New Zealand Prime Minister Apologizes To Kim Dotcom

New Zealand Prime Minister John Key has apologized to Kim Dotcom after a report from the Inspector-General of Intelligence and Security found that the government illegally monitored the Megaupload founder. The Government Communications Security Bureau (GCSB) carried out surveillance on Dotcom, but did not check out his residency status, instead relying on incorrect information supplied by the police.

“Of course I apologize to Mr Dotcom, and I apologize to New Zealanders.”

These were the humbling words of New Zealand Prime Minister John Key today after a report from Inspector-General of Intelligence and Security Paul Neazor found that a NZ security service did indeed wrongfully spy on Kim Dotcom and associate Bram van der Kolk.

In a media conference following the release of the report, Key said that New Zealanders had a right to be protected by the law and that the government had “failed to provide that protection to them.”

The findings of the report, commissioned by the Prime Minister on September 17, were released this morning and are a clear embarrassment to the government.

Neazor found that the Government Communications Security Bureau (GSCB), which by law can only conduct action against foreign targets, failed to check Dotcom’s immigration status. If they had done so they would have discovered he hold’s a permanent resident’s visa.

“The GCSB relied on information provided to it by the Organized and Financial Crime Agency. In my view, reliance on another party by GCSB is unacceptable,” Key said.

“It is the GCSB’s responsibility to act within the law, and it is hugely disappointing that in this case its actions fell outside the law. I am personally very disappointed that the agency failed to fully understand the workings of its own legislation.”

So just how did Dotcom come to be monitored illegally? The purported answers to that question can be found in a section of the report titled “Potential for confusion.”

“As this matter went along what was discovered in the case of Dotcom and associated people was that resident status had been obtained on their behalf under the Immigration Act 1987 and carried forward under the later 2009 Act. It was understood incorrectly by the GCSB that a further step in the immigration process would have to be taken before Dotcom and associates had protection against interception of communications,” Neazor wrote.

“The illegality arose because of changes in the Immigration Act wording and some confusion about which category Dotcom was in thereafter.”

But whatever the case, according to a document published by ComputerWorld, police clearly knew of Dotcom’s residency status when they compiled a planning document known as the “Blue Folder” in which help from the anti-terrorist Special Tactics Group was requested.

Following Mr Key’s apology today [video here], Dotcom announced his acceptance via Twitter, but called for an investigation into the case against him.

“I accept your apology,” Dotcom wrote. “Show your sincerity by supporting a full, transparent & independent inquiry into the entire Mega case.”

       I think that’s why Kim D has asked the PM to take that next step and call a full, independent inquiry in the whole MegaMess.

      Only once those findings are made and published can the PM offer a full and more appropriate apology.

      But major kudos to PM John Key for apologising at this early stage.  It’s a good (and clever) move politically.

         Actually… we in the US attempt to guide a savage world toward the light of a peaceful global civilization based upon freedom and respect for all. Been chipping away at this project ever since we destroyed the Spanish Empire, created the League of Nations, the United Nations and held back the Soviet Union monster until it died. I personally helped do the latter and take pride in preserving Europe.

    Still, John Key should step down.  He has to apologize even though he still continues to blame the GCSB which solely answer directly to him for orders.  It’s definately a political move based on the fact he would be disowned by the public around this fiasco.  I do however commend Kim Dotcom for accepting this apology,  even I wouldn’t have.  The real issue is that now that the Prime Minister has been found to have been involved, thats where the buck stops with NZ in terms of power (or assumed power).  Lets hope this opens a can of worms up the food chain, and the information that was shared with the FBI from the GCSB becomes inadmissable evidence if this stupid idea of justice ever events to an extradition.

      Solely answer directly to him? Not on a daily basis, I think. I am sure that there is a ‘chain of command’ in that organization and that the prime minister doesn’t micromanage them.

      Basically, if he was never told that they were doing this or was lied to about why they were doing it? I give him a pass on this since he acknowledged the mistake. That said, the people who made the mistake under him should be penalized financially with reduced pay or just out and out fired.

        Everyone should be sceptical regarding the “plausible deniability” excuse. As PM he may not be responsible for every action his underlings take – but he is certainly responsible for the underlings themselves.

        So in order for his deniability to hold, heads must roll in the departments under him. Assuming NZ hasn’t done like Sweden and abolished the accountability of government employees…

        Christopher, you are failing to see where the ultimate responsibility lies. No, he doesn’t micromanage their every move, but the ultimate responsibility lies on him.

        If you watch the video where the PM is being grilled, he is asked if this is incompetence or lies were involved. In either case, he is an incompetent leader, or is running an organization of liars. IE: He has no control over an organization he oversees, therefore is guilty himself. No plausible deniability when you’re supposed to be the boss. He has to sign off on all orders. The buck stops with him. If he were to try and pass it off, it would show gross incompetence on his part.

          1)  The less tech savvy and borderline computer illiterate that still don’t know about the Megaupload case or even what a cyberlocker in general is.  

          2)  The rest of the people that have been appalled by this case since January and have been waiting patiently for this to blow up in the dinosaurs’ faces and for MegaBox and Megaupload 2.0 to rise from the ashes.

    John Key had no other option for this fuck up. He had the option to cover over Banks, but in this case, his spindoctors have adviced him to man the fuck up and apologize.

    That being said this whole case and the whole thing surrounding cyberlocker is a fictional made-up story by the MAFIAA. They succeeded as they took the best providers of the service out and left the others scrambling and being scrutinized by the MAFIAA and lame porn studios.

    this is nothing other than a ‘trying to cover my arse’ exercise by Key. i am waiting to see who he manages to pass the buck too so that they, not he, takes the fall. on top of everything else, this shows that the NZ law enforcement were ready and willing to go along with the bullshit and lies the USA had fed them, just to prove they were ‘good little supporters who didn’t want their bum smacked’. i dont suppose it will make any difference, other than for countries put into similar positions to check, check and double check before acting, but i would like to think that perhaps the USA government is now seen for what it is, a selfish, self-centered, liar that cares for nothing and no one other than itself and it’s own, that will go to any lengths to preserve them, regardless of the effects on others and is left out on a limb by itslf

      With all due respect, most countries on law enforcement things assume that the foreign country is being forthright and honest with them. It just gets way too complicated if you assume that they are lying though in my opinion the assumption that they are not correct and not wrong, that they are just giving you a bunch of evidence and you should investigate is the correct road to take.

    The most obvious attribute of raw power:  It is free to inflict vast damage without incurring consequence. 

    That is impunity. 

    When the prosecution of MegaUpload falls apart, the complicit copyright enforcers will seek to step gingerly away from, and beyond, the shambles they’ve created.  The damages to MegaUpload; as well as the extra-judicial nature of the prosecution, will be an afterthought as they move seamlessly to whatever predation is next on their agenda. 

    What we need is for the private agents who instigated and organized this fiasco; as well as the public agencies who implemented it, to be held accountable. 

    In this context, DeJaz1 and Roja Direct are bad examples:  Victorious small players whose just victory can be found in the more obscure corners of the public record. 

    We need a very public bitch slapping. 

    We need to see multi billion dollar judgements in compensatory damages; and, we need to see MegaUpload emerge ten times bigger from these efforts to destroy it. 

    I would call that progress worth waiting for. 

    Copyright Distributors would probably just call it the beginning of the end of their impunity.

      The MAFFIA and the prosecution are not going to walk away from prosecuting Megaupload and of those involved with this until a guilty verdict has been reached in a court of law or stands at being guilty from the highest appeals court if it goes that far. No way are the MAFFIA going to let go of the 150 Million Dollars that they have seized and frozen. What ever goes wrong against the MAFFIA, the illegal raid, the illegal warrant, the illegal transfering of data from NZ to the US and now this spying they will just ignore as its water of a ducks back to them. They will not stop from this case or walk away from it until a guilty verdict has been given.

    The apology would have meaning if it came with a bj!   But words don’t cut it,  how many millions has Kim lost with megaupload down these last few months.  The whole cyberlocker ecosystem was shaken up,  They all ought to join together in a megabillion dollar lawsuit against NZ and the Us Justice department.  Words are nothing without consequences.

    This is a very positive development. The PM isn’t apologizing if enough of NZers didn’t vociferously complain about this travesty of “justice”.

    Politically, it may ultimately cripple him, and should serve as a valid warning for other world leaders not to allow themselves to be led around by the corrupt US regime.

    The real impact, hopefully, is that Dotcom’s new venture, and the anticipated return of MegaUpload may not be interfered with further.

    It should be noted that both FBI Directors who signed off on that criminal and illegal attack stealing megaupload were also involved or primarily responsible for designing the 2001.09.11 fly-by-wire incidents and the related disinformation and counterintelligence that made the last decade of holocausts possible.
