay for. And if you can’t accept that your not going to have any control regarding online privacy and the right to say, or read or download ANYTHING you want on it, then you should just stop paying for that service and accept defeat.

This myth that ppl have in their heads that they have any control over anything they do or say online must stop. I wish it were true, but it simply is not. Your just going to have to find a way to get over that. The internet is not yours, and it never will be and you will never have complete freedom on it.

  For starters, what your argument boils down to, in real, practical terms is that the internet will have to be abolished altogether. Because in real practice, before the DMCA notices become “effective” at all, any legal business simply ceases to work.

Unfortunately the DMCA notice is usually the only way for a photographer to get stolen images off the net. I’ve found Chinese and Russian ISPs rarely respond to a direct email even if translated into their own language.

Putting a corporation in prison for a crime is…problematic.

But since DMCA takedowns are issued under penalty of perjury, what if a company makes at least one perjured takedown for every executive in the company? Or even one per employee?

Could a company be sent to prison then?

  Corporations cannot be sent to prison. Does not mean they can’t be prosecuted for criminal actions. Just means that jail sentences are not within the array of punishments available against them. The most menacing and punishing; and perhaps instructive penalty available against a Corporation is revocation of its Corporate Charter. That is an actual Corporate Death Sentence: the Corporate Charter is in effect, the Corporations Birth Certificate, which gives it legal standing to do business within the jurisdiction of the Sovereign State. The Corporation does not exist upon the state’s revocation of its Charter. The fact that we never see that sanction used, does not mean that it does not exist; or that it is inherently bad policy. Many of the American Colonies refused to tolerate Corporate misconduct (criminal or otherwise), and, often, if not routinely, revoked Corporate Charters.
  
  I wish that revocation of Corporate Charter was a much more applied penalty today. What we know is that, in respect to Oligopolies and Monopolies, Financial penalties are shockingly ineffective inhibitors of bad behavior. The costs are simply passed down to customers and counter-parties.
  
  Given the atrocious behavior we see every day from Corporations, why don’t we ever see revocations of Charter today?
  
  When you allow Corporations to become monopolies, they ask to be treated as people.
  
  When you treat them as people, they insist on being allowed to have a say in the making of law.
  
  When you let them have a say in the making of law, you discover that the heaviest sanctions of criminal law apply to you, not to the corporations.
